By signing this contract, the lessee declares to have visited the property leased to him, to have found it suitable for the agreed use and to take it over for all legal purposes with the collection of the keys, constituting himself, from that moment, the custodian of the same. The lessee undertakes to return the leased property unit in the same condition in which it was received, except for normal wear and tear, under penalty of compensation for damages. 7) (Changes and improvements) The lessee may not make any changes, innovations, improvements or additions to the leased premises and their use, or to existing facilities, without the prior written consent of the lessor. 8) (Lessor's disclaimer) The lessee expressly exempts the lessor from any liability for direct or indirect damages that may arise from third parties, as well as for unintentional interruptions of services. 9) (Visits) The tenant must, at all times, allow access to the entire real estate unit, to the landlord and his/her agents, in all cases in which they have reason to do so (always leaving their bedroom open), for example to carry out: - check-in/check-out of the other tenants - cleaning (on days and daytime hours and at the sole discretion of the lessor) - periodic inspections for various purposes (also check the state of maintenance, cleanliness, order of the leased premises). 10) (Obligations and Prohibitions) The tenant undertakes to: - keep both the common areas (kitchen, bathroom, corridor, terrace) constantly clean, regardless of who caused the dirt and disorder, and the entire portion of the room surrounding your bed (for example, avoiding consuming or leaving food and drinks in it) - use correctly, throughout the stay in the apartment, the night set (1 mattress cover, 2 pillowcases, 4 sheets, 1 duvet, 1 duvet cover) and the bathroom set (1 large towel, 1 small towel) received at check-in. In particular, always use the mattress cover and the 2 pillowcases provided by the landlord, use the duvet only after placing it inside the duvet cover, ... - wash the sheet over the mattress cover and the pillowcase at least once every 15 days - separate garbage collection (as indicated on the landlord's blog) - bring the garbage bags to the appropriate condominium rooms (as indicated on the landlord's blog) - always leave your bedroom open, to allow check-in/check-out of other tenants, cleaning, inspections - comply with national laws relating to the maximum temperature (20 degrees) to be maintained inside each home - keep the premises ventilated - check, approximately every 15 days, the water level of the boiler, or check that the needle of the pressure gauge is always in the green area, otherwise inform the landlord promptly - immediately provide, at their own expense, for routine maintenance, repair damage caused by fault, negligence or misuse of the premises, facilities and existing furniture - comply with the condominium regulations and the resolutions of the condominium assembly The tenant also undertakes NOT to: - perform acts and behave in a way that could damage the rented apartment, harass the other possible tenant and the landlord (for example, disturb the sleep of others with excessive stays in the bathroom from 12:00 a.m. to 9:00 a.m., eat in the bedroom, etc.) and the inhabitants of the building - make noise (music, etc.), in particular from midnight to 9:00 a.m. - sleep on the mattress without a mattress cover, use the pillow without a pillowcase - make mistakes and/or forget to separate waste - use the washing machine when it is not full and when others are sleeping - forgetting to turn off the lights - let relatives, friends or acquaintances into the rented apartment and the common areas of the condominium - smoking, anywhere in the apartment and also on the terrace - leave any of your own items in the common areas (e.g. books in the kitchen, towels in the bathroom, etc.) - change the default thermostat settings - use electric stoves - violate national laws relating to the maximum temperature (20 degrees) to be maintained inside the apartment - interrupt the flow of electricity to the boiler (by moving the button next to it from 1 to 0). 11) (Stamp duty and registration fees) Any stamp duty for this contract and for the consequent receipts will be borne by the tenant. The lessor will register the contract, informing the lessee. The latter will pay, if due, the share due to him, equal to half. 12) (Election of domicile and jurisdiction) For all purposes of this contract, including the notification of enforcement deeds, the Lessor elects domicile at the address of residence stated in the contract, while the Lessee elects domicile in the premises leased to him even if he no longer occupies or otherwise holds them and has not, in the meantime, notified the Lessor, by registered letter with return receipt, of his new domicile. The competent court is the Court of Bergamo. 13) (Amendments) Any amendment to this contract cannot take place, and cannot be proven, except by written deed. 14) (Communication of personal data) The Lessor and the Lessee mutually authorize each other to communicate their personal data to third parties in relation to obligations related to the lease relationship (Law no. 675 of December 31, 1996). 