Upper level mirrors the main level with 800 square feet and bay windows offering a lake view. Pool table and darts with 52" Television and surround sound. Gas fireplace. Built in cabinets with refrigerator and convection microwave. Lower level family room with gas fireplace. The Grounds Eight acres of beautiful Minnesota grass and lake. Large front yard for parking and games. Walking path about 200 yds through the woods to access the lake. Use our golf cart as needed. Mostly PRIVATE lake shore with dock, hard sand swimming with large area for families of all ages to play together in the water. (Some like to wear water shoes because of the mussels.) Two decks and a large patio. The large property is joined to a smaller duplex unit and a lower apartment area where the owners and owner’s family live. A separate dock and walkway to the lake may be used by owners to access their boat. We do not share the lakeshore with you while you are renting. We make every effort to respect your privacy and use of the space. Feel free to drive vehicles or the golf cart down to the lakeshore. Guest access Guests access all 3 floors with 8 bedrooms and 8 bathrooms, large kitchen, dining room, 3 living room areas, patios on both sides of the house, downstairs exercise room, walkway to the lake, private beach, dock, and the grounds in front of and behind the house. There is a wheelchair ramp available to access the front door. Feel free to drive the golf cart or vehicles down the path to the lakeshore if needed. There is plenty of parking in the yard. There are grocery stores, unique shopping boutiques and restaurants, an Art Gallery, Paddle board, boat, bike and ski rentals, Glendalough park for cross-country skiing, hiking, icecream candy store in the summer, Yoga workout and healthy eating all year at Never Better, pizza and burger restaurants all year in Battle Lake, 5 min. away. Justice 2 coffee shop right next door - open Memorial Day to Labor Day. Other things to note By agreeing to rent our house, guests agree to these rules/conditions, and are required to sign this contract before/upon arrival. Terms and Conditions of the Rental I, (We) the undersigned, the guests renting for vacation or business purposes, agree to strictly adhere to all of the following: 1. Payment/Deposit: I (We) are responsible for full payment for the entire rental period, including the occupancy rent amount, being due 90 days prior to occupancy or at the time of booking, whichever is earlier, cleaning fee and damage insurance. Failure to make rental payments when due will result in cancellation of this Agreement and forfeiture of the Deposit. 2. Cancellation: If I (we) request to cancel our reservation after it has been confirmed, the Owner will make every attempt to re-book my (our) reservation. If the reservation is re-booked at the same rate, I (we) will be refunded 75% of the total reservation amount less any fees charged by VRBO or credit card fees. If the reservation cannot be rebooked I (we) understand that the moneys paid may not be returned. 3. Condition: If I (we) do not personally inspect the premises prior to signing this Agreement, I (we) agree to accept the rental property upon arrival, provided it meets the basic description as listed on the Rental Websites. In Addition, I (we) agree that we will not be entitled to a refund of rent money, nor relocation to another property, and will have no claim or recourse against the Owners. 4. Smoking: I (We), our other guests and visitors, agree to not smoke inside the home. Smoking is allowed in outdoor areas only. Butts are to be disposed of properly and not left on the property. I (We), our guests and visitors agree to not bring on to the premises any pesticides, cleaning products, aerosol sanitizers, air fragrances, incense, etc. The occurrence of smoking or other odors may incur cleaning and deodorizing charges. 5. Pets: I (We), our other guests and visitors, agree to not have pets on the property. 6. Noise/Parties: There will be no loud or large parties in the home or on the patio. That all guests will conduct themselves in a manner inoffensive to the neighbors. No music will be played outside past 10:00 pm and outside activities will be kept at conversational noise level. Outside activity will end by midnight. Noise travels easily at the lake and we ask that you respect our neighbors and their right to enjoy the lake life. House parties are strictly prohibited. Complaints from neighbors are grounds for immediate eviction. 7. Hazardous/Illegal Activity: I (We) and our other guests and visitors agree that any drug use on the property, or any disturbance, annoyance, endangerment, or inconvenience of the neighbors; or use of the premises for any immoral or unlawful purposes, or violation of any law or ordinance or commit waste or nuisance on or about the premises will immediately terminate our occupancy and rental agreement of these premises. 8. Owner Access: Owner or Owner’s Agent may enter the premises immediately in the event of an emergency, in order to perform necessary repairs and/or maintenance, or in case of reasonable suspicion of violation of these Terms and Conditions; or with 24 hours notice for normal maintenance or inspection, or to show a prospective renter. 9. Occupancy: Occupancy (including small children, infants, guests, and visitors) is not to exceed 24 persons without prior written permission from the Owners. If more than the maximum number is found to be occupying the leased property, I (we) agree that a charge of $100.00 per person will be made to my (our) credit card, or if I (we) are paying by check or money order, I (we) will promptly submit moneys due. Additionally, this will be cause for this Agreement to be immediately terminated without refund. 10. RVs/Campers: Occupancy of RVs, campers and /or tents on the premises, driveway or parking area is forbidden. 