The oceanfront beachfront penthouse is perfect for friends & family retreat, romantic getaway, long staycation or remote work. It features open concept living, cathedral ceilings, a cozy gas fireplace, and private deck overlooking everything. Enjoy the ocean views, sunrises & sunsets from the unit and walk down right onto the sand. Almost every room has a view of the ocean during the day and has built in skylight giving you view of the stars in the night and quiet enough to hear ocean waves. The space This beachfront & oceanfront penthouse condo is a great place to build memories. Come enjoy a weekend or better yet, a week-long stay with your family and friends. Virtually every room has view of the ocean and water - weather bedrooms, living room, kitchen or perhaps the bathroom, when you are alone in the house. The penthouse condo features open concept living, cathedral ceilings, a cozy gas fireplace, and private deck overlooking everything. Almost every room has built in skylight giving you a view of the stars. This property is ideal for gatherings with family and friends for a long staycation or remote working. This is where you can bond, share stories and make memories with your loved ones. Located near town center, arcades, "beach pizza" and many other restaurants (such as "Seaglass") Please note that pets, smoking, vaping, drugs, loud music, loud noise, parties anytime are not allowed on the premises. You must maintain quiet hours between 10pm and 7am. This is a rule by HOA. Property managers live onsite. Guest access The unit has three dedicated tandem parking spot in front of the unit. Pictures show three mid size SUV can fit. After parking, walk up two flight of stairs to the unit entrance. There are no elevators. Property is not handicapped accessible. Property is not pets accessible. You will be provided an access code to get in the unit, a day before your arrival. The access code will be good throughout the duration of your stay only. SNOW STORM PARKING : We don't guarantee parking in our parking lanes during snow storms as plow trucks must do their jobs. Guest must pull out pf the parking lanes and find their own street parking, of which plenty maybe available during winter season, down the end of Atlantic Ave. For the duration of the storm, guests vehicles may not be returning back to our parking lanes until storm has ended and parking lot has been cleared by plow crew. Guests shall manage their own snow shoveling, such as around their cars etc. Shovels are available on premises. If our parking lanes are clear of snow, three cars or less can park, depending on what may fit as snow piles can take its own space. If you need guaranteed onsite snow season parking during snowstorm, we mayn't be the right choice for your needs. Other things to note To book this property, you & your party of occupants or guests or visitors, agrees to this Vacation Occupancy agreement, described below. This agreement is for "Vacation Occupancy" only as defined under state of Massachusetts Law, 830 CMR 64G.1.1. Vacation Occupancy is NOT considered Tenant Occupancy under this Law. "Property" "Premises" "Vacation Rental" and "Property name" refer to "Oceanfront Penthouse with Friends & Family" located at "57 Atlantic Avenue, Unit E, Salisbury, MA 01952" "Guest" "Responsible Party" "You" refers to the individual who is making the booking and all of your guests who will be staying at this property. "Owner" "We" "Us" are the owners of the property (Jim S Basu) For good and valuable consideration, the sufficiency of which is acknowledged, the parties hereby agree to the following:  Address : As per your confirmed booking.  Maximum occupancy at rental price is 10  Extra persons beyond 10. The condo unit can sleep up to 10 people. So maximum occupancy for this unit is 10.  Minimum age to book is 25  Check-in time : 4PM  Check-out time: 10AM Check-in/out: Because your booking platform insurance policy is only valid from your booking check in time to booking check out time, we are unable to fulfill your early check in or late check out requests. so please don't ask. You will receive digital key code that will be valid only thru the duration of your stay, strict to the check in and check out times. We monitor check in and check out for your safety. Please don't check out late, as beyond the checkout time you will incur extra charges. If circumstances are extraneous such as an emergency, please seek permission from us via booking platform messaging, well ahead of your check out time. Payment & Cancellation Policy: All payments are subjected to cancellation policy as per your booking platform. All payments must be made through this booking platform. We are strict to our cancellation policy. You may consider buying travel insurance if you think your trip may/will have uncertainties. Damages: If there are damages, inspections performed & evidence gathered will be shared with booking platform and you. The booking platform will bill you for any damages to the property or furnishings, any mess or odors requiring cleaning above and beyond the fee already paid to the cleaning company, any charges billed to the owner by municipality due to the actions of you or your guests, and/or any evidence of rule violations by you or your guests (occupancy limits, age, animals, smoking, parties, events, quiet hours, good neighbor policy). If this leads to any litigation, it will be handled in Essex County, State of Massachusetts, where this property is located. Issues/Concerns during your stay: Although we live close by, for safety reasons, we are not available to meet with you in person - before, during, after your stay. However we are available to help you in responding to your needs, otherwise. Please communicate all requests, issues, concerns through your booking platform. You must document your issues via means of time stamped - audio, photos and videos inside our listing to be valid. Issues are only relevant if caused by elements inside our property & were not disclosed before