Other things to note HOUSE RENTAL AGREEMENT House Rules, Safety Requirements & Release of Liability PART 1 — HOUSE RULES & SAFETY * No Parties or Events: This property is strictly a peaceful retreat designed for relaxation, rejuvenation, and enjoying nature. * Safety & Child Supervision: Guests must keep a close and constant eye on children at all times. Children must be supervised by an adult at all times without exception. IMPORTANT — LIMITATION ON CHILD CLAIMS: Under Texas law, a parent or guardian cannot waive or release legal claims on behalf of a minor child. Nothing in this Agreement releases or limits any claim belonging to a minor child. Guest acknowledges this limitation and agrees it does not affect the enforceability of the remainder of this Agreement. PART 2 — RELEASE OF LIABILITY, ASSUMPTION OF RISK & INDEMNITY AGREEMENT BY COMPLETING THIS AIRBNB RESERVATION AND/OR SIGNING BELOW, YOU (THE "GUEST") AGREE THAT YOU HAVE READ, UNDERSTOOD, AND FULLY ACCEPT THE FOLLOWING TERMS. PLEASE READ THIS AGREEMENT CAREFULLY BEFORE ACCEPTING THE RESERVATION. THIS AGREEMENT AFFECTS YOUR LEGAL RIGHTS. ⚠ IMPORTANT NOTICE TO GUEST: THIS AGREEMENT CONTAINS A RELEASE OF LIABILITY, ASSUMPTION OF RISK, AND INDEMNIFICATION PROVISIONS THAT MAY AFFECT YOUR RIGHT TO RECOVER DAMAGES IF YOU OR A MEMBER OF YOUR PARTY IS INJURED OR SUFFERS PROPERTY LOSS WHILE ON THE PREMISES. 1. PROPERTY CONDITION Guest acknowledges they are renting the property "as is." Guest agrees to inspect the property upon arrival and promptly report any defects or unsafe conditions to the Host within two (2) hours of check-in. Absent timely written notice to the Host, the property will be deemed to be in good, safe, and clean condition at the time of Guest's arrival. 2. ASSUMPTION OF RISK Guest acknowledges that staying at property and participating in outdoor and water activities — including but not limited to and use of the fire pit — involves inherent risks of property damage, severe bodily injury, or death. GUEST VOLUNTARILY AND KNOWINGLY ASSUMES ALL RISKS ASSOCIATED WITH THE USE OF THE PROPERTY, FIRE PITnOR OTHER EQUIPMENT PROVIDED. 3. RELEASE OF LIABILITY — TEXAS EXPRESS NEGLIGENCE DOCTRINE COMPLIANT TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, GUEST EXPRESSLY RELEASES, WAIVES, AND FOREVER DISCHARGES THE PROPERTY OWNERS AND HOST (COLLECTIVELY, "RELEASED PARTIES") FROM ANY AND ALL LIABILITY, CLAIMS, DEMANDS, OR CAUSES OF ACTION FOR PERSONAL INJURY, BODILY INJURY, DEATH, OR PROPERTY DAMAGE ARISING OUT OF OR RELATED TO THE OCCUPANCY OR USE OF THE PROPERTY, FIRE PIT THIS RELEASE SPECIFICALLY AND EXPRESSLY INCLUDES CLAIMS CAUSED BY OR ARISING FROM THE SOLE, JOINT, OR CONCURRENT ORDINARY NEGLIGENCE OR FAULT OF THE RELEASED PARTIES. LIMITATION — GROSS NEGLIGENCE & INTENTIONAL ACTS: This Release does NOT purport to release any claim arising from gross negligence (as defined under Texas Civil Practice & Remedies Code § 41.001) or intentional misconduct on the part of the Released Parties. Any such provision, if included or construed to be included, shall be severed from this Agreement and shall not affect the enforceability of the remaining provisions. LIMITATION — MINOR CHILDREN: This Release does not and cannot release or waive any claims belonging to minor children, as such waivers are unenforceable under Texas law. The enforceability of this Release as to adult Guests is not affected by this limitation. 4. INDEMNIFICATION Guest agrees to INDEMNIFY, DEFEND, AND HOLD HARMLESS the Released Parties from and against any and all claims, lawsuits, damages, or liabilities (including reasonable attorney's fees) brought by Guest or any adult member of Guest's party arising out of Guest's rental period, to the extent such claims arise from the ordinary negligence or intentional acts of Guest or Guest's adult invitees. This indemnification obligation does not require Guest to indemnify the Released Parties for their own gross negligence or intentional misconduct. 5. PROPERTY DAMAGE & LOSS Guest accepts full financial responsibility for all persons and pets on the property during the rental period. Guest is fully liable for any damage, theft, or loss to the property or its contents during the rental period, excluding acts of God or pre-existing damage reported at check-in per Section 1. Host is not responsible for the loss, theft, or damage of Guest's personal property during the rental period. 6. SEVERABILITY If any provision, section, or clause of this Agreement is found by a court of competent jurisdiction to be invalid, void, or unenforceable for any reason, the remaining provisions shall continue in full force and effect as if such invalid provision had never been included. The invalidity of one provision shall not invalidate the Agreement as a whole. 7. GOVERNING LAW & ENTIRE AGREEMENT This Agreement shall be governed by and construed in accordance with the laws of the State of Texas. This Agreement constitutes the entire agreement between the parties regarding liability and supersedes any prior representations. Completion of the Airbnb reservation and/or signature below constitutes Guest's acknowledgment of and agreement to all terms herein.
