Two-bedroom villas are essentially the one-bedroom villa and the studio villa combined. They offer an expansive 1400 sq ft and can accommodate up to 8 guests with plenty of space for everyone. The master section includes the full size kitchen, dining, and living area. The guest section includes it’s own kitchenette. Both sections include an en-suite washer/dryer. There is a king size Heavenly Bed in both the master bedroom and the guest bedroom. The living room and guest bedroom each feature a queen convertible sofa sleeper. The full size balcony can be accessed from the living room or master bedroom. Each bathroom features signature Heavenly Bath with dual granite vanities, a glass walk-in shower, and a separate whirlpool soaking tub. All villas feature upscale finishings and offer quite a bit more livability than a standard hotel room. Finishings include granite countertops, wood cabinetry, LCD flat panel televisions with DVD players, and Bose stereos. OUTLINE: All rentals are final; No changes, No cancellations, and No refunds anytime after booking. The traveler/guests booking will not get a refund if they cancel their booking at any time after it is accepted All Guests Must Provide a Valid Government-Issued Photo ID After Booking to Acknowledge Rental Terms & Policies, and Verify who the Primary Guest of Reservation to be added to the Guest Certificate. Renter checking in must be at least 25 years of age. If Guest ID/Information is not provided at least 7-Days prior to arrival OR within the hour of a last-minute check-in, the Club/Management may cancel your reservation without notice. Stays outside of the Friday-Friday, Saturday-Saturday OR Sunday-Sunday stay MAY require a Villa change. Our deeds are 7-Nights, if your stay exceeds the 7-Night availability, there may be a Villa change. This is not something we can predict. The onsite management team is in charge of Rooms Control/Assignment per our contracts. No items are shipped to you or picked up from us. Once a booking is confirmed and paid for, you will be provided a Booking ID Number/Confirmation Number. Renter shall not sublet this lease without Chimera Vacations/Owner’s express written consent. Occupancy shall be no more than "Max Persons" allowed. Renter agrees to abide by policies set by the management, refrain from loud noise and to return unit in clean sanitary rentable condition or pay costs of same. Renter is responsible for any damages. Renter agrees that pets shall not be allowed in vacation property, unless pre-approved by Chimera Vacations and Owner of unit. Personal Property and Liability: All personal property kept by Renter in said-premises shall be and remain at his/her sole risk. Chimera Vacations/Owner and Broker(s) shall not be liable for any damages to, or loss of such personal property ensuing from any acts of negligence of any other persons, nor from any problems with the rental unit from any other cause whatsoever, nor shall Chimera Vacations/Owner or Broker(s) be liable for any injury to the Renter or guests of the Tenant in or about the premises. The Renter expressly agrees to save Chimera Vacations/Owner and Broker(s) harmless in all such cases. Rental Rules: Guest agrees to abide by the Rental Rules (attached to this agreement) at all times while at the property, and shall cause all members of the rental party and anyone else Guest permits on the property to abide by the following rules at all times while residing at the property.  Access: Guest shall allow Homeowner access to the property for purposes of repair, inspection or emergency. Homeowner shall exercise this right of access in a reasonable manner by giving at least 12 hours notice (unless in case of emergency)/ POLICIES & AGREEMENTS A. Rental Rates, Fees; Cancellation Policy; No-Shows: The Booking Calendar helps provide availability and estimated price quote. Always inquire with Chimera Vacations and do not reserve airfare until your confirmation has been received. Chimera Vacations, LLC does not hold units and is first-come, first-serve.  Full Payment along with a copy of the Payee and Primary Guest's Valid Driver's License must be received to finalize reservation in Renter’s/Guest’s Name. Accommodation Rates/Promotional Rates are subject to change or become unavailable without notice. Separate Security Deposit is collected by Property for Security Purposes and will be refunded within 30 days of the Check-Out Date, provided NO deductions are made due to: i. damage caused to the property or furnishings; ii. dirt or other mess requiring excessive cleaning; or iii. any other cost incurred by Homeowner due to Guest’s stay. Rental payments are NON-refundable for any cancellations. No full or partial refunds will be granted for no-shows. No full or partial refunds will be granted if you cancel less than 30 days before the first night of your reservation. Any partial payment received towards stay will be NON-Refundable. No full or partial refunds