your check in time of 4pm. We keep time stamped documentation of our property - before & after your stay. Our professional service providers perform verification, documentation and validation to address your stated issues before, during & after your stay. We will share our professional findings with you & the booking platform. If our professionals don't find any issues that was caused by our property, you accept the responsibility for all expenses related to the service call. Cleaning Fees: The cleaning fees (if any) you may pay is for normal and reasonable use of the property. Sometimes we waive cleaning fees as special discount but this is not the normal. In order to avoid any discrepancies of extra cleaning services needed, after your departure, we take detailed time stamped pictures of the place, immediately before your arrival and after your departure. If property is found to be trashed such as food left in freezer or refrigerator, oven with burnt grease or spills, piled dishes in kitchen or sink, food packages scattered all around, beverage bottles in various corner of the house, sand everywhere in the house, couches, chairs, beds, evidence of smoking or vaping...you get the picture - feels like a war zone - you will be subjected to an additional cleaning fees. This can get expensive so please try to be respectful of the property and leave us the property as you found it, except for normal use. Bugs: This is beach. During various seasons there may be bugs or ants. We are not liable for your health issues and phobias and consider, ants, insects and any other natural specimen as ordinary for the beach area. While we will always make best efforts, we would like to remind guests that mosquitos, ants, flies, bees, and any other pests are a part of the area and not a reflection of the homes cleanliness. Furthermore, it is your responsibility to keep windows and doors close so bugs don't get inside the house. Surroundings: Although we are in a quiet place overall, we are are still at the beach surrounded by a lot of hustle & bustle. If people outside our premises are socializing by means of smoking, drinking or being loud, it is not in our control. It is your responsibility to close all doors and windows to shield yourself from the outside. You accept the place as is. Supplies: The home is maintained very well, and we do our best to be sure all necessities are stored in the home. However, if we are missing some items, please let us know and we will do our best efforts to replenish these items. During your stay and because of your own use, if you run out of kitchen supplies, bathroom supplies, bedroom supplies, various linens or anything else you may consider a necessity, we are not liable for your inconvenience and we will not grant any cancellations or discounts as a result of this inconvenience. Cancellations: You acknowledge that you have read and accept our cancellation policy on your booking platform. It is highly recommended guest purchase trip cancellation/interruption insurance in case of family emergencies/bad weather delays, funerals, flight/rental car cancellations, job loss, snow/ice, Covid-19 bans/restrictions, early departures etc. If you are from an area prone to hurricanes, forest fires, etc. and cannot make (fly, drive etc.) your trip, please seek reimbursement through your travel insurance. You understand that our cancellation and refund policy applies regardless of the reason for cancellation. External Security Camera: The property has a security camera capable of recording or sending video, audio, or still images. This camera is located outside the unit (as shown in one of the photos) facing the parking lot and clearly visible when you approach the entry door from outside. This camera is always turned on. Tampering with security camera is prohibited. This camera monitors the parking lot & surrounding areas for your safety, ensures parking violations and ensures correct occupancy. House Rules: The house is meant for your comfort and family / personal enjoyment and is not marketed as an event space. Violation of house rules will lead to cancellation of your reservation and no refunds will be granted. As such, please note the following house rules - ● No early check in or late check out. ● No Parties! This is also banned by the platform. ● No smoking /vaping anywhere in the premises (not inside the unit, not outside in the porch or the balcony or the parking area). This is a fire hazard for our building and against HOA rules. ● No illegal Drugs anywhere on premises. ● No Pets - This property does not accept any pets (including emotional support animals). This is against the HOA rules and is strictly enforced! Please do not try to sneak them in as our cameras will detect & our property manager lives in the building. You will be asked to leave ! ● No Balloons, or signs permitted at the home. ● No Yoga instructors or Massage or therapists’ visitors. ● No Photo Shoots or any social media photo shoots, no production movie films. ● No moving the furniture or beds around all over the house. ● No beer pong or any juvenile games. No Karaoke Machines. No large portable speaker or amplifiers permitted. ● No Fireworks, Drones or anything that can we launched into the sky. ● Keep out of the sand dunes area, at all times, for any purposes. This is protected area by state of MA. ● No trashing/littering/digging anywhere in our yards - not by adults or by children. ● No tampering with ANY electronic devices such as Yale Door Lock, Outside Security Camera, Internet, Thermostats. Normal use is ok. The security devices are registered & linked directly to law enforcement authority’s database. The security camera lights are motion activated between dusk/dawn and turn on and off automatically. ● Barbecue only in designated areas in the yard. You bring your own grille. We only allow propane based grille. Charcoal is strictly prohibited. ● No deliveries and if you have anything delivered before/after your check in/out day and time, it will be