Description

House is located in a quiet location, separated from the Schlei only by a cul-de-sac. The apartment is spread over two floors. The living area upstairs offers a panoramic view to the west over the Schlei. Also kitchen, open dining and living area and terrace have a water view. The three bedrooms with double beds and bunk bed are located on both floors, each right next to one of the shower rooms. Guest access A maximum of one knee-high dog can be brought along. We would like to point out the following circumstances: Access to the residential units is exclusively via grating stairs and paths. In the residential units, there are smooth softwood stairs. Dogs are not allowed on the upholstered furniture or in the beds. Dogs are not allowed to be left unattended in the vacation home. The property is not fenced. Other things to note The use of the wallbox is an additional paid service and must be discussed in advance of the holiday. Smoking is not allowed in the Fjordhaus. Furthermore, it cannot be used for parties. Contract / Arrival and Departure With the booking request, which can be made via the website, verbally, by telephone or in writing, the tenant bindingly commissions the rental of a vacation apartment. Reservations can be made by mail, email, phone, verbal or via internet. The respective availability of the arranged apartment will be updated. When booking via the website, the rental agreement is concluded when the deposit is made by the tenant and the booking has been confirmed by the landlady. When booking by email, phone, verbally or via correspondence, the rental agreement is concluded when the down payment is made by the tenant and the rental agreement has been signed by both parties. When booking via other booking platforms (e.g. Airbnb, booking, etc.), the contract is concluded in accordance with the regulations of the respective platform. The number of nights booked is calculated, a late arrival does not reduce the nightly rate. The accommodation is available from 16:00 on the day of arrival and until 10 a.m. on the day of departure. You will receive the code to open the door on the day of your arrival at 16:00 via SMS to the mobile number you provided. You can use the code for the entire rental period. The code will be generated for you personally and is invalid after the rental period has ended. The apartment must be returned on the day of departure no later than 10 a.m. The apartment must be swept clean when returning, dishes and cutlery are washed and put in the cabinets, the fridge is taught, the garbage must be disposed of, windows and doors must be closed. Rental 1. General The agreed apartment or the entire house "Fjordhaus an der Schlei" is rented. Both apartments are fully furnished. The apartments may only be occupied by the number of people you specify without exception. Smoking is not allowed in the apartments. The tenant undertakes to treat the accommodation and the inventory contained therein with care. Defects found at the property must be reported immediately. During the rental period, damage caused to the rental property must be replaced by the tenant without proof of fault. Damages found after departure will be charged to the tenant or withheld from the deposit. The use of the WallBox may take place together with the tenants of the other apartment, is subject to a fee (billing according to consumption) and must be registered and agreed separately before arrival. The provision of the TV, Wi-Fi and the washing machine is a free service, which is not part of the rental agreement and therefore cannot be recourse in case of failure. In addition, the provision can be revoked at any time. 2. Payment Terms Immediately after the conclusion of the contract, the tenant must transfer 25% of the rental price, at least EUR 30.00 of the agreed fee, or sent via stripe. The remaining 75% must be paid no later than 28 days before the trip. If the payment is not made within the specified period, the landlord is entitled to withdraw from the contract. The landlord is then entitled to claim compensation in accordance with the cancellation agreements. When booking via external portals (e.g. Airbnb, booking, etc.), the payment terms may differ, i.e. the terms and conditions agreed upon in connection with the booking apply. City of Kappeln Accommodation Tax Your net invoice amount includes approximately 5% accommodation tax, which is paid to the city of Kappeln. Under certain circumstances, it is possible to be exempt from this tax (e.g. for business or professional overnight stays). If you are exempt from the accommodation tax, please provide a written confirmation/certificate before the start of the stay. Then you will be refunded the paid accommodation tax. Cancellation, cancellation, early departure 1. The tenant can withdraw from the trip at any time before the start of the trip. The decisive factor is the access to the declaration of withdrawal. From the payment of the contractually agreed remuneration, the guest is not exempted by the fact that he cannot use the rental property due to a reason in his person, e.g. prevention for professional or family reasons, illness, etc. 2. The landlord is entitled to 60% of the contractually agreed rental price in case of termination up to 42 days before the start of the rental and to 80% of the contractually agreed rental price in case of termination up to 14 days before the start of the rental, unless it is possible to rent the rental property for the same period and rental price. In case of termination from 14 days before the start of the rental the landlord is entitled to 100% of the contractually agreed rental price. The security deposit will be refunded in full. The decisive factor in the determination of the compensation is the access to the return declaration. 
