Please review prior to booking. 1) Parties: This lease agreement for the rental of residential property is between Housing Helpers of Las Vegas, LLC ("Lessor") and NAME (“Lessee(s)”): 2) Leased Premises: Lessor hereby leases to Lessee(s) the fully furnished premises known as: ADDRESS 3) Term: The initial lease term shall be from 4:00 pm on DATE to 10:00 am DATE. Please initial option A A :_________ Fixed Term : Lessee(s) agrees to vacate the premises at the end of the initial lease term. 4) Rent Monthly rental amount is $PRICE. Rent payments are due on or before the DATE of each month and shall be made payable to: Housing Helpers, 999 E. Tropicana Ave., Las Vegas, NV 89119. Lessee(s) shall incur and be charged a late fee equal to five percent (5%) of the monthly rental amount for rent not received by the close of business on the DATE day of the month. Such a fee will be considered additional rent. Rent not received by the close of business on the due date may be charged to the credit card provided by the Lessee(s). There is a charge of $35.00 for any Lessee(s) check returned to Lessor because of insufficient funds. Partial months will be prorated at the nightly rate of one thirtieth (1/30) of monthly rental amount. Additional charges may include extra cleaning, carpet cleaning, upholstery cleaning, and trash removal, if necessary. 6) Damages It is the duty of the Lessee(s) to return the leased premises, including furniture, fixtures, appliances, electronics , housewares, and outside areas to the condition at the commencement of this lease agreement, except for ordinary wear and tear. If actual cause exists to bill lessee for damages, Lessor shall provide Lessee(s) with a statement listing the reasons. 7) Pets No pet shall be allowed, even temporarily anywhere in the leased premises, without the consent of Lessor to be given hereunder. A fee of $300.00 per pet will be charged, should Lessor give such consent. This fee does not cover the cost of deodorizing, defleaing and shampooing, cleaning up animal feces, or any other damage caused by pet(s). Lessee(s) shall also be held fully liable for any and all damages or injury caused by such pet(s). Should Lessee(s) allow a pet to reside at the premises without the consent of Lessor, such action shall constitute a material breach of this Lease Agreement and constitute grounds for immediate eviction. Lessee(s) agrees to pay Lessor a $750.00 fee, due upon demand for each such unauthorized pet. Lessee(s) shall also be held fully liable for any and all damages or injury caused by such unauthorized pet(s). This includes internet use limited to 1024 GB of data per month. If limit is exceeded, Lessee agrees to pay Lessor the actual charges for the amount over 1024 GB of data, due to Lessor immediately. Lessor agrees to provide Lessee documentation of any internet use overage charges upon request. Combined monthly gas and electric service charges shall be limited to $AMOUNT per month. If limit is exceeded, Lessor will bill the Lessee at time of utility bill and or within 30 days after expiration of lease, and Lessee agrees to pay such charges upon receipt. The garage is considered a non-smoking area. Smoking or vaping in the property will incur damages to the property and will require remediation upon your move out, remediation of smoke damage may include but not limited to, repainting of the walls, ceiling, baseboards and all carpeted areas, any burns present upon move out that were not brought to the attention of the m shall be considered a direct result of your tenancy. Lessee(s) shall be responsible for remediating all burns which may include replacing furniture, resurfacing, touch up paint and carpet. Lessee(s) agrees to pay a MINIMUM charge of $750.00 to Lessor, if in the sole discretion of Lessor, Lessee(s) has smoked inside the Leased Premises. All smoking may only be done outside of Leased Premises. This includes but is not limited to, all smoking materials including marijuana and all medicinal and prescribed materials. If premises is located in a common interest community, Lessee(s) agrees to abide by all the governing documents, including declarations, Bylaws, Articles, Rules and Regulations. Copies of which will be given upon request of Lessee(s). 11) Occupancy No more than two unrelated people per bedroom at any time. Lessee(s) shall not allow guests to stay upon the premises for more than 7 days per month without the written consent of the Lessor. 12) Parking and Access The premises includes the following: PARKING: Mailbox #: WiFi: Password: 13) Notice Unless otherwise specified in this lease all notices shall be in writing and shall be delivered to the other party personally, or sent (electronic mail or US first class Mail) or securely and conspicuously posted, as follows: To Lessee(s): at the Leased Premises or at Lessee(s)'s last known address. To Lessor: Housing Helpers, 999 E. Tropicana Ave., Las Vegas, NV 89119, or electronically. Notice to one Lessee shall be deemed to be notice to all Lessees. 