The flat is furnished and includes a fully equipped kitchen with microwave, oven, plates, dishes, coffee machine, boiling waters, plates, cooking appliances,fridge,washing machine. The living room comprises a tv and dvd with a dining table, chairs,sofa, a glass door cabinet and bookcase.The rooms include two single beds, cupboards, the ironing facilities, a desk and table lights.The flat has two toilets. The access to the flat is conditioned on the signature of an agreement under Belgian law The space The flat is ideal for business travelers or two guests with a child for a long term stay. The guests can use the entire flat and are given a reasonable credit for the use of water and electricity based on previous tenants diligent use of the premises and amounting to 100 eur and 30 eur (for stays of less than one year, otherwise a monthly provision of 230 eur in addition to monthly electricity charges of 40 eur each subject to yearly adjustments, will apply). Multiples towels and bed linen and bed covers are provided in the flat. There are two TVs with DVDs and an air conditioner for the summer period. The kitchen is equipped with plates, dishes, glasses, champagne glasses, a mixer, pots,woks, potato cooking appliances, vegetable mixers, saladiers, a toaster, the microwave, the oven etc. The WiFi must be paid for separately. (29 Eur for a month). There is a tax in brussels amounting to 4.24 per night which may apply. This has to be factored in separately. Guest access The flat and the balcony can be used by guests Other things to note Legal considerations The access to the flat is conditioned on the signature of a two pages agreement under Belgian law, which will set forth the details of the stay, the maintenance of the flat, the entrance and exit inventories and compliance with laws in Belgium and the homeowners regulation. The agreement is provided in English prior to the check in on requests made by the guests. In the absence of a request the host will by his own motion provide the agreement by email in order to comply with Airbnb terms of services. The Airbnb listing ad contains the main principles of the stay while details are regulated by the applicable Belgian law and the lease agreement according to the Regulation 593/2008(“Rome I regulation”) and the 1215/2012 regulation (“Brussels regulation”) as the case may be. The interactions of the guests and the host on the Airbnb platform are subject to Airbnb terms of services. Guests represent and warrant that they will use the flat as if it were theirs and the guarantee set on Airbnb is only indicative. In the event of damages, they will need to cover to the fullest extent permitted by Belgian law all the damages they may have caused, which may in and of itself exceed the guaranteed amount on Airbnb. The host can ask the restoration of the premises to their initial state including the complete replacement or refurbishment further to damages. Reference is to be had to the agreement which will set forth the details of the terms of the stay based on entrance inventories. Guests represent and warrant they will hold the host harmless of any damages in case they don’t follow the instructions provided on entrance. The guests represent and warrant that they will be registered at the premises for the entire duration of their stay and in the absence of the notification of a new address to the host, they will keep the registered address after they have left the flat. The registered address is only kept for the purpose of establishing jurisdiction in Belgium and guests represent and warrant that they consent to the processing of their personal data for the purpose of their stay in accordance with the regulation 2016/679 (“GDPR”) by making a booking. Guests hereby agree that their booking with the host (as defined in the terms of services) on the Airbnb platform (“Airbnb Contract”) and the contract entered into with the host (“Lease Agreement”), as the landlord, in order to enter the premises, will be governed by Belgian law. Any disputes arising in connection with the Airbnb Contract and notably the Lease Agreement shall be subject to the exclusive jurisdiction of the courts in Brussels. Disclaimer The host lists the flat on a private occasional basis and does not intend to derive a business income in connection with the listing. The Lease Agreement entered into with potential tenants will be in principle fixed term contracts under the applicable Belgian law and the host hereby disclaims any responsibility in connection with the management and running of a hotel service under Belgian law. The host acts as an individual managing his own wealth and will derive (if applicable) rental income according to Belgian tax law(code des impôts sur le revenu tel que modifié), mainly for period lapsing between two long term lease agreements entered into with tenants outside the scope of Airbnb platform. The Lease Agreements are the intellectual property of the host/landlord and any disclosure to third parties (including airbnb) is prohibited and must be made pursuant to the prior written approval of the host/landlord.