15) (Reference) For anything not provided for in this contract, the parties expressly refer to the National Convention pursuant to art. 4 c.1 L. 431/98, to the decree of the Minister of Public Works in agreement with the Minister of Finance pursuant to art. 4, c 2 L. 431/98, to the provisions of the Italian Civil Code, of Law 392/78, of Law 431/98 and in any case to the regulations in force and to local customs. 16) (Flat rate tax) The lessor adheres to the flat-rate tax regime, therefore waiving, throughout the validity of the aforementioned option, any update of the fee, including the ISTAT update. The guest must: - print it - sign every page with a clear and legible signature - take a photo of every signed page of the contract - send all the photos with signed pages of the contract to the host by both emails. ITALIAN FISCAL CODE According to Italian law, if the guest (in Italian "conduttore") wants to book a bed in an apartment for more than 30 days: - a contract is mandatory - the contract must be registered by the host within 30 days from the check-in - to register the contract, within 30 days from the check in, the host needs the Italian fiscal code of the guest, even if the guest comes from abroad, from extra EU countries too. So every guest must send their fiscal code to the host within 15 days from the check-in and in the contract it is written that the guest (in Italian "conduttore") MUST write to the host his/her Italian fiscal code WITHIN 15 DAYS after the first day (check-in) he/she will be in his apartment. If the guest comes from abroad or from non-EU countries, immediately after the booking on Airbnb, to obtain his/her fiscal code, he/she must send an email to “Agenzia delle entrate”, writing them as follows. " Dear Sirs, I am not an Italian citizen and I do not want to immigrate to Italy, I just want to participate in a Ryanair training course in Bergamo for about 45 days, in order to become a Ryanair flight attendant. CHECK-IN HOURS Check-in during the day is possible only and exclusively on the following days: - Monday - Tuesday - Thursday - Friday. On weekends: the host is far from Bergamo. check-in is possible only in the evening hours of Sunday Check-in appointment hours will always be decided by the host. INVENTORY & KEYS Check-in is basically the guest must: - Check that everything in the apartment is working and clean. - sign the following inventory and key delivery - photograph each page of the signed inventory - send the host, with a message on Airbnb, every photo of the signed inventory and key deposit - pay 100 euros for the key deposit. DIFFERENTIATED WASTE Garbage separation is STRICTLY MANDATORY according to municipal and condominium rules. The guest, under penalty of immediate reporting to Airbnb with a claim for damages, also undertakes NOT to: - carry out acts and behave in ways that could damage the rented apartment, harassment of the other guests possibly present in the apartment, and the inhabitants of the building - make mistakes and/or forgetfulness in the separate collection of garbage - leave any object in the common parts (example: books in the kitchen, towels in the bathroom, etc.) - make noise (music, etc.), especially after 10 p.m. - bring friends or acquaintances into the rented apartment and common areas of the condo - smoking, anywhere in the apartment and also on the terrace; - change the thermostat's default settings. In particular, always use the mattress cover and the 2 pillowcases provided by the landlord, use the duvet only after placing it inside the duvet cover, ... - wash the sheet over the mattress cover and the pillowcase at least once every 15 days - separate garbage collection (as indicated on the landlord's blog) - bring the garbage bags to the appropriate condominium rooms (as indicated on the landlord's blog) - always leave your bedroom open, to allow check-in/check-out of other tenants, cleaning, inspections - comply with national laws relating to the maximum temperature (20 degrees) to be maintained inside each home - keep the premises ventilated - check, approximately every 15 days, the water level of the boiler, or check that the needle of the pressure gauge is always in the green area, otherwise inform the landlord promptly - immediately provide, at their own expense, for routine maintenance, repair damage caused by fault, negligence or misuse of the premises, facilities and existing furniture - comply with the condominium regulations and the resolutions of the condominium assembly The tenant also undertakes NOT to: - perform acts and behave in a way that could damage the rented apartment, harass the other possible tenant and the landlord (for example, disturb the sleep of others with excessive stays in the bathroom from 12:00 a.m. to 9:00 a.m., eat in the bedroom, etc.) and the inhabitants of the building - make noise (music, etc.), in particular from midnight to 9:00 a.m. - sleep on the mattress without a mattress cover, use the pillow without a pillowcase - make mistakes and/or forget to separate waste - use the washing machine when it is not full and when others are sleeping - forgetting to turn off the lights - let relatives, friends or acquaintances into the rented apartment and the common areas of the condominium - smoking, anywhere in the apartment and also on the terrace - leave any of your own items in the common areas (e.g. books in the kitchen, towels in the bathroom, etc.) - change the default thermostat settings - use electric stoves - violate national laws relating to the maximum temperature (20 degrees) to be maintained inside the apartment - interrupt the flow of electricity to the boiler (by moving the button next to it from 1 to 0). 