14) Keys Lessee(s) shall be responsible for any keys issued for the leased premises. The minimum charge for lost or unreturned keys, gate remotes and/or garage remotes is $75.00. If the property is re-keyed due to a lost or unreturned lessee will be responsible for cost of re-key and service fee. If there is a lock-out during stay, a $100.00 lock-out fee will be the responsibility for Lessee. Upon vacating, Lessee(s) agrees to leave keys and remotes inside on the kitchen counter of the Leased Premises, or returned to Housing Helpers office located at 999 E. Tropicana Ave., Las Vegas, NV. 15) Privacy Lessee(s) shall permit Lessor to enter the premises at reasonable times and upon reasonable notice for the purpose of making necessary convenient repairs or reasonable inspections, or to show the premises to prospective residents, purchasers, or lenders. Entry may be made without prior notice if Lessor reasonably believes that an emergency exists, such as a fire or broken water pipe, or that the premises have been abandoned. 16) Holdover Lessee(s) agrees at the expiration of this lease to peacefully surrender and deliver the leased premises to the Lessor. In the event the Lessee(s) holds over beyond the expiration date of this lease without the written consent of the Lessor the lease shall not be deemed renewed. Lessee(s) shall be regarded as a Tenant at sufferance, and Lessee(s) shall be liable for a holdover fee of $500.00 in addition to rent until possession is returned to Lessor. 17) Assignment Lessee(s) shall not assign this lease, or sublease any portion of the premises for any part or all of the term of this lease without prior written consent of Lessor. 18) Noise/Nuisance Lessee(s) agrees not to make any excessive noise or to create a nuisance such as will disturb the peace and quiet of neighbors. Lessee(s) acknowledges and agrees that sound transmission in condominiums and residential property are very difficult to control and noise from adjoining residences and mechanical equipment can often be heard from adjoining residences. Lessee waives and expressly releases any such warranty and claims for loss or damages resulting from sound transmission. Residences are often located near multi-lane freeways and high traffic streets subject to high levels of noise, construction, maintenance, repair, dust, and other nuisance from such roadways and railways; and Lessee hereby releases all parties from claims arising from or relating to roadways and railways and/or noise, dust, and other nuisances related thereto. 19) Repairs/Maintenance If repairs are required, Lessor shall be responsible for making such repairs. Lessee(s) shall not make repairs without prior written consent of Lessor. Lessee(s) shall pay reasonable charges for the repair of damage to the premises or common areas caused by the negligence or willful acts of Lessee(s) or their guests. Such charges shall be due and payable upon demand by Lessor. Excessive damage to the premises by Lessee(s) shall be grounds for eviction. If any fire protection device, including without limitation, a smoke detector or fire extinguisher, is located within the premises, then upon taking occupancy the Lessee(s) assume responsibility for the maintenance of any such device. Lessee(s) understands that various pest, rodent, and insect species (collectively, "pests") exist in Southern Nevada. Pests may include, but are not limited to, scorpions, spiders, bees, snakes, ants, termites, rats, bed bugs, mice, and pigeons. If Lessee(s) fails to report any pest infestation and/or problems with the Premises within seven (7) calendar days of lease start date, it shall be an acknowledgement by Lessee(s) that the Premises are acceptable, in good condition, and pest free. In the event there are pests on property after seven (7) calendar days from lease start date, it is the full responsibility of the Lessee to successfully mitigate, pay for any and all costs, and be responsible for damage to furniture and premises caused by pests. Mitigation process and pest extermination must be done by a licensed person or pest control company. Lessee(s) acknowledges that Lessor does not guarantee a pest free environment. Lessee(s) agrees to cooperate fully with and to undertake all efforts and tasks required by Lessor’s pest control company employed to eradicate pests. Lessee(s)’s full cooperation includes but is not limited to immediately reporting pest infestation to the Lessor, making the premises available for entry to complete pest inspection and eradication treatment(s), completing all required pre-treatment activities, evacuating the premises during and after the treatment for the required time frame, completing all required post-treatment activities, and immediately reporting ineffective treatment or re-infestation to the Lessor in writing. If Lessor fails to cooperate fully with the treatment plan and the unit is either re-infected or the initial treatment is ineffective, Lessee(s) agrees to pay all costs of all subsequent treatments, as well as the treatments for the spread of the infestation to additional units. Lessee(s) agrees not to acquire or bring into the Premises any used or secondhand furniture. 20) Alterations to Premises Lessee(s) agrees that before making alterations to the premises including, for example, painting, adding or changing door locks, or installing plant hangers or toggle bolts, advance written consent of Lessor will be obtained. The furniture in the home is not to be moved. Lessee(s) understands and agrees to pay Lessor for replacements of any housewares, linens, and electronics that are unreasonably damaged or missing. 