will be granted if you arrive after the first night of your reservation, or depart before the last night of your reservation. Except as expressly provided in this Agreement, NO refunds or compensation will be given and Chimera Vacations LLC. shall not be liable to you for failure to arrive at accommodation, stay in accommodation or make the property available for occupancy if the property is unavailable or becomes partially or wholly unusable for any reason outside Chimera Vacations LLC.’s control - including but not limited to: natural disasters or unforeseen circumstances, accidents, health or medical concerns, adverse weather conditions, mechanical failures, evacuation orders or other acts of government agencies, utility outages or other issues that may prohibit Guest from traveling. The Covid-19 pandemic is considered a foreseeable risk. The Renter, by voluntarily executing, accepting this Rental Agreement, and/or simply providing payment, the guest hereby acknowledges and accepts the risk that this threat, or any other epidemic or pandemic may prevent travel or occupancy of the rental unit, limitations on access to, or a cessation of any property amenity and that this will not serve as a basis for requesting a refund or initiating a chargeback. Unavailable amenities, pool, beach, theme park, etc. does not merit a refund. This clause specifically removes the obligation of the owner to provide a habitable unit, if the cause is due to the Coronavirus pandemic, any other epidemic or pandemic or other force majeure events. You accept and agree to these terms by completion, execution and delivery of the rental agreement and/or a payment for the rental due thereunder. If the premises appear dirty or damaged upon Check-in, Guest shall inform Property’s Management immediately, otherwise, Chimera Vacations and property will not be liable. Chimera Vacations LLC. advises guests to obtain appropriate and comprehensive travel insurance that covers Renter and all Occupants and that includes coverage for personal injury and property damage or loss. Any travel insurance you obtain shall be primary for all occurrences in which you or any Occupant claims injury, loss or damage. Any issues with resort service, accommodations, physical plant, amenities, etc. are the direct responsibility of the developer and must be handled through the resort, not Chimera Vacations, LLC. Photos are thought to be truly representative of the resort and accommodations. Any variation from the photo and actual property are unintentional, so guests are encouraged to do their own due diligence prior to reserving. Any variance or disruption including but not limited to renovation, unavailable amenity, change in decor, etc. during the stay, whether announced prior to reservation, occurring during the stay or announced after confirmation, is a matter strictly between the guest and resort, are not deceptive advertising, breach of contract or the responsibility of Chimera Vacations. A view per the Property’s definition of a view and they allocate units in their sole discretion, although requests can be made. Requests cannot be guaranteed, although management will strive to fulfill all requests. B. Insurance: We encourage all renters to purchase traveler insurance in case of unforeseen circumstances, accidents or other issues that may prohibit Guest from traveling or fulfilling rental terms. Chimera Vacations is not liable for any natural disaster or unforeseen circumstances, accidents or other issues that may prohibit Guest from traveling or fulfilling rental terms. Standard Rental Rate and Fees, Cancellation Policy, No Shows still apply as stated in Section A. B.. C. Minimum Age: The “Minimum Age” to rent the Property is the age specified in any Unit- Specific Terms. If no age is specified in the Unit-Specific Terms, the Minimum Age is 25 years of age (or the minimum age required by law in the jurisdiction where the Property is located, if different). You agree to provide us with proof of age upon request. A parent or legal guardian must accompany all guests who are under the Minimum Age for the entire duration of the rental. D. Early Check-In/Late Check-Out. Early check-in or late check-out may be available; additional charges may apply. If you do not vacate by check-out time (or late check-out time as agreed by Chimera Vacations LLC.), you authorize us to bill your credit card on file for a late departure fee of up to one night’s rental and we may remove all Occupants and their personal property from the Property. E. Maximum Occupancy. The number of people present at the Property may not exceed the maximum posted occupancy unless we have given you advance written permission to hold an event at the Property, in which case the number of people present at the Property may not exceed the maximum number of people authorized by Chimera Vacations LLC.. F. Responsible Renter: As the Renter, you agree to be an occupant of the Property