Welcome to Lil’ Hickox! A beautifully furnished 1 bedroom guest house with private yard and entrance. This happening little spot is in a great location, literally steps from Tune up Café, the City of Mud Gallery, and Arandas grocery, and within a ten minute walk from the Santa Fe Railyard. Its an easy drive or bike ride to downtown Santa Fe. Guests enjoy wifi, a fully furnished kitchen, an outdoor hot tub, smart TV and one off street parking space. Other things to note CLEANING: For any guests staying over 30 days we require one additional professional monthly cleaning for each month during your stay. The charge for this cleaning is $55 and will take 1-2 hours to complete and we will send a payment request for this charge. If you are staying exactly one month we will only charge the single $55 cleaning fee noted on the listing unless you request additional cleaning. No matter the length of your stay, you are welcome to request an intermittent cleaning and this can be arranged for an additional $55 if cleaning requested. EARLY CHECK-IN OR LATE CHECK OUT: You are welcome to inquire on either an early check-in or late check-out and we will try accommodate your request if possible. The following charges will apply. $10 for an early check-in between 2-3pm. $20 if between 1pm-2pm. $10 for late check-out between 11am-12pm. $20 if between 12pm-1pm. COVID-19 DISCLOSURE: We understand that Covid-19 is a major concern for travelers and encourage you to adhere to any restrictions and take precautions as listed on the NM Department of Health Website. Should you become aware that you are infected or may have been exposed to Covid-19 and are staying at our rental we do require that you notify us so we can take additional measures to ensure the safety of other guests after your stay. ALL GUESTS WHO CHOOSE TO USE THE HOT TUB AGREE TO THE FOLLOWING HOT TUB RELEASE & WAIVER OF LIABILITY AND INDEMNITY AGREEMENT IN CONSIDERATION OF the risk of injury that exists while SOAKING IN the HOT TUB (hereinafter the “Activity”); and IN CONSIDERATION OF my desire to participate in said Activity and being given the right to participate in same; I HEREBY, for myself, personal representatives, executors, administrators, assigns, guests, children, heirs, and next of kin, (hereinafter collectively, “Releasor,” “I” or “me”, which terms shall also include Releasor’s parents or guardian if Releasor is under 18 years of age), knowingly and voluntarily enter into this WAIVER AND RELEASE OF LIABILITY and hereby waive any and all rights, claims or causes of action of any kind arising out of my participation in the Activity; and I HEREBY release and forever discharge Jose La Cruz-Crawford and Andrea La Cruz-Crawford, (hereinafter “Lessors”) their affiliates, managers, members, agents, attorneys, staff, volunteers, heirs, representatives, predecessors, successors and assigns (collectively “Releasees”), from any physical or psychological injury that I may suffer as a result, direct or indirect, of my participation in the Activity. I HEREBY acknowledge that upon entering the hot tub area, I will continuously thereafter, thoroughly inspect such area. My continued presence constitutes an acknowledgment that I have inspected this area and find and accept such areas as being safe and reasonably suited for the purposes of the Activity. I further agree and warrant that if, at any time, I feel or think anything to be unsafe, I and all guests will immediately leave the area and advise Lessors. I HEREBY acknowledge that I am aware of the potential risks associated with the use of the hot tub due to the Covid-19 pandemic. Nonetheless, I assume all related risks, both known and unknown to me, of my participation in this activity. I also agree to notify Lessors immediately if I am currently experiencing, or have ever had any symptoms related to Covid-19, before, during, or after my stay and will disclose any known test results. I am voluntarily participating in the Activity and I am participating entirely at my own risk. I am aware of the associated HOT TUB RISKS which may include but are not limited to drowning, heat exhaustion, heat stroke, skin/ear/bladder/lung or other infections, chemical burns or irritations, physical/psychological injury, pain, suffering, illness, disfigurement, disability, economic or emotional loss, paralysis or death. I understand that these injuries or outcomes may arise from my own or others’ negligence, including that of Lessors, or from the conditions at the Activity location. Nonetheless, I assume all related risks, both known and unknown to me, of my participation in this activity. Some of the known risks and precautions are noted below and by signing below I am acknowledging that I have read, understand, and will comply with the following: 1. Please KEEP the hot tub CLEAN and CLEAR: You MUST SHOWER with soap and water before you get in to get off most particles, oils, cosmetics and hair and skin products. Never use soaps or oils in the hot tub. No glass containers, shoes, pets, in or around the hot tub. DO NOT eat, or drink, or use soap and shampoo while inside the hot tub. DO NOT urinate or spit into the hot tub. And please, no “adult activity” while inside the hot tub. Failure to keep the hot tub clean WILL result in an additional $50.00 cleaning fee. 2. If the water looks murky or slimy, don’t get in and alert Lessor. 