21) Insurance Lessor's insurance does not cover Lessee(s)’s personal possessions in the event of loss or damage due to fire, flood, theft, vandalism or other similar cause. Lessee(s) is hereby notified that all personal belongings of Lessee(s) are not the responsibility of either the Owner of the leased premises nor of Housing Helpers of Las Vegas, LLC. Lessor recommends that Lessee(s) secure property and liability insurance to protect against losses occasioned during the term hereof. 22) Eviction/Abandonment A. Lessor may evict Lessee(s) from the premises or undertake other legal action to regain possession for non-payment of rent, utilities, or other charges, abandonment, violation of the occupancy, use, assignment/subletting, noise and nuisance, pet provisions or other breach of this lease. B. Lessee(s) shall continue to be liable for rent and be bound by the other provisions of this lease, even though Lessor has chosen to seek eviction because of breach of the lease agreement. C. If Lessee(s) is continuously absent from the premises, without prior explanation to Lessor of the reason for the absence, for 5 or more continuous days while all or any portion of the rent is unpaid, Lessor shall have the right to deem the premises abandoned. In the case of any abandonment, Lessor may enter the premises and may remove Lessee(s) belongings so long as there is no breach of peace. D. If the premises are abandoned or if the Lessee(s) is evicted, Lessee(s) will remain liable for any loss of rent for the remainder of the lease term. Lessor may re-let the premises under these circumstances for such rent and upon such terms, as Lessor deems reasonable and advantageous without affecting Lessee(s) liability under this Paragraph. E. If Lessor obtains possession of any of Lessee(s) belongings; Lessor shall make a reasonable effort to notify Lessee(s) of such fact. If Lessee(s) fails to assert ownership interest in the belongings for a period of one month, Lessor may deem the belongings to be abandoned and may dispose of the belongings in any manner Lessor deems suitable. F. Lessee(s) shall be charged an administrative fee of $100.00 per eviction attempt to offset the costs of eviction notices and proceedings. Lessee shall be charged for service of legal notices and all related feeds according to actual costs incurred. 23) Waiver Any waiver, by either party, of any breach of any provision of this lease shall not be considered to be a continuing waiver or a waiver of a subsequent breach of the same or a different provision of this lease. Nothing contained in this Agreement shall be construed as waiving any of the Lessor or Lessee(s) rights under the laws of the State of Nevada. 24) Severability The unenforceability of any provision of this lease agreement shall not affect the enforceability of any other provision or provisions. 25) Joint and Several Liability If this lease is signed on behalf of Lessee(s) by more than one person, the liability of the persons so signing shall be joint and several. 26) Injuries/Damage Lessor shall not be liable for any injuries or damage to persons or property due to any of the following: (a) entrustment of any property to Lessor's employees or agents; (b) loss of property due to theft; (c) steam, gas, electricity, falling plaster, breakage of water from pipes, rain, snow, malfunction of appliances, leakage or dampness of any nature beyond the control of Lessor; (d) the actions or omissions of other Lessee(s)s; (e) interference with light, view or similar intangible benefits; (f) operations in construction of any public or quasi-public work; (g) any latent defect in the building(s); (h) the use by Lessee(s) or guests of any storeroom, laundry room, clubhouse, swimming pool or any other ancillary facility furnished by Lessor for Lessee(s)'s use; (i) Lessee(s) shall give Lessor immediate notice of fire, accidents or defects in any fixture or equipment. Lessee(s) agrees to indemnify, save and hold harmless Lessor, their agents and assigns from any and all liability for damage or injury to any person or property in or about leased premises, no matter how occasioned, or for injury to any person or property resulting from breakage, leakage, or obstruction of water or gas pipes, radiators, sprinkler pipes or tanks, or from electrical or other apparatus installed or to be installed in the premises. Lessee(s) further agrees to indemnify, save and hold harmless Lessor from any and all liability resulting from any and all actions of Lessee(s), his family, servants, agents or guests. 28) Attorney’s Fees In the event of any legal action concerning this lease, which results in a judgment, the losing party shall pay to the prevailing party reasonable attorney's fees and court costs to be fixed by the court. An 18% per annum finance charge on rent or other monies owed by Lessee(s) or Lessor can also be collected in this judgment. 29) Corporate Agent Liable Any person signing on behalf of a corporation certifies that he or she is authorized by said company to sign Lease Agreements. In the event that the corporation denies such authorization, the person executing this Lease shall be considered to be the Lessee(s) hereunder. 30) Binding Effect Lessor may adopt rules and regulations in accordance with the laws of the State of Nevada upon thirty (30) days written notice to the Lessee(s). 31) Signatures/Amendment of Lease This lease agreement contains the entire agreement of the parties and may not be altered or amended except by mutual written agreement signed by both parties.
