Description
The whole group will enjoy easy access to everything from this centrally located home. Walking distance to park, restaurants, ice cream, shopping. 2 minutes to walk across the beach road to the water. On a beach access. Guest access Owner closets are locked. Guests have access to remainder of home, yard, pool and hottub. Other things to note Prior to arrival, you will be asked to sign the Short Term Lease Agreement below: This Vacation Rental Short Term Lease Agreement is made by and between (Owner) Carole Whitener and (Guest)on the date last written on the signature agreement. The Owner and Guest may be referred to individually and collectively as, “Parties”. The Parties, after careful and sufficient consideration agree to the following: 1. The Property is described as a house with 5 bedrooms, 3 full baths, 2 half baths, an outdoor shower, and private pool. The house is fully furnished and equipped for light housekeeping. The following amenities are furnished by the Owner: 2 Microwaves Dishwasher 2 Refrigerators Stove Washer and Dryer WiFi TVs Swimming Pool Linens Ramada Grill Firepit Hot tub Lounge chairs Outdoor furniture 2.Rental Party All persons in the rental party will be bound by the terms of this Agreement. The total number of adults in the rental party will be no more than 12. 3.Maximum Occupancy The maximum number of persons allowed to stay overnight at the property is limited to 12 unless the Owner gives written consent. 4. Visitors A Visitor is an Occupant of the Property who does not stay overnight. No Visitor is allowed to use the common facilities or any amenities, including the pool, when the Guest is not on the Property. 5. Rental Period and Check-in The term of this Lease will be the date agreed to when guest registered. The Property will be ready for the Guest’s occupancy by 5:00 P.M. of the Arrival Date and the Property must be vacated by 10:00 A.M. of the Departure Date. If the Guest or any member of the Rental Party stays on the property beyond the Departure time and date, the Guest will be responsible to pay the rental rate for an additional week. 6. Access Codes Owner will provide the Guest with the Access Code for the doors and pool gate the week prior to arrival. Owner -locked closets are not to be accessed by guests. Any attempt to access an owner-locked private closet or shed is just cause for termination of this Agreement, forfeiture of all rent paid, and the Guest will be liable for damage or missing items. 7. Rules and Restrictions Guests agree to abide by the following rules by the Owner The maximum number of occupants allowed overnight on this Property is 12 unless a written exemption is given by the owner in advance. Smoking is not permitted inside the property. Smokers outdoors will dispose of butts in receptacles Pets are not permitted on the property. Please use the cutting boards to protect the counters. Do not cut/chop items or place hot pots directly on the counters since this may crack or discolor the counters and the guest is liable for replacement costs. No sitting or climbing on the deck railings or counter tops. NO DIVING. Pool is too shallow. Observe posted pool rules. Children are not allowed in the pool area or in Hot tub without the close supervision of an adult. The pool alarm must be on if small children are in the house so that adults will be alerted if they go outdoors to the pool. Never leave the pool gates open without a responsible adult presence. No glass items are permitted in the Ramada or at Pool side. Doors and windows must remain closed while the air conditioning is in use. This is necessary to prevent the system from shutting down or burning out, necessitating a repair call and guest discomfort. Guest will allow backyard access to Pool Maintenance person, as needed. Guest will adhere to the following checklist prior to checkout: Please run the dishwasher and leave no dirty dishes in sinks. Garbage disposed of in outdoor cans and cans must be taken to the curb for Monday morning pickup. Empty Refrigerators. Remove used packages of foodstuffs from cabinets. Please place soiled linens in bags provided. Do not launder sheets and towels prior to leaving. Please lock doors. Return all furnishings to their original places. If any member of the Rental Property fails to follow any of the rules, the Guest may be required to vacate the Property and, and in the event of eviction, the Guest will forfeit Rent paid. 8. Security Deposit The Security Deposit of $500 will be refunded within 14 days of the Guest’s departure, less deductions for any damage to the property or furnishings or excessive messiness or soiling requiring additional cleaning or costs incurred outside the normal course, due to the Guest’s stay. 9. Cancellation If Guest cancels the Reservation, the Reservation Deposit will be forfeited. If Guest cancels the Reservation within 2 weeks of the Arrival Date, the Total Amount Due, less the Security Deposit will be forfeited. 