This Agreement will remain effective for the duration of the rental period. This Agreement ensures both the enjoyment and safety of the property's amenities while protecting the interests of both the Renter and the Property Owners. 1. Equipment and Amenities Provided • Kayaks: One kayaks and two (2) paddles and lake mat are provided at no additional cost. Renter is responsible for their proper use and return in the same condition as received. Renter(s) and all guest take full responsibility to monitor all guests near the water or on the dock without a life jacket on. 2. Usage and Safety Requirements Paddleboarding and Lake Mat: • Life vests must be worn by all individuals on the kayak and lake mat. • Renter shall at all times have a life vest for each person on the kayak and lake mat. If life vests are not available at the property, it is the responsibility of the Renter to provide their own. • Renter is responsible for placing the kayaks, lake mat and paddles on the patio after use and returning all life vests to the Life Vest Storage box in the gazebo. 3. Responsibilities and Liabilities Equipment Damages: Renter is solely responsible for any damages or losses to the kayak, lake mat and paddles resulting from misuse, negligence, or violation of any of the rules and regulations set forth in this Agreement. The Renter agrees to reimburse the Property Owner for the full cost of repair or replacement of the kayaks and paddles, including any associated labor costs, resulting directly from such damages. Payment for these damages shall be made by the Renter to the Property Owner within seven (7) days of the Renter's receipt of a written estimate or invoice for such repairs or replacement. 4. Acknowledgment of Risks and Indemnity Renter acknowledges the inherent risks involved in renting this property, kayaks, and lake mat including physical injury or property damage, and agrees to release, indemnify, and hold harmless the Property Owners against all related claims, damages, or injuries arising from the use of the entire property and equipment under this Rental, kayak and lake mat Usage Agreement. Renter agrees to follow all safety guidelines and to use the equipment in a safe and responsible manner. 5. Compliance and Governing Law Renter agrees to comply with all applicable laws and regulations. This Agreement is governed by the laws of the State of Alabama. 6. Termination and Entire Agreement Violation of any terms may result in termination of the rental agreement. This document constitutes the entire agreement between the Parties. 7. Governing Law: This Rental Agreement and kayak and lake mat Usage Agreement shall be governed by and construed in accordance with the laws of the state of Alabama. 8. Entire Agreement: This Rental Agreement and the kayak and lake mat Usage Agreement constitutes the entire agreement between the Parties and supersedes all prior agreements, whether written or oral. 9. Acknowledgement of Understanding By renting the property, Renter confirms they have read, understood, and agreed to all terms and conditions set forth in this Kayak and Lake Mat Usage Agreement.
