Locked doors or cabinet/closets with zipties are off limits. Ample parking for a large group. As much as is necessary, generally a meeting prior to check in to deliver the key and or greeting when you arrive for a tour of the house. This Short Term Rental Agreement (the “Agreement”) is made by and between ____Mountain House Associates, LLC____________ (“Homeowner”) and ____ (“Guest”) as of the date last set forth on the vacation rental online platform. For good and valuable consideration, the sufficiency of which is acknowledged, the parties hereby agree as follows: 1. Property. The property is located at: ____the address stated on the vacation rental platform 2. Rental Party: The Rental Party shall consist of Guest and the following persons: See Attached Listing 3. Maximum Occupancy: A) The maximum number of guests who may sleep over is 22 persons. Additional fees will be charged against your deposit and additionally to you, if more than 14 guests sleep over. B) The maximum number of individuals (including minors) who may be on the property at any time is 35. Therefore the number of individuals you may invite to visit with you without staying over will depend on the number of people in your Rental Party. If more than 25 individuals wish to sleep over, you must direct the additional people to utilize another lodging arrangement elsewhere (motel, B&B, etc.) 4. Term of the Lease. The lease begins at _2____ p.m. on ____________ (the “Check-in Date”) and ends at ___2__ p.m. on _______________ (the “Checkout Date”) as set forth on the online vacation rental platform 6. Rental Rules: Guest agrees to abide by the Rental Rules attached as Exhibit A at all times while on the property and shall require all members of the Rental Party and anyone else that Guest permits on the property to abide by the following rules at all times while at the property. 7. Access: Guest shall allow Homeowner and its agents access to the property for purposes of repair and inspection. Homeowner shall exercise this right of access in a reasonable manner. The premises will be inspected after Guest’s departure for damage and any dirt or mess requiring excessive cleaning 8. Outdoor and Other Hazards: The outdoor portions of the property contain multiple hazards arising from rocks, boulders, ponds (natural and artificial), uneven terrain, and other potential causes too numerous to identify. The Guest and his/her family, friends, and guests assume all risks of injury (including fatal injury) no matter how caused while on the outdoor or indoor portions of the rented property whether or not said risks are identified above and agree that the Homeowner has no responsibility for any injuries or death arising from such hazards. The Guest agrees to apprise his/her family, friends and guests of this provision of the Short Term Rental Agreement and agrees to indemnify and defend the Homeowner and its agents against, and hold the Homeowner and its agents harmless from, any claims or lawsuits for injury (including fatal injury) brought by any member of the Guest’s family or by any friend or guest of the Guest. The Guest, having assumed all such risks agrees not to bring suit against Homeowner or its agents for any injury however caused while on any portion of the property 9. Rental Rate and Fees a. Deposit: The $1,000refundable deposit is for security for damage and shall be refunded within __7__ days of the Checkout Date provided no deductions are made due to: i. damage to the property or furnishings; ii. dirt or other mess requiring excessive cleaning; or iii. any other cost incurred by Homeowner due to Guest’s stay. Liability for damage is not limited by the amount of the security deposit. If the premises appear dirty or damaged upon Check-in, Guest shall inform Homeowner immediately by email. b. Rental Rate & Fees- As set forth and agreed upon in the online vacation rental platform 11. Payment: Will be made as agreed upon in the online vacation rental platform. 12. Rental Rules (including Security Rules: The Rental Rules below are incorporated in and are part of this agreement. Guest must comply with all of these rules including those pertaining to steps to take before departure. Homeowner Representative: Guest: Exhibit A RENTAL RULES 1. Smoking is allowed outside only. Any butts or other refuse deposited outdoors must be collected and disposed of prior to departure from the premises. 2. No more than 22 people may stay overnight in the property. 3. The premises are privately owned; the owners are not responsible for any accidents, injuries or illness that occur while on the premises or its facilities no matter how caused. The Homeowner is not responsible for the loss of personal belongings or valuables of the guest. By accepting this reservation, it is agreed that all guests and others whom they invite to use the premises are expressly assuming all risks of injury or harm occurring while they are on the premises. 4. Keep the property and all furnishings in good order. All furniture is to be left where it is do not move around. All windows and doors must be kept closed when it is raining or snowing, and must be closed and locked when away from the premises during the rental period. 5. Departure Rules: 1. At the end of your stay the thermostats must be set at 55°. If air conditioners have been used, their controls must be set at “Off” when you leave. 