We are located in beautiful historic Hale’Iwa Hawaii, a cute little town on the north shore of Oahu, in fact the only town. It is the home of the Hawaiian shirt and the shave ice, and has lots of little shops &restaurants.. we are located 1/2 mile from town. Haleiwa is the home of one of the three surf breaks, that make up The Tripple Crown of Surfing. We are lucky enough to have some of the best snorkeling on the island, directly in front of the property and the beach is never crowded. We have picnic tables and bbq’s at the sands edge, where you can watch the sunset and have a great dinner & a glass of wine. We are located on the second floor and have more than enough parking. VACATION RENTAL AGREEMENT This Vacation Rental Agreement ("Agreement") is made and effective this _. , 2018__ (“Agreement Date”) by and between Keohen Smith ("Owner") and (“Renter(s)"). This Agreement creates joint and several liabilities in the case of multiple Renters. 1. PREMISES. Owner hereby rents to Renter and Renter accepts in its present condition the condominium unit at following address: 66-303 Haleiwa Road, Unit #209, Haleiwa, Hawaii, 96712 ("Condo"). 2. TERM. The term of this Agreement shall start on (“Arrival Date”), no earlier than 3:00pm, and end on (“Departure Date”) at 11:00am 3. RENT/ FEES. A. Renter agrees to pay, without demand, to Owner as rent for the Condo the sum of: $ .00__ (“Rental Amount”), Tax $129.83, VRBO/HomeAway Service Fee $ .00 and a non-refundable cleaning fee of $150. The total rental amount is $ (“Total Rental Amount”) B. If this agreement is within 60 days of the Arrival Date, the Total Rental Amount is due to Owner to secure reservation dates (Arrival Date through Departure Date). If the Agreement date is greater than 60 days from the Arrival Date, 50% of the Total Rental Amount is due to secure reservation dates. The remaining 50% is due 30 days prior to Arrival Date. Rental Amount must be paid with credit card or Paypal. (Effective dates on notices are described under “Notices” below) C. The Condo shall not be reserved until said rental amounts are received and cleared by Owner’s bank. 4. SECURITY DEPOSIT. Upon execution of this Agreement, Renter deposit with Owner is $0 (Security Deposit Amount), as security for the performance by Renter of the terms of this Agreement to be returned to Renter, following the full and faithful performance by Renter of this Agreement. In the event of damage to the Condo caused by Renter or Renter's family, agents or visitors, Renter remains liable. 5. USE OF PREMISES/ CONDO POLICIES. Renter shall comply with the following Condo Policies: a. No smoking in the condo or on the enclosed lanai b. No pets allowed on premises c. Quiet hours are from 10PM to 8AM d. Condo shall be locked upon leaving premises e. Shoes shall be taken off and left outside of condo or in foyer upon entering condo f. No sand in Condo (please use outside shower) g. No wet towels or clothing on furniture or carpet h. All garbage must be disposed of in complex bins 6. NUMBER OF OCCUPANTS Renter agrees that the Condo shall be occupied by no more than 4 persons, including no more than 2 children under the age of eighteen (18) years, without the prior written consent of Owner. 7. CONDITION OF PREMISES. Renter agrees that Renter has examined the Condo, and that it is, at the time of his/her arrival, in good order, operable, safe, clean, and Rentable condition. The Rental shall immediately report any exceptions or changes to this condition to the Owner Keohen Smith at phone number: 949 701-3366 8. ASSIGNMENT/ SUBLETTING. A. Renter shall not assign this Agreement, or sublet or grant any concession or license to use the Condo or any part of the Condo without Owner's prior written consent. B. Any assignment, subletting, concession, or license without the prior written consent of Owner, or an assignment or subletting by operation of law, shall be void and, at Owner's option, terminate this Agreement. 9. ALTERATIONS AND IMPROVEMENTS. Renter shall make no alterations to the Condo or make other improvements without the prior written consent of Owner. 10. RIGHT OF INSPECTION. Owner and Owner's agents shall have the right at all reasonable times during the term of this Agreement and to enter the Condo for the purpose of inspecting the premises and/or making any repairs to the premises or other item as required under this Agreement. 11. HOLDOVER BY RENTER. Should Renter remain in possession of the Condo with the consent of Owner after the expiration of the Term of this Agreement, an additional rental period shall be created which shall be subject to all the terms and conditions of this Agreement. If Renter holds over without Owner's consent, Owner is entitled to double rent, pro-rated per each day of the holdover, lasting until Renter leaves the Condo. 12. SURRENDER OF PREMISES. At the expiration of the Agreement, Renter shall quit and surrender the Condo in as good a condition as it was at the commencement of this Agreement, reasonable cleaning expected. 13. CANCELATION /FORFEITURE OF RENTAL AMOUNT Cancellations must be in writing and received by the Owner, at least 30 days prior to arrival date. Cancellations received within 30 days from date of arrival result in 100% forfeit of the Total Rental Amount. If the cancellation is received greater than 30 days but less than 90 days from the date of arrival, fifty percent (50%) of Total Rental Amount is forfeited. If cancellation is received greater than 90 days from the date of arrival, the larger of 15% of the Total Rental Amount or $200 is forfeited. The Security Deposit is fully refundable upon cancellation at any time (effective dates are defined in “Notices” section below) 14. SECURITY. Renter acknowledges that Owner does not provide a security alarm system or any security for the Condo or for Renter. Renter hereby releases Owner from any loss, suit, claim, charge, damage or injury resulting from lack of security or failure of security. 15. SEVERABILITY. If any part or parts of this Agreement shall be held unenforceable for any reason, the remainder of this Agreement shall continue in full force and effect. 16. INSURANCE. Renter acknowledges that Owner will not provide insurance coverage for Renter's property, nor shall Owner be responsible for any loss of Renter's property, whether by theft, fire, acts of God, or otherwise. 17. BINDING EFFECT. The covenants and conditions contained in the Agreement shall apply to and bind the Renter and permitted assigns of the parties. 18. ENTIRE AGREEMENT. This Agreement shall constitute the entire agreement between the parties. Any prior understanding or representation of any kind preceding the date of this Agreement is hereby superseded. This Agreement may be modified only in writing signed by both Owner and Renter. 19. NOTICES. Any notice required or otherwise given pursuant to this Agreement shall be in writing. The date of any notices sent via mail shall be the U.S. post-mark date. The date of any notices sent via e-mail, shall be the date received by the Owner.
