The house is not appropriate for parties or events and are not allowed. Sleeps in beds: 19 Max capacity: 24. There are 22 places to sleep including 3 sofas. This is the primary BR (plenty of room for crib, air bed, etc.) BR 2: Cal King bed with dedicated full bathroom. Den area: one sofa Upstairs: BR 3: Queen bed with ensuite full bathroom. Plenty of room for air bed or crib. BR 4: Queen bed with room for a crib. Jack'n'Jill bath with private sink and shared toilet and tub/shower. BR 5: King bed with Jack'n'Jill bath. Private sink and shared toilet and tub shower. BR 6: Three Twin beds, room for a crib, this bedroom is accessed through BR 5. Loft area with sofa Garden terrace level: BR 7: Two Queen beds. This room also has room for a crib. BR 8: Daybed with trundle in the exercise room. Curtain for privacy. Our place can “absorb” a large number of people and not feel one bit noisy, crowded or cramped. Other things to note The driveway is somewhat steep but not terribly. 4-wheel-drive is NOT required. You will be required to sign a waiver for use or non-use of the swimming pool. Swimming Pool Waiver and Release of Liability Form Release of Liability, Waiver of Claims, Assumption of Risk, and Indemnity Agreement PLEASE READ CAREFULLY. BY SIGNING THIS DOCUMENT, YOU CHOOSE TO WAIVE CERTAIN LEGAL RIGHTS, INCLUDING THE RIGHT TO SUE. To: Ellen and Jason McDougald, (Owners of Oak Hill House Property, Releasees) I may or may not wish to swim at the vacation home’s pool facilities at during the length of our stay at your property in Fletcher, NC. By staying at the vacation home, and/or by swimming in the vacation home pool, I recognize and fully understand certain things, including: • At no time is there a lifeguard on duty, I (the renter) am responsible for the safe operation of the pool and am responsible for ALL PERSONS USING THE POOL during my stay, whether in my party or not. • My use of the pool facilities during my stay involves certain risks, including but not limited to: 1. The risk of injury resulting from possible malfunction of the pool equipment; 2. The risk of injuries resulting from tripping or falling over obstacles in the pool area; 3. The risk of injuries resulting from unsupervised divers and swimmers colliding; 4. The risk of other injuries resulting from participating in any action in the pool. • I recognize and fully understand that the above list is not a complete or exhaustive list of all possible risks; the list only provides examples of types of risks that I am assuming. In exchange for the Owners’ allowing me to utilize the pool and area during my stay, I hereby agree to the conditions below. I fully intend and choose to give up the legal rights, as stated below: 1. TO WAIVE ANY AND ALL CLAIMS that I have or may have in the future against the Owner, its directors, officers, employees, agents, or representatives (hereinafter referred to as the “Releasees”) relating to my use of the pool and pool area; 2. TO RELEASE THE RELEASEES from any and all liability for any loss, damage, injury, expense, or other costs that I may suffer or that my next of kin may suffer in connection with my use of the Releasees pool or pool area to any cause whatsoever, INCLUDING NEGLIGENCE ON THE PART OF THE RELEASEES; 3. TO HOLD HARMLESS AND INDEMNIFY THE RELEASEES from any and all liability to property, or personal injury to, any third party, resulting from the use of the pool or pool area 4. That I am over the age of 18 and that I am responsible and that I will adhere to all the rules of the property; 5. That this Waiver, Release, and Agreement is fully effective and shall be effective and binding upon me, and my heirs, next of kin, executors, administrators, and assigns, or anyone else authorized to act on my behalf or on behalf of my estate. 6. That this Waiver, Release, and Agreement is fully effective and shall be effective and binding upon anyone in my party staying at the vacation home (referred to as “rental party"), any guests of anyone in my rental party, and any of my rental party’s heirs, next of kin, executors, administrators, and assigns, or anyone else authorized to act on anyone in my rental party’s behalf or on behalf of any of the rental party’s estates. 7. That I have been offered the option TO HAVE THE SAFETY POOL COVER PLACED ON THE POOL before my party’s arrival and for the entire duration of my party’s stay. It cannot be taken off and put back on at any time during my rental period once my party has arrived. I have read and understand this document. I am aware that by signing this document, I am waiving certain legal rights that I may have against the Releasees, and I fully agree to do so.