for the entire duration of the rental. All other occupants will be family members, friends, other responsible adults over the Minimum Age, or accompanied by a parent or legal guardian. You agree to be solely responsible for your actions and the actions of all family members, guests, and invitees (collectively, “Occupants”) present at the Property at any time during your stay, and to ensure that all Occupants understand and comply with the Terms. G. No Smoking. No smoking is permitted at the Property (including porches, decks or outdoor areas) at any time. H. Animals. No animals or pets of any kind are permitted at the Property except (1) as specifically authorized in your reservation, or (2) bona fide service animals that we are required by law to allow. Emotional support animals are not permitted except as authorized pets. You agree that a prohibition on animals is not a guarantee than an animal has not been inside the Property or that the Property is free of animal or pet allergens. I. Maintenance or Housekeeping Issues; Property Conditions. The Property is provided as is, and we are not responsible for the inoperability or unavailability of any amenities. You agree to contact Chimera Vacations LLC., using the contact information provided in your confirmation email, as soon as you notice any maintenance or housekeeping problem, or any potentially hazardous condition, at the Property, or if any incident occurs at the Property that is related to such a problem or condition. You further agree to give Chimera Vacations LLC. a reasonable amount of time to respond to your report and to cooperate with Chimera Vacations LLC.’s efforts to address the concern or provide a remedy. We will take reasonable and appropriate steps to remedy any reported problem as soon as practicable. We may enter the Property at your invitation to remedy any problem you report, at reasonable times and with reasonable notice to inspect, maintain, or repair the Property, and to address any situation that we reasonably deem an emergency that threatens persons or property. You acknowledge that if the Property has access to amenities that are shared with other properties, such as a shared pool, hot tub, parking lot, or fitness center, that the availability and condition of those amenities is outside Chimera Vacations LLC.’s control. J. Good Neighbor Policy: Because the Property is a privately owned home and resort, all Occupants must comply with this good neighbor policy. Please treat the Property with the same care you would use with your own residence and leave it in the same condition it was in when you arrived. To prevent theft of or damage to furnishings or your personal property, you agree to close and lock doors and windows when you are not present at the Property and upon check-out. You and other Occupants agree to conduct yourselves throughout your stay in a manner that is respectful of and not disruptive to neighbors, traffic flow, or the community and that will not prompt complaints to Chimera Vacations LLC. from police, neighbors, or neighborhood or homeowner associations. Noise audible outside the Property is prohibited between 10 p.m. and 8 a.m. You and other Occupants agree to abide by all applicable parking restrictions and limitations. Any guest who is being disrespectful/abusive/hostile will be removed from the property and NO REFUND WILL BE PROVIDED. K. No Permanent Residence. You agree that your use of the Property is on a temporary and transient basis only; that you may not use the Property as a permanent residence; and that your permanent residence is and will remain elsewhere than at the Property. L. Events and Commercial Photography; Structures; Charcoal Grills. Events and commercial photography or filming are prohibited at the Property without our express written permission. (If approved, additional conditions and fees may apply.) No tents or other structures may be erected on the property without our express written permission. The use of charcoal grills is not permitted. M. Criminal Activity Prohibited. Use of the Property for any criminal activity is prohibited and may result in fines, prosecution, and/or your immediate removal from the Property. This prohibition extends to use of the Property’s internet service, if any, for criminal activity, including but not limited to unlawful downloads of copyrighted material, including movies, music, software, or other material. We may cooperate with any investigation of alleged criminal activity that occurred at the Property during your stay. N. Payment Terms; Fraud. Should Chimera Vacations LLC. receive any notification of a Dispute of Payment by Guest, Chimera Vacations LLC. will be authorized to charge guest an extra 15% on top of payment made for time and any loss of finances. We will also have the right to send your account to a Collections Agency to collect the funds due to us for your booking. This will also incur an additional 25% fee on top