2. All refuse inside and outside the premises must be collected, placed in the black garbage bags provided in the garage, and brought to the Town Garbage Dump by Guest (or by someone assisting Guest). Garbage left anywhere on the premises is an attraction to vermin and wildlife. 3. All windows and doors must be closed and locked and the key returned per arrangements. Failure to follow any of these rules may result in damage (such as water damage) for which Guest will be held responsible. 6. Only use appliances for their intended uses 7. PETS are permitted only with prior approval and the Pet Addendum must be completed. 8. Parking: PARKING – Parking is limited to ___10____ vehicle(s). Vehicles are to be parked in designated parking areas only. Parking on the road is not permitted. Any illegally parked cars are subject to towing; applicable fines/towing fees are the sole responsibility of the vehicle owner. 9. Housekeeping: There is no daily housekeeping service, unless otherwise arranged. While linens and bath towels are included in the unit, daily maid service is not included in the rental rate. We do not permit towels or linens to be taken from the house. 10. Skis, Snowboards and Boots: There are to be no skis brought into the house; there is a ski/snowboard rack in the garage. ABSOLUTELY NO SKI BOOTS ANYWHERE EXCEPT BOOT ROOM ON LOWER LEVEL OF HOUSE. 11. Hot Tub: No children under the age of _5_ are permitted in hot tubs at any time. No children are to be permitted in hot tub without direct adult presence and supervision. When using the hot tub, remember there is a certain health risk associated with this facility. Use at your own risk. Our housekeepers sanitize, refill and replenish chemicals in all tubs prior to your arrival. DO NOT STAND ON THE HOT TUB COVER. Hot tub covers are for insulation purposes and are not designed to support a person or persons. They will break and you WILL be charged for replacement. Remember: when not using the hot tub, leave the cover on so the hot tub will stay warm. Should the cover be found off when inspected the security deposit will be charged. Be mindful of water spilling out of hot tub. If water spills please soak up with towel or mop. If excessive water spills from tub and leaks to the room below, your security deposit will be charged 12. A) Gas Fireplaces on Main and second Floors: These fireplaces are in a propane gas log fired firebox. The remote control should be on the mantle near the fireplace. Press the Mode button to turn on. They work well and will make the room rather warm, if left on. For your comfort and in order not to waste propane, please do not leave them on when not in room. B) Wood Burning Fireplace on lower level: Open flue prior to lighting fire and keep screen closed at all times when not tending to the fire. DO NOT LEAVE FIRE UNATTENDED. Close Flue after fire is out 13. Water and Septic: The property is on a well and septic systems. The water in the well(s) contains clay, for which there is a filtration system installed. Water should be clear; however, under heavy use it may have a slight red tint from the clay. Water is safe to drink; however, if the water is particularly clay-colored or the coloration does not subside please let us know so we can have it addressed. WATER USAGE: When multiple individuals are taking showers or otherwise using water, the water level in the water tanks on the ground floor may go down. Normally the wells will keep the tanks reasonably full. HOWEVER, if the water level falls below the red line on the water tanks, STOP all water usage until the wells replenish the water tanks up to half full. The septic system is very effective; however, it will clog up if improper material is flushed. DO NOT FLUSH anything other than toilet paper. No feminine products should be flushed at any time. If it is found that anything other than toilet paper has been flushed and clogged the septic system, you could be responsible for the costs incurred to remedy same. 14. Storms: No refunds will be given for storms. Mountain roads can be curvy and steep. Gravel drives are well maintained; however, we highly recommend four/all-wheel drive and/or chains during the snow months. We do not refund amounts paid due to road conditions. 15. Pond Rules: a. Use Pond at YOUR OWN RISK b. Bathers MUST Shower prior to entering Pond c. NO Diving into Pond d. NO Jumping into Pond e. ALL Children Must have Adult Supervision at all times f. NO Walking, Running, or Playing on Rocks g. NO Swimming or Use after Sunset h. NO Pets in Pond i. NO Walking in BioZone j. NO Swimming in Pond when raining or thunderstorms k. Enter/Exit Pond Only from Beach Area l. NO Glass in Pond Area m. NO Running or Rough Play in Pond Area n. DO NOT USE THE POND FOR ICE SKATING unless two conditions are both met: A) the ice is measured on the day in question and is over 4 inches thick, and B) the air temperature has remained below freezing after the ice thickness has been measured as over 4 inches. Winter Pond Rules: • USE POND AT YOUR OWN RISK. The owner assumes no liability for injury, fatal or otherwise, when using the pond. • The temperature must be 30 degrees Fahrenheit or lower and ice 4 inches thick. This must be verified to Renter by authorized agent of the owner before use. No children 12 years of age or younger are permitted to use pond without parental supervision. • Pond is only to be used for ICE SKATING and NOTHING ELSE. • No running, walking or sledding on the pond at any time. • No use of the pond after dusk. • Snow must be removed from the pond by authorized agent of the owner before legal use.
