If a Booker OR Guest engages in Fraud AND Deceit and so Exploits the Valuable Limited Time of any Administrator or Manager, including the Host, he or she shall be Amerced an Administration Fee or a Management Fee in an Amount Representing the Value of the Administrator/Manager’s Service AND Time Defrauded by the Booker or Guest under False Pretenses, Fraud AND Deceit OR Harassment. Failure to Satisfy an Amercement shall Authorize Litigation for Fraud AND Deceit OR Harassment (civil or criminal) Guest access The Moroccan volunteer-fundraiser for this Molokaiian charitable trust hereby invites each Booker or Guest to utilize the "Send or request money" feature (if you've already Booked), or use the "Message Host" feature (if you haven't already Booked), to MESSAGE THE HOST and proffer your own tax deductible quid pro quo contribution (made payable to: The CHARITABLE TRUST OF MOLOKAI) in any amount of your choosing, partly as a charitable donation and partly in exchange for the use and benefit of the equitable goods and equitable services furnished by The Home-Office, Host, of The CHARITABLE TRUST OF MOLOKAI, Licensee (*Note: T Bey Irrevocable Family Trust, a Non-Profit Family Trust, is the Licensor of The Charitable Trust Of Molokai, Licensee.). Usually within twenty-four (24) hours, a volunteer fundraiser will ACCEPT an offer sent, but may propose an ADJUSTMENT of the offer received, and may request additional details confirming the authenticity of any offer. During your stay WATER SAFETY; The Kalohi Channel, a natural body of water, is a mere one-hundred (100’) feet walk from the entrance to The Home-Office. A natural body of water may be a draw (to some), but can also present safety risks. There’s no separation (fence, gate) or natural obstruction between The Home-Office entrance and the beach or the shore; PLEASE BE ADVISED, we DO NOT have available for use: Rescue equipment (shepherd’s crooks; reaching poles; ring buoys; a life preserver-ring; a life vest), a boat, raft, life guard, water watcher or touch supervision; Other things to note A Provision of The Legislative Council for The County Of Maui excludes “lodging provided by nonprofit corporations or associations for religious, charitable, educational, or marine science research purposes” from its regulation of Time Share Plans used by Transient visitors or Transient guests, if no rental income is produced. "Transient" or "transients" means any person who owns, rents, or uses a lodging or dwelling unit, or portion of it, for less than one hundred eighty (180) days and whose permanent address for legal purposes is not the lodging or dwelling unit occupied by the person, which includes: Any person who uses, possesses, or occupies a property based on an arrangement, schedule, plan, agreement, license, or any other means or scheme where an owner of the property, or member, partner, owner, trustee, or shareholder of the corporate or limited liability entity that owns the property, receives ownership rights or the right to use the property for a period of less than one hundred eighty days. This definition does not apply to family members or nonpaying guests of the family occupying the unit; or to health care providers actively engaged in providing medical services within the County; or full-time students while attending general education classes or programs located in the County; or employees who receive room or board as part of their salary or compensation for work performed within the County by the employer providing their room or board; or military personnel while performing military service within the County; or low-income renters receiving rental assistance from governmental entities whose rental periods are for durations shorter than one hundred eighty days; and lodging provided by nonprofit corporations or associations for religious, charitable, educational, or marine science research purposes if no rental income is produced. “Lodging provided by nonprofit corporations or associations," including the Charitable Trust Of Molokai, established "for religious, charitable, educational, or marine science research purposes”, are excluded from the regulation of time share plans used by transients, if no rental income is produced. And, no rental income is produced through the beneficial use of a Molokaiian Room-For-Use furnished by The Home Office Of The Charitable Trust Of Molokai, Host. In addition to the exemptions prescribed in sections 501(a) and 508(c) of the U.S. internal revenue code (see 83 STAT. 494), in accordance with section 502 of 68A STAT. 166, “trade or business” (inapplicable) does not include "rents" (inapplicable) not reaching any tax deductible quid pro quo contribution for the beneficial use of a Molokaiian Room-For-Use furnished by The Home-Office, Host, of The CHARITABLE TRUST OF MOLOKAI, Licensee. (Note: T Bey Irrevocable Family Trust, a Non-Profit Family Trust, is the Licensor of The Charitable Trust Of Molokai, Licensee.) The Private-Molokaiian Room-4-Use is licensed and operated by The Charitable Trust Of Molokai, a not-for-profit entity, organization or institution, owned, operated and supervised by one or more nonprofit corporations or religious associations formed pursuant to applicable State laws, no part of the net earnings of which inures, or may lawfully inure, to the benefit of any private shareholder or individual; and the Private-Molokaiian Room-4-Use is provided by the Charitable Trust Of