11) (Stamp duty and registration fees) Any stamp duty for this contract and for the consequent receipts will be borne by the tenant. The lessor will register the contract, informing the lessee. The latter will pay, if due, the share due to him, equal to half. 12) (Election of domicile and jurisdiction) For all purposes of this contract, including the notification of enforcement deeds, the Lessor elects domicile at the address of residence stated in the contract, while the Lessee elects domicile in the premises leased to him even if he no longer occupies or otherwise holds them and has not, in the meantime, notified the Lessor, by registered letter with return receipt, of his new domicile. The competent court is the Court of Bergamo. 13) (Amendments) Any amendment to this contract cannot take place, and cannot be proven, except by written deed. 14) (Communication of personal data) The Lessor and the Lessee mutually authorize each other to communicate their personal data to third parties in relation to obligations related to the lease relationship (Law no. 675 of December 31, 1996). 15) (Reference) For anything not provided for in this contract, the parties expressly refer to the National Convention pursuant to art. 4 c.1 L. 431/98, to the decree of the Minister of Public Works in agreement with the Minister of Finance pursuant to art. 4, c 2 L. 431/98, to the provisions of the Italian Civil Code, of Law 392/78, of Law 431/98 and in any case to the regulations in force and to local customs. 16) (Flat rate tax) The lessor adheres to the flat-rate tax regime, therefore waiving, throughout the validity of the aforementioned option, any update of the fee, including the ISTAT update. The guest must: - print it - sign every page with a clear and legible signature - take a photo of every signed page of the contract - send all the photos with signed pages of the contract to the host by both emails. ITALIAN FISCAL CODE According to Italian law, if the guest (in Italian "conduttore") wants to book a bed in an apartment for more than 30 days: - a contract is mandatory - the contract must be registered by the host within 30 days from the check-in - to register the contract, within 30 days from the check in, the host needs the Italian fiscal code of the guest, even if the guest comes from abroad, from extra EU countries too. So every guest must send their fiscal code to the host within 15 days from the check-in and in the contract it is written that the guest (in Italian "conduttore") MUST write to the host his/her Italian fiscal code WITHIN 15 DAYS after the first day (check-in) he/she will be in his apartment. If the guest comes from abroad or from non-EU countries, immediately after the booking on Airbnb, to obtain his/her fiscal code, he/she must send an email to “Agenzia delle entrate”, writing them as follows. The guest can ask for information about the tax code from Ryanair, Airbnb, Consulate, etc., but not from the host. CHECK-IN HOURS Check-in during the day is possible only and exclusively on the following days: - Monday - Tuesday - Thursday - Friday. On weekends: the host is far from Bergamo. check-in is possible only in the evening hours of Sunday Check-in appointment hours will always be decided by the host. INVENTORY & KEYS Check-in is basically the guest must: - Check that everything in the apartment is working and clean. - sign the following inventory and key delivery - photograph each page of the signed inventory - send the host, with a message on Airbnb, every photo of the signed inventory and key deposit - pay 100 euros for the key deposit. To come back to the elevator, if the door is closed, open it with a second key BEHAVIOR The guest, under penalty of immediate reporting to Airbnb with a claim for damages, undertakes to: - comply with the condominium regulations and the resolutions of the condominium assembly - separate garbage - carry and empty the differentiated garbage bags in the appropriate condominium room; - inform the host by email about the check-out time, at least 3 days before the check-out day. The guest, under penalty of immediate reporting to Airbnb with a claim for damages, also undertakes NOT to: - carry out acts and behave in ways that could damage the rented apartment, harassment of the other guests possibly present in the apartment, and the inhabitants of the building - make mistakes and/or forgetfulness in the separate collection of garbage - leave any object in the common parts (example: books in the kitchen, towels in the bathroom, etc.) - make noise (music, etc.), especially after 10 p.m. - bring friends or acquaintances into the rented apartment and common areas of the condo - smoking, anywhere in the apartment and also on the terrace; - change the thermostat's default settings. VISITS The guest must, at any time, allow access to the entire property unit, the host and his appointees, in all cases where they are right (always leaving their bedroom open), for example for: - check-in/check-out of the other guests - cleaning (at least one hour each week for each guest, on daytime days and times and at the sole discretion of the host). - periodic inspections for various purposes (also checking the state of cleanliness, order, maintenance of the leased apartment)
