We are located right off the main roadway that circles Oahu. Our neighborhood is peaceful and quiet. You can enjoy ocean views from the master bedroom lanai and there is a secluded beach about a 5 minute walk away; best for taking walks not swimming. Popular attractions such as Waikiki, Hanauma Bay, & Chinatown are within a 15 minute drive away. Stays less than 180 days are subject to our Hale Wa’a Beach Gear Rental Package. Please read our Terms and Conditions for more details. The space Hale Wa'a, the house by the sea, is located just off the main highway heading east from the Daniel K. Inouye airport. Hale Wa'a is a 2 story guest house that is located on the same property as our main house. The houses are completely separate to provide complete privacy. The unit's 2 bedrooms and 2 bathrooms easily accommodate 4 guests, but we do allow groups of up to 6. **All bedrooms and the downstairs living space/kitchen have AC, and all bedrooms, bathrooms, and the living space downstairs have ceiling fans** Master Bedroom: - Full Sized Bed - Closet Space, Luggage Holder and Lingerie Chest - Lanai Deck with two chairs and a table; more chairs can be provided upon request Master Bathroom: - Jacuzzi Bathtub & Glass Paneled Shower - Plenty of extra Bathroom Towels - Body Soaps, Shampoo, Conditioner, & Makeup Wipes - Vanity Mirror, Hair Iron, & Hair Blow Dryer Second Bedroom: - 2 Twin Sized Trundle Beds; there are drawers that come out from the trundle bed as well for clothing and other luggage - Closet Space and Luggage Holder Downstairs Living Room: - 32" Vizio Wall Mounted T.V. with Internet Channels such as Netflix, Hulu, & Amazon Video - 2G and 5G Wifi that can be reached throughout the entire house - Retan Sofa that can fit 6 guests easily Kitchen: - Refrigerator with Freezer, 4 Burner Electric Stove, & Dishwasher - Pots/Pans, Rice Cooker, Toaster Oven, & Blender - Full Cutlery, Plates/Bowls, Knives/Cutting Board, Pyrex Food Containers, & Baking/Cooking Utensils Downstairs Bathroom - Shower with Bath Soap/Shampoo/Conditioner - Extra Bathroom Towels & Beach Towels - Sunscreen, Sunburn Lotion, & First Aid Kit **There is also a Stack Washer/Dryer guests can use 24/7 inside the guest house. We also provide Laundry Detergent and Dryer Sheets. There is also a Vacuum, Broom, Mop, and Fire Extinguisher** Guest access There is a parking space available in front of our house for you to utilize at any time and there is plenty of street parking in the neighborhood. Other things to note Hale Wa’a Guest House Rules (Updated May 15, 2024) TERMS AND CONDITIONS This agreement is made between Owners, Agent for the Owner, and Guests. No landlord-tenant relationship shall be created hereby. 180 Night Stay or More Terms Minimum 180 night stay for the guest house. Stays Less than 180 Nights Terms – Ocean Sports Fun Package Stays less than 180 days are subject to our Hale Wa’a Beach rental package. The fee shown on the Airbnb/VRBO platform when you book is for renting the beach equipment and the guest house is included free with this package. Please inquire for more details. General Rules Suitable for infants (under 2 years) and children (2 to 12 years old). Pets allowed with special request and additional fee. No Smoking, Parties, or Events. Check Out & Check In Officially, check-in is at 4 p.m. and check-out time is 11 a.m. We can be flexible on these times if you message us ahead of time and there are no other guests checking in/out on the same day. Pre-Check In Requirements All individuals residing as guests must be listed on this form or included in the booking online. The booking guest certifies that only the individuals listed on the registration will occupy the house. Extra Guest Fees and Rules The home is set for 4 persons; however, we can accommodate a maximum of 5 adult guests (we do make exceptions for families of up to 6 guests with children). There is a $50 per night plus taxes fee for guests after 4 (for reservations made after May 1, 2024). If the 5th additional guest is a child 13 years and under, there is no additional guest fee. If the additional 5th and 6th guests are children 13 years and under (6 guests total), we charge our normal additional guest fee of $50 per night plus taxes. We welcome dogs and cats up to 25 lbs for an additional fee of $30 plus tax per stay. Dogs may not be left unattended in rooms. Pet beds and bowls are provided. Unregistered Guests Any unregistered individuals will be considered unauthorized and additional fees of $100 per person per day will be charged. If it is brought to our