Molokai, for religious, charitable, educational, or marine science research purposes, and no rental income is produced. T Bey (age 56 in 2025), an aboriginal native New-York Citizen Of The U. S. A., is a Moroccan-treaty national and a free inhabitant of the Island, Country, Sea Ports and Harbors of, Molokai, the Hawaiian Islands. His domicile of origin is New-York, U. S. A. And his domicile of choice is New-York, U. S. A. T Bey, Free Inhabitant, is the Grantor and a Trustee of The T Bey Family Trust, a self-settled irrevocable trust founded to benefit bloodline family, related by blood, adoption, marriage, or civil union and Moroccan-treaty nationals. T Bey Family Trust is the holder of the legal and equitable title to the fee or long-term leasehold interest in The Private-Molokaiian Room-4-Use ("TIME SHARE UNIT") and T Bey Family Trust, Licensor, hereby gives notice of the existence of A TIME SHARE PLAN for The Private-Molokaiian Room-4-Use, Plus Shared Space, Comprising The Home-Office Of The Charitable Trust Of Molokai, Licensee. This NOTICE OF TIME SHARE PLAN hereby provides notice that THE USE PERIOD for all time share interests, including, but not limited to, members, beneficiaries, and Guests, is not more than ten (10) days (that is, not more than nine (9) nights), cumulatively, per year. Please take further notice that this TIME SHARE UNIT, Private-Molokaiian Room-4-Use (Plus Shared Space) is licensed and provided by the Charitable Trust Of Molokai, Licensee, for religious, charitable, educational, or marine science research purposes; no rental income is produced; an Act of The Council for The County Of Maui excludes lodging provided by nonprofit corporations or associations, for religious, charitable, educational, or marine science research purposes, from regulation of TIME SHARE PLANS used by transients, if no rental income is produced. Advertising, publishing, offering, and booking of the private-Molokaiian room-4-use shall not offer the Private-Molokaiian Room-4-Use as a bed and breakfast home making breakfast available to onsite guests. Advertising, publishing, offering, and booking of the private-Molokaiian room-4-use shall offer the private-Molokaiian room-4-use as A TIME SHARE UNIT, under A TIME SHARE PLAN, for up-to ten (10) days (that is, nine (9) nights) use, and not as the operation of a bed and breakfast home making breakfast available to onsite guests. This "private-Molokaiian room-4-use" is NOT A BED AND BREAKFAST HOME making breakfast available to onsite guests. Any communication or any response to a booking inquiry shall not imply that The TIME SHARE is offered as a bed and breakfast home. Any communication or any response to a booking inquiry must affirm or state that the private-Molokaiian room-4-use is offered as A TIME SHARE UNIT, under A TIME SHARE PLAN, for A USE PERIOD of not more than ten (10) days (that is, not more than nine (9) nights) per booking/per guest per year. All advertising, publishing, offering, and booking of Private-Molokaiian Room-4-Use must include an open notification that this Private-Molokaiian Room-4-Use is provided by The Charitable Trust Of Molokai for religious, charitable, educational, or marine science research purposes, and no rental income is produced, plus the legislative provisions of the County Of Maui exclude “lodging provided by nonprofit corporations or associations for religious, charitable, educational, or marine science research purposes” from regulation of time share plans used by transients, if no rental income is produced). The Private-Molokaiian Room-4-Use (https://www.airbnb.com/h/kaunakakai) is situated near the Kalohi Channel (the Kalohi Channel is situated between Molokai and Lanai); and, the Private-Molokaiian Room-4-Use is situated near the Pailolo Channel (the Pailolo Channel is situated between Molokai and Maui). This Private-Molokaiian Room-(Plus Shared Space)-For-Use is not quite walking distance from the nearest town (as Kaunakakai town is approximately five miles away) but an MEO bus (operated by Maui Economic Opportunity, Inc.), Hele Mai Taxi, and Alamo Rent-A-Car or other ground transportation services are available. The private-Molokaiian room-4-use with an ocean view on the beach is situated on private premises, with a front yard setback of at least 100' x 50', a rear yard setback of at least 100' x 50,' and a side yard setback of at least 30' x 20'. A one-square (1'x 1') foot bulletin shall be attached to a fence at the front of the property (property line) along the main access road, and/or the sign may be attached to any existing structure of the property, advertising "Private-Molokaiian Room-4-Use," and shall also include the email address, a local telephone number with MMS/SMS messaging and local fax machine number for the “Private-Molokaiian Room-4-Use.” A visible off-street parking area, including parking spaces, loading spaces, driveways, lanes and aisles, for Guest parking of automobiles, is provided and furnished to Guests. Free and unlimited open Wi-Fi is provided and furnished to all. Single-station smoke detectors are provided in the corridor, in the Private-Molokaiian Room-4-Use and in each sleeping room of the Premises. The total number of Guests is limited-to up-to two (2) adult Guests and up-to two (2) minor Guests. The Home-Office Of The Charitable Trust Of Molokai shall post house policies (and/or house rules) in the private-Molokaiian room-4-use; and, the Home-Office Of The