3. Enter and exit the hot tub slowly. Be very careful so you don’t slip and fall. 4. During the winter months, ice may be present and the steps to enter the hot tub and the area around the hot tub may be slippery. If there is ice present or if there are any unsafe surface conditions present, it is recommended that you avoid the hot tub area. 5. No jumping or diving of any sort. 6. Do not use alcohol, drugs, narcotics, or medications before or during hot tub use. 7. Pregnant women and those with heart disease are not allowed in the hot tub without first consulting a doctor for approval. In the event that a doctor’s consultation is not an option, DO NOT use the hot tub. 8. NEVER permit any child to enter the hot tub without adult supervision. Children under 12 must be supervised by an adult and children under the age of 3 are NOT ALLOWED in the hot tub. 9. If you are taking medication of any kind, or being treated for diabetes, low or high blood pressure, strokes, epilepsy, weakened immune system or other conditions, or are a frail elderly person, consult your physician prior to use of the hot tub. 10. Don’t get in the hot tub if you have open sores or wounds, or cuts, or diarrhea. 11. Check the temperature. Do not get in if over 104˚. 12. It is advised to limit your soak in the hot tub to no more than 15 minutes at a time, and cool off before re-entry. If you overheat and faint, you can drown. 13. Keep your head, arms and upper chest out of the water to avoid overheating. Get out if you feel dizzy, overheated, nauseous, or unwell. 14. Stay hydrated before getting into the hot tub. 15. Replace the spa cover after each use and ensure that the cover is closed when you are finished. 16. Do not sit, lay down, or stand on the hot tub cover. 17. Turn off high jets after use. 18. The floating bromine dispenser should be kept in the hot tub when not in use. You may remove the dispenser during use at your discretion but recommend leaving it in the hot tub at all times. I FURTHER AGREE to INDEMNIFY, DEFEND AND HOLD HARMLESS the releasees against any and all claims, suits or actions of any kind whatsoever for liability, damages, compensation or otherwise brought by me or anyone on my behalf, including attorney’s fees and any related costs. I FURTHER ACKNOWLEDGE that Releasees are not responsible for errors, omissions, acts or failures to act of any party or entity involving this Activity on behalf of the Releasees. In the event that I should require emergency medical care or treatment, I authorize Lessor to authorize emergency transport and medical treatment. I further agree to assume all costs involved and agree to be financially responsible for any costs incurred as a result of such treatment. I am aware and understand that I should carry my own health insurance. I hereby acknowledge that I have carefully read this “waiver and release” and fully understand that it is a release of liability. I expressly agree to release and discharge Lessor and their Releasees from any and all claims or causes of action and I agree to voluntarily give up or waive any right that I otherwise have to bring a legal action against Lessor for personal injury or property damage. To the extent that statute or case laws does not prohibit releases for ordinary negligence, this release is also for such negligence on the part of Lessor and Releasees. I agree that this Release shall be governed for all purposes by New Mexico law, without regard to any conflict of law principles. This Release supersedes any and all previous oral or written promises or other agreements. This waiver and release of liability shall remain in effect for the duration of my participation in the Activity, during this initial and all subsequent events of participation. In the event that any damage to equipment or facilities occurs as a result of my or my family’s, guests, or agents willful actions, neglect or recklessness, I acknowledge and agree to be held liable for any and all costs associated with any such actions of neglect or recklessness, inclusive of Releasees court costs and attorney fees. In the event that any provision contained within this Release shall be deemed to be severable or invalid, or if any term, condition, phrase or portion of this agreement shall be determined to be unlawful or otherwise unenforceable, the remainder of this agreement shall remain in full force and effect.
