You also have access to 2 semi private neighborhood beaches, and the waterfront behind the home, and 3 kayaks. Other things to note Please note that by booking you agree to our hold harmless agreement. please also note this is a 3 bedroom unit, the 4th bed is a pullout couch located in the downstairs livingroom (game room) minimum age 21 for primary renter. HOLD HARMLESS AGREEMENT This Hold Harmless Agreement (the “Agreement”) is entered into by and between [Host Name] ("Host") and the undersigned guest ("Guest"), in connection with the booking of the Airbnb property located at [Property Address] ("Property"). 1. Assumption of Risk: Guest acknowledges that the Property is a waterfront location, with direct access to water, rocks, and other natural features, and that engaging in activities near or in the water, including but not limited to swimming, boating, kayaking, and using water toys or other recreational equipment, involves inherent risks of injury or death. Guest acknowledges that the rocks and water features present potential hazards. 2. Hot Tub and Water Toys: Guest acknowledges the risks associated with the use of the hot tub and water toys (such as kayaks, paddleboards, inflatable devices, etc.) provided at the Property. These risks include, but are not limited to, injury from improper use, slipping, falling, or overheating, and Guest agrees to take all necessary precautions in the use of these amenities. 3. Hold Harmless Agreement: By booking this property all parties are in agreement, Guest agrees to hold harmless, indemnify, and defend the Host, their agents, employees, and affiliates from and against any and all claims, demands, liabilities, injuries, damages, costs, or expenses, including attorney’s fees, arising out of or related to the use of the Property, the hot tub, water toys, or access to the waterfront, regardless of whether the damage or injury is caused by the negligence or fault of the Host. 4. Medical Emergency: Guest understands that the Host is not responsible for providing medical care and agrees to take appropriate steps to secure medical assistance in the event of an emergency. Guest acknowledges that they are in good physical condition to engage in the activities available at the Property. 5. Acknowledgment of Understanding: By booking, the Guest acknowledges that they have read and understood this Agreement, fully accepts the risks involved, and agrees to release and hold the Host harmless as described above. 6. Governing Law: This Agreement shall be governed by and construed in accordance with the laws of the state of Rhode Island, without regard to its conflict of law principles.