Charitable Trust Of Molokai is responsible for enforcing such policies. Quiet hours are maintained from 9PM (21:00) HST to 8AM (08:00) HST, during which noise in and about the private-Molokaiian room-4-use shall not disturb anyone on a neighboring property, amplified sound that is audible beyond the property boundaries of the private-Molokaiian room-4-use is prohibited and motor vehicles must be properly parked in the designated onsite parking area; Generally, Airbnb charges the Total Price due after the Host accepts a booker's request. The Host, Charitable Trust Of Molokai, hereby appoints Airbnb Payments as the Host’s payment collection agent solely for the limited purpose of accepting and processing funds from Guests purchasing Host Services on the Host’s behalf. Each payment made by a Guest through Airbnb Payments shall be considered the same as a payment made directly to The Charitable Trust Of Molokai; and the Charitable Trust Of Molokai will provide the Host Service booked by the Guest in the agreed-upon manner as if the Host has received the payment directly from the Guest. Upon a Guest’s payment of the funds to Airbnb Payments, the Guest’s payment obligation to the Host for the agreed upon amount is extinguished, and Airbnb Payments is responsible for remitting the funds successfully received by Airbnb Payments to the Host. “Payin” involves charging the payment method associated with a payor's Airbnb account, such as credit card, debit card, bank account, Pay Pal account, digital wallet or installments product provided by a credit provider (“Payment Method”) and payin shall be made to https://www.airbnb.com. “Payout” involves payments to the Host made thru the financial instrument associated with the Host's Airbnb account, such as a Pay Pal account, bank account, a prepaid card, or a debit card (“Payout Method”) and Payout is made payable to the Charitable Trust Of Molokai. Airbnb Payments is not a party to the agreement between the Guest and the Host. Airbnb Payments acts as the Host’s payment collection agent for the limited purpose of accepting payments from Guests on behalf of the Host(s). Guest contributions ("quid pro quo contribution") for any incidentals or any upgrades shall be made through Airbnb; plus, the payment and collection of any and all charitable donations to the Charitable Trust Of Molokai shall be made through https://www.airbnb.com. If the Host has reason to believe a booker or guest participated in fraudulent activity, such as an underpayment scam, booking fraud or other fraud, and Airbnb Payments recoups from the Host such amount by reducing, deducting or debiting such amount from any future payouts owed to the Host, the Host may recoup from guest or booker such amount through the Resolution Center; If a booker or guest engages in fraud and deceit and so exploits the valuable limited time of any administrator or manager, including the Host, he or she shall be amerced an administration fee or a management fee in an amount representing the value of the administrator/manager’s service and time exploited by the booker or guest under false pretenses, fraud and deceit or harassment. Failure to satisfy an amercement shall authorize litigation for fraud and deceit or harassment (civil or criminal). Additional Payments may include: any amount owed by a Guest to Airbnb; amounts due to the Host from a Guest for any incidentals or any upgrades; amercements, where applicable; any amount to be paid through the Resolution Center; any Damage Report amounts owed; overstay penalties, including any cost and expenses incurred in collecting the overstay penalty; any service fees or cancellation fees imposed; any amounts (double payments) already paid to you as a Guest; and any amounts paid in accordance with the Terms, Rebooking and Refund Policy for Homes, Refund Policy for Services and Experiences, Major Disruptive Events Policy, Luxe Rebooking, Refund Policy, and/or other applicable policy. If the Host is unable to collect any amounts owed by a booker or a guest, the Host may engage in collection efforts to recover such amounts. HOME-OFFICE OF THE CHARITABLE TRUST OF MOLOKAI Begun and held in the Countryside and Sea Ports of The Hawaiian Islands and on The Pacific Island Of Molokai, Hawaiian Islands, Monday the 7th day of March, 2025. ACT I An Act to establish as a fundraiser for the Charitable Trust Of Molokai a Private Room-4-Use With Shared Space(s) At Molokai for beneficiaries of the Charitable Trust Of Molokai or members and Guest’s-only, for not more than ten (10) days, in exchange for a Quid Pro Quo Contribution payable to the Charitable Trust Of Molokai, for their use, and for other charitable purposes. I-A.1: Beneficiaries, members, aboriginal-native Hawaiians, and Guest’s-only, shall enjoy the exclusive benefit & use of a key & locked private room (11.5’x 11.5’ x8’) plus active (24 hours) access to all shared spaces (35’x 24’ x 8’) comprising the Premises, including, but not limited to, Front Yard (100' x 50'), Back Yard (100' x 50'), Deck (10' x 10'), Porch (10' x 10'), Home-Office (11.5’x 11’ x 8’), Closet (6.5' x 2.5' x 8'), Storage Space, Kitchen, and Bathroom (Bathtub, Shower, Sink, & Toilet). I-A.2: A description for the res and Private Room shall include, but may not be limited to, “A Private Room-4-Use With Shared Space(s) At Molokai.” I-A.3: The URL of and/or for the private room-4-use shall be and hereby is https://www.airbnb.com/h/kaunakakai.