attention that there are unregistered guests and/or an event on the premises and/or any violation of other terms and conditions, the agent reserves the right to enter the property to review the situation and impose fines and fees if necessary. The guest may be subject to immediate cancellation and forfeiture of all rents received at the Agent's discretion. Any misrepresentation about the nature or size of the group, or about the use of the property will constitute a breach of the rental agreement. General Rules There will be no subletting or assigning to other parties. Guest(s) agree to take the property as advertised on the website. Guests are responsible for learning about the area of the rental home and the layout of the home. The owner is not responsible for relocating guests once possession of the rental is taken. Owner(s) reserve the right to cancel or rescind any rental agreement if it is found that the guests are conducting unlawful activities. NO parties, please. Check with the host for conditions if you have a question about this. Guests' friends or family not listed on the reservation may visit the guest house with the permission of the owner. Rates do not include daily maid service, car rental, food, liquor, laundry, personal items, or excessive cleaning upon departure (i.e., upholstery or rug shampooing, etc.). Gratuities are not accepted. Laundry and cleaning may be arranged if needed and pricing varies. Guest(s) shall be liable for all acts of the family, invitees, and guests present on the property. Should there be any legal action arising from/relating to occupant(s) use of the residence, the owner shall be entitled to recovery of all legal fees and costs. The owner will not be liable under any circumstances to refund any unused portion of booked accommodations or services, except as noted in the Cancellation Policy. The owner will in no way be responsible or liable for personal property loss due to theft, flood, fire, unforeseen circumstances, or natural disasters. Owner or its agents may enter the property to make necessary/requested repairs, show, or inspect the property. The owner reserves the right to switch Guest(s) to another rental, based on availability, or offer a refund (if the house is not approved by the guests) due to an emergency, fire, sale, unforeseen circumstance, or natural disaster. Any additional cleaning and repair charges, damage, or theft of the property will be deducted from the security deposit and may, if necessary, be charged to occupants as an additional expense if the deposit or waiver is not sufficient. Additional cleaning also includes unremovable stains from linens, towels, and any other fabrics in the guest house. Guests will be charged a replacement fee for the item in this case. All towels, linens, and other fabrics are thoroughly checked after each check-out to notice any discrepancies. Cancellation Policy Any owner or guest(s)' cancellation must be in writing with an email confirmation to meet our requirements. For Airbnb, Firm: Full Refund: Guests can receive a full refund if they cancel at least 30 days before check-in. 50% Refund: If guests cancel between 7 and 30 days before check-in, they will receive a 50% refund of the nightly rate and the cleaning fee. No Refund: If guests cancel less than 7 days before check-in, they will not receive a refund for the nightly rate. However, the cleaning fee will be refunded. For VRBO, Moderate: Full Refund: Guests can receive a full refund if they cancel at least 30 days before check-in. 50% Refund: If guests cancel between 14 and 30 days before check-in, they will receive a 50% refund of the amount they paid. No Refund: If guests cancel less than 14 days before check-in, they will not receive a refund. If the cancellation is at the owner's request, a full refund will be made to the guests. In the event of a sudden death in the family or other similarly unavoidable circumstances outside of the guest's control, allowances will be made out of respect with proof of the incident. Insurance Policy For Guest(s)' own protection, it is strongly recommended that Guests purchase travel insurance. Travel insurance is available and is the sole responsibility of the Guest(s) to secure. No refunds will be made for late check-ins, early checkouts, or no-shows. Refunds will be made only if the property rented becomes unfit for habitation and cannot be repaired or restored to its advertised condition at the time of occupancy. Security Deposit THE ENTIRE DEPOSIT of $500 SHALL BE FORFEITED IF GUEST(S) VIOLATE ANY OF