 3. If the tenant claims that a lesser damage has occurred to the landlord, the corresponding proof must be carried out by the tenant. 4. In the case of early departure, the contractually agreed fee must be paid in full, a partial refund claim of the tenant does not exist. 5. It is recommended to take out travel cancellation insurance. When booking via external portals (e.g. Airbnb, booking, etc.), the terms and conditions may differ, i.e. the terms and conditions agreed upon will apply. Security deposit With the payment of the rental price, the deposit is due. If the deposit is not provided, the handover of the property can be refused. The inventory and the rental property must be treated with care by the tenant. The tenant is obliged to check the inventory as well as the apartment at the beginning of the stay and to immediately notify the landlord of any defects. The tenant is obliged to report any damage occurring during his stay to the landlord. The renter is personally liable for the damage caused by him, his fellow travelers and, if applicable, the dog brought along. In addition, the tenant is obliged to do everything reasonable in the event of any service disruptions and to contribute to a remedy of the disturbance in order to minimize any damage. The tenant must always inform the landlord about this. If the tenant fails to report a deficiency, he is not entitled to any reduction claims. The deposit will be transferred back to the account specified in the rental agreement or via stripe within 8 business days of departure, unless there are any defects or damage. Damage that goes beyond the deposit must also be reimbursed by the tenant. When booking via external portals (e.g. Airbnb, booking, etc.), the conditions for depositing a deposit may differ. Liability Claims for damages vis-à-vis the landlord are excluded regardless of the nature of the breach of duty, unless there is intentional or grossly negligent action. There is a septic trough in the meadow to remove the rainwater. This is not for bathing or playing. Please also pay attention to your children! Consent The tenant agrees that his mobile number for emergencies will be passed on to the "holiday home care - Anja Alms", which takes care of the fjord house. Dogs In each residential unit (the entire house is considered one unit), a maximum of one knee-high dog can be brought. We would like to point out the following circumstances: Access to the residential units is exclusively via grating stairs and paths. There may be a risk of injury to your dog. We are not liable for injuries to your dog on our property or in the house. In the residential units, there are smooth softwood stairs. Dogs are not allowed on the upholstered furniture or in the beds. Dogs are not allowed to be left unattended in the vacation home. The property is not fenced. Please always keep your dog on a leash so that your neighbors remain undisturbed. The property must always be kept clean, the open spaces are used for playing and recreation for all guests. Extra agreements There are no verbal side agreements. Changes and additions to this Agreement must be in writing. This includes the modification of this written form clause. Governing Law German substantive law shall apply, unless mandatory regulations prescribe the validity of another law. Privacy The basis for the data processing is Art. 6, para. 1 lit. f GDPR, which allows the processing of data for the fulfilment of a contract or pre-contractual measures. 1. Processing of personal data The data we collect (name, email address and phone numbers) is essential for our activity – the rental of the cottage. Further data about people traveling with you will only be due upon the conclusion of a rental agreement and transmitted by email or post. We would like to point out that security gaps cannot be excluded when data is transmitted on the Internet (e.g. also in the case of communication via email). It is not possible to fully protect the data against access by third parties. 2. What do we use your data for? Your details are relevant to the rental agreement and issuing the invoice. If you have booked via a holiday home portal, this is itself responsible for the GDPR-compliant processing of the transmitted data. For the collection of tax, your information will be shared with the responsible administration if a lease agreement is concluded. 3. Information, blocking, deletion You have the right to have free information about your personal data stored, the purpose of the data processing and, if applicable, the right to rectification, blocking or deletion of this data at any time within the scope of the applicable statutory provisions. With the conclusion of the rental agreement, you accept the procedure described here regarding data protection. Wifi 1. This is a free service that is not part of the rental agreement and therefore cannot be recourse in the event of a failure. In addition, the provision can be revoked at any time. 2. The Wi-Fi is only available with user access and password for the booking period. Third parties may not receive access and user data may not be shared. 3. The landlord reserves the right to block certain pages and services. 4. The Wi-Fi allows malware (viruses, trojans, worms) to access the devices. The landlord assumes no liability for this. 5. The tenant is responsible for the data, paid services and legal transactions transmitted via the Wi-Fi and shall bear their costs. 6. The tenant shall comply with the applicable law in the use of the Wi-Fi, shall not use or disseminate any moral or unlawful content, unlawfully reproduce, distribute or make accessible to copyrighted goods, must comply with the applicable youth protection regulations, shall not send or distribute harassing, defamatory or threatening content, and do not use the Wifi to send mass messages (spam) or for any other unauthorized advertising. Damages and claims of third parties attributable to the unlawful use of the Wi-Fi shall be borne by the tenant and are a violation of the general terms and conditions of the fjord house. 7. The Tenant shall bear all costs and expenses in connection with any unlawful or contrary to the terms and conditions of use of the Wi-Fi. Severability If individual provisions are invalid or unenforceable or become invalid or unenforceable after the conclusion of the contract, the remaining components shall remain unaffected by the invalidity. In place of the invalid or unenforceable provision, the effective and enforceable provision is intended to replace the effective and enforceable regulation whose effects come closest to the economic objective pursued by the contracting parties with the invalid or unenforceable provision. The above provisions apply accordingly in the event of gaps.
