The guest by signing this registration card, warrants that he or she (“he”) is duly authorized to sign for and bind all persons represented by him or for whom he is responsible or for who he is arranging accommodation at the Guest House to these conditions of residence and failing such authority in respect of any member of his party, agrees that in addition to any other remedies the Guest House may have him, for breach of his warranty, to be personally liable for all amounts arising from the residence of himself and his party at the Guest House and indemnifies the Guest House against any claim made by any member of his party, as contemplated in clause 5 below. 2. It is specifically agreed that notwithstanding any reservations made or accepted, the guest is obliged to pay, in advance, for the first night`s stay, before the guest is entitled to occupy a room. 3. Subject to availability of rooms, guests may check-in from 15:00 on the arrival date and must check-out by no later than 10:00 on the departure date unless prior arrangement with management. Arrivals after 20:00 will be seen as a late arrival and must be arranged with management. 4. The guest hereby agrees, on his behalf and on behalf of all the members of his party, that it is a condition of his/their residence at the Guest House, that the Guest House shall not be responsible or liable for any injury to or death of any person (or any minor dependent of such person), or for the loss or destruction of or damage to any property or any damages of any kind whatsoever. 5. The Guest House does not accept any responsibility or liability for the safe custody or loss of or damage or destruction to any property stored or left in the room and or any other premises of the Guest House. 6. The guest and all the other persons occupying the room together with the guest, and all invitees of the guest hereby indemnify the Guest House against any claim, action, judgement, costs or expenses which may be made or instituted against the Guest House in respect of any loss of or damage to property or possessions, or the death of or personal injuries, including injuries to dignity or reputation, sustained by him arising from or connected to the guest making use of any facilities, services, accommodation or receiving treatment or taking part in any activities or whatsoever nature. 7. The guest acknowledges that any key, remote or tag which is lost or damaged by him shall be replaced at his cost and he agrees to pay the Guest House, prior to the obtaining of replacement, the cost of replacement of the key or remote or any locksmith charges that are incurred as a result of key/remote. 8. No changes, alterations or cancellation of any of the above conditions shall be binding on the Guest House unless agreed thereto by the Guest House in writing. These conditions and every contract in which they are incorporated, shall be governed by and construed in accordance with the Laws of the Republic of South Africa. 9. An expression which denotes any gender includes the other genders, a natural person includes an artificial person or juristic person, including the State and vice versa and the singular includes the plural and vice versa. The Guest House includes all its members, employees, representatives and contractors.