THESE TERMS AND WILL BE LIABLE FOR ADDITIONAL DAMAGES IF THE AMOUNT EXCEEDS THE SECURITY DEPOSIT OR SECURITY DEPOSIT WAIVER FEE COVERAGE AMOUNT. We also reserve the right to deduct the amount we see fit from the damage deposit for any damaged or lost items during the guest's stay. Neighborhood Noise Restrictions & Policies You will be in a quiet residential neighborhood. Please KEEP NOISE TO A MINIMUM AT ALL TIMES and in particular between 9 p.m. and 7 a.m. Please be extra courteous to our neighbors, they are really nice people. Please no music played above personal decibels. No honking/drive slow. Please do not honk your horn at any time or spin your tires when leaving the driveway or property. Also, as a courtesy, please drive slowly in/out and around the surrounding streets. Do not enter other neighbors' property and be respectful of neighbors while walking around the neighborhood. NO FIREWORKS are allowed at any time. There are fireworks from the Kahala Hotel every Friday evening. The best view is from the lanai upstairs. No open flame cooking on the property. Smoking There is no smoking allowed inside the guest house, on the premises, or in the surrounding neighborhood. There will be a cleaning fee of $500 with additional charges if smoking Tobacco, Cannabis, or any other substance occurs/is suspected of occurring. This includes bongs and flavored waters, electronic cigarettes, etc. Trash & Recycling All trash must be bagged. This is essential to keep tropical pests away from the home. Failure to remove copious amounts of trash from the property before your departure will result in appropriate deductions from your security deposit, or additional charges if it exceeds security deposit waiver coverage. Please separate and wash out Glass bottles, Aluminum Cans, and Plastic Bottles from other trash. We take these items to a separate recycler. For trash, please put all cans, plastic bottles, and glass bottles in the white bin under the sink. For plastic bottles, please remove the cap. The plastic bottle caps can be tossed in either the white or black trash bins under the sink. All other trash can go in the black bin. When the trash bin fills up, you can leave it in front of the guest house by the door and we will pick it up. Energy Conservation Make sure to conserve energy and turn off all lights and air conditioners when leaving. Air conditioners can be left on all day for an additional $20 per day plus taxes charge. This fee will automatically be assessed if the air conditioners are left on all day. If it comes to the host's attention that the AC is running and the guest does not want this fee incurred, then the host can turn off the AC manually. Beach Equipment (i.e., Beach Chairs, Boogie Boards, etc.) Disclaimer for equipment: Use all equipment at your own risk Guests will use the equipment in a good and careful manner and will comply with all the manufacturer's requirements and recommendations respecting the equipment and with any applicable laws, whether local, state, or federal, respecting the use of the equipment, including, but not limited to environmental and copyright law. The guests will use the equipment for the purpose for which it was designed and not for any other purpose. Unless the guests have written permission from the owner, the guests will not alter, modify, or attach anything to the equipment unless the alteration, modification, or attachment is easily removable without damaging the functional capabilities or economic value of the equipment. We understand items have a life and some may break due to age and this is something we will not charge for. Sand: Please make sure all guests wash the sand off their feet every time before entering the house with the hose by the parking spot or on the side of the guest house. Please leave shoes at the front door. Please make sure hoses are turned off completely when you are finished using them and report any leaks. When going to the beach, please use the beach towels provided. Do not use bath towels for the beach. When returning from the beach, please rinse bodies and feet using the outdoor hose. Please make sure to shake the sand out of the beach towels and beach mats before coming inside. All beach towels can be left outside and the Host will wash them for you in a larger washing machine. Leave them down by the gate and/or text if you would like this done for you. Clean beach towels will be ready overnight. Wet swimwear: Please do not lounge in wet swimwear inside the house. Water Disclosures Water disclosure pertaining to any of our