of the total cost of booking for our time. If you are paying by credit card you represent that you are the account holder or an authorized user of the account. If for any reason, Chimera Vacations LLC. believes your payment may be refused by the card processor, Chimera Vacations LLC. may ask you for a different form of payment. Upon Chimera Vacations LLC.’s request, you will immediately provide another form of payment and adequate proof that you are the account holder or an authorized user of the account used for payment (such as a government-issued ID that matches the name on the account). Chimera Vacations LLC. may cancel your reservation or remove you and all Occupants from the Property immediately if you fail to provide a form of payment that can be validated by Chimera Vacations LLC.. We may share your credit card information and other information about you with law enforcement if we suspect fraud. Chimera Vacations LLC. may cancel your reservation or remove you and all Occupants from the Property immediately if we suspect fraud. O. Consequences of Breach; Charges for Damage. Any failure by you or any other Occupants to comply with any of the terms, conditions, or policies above is a breach of this Agreement and may result in a forfeiture of your rights to rent the Property, up to and including immediate removal from the Property without refund and with or without the assistance of law enforcement. Chimera Vacations LLC. may terminate this Agreement for breach, and if you are notified of such termination you agree to leave the Property immediately. In addition, you are responsible for, and you authorize us to bill your credit card on file for the full amount of: (1) any damage or loss that occurs at the Property during your stay; (2) a charge of up to $1,000 USD for violations of the pet policy, including for bringing more pets or different types of pets than specifically authorized; (3) an additional cleaning fee of up to $1000 USD (or the actual cost of cleaning services, if greater) for violations of any of the guest policies above (other than the pet policy) or for excessive cleaning required by the acts or omissions of any Occupant during your stay; and (4) any fines issued by police, other government officials or agencies, utility providers, and/or homeowner associations for violation of any law, ordinance, or rule during your stay, and any damages (which may exceed the amount of fines) that result from the violation. If any unauthorized download of copyrighted material via the Property’s Internet service occurs during the period of your stay, you agree that we may share your contact information with the internet service provider or any other party we believe, for any reason, has enforcement rights. ADDITIONAL TERMS AND CONDITIONS P. Choice of Law; Jurisdiction and Venue; Dispute Resolution. P.1. Choice of Law. Unless otherwise specified in any Unit-Specific Terms or if a different choice of law is required by the law of the jurisdiction in which the Property is located: If the Property is outside Europe, this Agreement shall be governed by laws of the State of California, U.S.A, without regard to its conflict-of-law provisions. If the Property is in Europe, this Agreement shall be governed by the laws of Switzerland, without regard to its conflict-of-law provisions. P.2. Dispute Resolution and Arbitration Agreement: United States. If (a) your claim relates in any way to a reservation for or stay at a Property located in the United States, or (b) you bring any other claim against Chimera Vacations LLC. in the United States (to the extent permitted by this Agreement), then you agree to resolve any dispute arising out of or relating in any way to this Agreement as follows: Agreement to Arbitrate. You and Chimera Vacations LLC. mutually agree that any dispute, claim or controversy arising out of or relating in any way to this Agreement will be settled by binding arbitration rather than in court, such arbitration to be conducted by the American Arbitration Association (“AAA”) under its Consumer Arbitration Rules, or such other AAA arbitration rules that the AAA decides to be applicable to a specific dispute, that are in effect as of the time of service of an arbitration demand. Payment of filing, administration and arbitrator fees will be governed by the AAA's rules. To begin an arbitration, a party must send a letter to the other party requesting arbitration and describing the claim. If Chimera Vacations LLC. requests arbitration, it will send the letter to your most recent email or physical address in Chimera Vacations LLC.’s records. If you request arbitration, you must send the letter to Chimera Vacations LLC.’s registered agent in the state in which the Property you reserved or stayed at is located, or if the dispute does not involve a reservation for or stay at a specific property, to Chimera Vacations LLC.’s registered agent in the state of California, Las Vegas and