Other things to note Supplemental Occupancy and Short-Term Rental Agreement Property: 92 or 94 Chapel St, Newton, Massachusetts This Supplemental Occupancy and Short-Term Rental Agreement (“Supplemental Agreement”) is incorporated into and supplements the Airbnb booking and any related rental agreement for the property located at 92 or 94 Chapel St, Newton, Massachusetts (“Property”). This Supplemental Agreement is effective as of the date of booking confirmation through Airbnb. For purposes of this Supplemental Agreement, all adult guests occupying the Property, whether listed on the Airbnb reservation or otherwise permitted to stay at the Property, shall be considered jointly and severally responsible parties under this Supplemental Agreement (“Guests”). By booking, occupying, or remaining at the Property, Guests acknowledge and agree to the following terms: 1. Responsibility for Eviction Costs and Collection Expenses Guests shall be responsible for all reasonable costs and expenses incurred by the homeowner and/or the homeowner’s authorized representatives in connection with: The removal or eviction of any Guest or occupant who remains at the Property beyond the agreed rental term; Collection of unpaid rent or occupancy charges; Recovery of damages caused by Guests or occupants; and Enforcement of this Supplemental Agreement. Such costs may include reasonable attorneys’ fees, court costs, constable or sheriff fees, and other lawful collection-related expenses to the extent permitted under Massachusetts law. 2. Unauthorized Holdover Occupancy Guests agree that occupancy of the Property beyond the mutually agreed and paid rental period, without the homeowner’s written consent, constitutes unauthorized holdover occupancy. For each calendar day or portion thereof that Guests remain in possession of the Property after the agreed checkout date and time without written authorization, Guests agree to pay liquidated damages in the amount of One Thousand Dollars ($1,000.00) per day, in addition to any other amounts owed under the reservation or permitted by law. The parties acknowledge that unauthorized holdover occupancy may cause substantial disruption, loss of rental income, and damages that may be difficult to calculate precisely, and that the foregoing amount is intended as a reasonable estimate of such damages and not as a penalty. 3. Assumption of Risk and Hold Harmless To the fullest extent permitted by Massachusetts law, Guests voluntarily assume all risks associated with their occupancy and use of the Property. Guests agree to indemnify, defend, and hold harmless the homeowner and the homeowner’s agents, representatives, property managers, employees, and contractors from and against claims, liabilities, damages, losses, or expenses arising from: Guests’ use or occupancy of the Property; Any acts or omissions of Guests or their invitees; Damage to personal property; or Injury occurring on the Property, except to the extent caused by the gross negligence or willful misconduct of the homeowner. Nothing in this provision is intended to waive or limit any rights that cannot lawfully be waived under Massachusetts law. 4. Attorneys’ Fees and Enforcement Costs Guests agree to reimburse the homeowner and/or the homeowner’s representatives for reasonable attorneys’ fees, court costs, and related expenses incurred in connection with: Collection of unpaid amounts owed by Guests; Recovery of damages to the Property; Enforcement of this Supplemental Agreement; or Legal proceedings arising from Guests’ breach of the rental terms. Any recovery of attorneys’ fees or costs shall be limited to the extent permitted by applicable Massachusetts law. 5. Acknowledgment and Acceptance Guests acknowledge that they have had sufficient opportunity to review and understand this Supplemental Agreement prior to booking or occupying the Property. Completion of the Airbnb booking, payment for the reservation, entry onto the Property, or continued occupancy of the Property constitutes acceptance of and agreement to all terms contained herein. 6. Identification Requirement All adult Guests occupying or visiting the Property during the rental period must present a valid government-issued photo identification upon request by the homeowner, property manager, Airbnb, or authorized representative prior to or during occupancy. Failure to provide such identification may constitute a violation of the rental terms and may result in denial of entry, cancellation of the reservation in accordance with Airbnb policies and applicable law, or removal from the Property where permitted by law. 7. Governing Law This Supplemental Agreement shall be governed by and construed in accordance with the laws of the Commonwealth of Massachusetts. If any provision of this Supplemental Agreement is found unenforceable, the remaining provisions shall remain in full force and effect to the maximum extent permitted by law.