rejected or disposed in trash. Food and grocery deliveries are ok, anytime. ● Observe Quiet Hours (10pm-7am) : We monitor noise loudness including chaotic activities such as thumping, jumping, screaming, throwing items, disruptive adults, disruptive children, kids or adults running around in the house etc. If or when our neighbor complains, you have already crossed the threshold of loud noise & disruption that our neighbors can tolerate. This is a violation of quiet hours. ● Behaving appropriately : This is our home and we have neighbors who live here. Please be respectful to others as you are our guests. Not everyone is on vacation. Yelling, screaming, throwing, cursing, getting drunk, assaulting etc. are marks of a bad behavior. ● Observe parking rules : The parking lane is strictly for maximum of three cars (two cars during winter/snow season). While parked elsewhere, if you get towed, it will be at your own expense. Don't park anywhere outside the white lines of your assigned Lane E. No part of your vehicle should be outside the lines. No part of your vehicle should be on the street. ● Observe maximum occupancy rules : Please be sure that the exact number of people you intend to sleep at the home is the exact number of people you book. We are reasonable and happy to consider practical requests for occupation, not exceeding the sleeping capacity and we encourage you to communicate. At anytime, there cannot be more than 15 people inside the unit. SNOW SEASON PARKING : We have a plow company do their jobs during snowstorms. We don't guarantee parking in our parking lanes during snow storms as plow trucks must get in the parking lanes to pull out the snow. As such the lanes need to be empty when they arrive. This mean, guest must pull out their cars and find their own street parking, of which plenty maybe available. During the storm, guests vehicles may not be returning back to our parking lanes until storm has ended. Once the storm is over, guests can bring in their cars back into the parking lanes. Also, guests shall manage their own snow shoveling to shovel around their cars or pathways. Shovels are available on premises. If there is snowstorm & our parking lanes are clear of snow, three cars or less can park. If guest needs guaranteed onsite snow season parking, we can't help, please don't book. No refunds will be provided as this would constitute a violation of our house (parking) rules. Check-out List: Our check-out is always at 10AM. As part of our check-out process, please do the following: • Empty the refrigerator and freezer, of your contents (leaving ice bag is ok). • Your food packages, foils etc. to the trash bin inside/barrel located outside. • Load any dirty dishes on sink/counter tops to dishwasher. • Shut off water faucets (kitchen, bathrooms), lights/fans, TVs, AC/heat. • Close all windows properly. • Lock ocean facing sliding glass door & place wooden dowel on tracks. • Lock the entry door as per instructions, upon your departure. • Not be parked in any of the parking lanes, past your checkout time CONDITION AND USE OF PROPERTY The Property is provided in “as is” condition. Rental Agent shall use its best efforts to ensure the operation of all amenities in the Property, such as internet access, cable TV access or pool as applicable. Rental Agent shall not be held responsible for such items failure to work, but will make every effort to correct any issues as reported as quickly as possible. Guest acknowledges that use of amenities such as fireplaces, decks, and the like may be potentially dangerous and involve potential risks if improperly used, particularly with regard to children and such use is at the Guest’s own risk. Guest shall use the Property for residential purposes only and in a careful manner to prevent any damage or loss to the Property and keep the Property in clean and sanitary condition at all times. Guest and any additional permitted guests shall refrain from loud noise and shall not disturb, annoy, endanger, or inconvenience neighbors, nor shall Guest use the Property for any immoral, offensive or unlawful purposes, nor violate any law, association rules or ordinance, nor commit waste or nuisance on or about the Property. RISK OF LOSS AND INDEMNIFICATION Guest agrees that all personal property, furnishings, personal affects and other items brought into the Property by Guest or their permitted guests and visitors shall be at the sole risk of Guest with regard to any theft, damage, destruction or other loss and Rental Agent shall not be responsible or liable for any reason whatsoever. Guest hereby covenants and agrees to indemnify and hold harmless property owner and their agents, owners, successors, employees and contractors from and against any costs, damages, liabilities, claims, legal fees and other actions for any damages, costs, attorneys fees incurred by Guest, permitted guests, visitors or agents, representatives or successors of Guest due to any claims relating to destruction of property or injury to persons or loss of life sustained by Guest or family and visitors of Guest in or about the Property and Guest expressly agrees to save and hold Rental Agent harmless in all such cases. RELEASE Guest hereby waives and releases any claims against Rental Agent, the Property owner and their successors, assigns, employees or representatives, officially or otherwise, for any injuries or death that may be sustained by Guest on or near or adjacent to the Property, including any common facilities, activities or amenities. Guest agrees to use any such facilities or amenities entirely at the Guest’s own initiative, risk and responsibility. By booking this property, you are electronically accepting this agreement, you agree to abide by the above conditions, house rules and hereby swear the information you provided to your platform and to us is true. You agree to the terms of this agreement and has read and understand the cancellation policy and give your booking platform permission to charge credit card accordingly
