Other things to note By booking Guest(s) agree to read, understand, accept and adhere to the Liability Waiver below: Liability Wavier In consideration for being permitted to enter the rental property located in River Trails, Thomas WV for vacation rental or any other purpose, each guest, for themselves, their personal representatives, guests, children, heirs, and next of kin, acknowledge, agree, and represent that guest has or will immediately upon entering the property, and will continuously thereafter, thoroughly inspect the property and the guest’s continued presence on and in the property constitutes an acknowledgement that guest has inspected the residence and entire property and guest finds and accepts such property as being safe and reasonably suited for the purposes of guest use and guest further agrees and warrants that if, at any time, guest feels that anything is unsafe or not reasonably suited for use, guest will immediately leave the area and advise the property owner and/or the property management company. Each guest herby agrees to Release, Indemnify, Defend and save harmless the property owner and the property management company, their members, partners (general and limited), shareholders, officers, directors, agents, employees, successors, and affiliates and assigns (collectively, the (“Releasees”), from all liability to the guest(s), its (their) family members, agents, representatives, assigns, invitees, or any other individuals staying at, visiting, or using the rental property (collectively, the “Releasors”) for any and all loss or damage, and any claim or demand thereof on account of INJURY to the guests or Releasors or their property or resulting in DEATH of the guests or other Releasors, whether caused by negligence of the Releasees or otherwise while in or upon the property or in the event of any use of the North Fork of the Blackwater River while renting the property. UPON BOOKING EACH GUEST hereby ASSUMES FULL RESPONSIBILITY FOR RISK OF BODILY INJURY, DEATH OR PROPERTY DAMAGE to themselves or any other Releasors while in or upon the property or in the event of any use of the North Fork of the Blackwater River while renting the property, regardless of whether such injury, death or property damage was due to the action, inaction or negligence of the Releasees or otherwise. EACH GUEST hereby certifies that they and invitees have adequate insurance to cover any injury, illness or damage that may be caused or suffered while in or upon area, or else agrees to bear the costs of such damage or injury. Each of the guests further states that they have no medical conditions which would interfere with the guests’ use of the rental property, including climbing stairs, and each of the guests assumes and bears the costs of all risks that may be created, directly or indirectly by any medical condition. Each guest further expressly agrees that the foregoing release, waiver and indemnity agreement is intended to be as broad and inclusive as is permitted by law and that if any provision is held invalid, it is agreed that the balance of this release, waiver and indemnity agreement shall, notwithstanding said invalid provision, continue in full legal force and effect. BY BOOKING THE RENTAL PROPERTY EACH GUEST CERTIFIES THAT HE OR SHE HAS READ, UNDERSTANDS AND ASSUMES THE RISKS ASSOCIATED WITH RENTING THE RENTAL PROPERTY, AND VOLUNTARILY AGREES TO THIS RELEASE, WAIVER OF LIABILITY AND INDEMNITY AGREEMENT, and further agrees that no oral representations, statements, or other inducements have been made by the property owner or property management company, apart from the foregoing written agreement.