properties. The agent hereby discloses that the ocean near the Island of Oahu constantly changes with the tide, moon phase, time of year, weather conditions, and other factors that are beyond any person's control. The agent cannot guarantee that there will be a certain amount of sandy area, nor can the agent guarantee the beach and water conditions during the Guest's stay. The guest is hereby advised that the ocean and reefs are inherently dangerous, that Hawaiian waves and currents are much stronger than those existing in other areas, and that extreme caution must be exercised by anyone who chooses to participate in any ocean activities. Beware of the reefs as diving off boats and into surf can be much shallower than you think. ALWAYS swim in the ocean with a companion. Please, please never look into a blowhole along the rocks and cliffs of the ocean. Rogue waves aren’t really that rogue and the water can suck you in and then under then out into the ocean. And most importantly here in Hawaii....NEVER turn your back on the ocean. Never turn your back on a cliff taking a selfie and do not run narrow trails. It is a federal crime to touch or otherwise harass sea animals in and out of the water. Keep your distance and take great pics. Be safe! Hiking on All Islands Please use extreme caution while hiking and use only State of Hawaii marked trails. NEVER hike after a strong rain. NEVER cross a stream during or after a storm. The trails can be treacherous as the vegetation hides the sheer cliffs that drop hundreds of feet. Waterfalls can be shallow at the bottom so use caution when jumping off into the pools below. Release of Liability and Indemnification Agreement In consideration for the right to occupy the vacation rental, the prospective guests acknowledge and agree as follows: Guest(s) agree to inform any and all people who will be on the property at the request of guest(s) or by invitation of the guest(s), of all the terms and conditions, and to monitor compliance with terms and conditions. Guest(s) agree to hold owner(s) and agent(s) free and clear of any liability for damage to self or property, resulting from accident, injury, or loss of enjoyment resulting from events beyond the owner and agent's control (e.g., the weather). Guest(s) acknowledge that the release and indemnity provisions in paragraph 2 apply to all claims for injury or damage resulting from any cause, including the negligence of any party released herein. I further acknowledge that this agreement shall be binding on all family members, guests, including minors, guardians, heirs, and any executor or personal representative or beneficiary. Guest(s) agree that this Agreement should be enforced to the full extent permitted by law. If any section or part of this Agreement is held not to be enforceable under the applicable law, the remainder of the Agreement shall be enforced. The release and indemnification provisions of this Agreement do not apply to reckless or intentional acts unless such provisions are permitted by the applicable law. This Agreement is subject to the laws of the state of Hawaii. Any disputes are subject to be settled by binding arbitration in Honolulu, Hawaii according to the rules of the American Arbitration Association. The prevailing party in any arbitration or litigation shall be entitled to recover reasonable attorneys' fees. I state that I am 18 years of age or older and legally competent to sign this Release of Liability and Indemnification Agreement. I understand that these terms are contractual and not a mere recital. I have signed this document of my own free act. Guest(s) agree to hold owner and agent free and clear of any liability for damage to self or property, resulting from accident, injury, or loss of enjoyment resulting from the weather or inoperable appliances or equipment (including hot tub, barbeque, etc.). I HAVE FULLY INFORMED MYSELF OF THE CONTENTS OF THIS RELEASE AND INDEMNITY BY READING IT BEFORE I SIGNED IT, OR BOOKED ONLINE THROUGH A TRAVEL SITE INCLUDING BUT NOT LIMITED TO AIRBNB AND VRBO. SIGNATURES Please sign here that you have read and understand all the above Terms and Conditions, Cancellation Policy, Insurance Policy options, and Security Deposit information. The foregoing constitutes the entire agreement between the parties and supersedes any and all other Agreements, whether written or oral, express or limited, and may be modified only if executed in writing by all parties. Confirmation occurs upon full execution of this agreement and receipt of the $500 deposit amount.