10. Acceptable Payment methods are Credit Card or Debit Card. 11. Cleaning Daily housekeeping is not included in the Rental Rate. Throughout the rental period, Guest will be responsible for keeping the Property clean and in good condition. Any unsafe or dangerous condition must be reported to the Owner immediately. Guest acknowledges that, on the Arrival Date, the Property is in good condition except for any defect the Guest reports to the Owner by the end of the first day following the Arrival Date. Guest promises to leave the Property in good repair and in the same condition it was found by the Guest on the Arrival Date. 13. Furnishings The kitchen is equipped with coffee maker, blender, waffle iron, pots and pans, 12+ place settings, serving bowls, utensils, glasses and cups. Downstairs bar has grilling utensils, cups, bowls, plates, coffee maker and microwave. Kitchen towels and wash cloths are provided as are sheets, washcloths, and bath towels in each room. Beach towels are provided by the entry. Guests should bring their own beach umbrellas and chairs if more than 4 beach chairs are needed for your stay. Loss of any items within the Property or damage to Property or furnishings beyond normal wear and tear will be charged to the Guest. The Property will be inspected following the Guest’s departure. All contents of the Property are the property of the Owner. If an item should break, Guest should notify the Owner immediately. Guest is not permitted to alter the wiring of the televisions or equipment in any way. 14. Parking is limited to five spaces. However, overflow parking may be available at beach accesses across the street and next to the house. Do not park overnight in the beach access parking lot or you may be fined. 15. Mechanical Failures Although all electrical and mechanical equipment on the Property are in good working order, the Owner cannot guarantee against mechanical failure, electrical service, stopped plumbing, water supply, heating or air conditioning, audio visual equipment, internet access, or appliances. Guest agrees to report any inoperative equipment or maintenance problem to Owner or designee, immediately. Owner will make every reasonable effort to have repairs done quickly and efficiently. Guest will allow Owner, or a person designated by Owner, to have access to the Property for the purposes of inspecting and making repairs. Owner is not responsible for inconveniences and no refunds or rent reductions will be made due to failure of such items. 16. Acts of God If a Mandatory Evacuation Order is issued by the local or state authorities, due to a storm or severe weather event, Guest shall be entitled to a pro-rated refund per night for each night the Guest is unable to stay on the Property. Owner will not be liable or deemed in Default under this Agreement for any failure to perform or delay in performing any of the obligations due to or arising out of any act not within the Owner’s control, including, without limitations, Acts of God. 17. Limitation on Liability Owner is not responsible for any accidents, incidents or illnesses that occur to Guest, visitors or any member of the Rental Party or on the Property. Owner is not responsible for the loss of personal belongings or valuables belonging to Guest, Visitors or any member of the Rental Party. Under no circumstances and under no legal theory, tort, contract, strict liability or otherwise shall owner be liable to guest, visitors or any member of the rental party for any damages of any nature, whatsoever, including rising out of or relating to this agreement or guest’s rental of the property or use of the property. In no event will the owner be liable for any damages in connection with this Agreement even if the owner shall have been informed of the possibility of such damage. 18. Indemnification Guest acknowledges that the use of the Property by the Rental Party and Guest’s Visitors is entirely at their own risk. Guest will indemnify and hold harmless the Owner from any and all expenses, costs, damages, suits, actions and liabilities whatsoever arising and related to any and all Property or the failure of any member of the Rental Party or Guest’s Visitors to observe the Rules and Restrictions. 19. Violation of Agreement If Guest or any member of the Rental Party violates any of the terms of this Agreement including but not limited to maximum occupancy, Visitors, and Rental Rules and Restrictions, Owner may evict Guest and Rental Party and Guest will forfeit all Rent and Security Deposit paid. 20. Governing Law This Agreement and all transactions contemplated by this Agreement will be governed by, constructed, and enforced in accordance with the Laws of the State of North Carolina (not including its conflict of laws provision). Any dispute arising from the Agreement shall be resolved through mediation. If the dispute cannot be resolved through mediation, then the dispute will be resolved through binding arbitration conducted within the rules of the American Arbitration Association. 21. Amendments This Agreement may be modified or amended in writing by both Guest and Owner. 22. No Waiver Neither the Owner or Guest will be deemed to have waived any provision of this Agreement or the exercise of any rights held under this agreement unless such waiver is made expressly and in writing. 23. Severability If any provision of this Agreement is found to be invalid or unenforceable in whole or in part, the remaining provisions shall not be affected, and shall continue to be valid and enforceable as though the invalid or unenforceable parts had not been included in this agreement. 24. Notices Any notices or communication under this Agreement must be communicated in writing through email electronic transmission. 25. Successors and Assigns This Agreement will insure to the benefit of and be binding upon the Owner, its successors and assigns and upon Guest and its permitted successors and assigns. 26. Entire Agreement This Agreement represents the entire agreement and understanding between the Parties with respect to the subject matter of this Agreement and supersedes all other negotiations made by and between the Parties.