Colorado. Place of Arbitration. The arbitration shall take place in the county in which the Property is located, or in Los Angeles, California; Las Vegas, Nevada or Denver, Colorado. If the dispute does not involve a reservation for or stay at a specific property, or in such other location as you and Chimera Vacations LLC. may mutually agree. Exceptions to Arbitration Requirement. As the only exceptions to the agreement to submit all disputes to binding arbitration as provided herein, Chimera Vacations LLC. and Renter both retain the right to pursue: (1) in small claims court in the county in which the Chimera Vacations chooses (or if the dispute does not involve a reservation for a specific property, the small claims court for Los Angeles, California), any claim that is within that court’s jurisdiction, and the parties consent to the personal jurisdiction and venue of such court; and (2) a suit in any court with jurisdiction to enjoin (whether by temporary, preliminary, or permanent injunctive relief) infringement or other misuse of intellectual property rights.O.3. Dispute Resolution: Outside the United States. Europe: If you are a resident of Europe and your claim relates in any way to a reservation for or stay at a Property located in Europe, you and Chimera Vacations LLC. consent to the exclusive jurisdiction and venue of the courts in Zurich or Zug, Switzerland. If applicable law prohibits exclusive jurisdiction over your claim in Switzerland, then you and Chimera Vacations LLC. agree to the non-exclusive jurisdiction and venue of the courts in Zurich or Zug, Switzerland, or your jurisdiction of residence. Outside Europe: If your claim relates in any way to a reservation for or stay at a Property located outside of Europe or the United States, you and Chimera Vacations LLC. agree to bring any action in the courts of the country in which the Property is located, or in such other location and forum as you and Chimera Vacations LLC. may mutually agree. Q.Class Action and Jury Trial Waiver. The parties agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated or representative action. If for any reason a claim proceeds in court rather than in arbitration, the parties waive any right to a jury trial. R. Limitation of Liability. TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO CASE SHALL THE OWNER OF THE PROPERTY OR Chimera Vacations LLC., NOR THEIR AFFILIATES, NOR THEIR RESPECTIVE OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, OR OWNERS, BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR EXEMPLARY DAMAGES, OR FOR ANY DAMAGES FOR PERSONAL OR BODILY INJURY, EMOTIONAL DISTRESS, OR DAMAGE TO PROPERTY, ARISING OUT OF OR IN CONNECTION WITH YOUR STAY AT THE PROPERTY. THIS LIMITATION APPLIES TO ALL CLAIMS FOR DAMAGES WHETHER BASED ON A THEORY OF WARRANTY, CONTRACT, TORT (INCLUDING ORDINARY NEGLIGENCE), STRICT LIABILITY, OR OTHERWISE, EVEN IF Chimera Vacations LLC. HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGE AND EVEN IF THE LIMITED REMEDY SET FORTH HEREIN IS FOUND TO HAVE FAILED OF ITS ESSENTIAL PURPOSE. S. Indemnity. You agree to hold harmless and indemnify Chimera Vacations LLC. and Owner, and their respective affiliates, for and from all claims for property damage, personal injury, or monetary loss resulting from your actions or omissions, and the actions or omissions of other Occupants, during or relating to your stay. T. Substitution of Property. On rare occasions, due to ownership changes, properties being removed from rental use, or a need for extensive repairs or maintenance, the Property may not be available for rental on the dates of your reservation. In this unlikely event, Chimera Vacations LLC. reserves the right to substitute a comparable property. If comparable accommodations are not available, you will have the option of (1) selecting from other available properties (in which case you are responsible for, or will receive the benefit of, any difference in cost. In the event of a substitution of rental properties, all Terms in this Agreement, plus any Unit-Specific Terms specific to the substituted property, shall apply to your stay in the substituted property. U. Assignment. Chimera Vacations LLC. may assign this Agreement or any of its rights, or delegate any of its duties under this Agreement, at any time without your consent. This Agreement is between you and Chimera Vacations LLC. Vacation Rentals of Hawaii LLC, acting for itself and for the Owner. This Agreement shall be governed by the law of the State of Hawaii, U.S.A, without regard to its conflict of laws provisions, and both parties consent to the exclusive jurisdiction and venue of the state and federal courts of Maui County, Hawaii, U.S.A. Check-In time for this unit is 4:00 PM local time.This document contains the entire agreement between the parties, and any changes, amendments, or modifications hereof shall be void unless the same are in writing and signed by the parties hereto.
