EAGLE LAKE LIABILITY WAIVER AND RELEASE OF CLAIMS READ CAREFULLY BEFORE SIGNING - THIS IS A LEGAL DOCUMENT ACKNOWLEDGMENT OF RISKS I understand and acknowledge that participation in the following activities at this property involves inherent risks and dangers: -Water-related activities (including use of lake, swimming, and bathtubs) -Fire pit use (including fire-related activities and equipment) -Kayak use (including water sports and watercraft activities) I acknowledge that these activities carry serious risks including, but not limited to: -Drowning or near-drowning -Burns, fire-related injuries, or carbon monoxide exposure -Capsizing, collision, or watercraft-related accidents -Serious bodily injury, permanent disability, or death -Property damage SPECIAL RISK ACKNOWLEDGMENTS I specifically understand that risks are heightened for: -Children who are not properly supervised at all times -Individuals with pre-existing medical conditions, health issues, or physical limitations -Pregnant individuals -Persons under the influence of alcohol, drugs, or medication that may impair judgment or physical ability -Individuals who cannot swim or have limited swimming ability ASSUMPTION OF RISK AND RELEASE I voluntarily assume all risks associated with these activities, whether known or unknown, foreseen or unforeseen, on behalf of myself and all members of my party. I hereby release, waive, and discharge the property owner, host, and their agents, employees, successors, and assigns from any and all liability, claims, demands, actions, or causes of action arising from: -My use of the facilities or participation in these activities -The use of facilities or participation in these activities by any member of my party -Any actions or conduct by myself or members of my party INDEMNIFICATION I agree to indemnify and hold harmless the property owner and host from any claims, damages, or expenses (including attorney fees) arising from: -My actions or conduct -The actions or conduct of any member of my party -Any third-party claims related to my party's use of the property BINDING AGREEMENT I understand this waiver is binding upon my heirs, executors, administrators, and assigns, as well as all members of my party. I acknowledge that I am at least 18 years of age, am signing this voluntarily, and have read and understood this document. I represent that I have authority to sign this waiver on behalf of all members of my party and assume full responsibility for their participation. For minors in my party, I represent that I have legal authority to sign on their behalf. If I do not have legal authority to sign this waiver on behalf of all members of my party, I will inform the hosts so that they may provide a waiver to those members for which I do not have authority.
