By booking you are agreeing to the terms below and will be contacted by a rental agent from Berkshire Hathaway Adirondack Premier Properties within 24 hours of your booking to finish your reservation.* TENANT COVENANTS AND AGREES AS FOLLOWS: 1. Not to assign this agreement or sublet the demised premises and contents, without written consent of the Landlord and/or his agent. 2. CHECK OUT IS STRICTLY ENFORCED AT 10AM 3. To permit the Landlord or his or her agents to enter within or upon the premises at reasonable hours in the daytime with prior notice to examine or show same or to make reasonable repairs therein. 4. To make no alterations in or on the premises without the written consent of the Landlord and to bear the responsibility and expense of all damages or repairs resulting from the neglect or carelessness of the Tenant, his family or guests during said term of occupancy and to quit and surrender the premises and furniture, etc., in as good a state and condition as they were at the time of occupancy. 5. That the maximum daily use or nightly occupancy is limited to 4 persons. Any violation of this agreement without consent shall result in a breach of this agreement and the Tenant agrees to immediately vacate the premises and forfeit all rent and security monies. 6. The Tenant agrees to leave the premises in neat condition upon departure. The tenant will not move furniture. In the event that the required cleaning exceeds the norm, any additional cleaning costs shall be deducted from the security deposit. 7. Tenants will not have parties without prior written approval or exceed the occupancy allowed. 8. If Tenant has not made prior personal inspection of the leased premises, Tenant acknowledges and agrees to lease the premises "as is" subject to any state of facts that a personal inspection would have disclosed. Neither Landlord nor agent shall be responsible for providing any item or service which is not present and should have been disclosed by a personal inspection. In such event the Tenant will have no claim or any recourse for misrepresentation by the Landlord or the rental agent and Adirondack Premier Properties Inc. LANDLORD COVENANTS AND AGREES AS FOLLOWS: 9. To have the premises and contents clean and in order for occupancy at the beginning of the term herein stated. And to allow said Tenant, upon paying the rent and performing the covenants and agreements contained herein to quietly enjoy the demised premises, furnishings, etc. for the term hereby granted. If the Tenant is not satisfied with the cleanliness of the premises upon arrival, the Tenant will so notify the agent within 24 hours so the appropriate cleaning arrangements can be made. Any other maintenance issues must also be reported upon arrival to allow said issues to be solved at the beginning of the lease term. 10. To pay all charges of electricity, fuel, local telephone, garbage removal and general operating expenses. General operating expenses shall include but shall not be limited to appliance repairs, limited home supplies, water usage, pest control, plumbing and electrical service calls and snow removal. All linens and towels are provided. 11. To see that the premises (including the plumbing, heating, lighting electrical and roof) are in working condition. To bear the responsibility of maintaining all appliances and providing basic telephone and cable television service, where applicable, as well as an operating telephone and television on the premises. 12. Landlord agrees to notify the escrow agent of all damages or charges against Tenant with the exception of telephone within 14 days of vacancy. Failure to provide timely notice shall be interpreted as full satisfaction and said escrow agent may release the security deposit or any portion thereof. 13. Landlord agrees that the balance after payment of items as provided for above, if any, shall be returned along with an itemized statement of those costs to the Tenant. In the event a dispute arises pertaining to the security, the escrow agent will continue to hold the security until the disagreement is settled between the parties. Should no settlement be resolved within 60 days then the escrow agent may pay the retained money into a Court. 14. If Tenant has not made prior personal inspection of the leased premises, Tenant acknowledges and agrees to lease the premises "as is" subject to any state of facts that a personal inspection would have disclosed. Neither Landlord nor agent shall be responsible for providing any item or service which is not present and should have been disclosed by a personal inspection. In such event the Tenant will have no claim or any recourse for misrepresentation by the Landlord or the rental agent and Berkshire Hathaway Home Services Adirondack Premier Properties Inc. 15. The Landlord and Tenant recognize Berkshire Hathaway Home Services Adirondack Premier Properties Inc. as the sole broker who brought about this lease.. Adirondack Premier Properties Inc is the agent for the Landlord and acts solely on his or her behalf. The Landlord agrees to pay a rental commission to the broker of 20% of the nightly, weekly or seasonal rent unless otherwise agreed herein for brokerage services only. 16. Quiet Enjoyment of Property: Any offensive or excessive noise or behavior that causes unreasonable disturbances or annoyances to neighbors, and which shall interfere with their quiet enjoyment shall constitute a breach of this agreement. If Berkshire Hathaway Home Services Adirondack Premier Properties, Inc. or law enforcement is contacted or dispatched to the property regarding any such disturbance then the tenant's security deposit shall be forfeited and such actions will be considered grounds for immediate eviction. Any outdoor fire located within the limits of Keene Valley must be extinguished no later than 10:00 PM. Make sure outdoor fireplaces are left neat and tidy, the same way as when you got to the property. Do not leave trash in or around the fire pits or the yard, it can attract animals. If these areas are left a mess there could be a forfeiture of a portion of your security deposit. We work hard and play hard so we need our rest. There are strict limits on noise levels between 9:00 PM and 7:00 AM. Ordinances will be enforced by any law enforcement agency with jurisdiction over the short-term rental property. A violation of this ordinance will result in termination of the contract. Fireworks are illegal in New York State, and not allowed under any circumstance. Help keep our wilderness safe! 17. FIRM CANCELLATION POLICY Full Refund for cancellations up to 30 days before check-in. If booked fewer than 30 days before check-in, full refund for cancellations made within 48 hours of booking and at least 14 days before check-in. After that, 50% refund up to 7 days before check-in. No refund after that. 18. UPON DEPARTURE THE TENANT WILL LEAVE A CLEAN KITCHEN WITH ALL DISHES WASHED. 19. No Smoking or Vaping is allowed in or on the premises.