11. Dock/Lifts: A dock is provided for guest enjoyment. The water at any point of the dock is NOT deep enough for diving. No diving from the dock. Clitherall Lake has at least one public access. It is maintained by MN DNR. Due to the variety of boat sizes and types, no lift is provided. Boats should be trailered when not being used and not left tied to the dock. I (We) and our other guests and visitors agree to be responsible for any dock damage incurred as a result of dock use or misuse. Damages will be charged to the credit card on file. 12. Housekeeping: When you arrive, the home will be clean and set up with linens and as a courtesy we have included the following list of supplies to accommodate the appropriate amount of guests during your stay: Bath towels, hand towels, wash clothes, napkins, dishwasher soap, hand soap, toilet paper. All supplies are provided and have plentiful supply. No items shall be removed from the premises. a. We supply games and activities for our guests, however some games have small pieces or parts and are not suitable for young children, i.e. toddlers and infants, who may put things in their mouths. Do not allow young children to play unsupervised with games. b. A fireplace is available to guests. Please ask owners for instructions. 13. Check Out Condition: The property will be left in the same good and habitable condition. Any damages or notable conditions found upon arrival must be reported to the Owners within one (1) hour of Occupancy. I (we) understand the property will be inspected prior to my (our) inhabitancy and when I (we) depart. I (we) agree to notify the owners of any damages incurred during our stay. I (we) understand that any intentional damages, missing linens or other items, technology adjusting, late check out or excessive cleaning costs may be posted to my (our) credit card. Excessive cleaning costs will include trash removal from the lake or the grounds, spills on the floors that are not cleaned and trash left in the home. Within 48 hours after checkout, the Owners will notify the guests of charges being assessed and will give an accounting of all charges within 30 days. 14. Check Out Procedure: See the check-out procedure list below. Due to the large size of the home and effort to prepare for the next guests, we will strictly enforce the check-out list. You will be charged for late check out or items not resolved on the list. 15. Lost Items: The Owners will not be liable or responsible for personal items left behind, lost or stolen. 16. Sublet: This Agreement may not be assigned or the property sublet, and is for the signed Guest’s use only. No changes to, or changing of locks of the home / premises are permitted. I /We will not use premises as a location for amateur or professional film/video without prior consent and arrangement with the Owners. Guests agree to keep the house fully locked and secured whenever they leave the building. 17. Property Sale: The Owners reserve the right to continue to market the property for rental, or leasing, as desired. Renters agree to allow the owners to show the property during rentals. 18. Owner Indemnification: I (we) agree to indemnify and save Owners harmless from all liability, loss or damage arising from any nuisance or harm made or suffered on the leased premises by me (us,) guests, or invitees. Also from any carelessness, neglect, or improper conduct of any persons entering, occupying or visiting the home during the rental period. Owner shall not be liable to Guest, Guest’s guests, licenses or invitees or any other person for any injury, loss or damage to any person or property on or about the premises. Guest shall hold Owner and Managers harmless and indemnified from and against all loss, injury or damage occasioned by the use or misuse or abuse of any part of the premises, garage or alley, parkway, or other surroundings and from any omission, neglect, or default of Guest, their other guests, or visitors. Initial each statement:  I understand that this is a family home and not a party house and agree to the designated quiet time at the lake to respect the home owners and the neighbors. No loud music or activities will take place outside after 10:00 p.m. and all outside activities will end at midnight.  I understand that I am responsible to leave the home in clean condition other than slept in bed linens, used towels and floors showing traffic and dirt. Spills will be wiped up and excessive dirt or other things on the floor will be cleaned. I understand I will be charged an additional cleaning fee if the home is not left in check out condition.  I understand that I am responsible to get garbage to the dumpster. I will be charged a cleaning fee for trash, including cigarette/cigar butts left at the lake, in the yard or other location in or outside the home.  The lakeshore is approximately 150 yards from the home. Feel free to drive vehicles down the path to the lake if needed.  I understand this home is attached to a smaller duplex home and a lower level walkout apartment that the owners and owner's family live in. The owners do not access your living space. A separate dock may be used by the owners to access their boat. We make every effort to respect your privacy and use of the space. The grounds in front and back and the two patios are for your use.  I understand that there are electronics in the home and agree to not unplug or rewire electronic equipment. I will call the home owner with any issues related to the home theaters or other electronics. I understand I may be charged a technician fee if equipment needs to be reset.  I understand no pets or smoking are allowed in the home.  I understand that if sheets are stained, or any other damage, insurance will not cover, I am personally responsible and my Credit Card will be charged.
