WATERFRONT PROPERTIES PRESENT INHERENT RISKS THAT MAY RESULT IN SERIOUS INJURY, DROWNING, ILLNESS, DEATH, OR PROPERTY DAMAGE. BY BOOKING, ENTERING, OCCUPYING, OR USING THIS PROPERTY, EACH GUEST ACKNOWLEDGES THAT THEY HAVE READ, UNDERSTOOD, AND AGREED TO THE TERMS OF THIS WATERFRONT AND DOCK SAFETY NOTICE, ASSUMPTION OF RISK, LIABILITY WAIVER, AND GUEST ACKNOWLEDGMENT. WATERFRONT PROPERTY DISCLOSURES Guests acknowledge and understand the following: • This property is adjacent to open water (Brady Lake). • A private dock is located on the property and is accessible to guests. • There are NO door alarms installed on the property. • There are NO window alarms installed on the property. • There is NO locked gate, fence, or barrier separating the residence from the waterfront. • No lifeguard is on duty at any time. • The property owner does not supervise activities occurring in or around the water, shoreline, or dock. • Guests are solely responsible for supervising and protecting all members of their party. CHILD SAFETY REQUIREMENTS Young children, non-swimmers, and inexperienced swimmers require constant supervision. Guests agree: • Never to allow children near the lake or dock without direct adult supervision. • To keep young children and weak swimmers within arm's reach when near or in the water. • To conduct a safety walkthrough upon arrival and identify all water access points. • To establish and enforce family rules regarding waterfront and dock access. • To secure doors, windows, and other access points as needed to prevent unsupervised access by children. Parents and guardians accept full responsibility for supervising minors and preventing unauthorized access to the waterfront and dock areas. WATER WATCHER RECOMMENDATION Whenever children are in, on, or near the water, guests are strongly encouraged to designate a responsible adult as a "Water Watcher." The Water Watcher should: • Maintain continuous visual supervision. • Avoid distractions, including phones, books, and electronic devices. • Not consume alcohol or use impairing substances while supervising. • Transfer responsibility directly to another adult if supervision duties change. OPEN WATER AND WATERFRONT RISKS Guests understand and voluntarily assume all risks associated with the waterfront, including but not limited to: • Drowning • Slips, trips, and falls • Sudden depth changes • Uneven, slippery, muddy, rocky, or unstable lake bottoms • Submerged objects, debris, rocks, vegetation, docks, and watercraft • Reduced underwater visibility • Aquatic vegetation • Wildlife encounters • Cold-water exposure • Weather-related hazards • Lightning, storms, wind, waves, and changing water conditions • Injuries occurring while entering or exiting the water These hazards may exist at any time and may not be visible or foreseeable. DOCK USE AT YOUR OWN RISK The dock and waterfront structures are provided solely as a convenience for guests. Use of the dock, shoreline, waterfront access areas, and any associated structures is entirely voluntary and at the guest's own risk. Guests acknowledge and agree that: • Dock surfaces may be wet, slippery, uneven, weathered, unstable, or affected by changing environmental conditions. • Water levels, weather conditions, and lake conditions may change without warning. • The property owner does not guarantee the condition, safety, or suitability of the dock for any particular activity. • Guests are responsible for determining whether conditions are safe before using the dock. • Children must be supervised at all times while on or near the dock. • Running, horseplay, roughhousing, and unsafe conduct on the dock are prohibited. • Diving from the dock is prohibited. • Guests use the dock entirely at their own risk. DOCK CONDITION AND REPORTING OF HAZARDS The dock and waterfront structures are exposed to weather, water, seasonal conditions, normal wear and tear, and other environmental factors. While reasonable efforts may be made to maintain these areas, they are not continuously monitored or inspected before every guest use. Guests are responsible for visually assessing the condition of the dock and waterfront areas before use. If a guest observes a potentially unsafe condition, including but not limited to loose boards, protruding nails, structural damage, storm damage, unstable surfaces, excessive slipperiness, or any other hazardous condition, the guest shall immediately discontinue use of the affected area and notify the host as soon as possible. Guests acknowledge that continued use of the dock or waterfront area after becoming aware of a potentially hazardous condition is undertaken voluntarily and at their own risk. LIFE JACKETS • Non-swimmers and inexperienced swimmers should wear a properly fitted U.S. Coast Guard-approved life jacket whenever near, on, or in the water. • Any life jackets provided should be inspected by guests before use. • Inflatable toys, floaties, water wings, and similar devices are not life-saving equipment and do not prevent drowning. ALCOHOL AND IMPAIRMENT Guests are strongly advised not to consume alcohol, cannabis, medications, or other substances that impair judgment while supervising children, swimming, boating, using the dock, or participating in waterfront activities. GENERAL SAFETY RULES • Never swim alone. • Assess weather and water conditions before entering the lake. • Exit the water immediately during storms, lightning, high winds, or unsafe conditions. • Remove and store water toys when not in use. • Discuss water safety expectations with all members of your group upon arrival. EMERGENCY INFORMATION IN CASE OF EMERGENCY, CALL 911 IMMEDIATELY. If a child is missing: Check the lake immediately. Check the dock, shoreline, and waterfront areas first. Call 911 without delay. ASSUMPTION OF RISK By booking, entering, occupying, or remaining on the property, each guest voluntarily accepts and assumes all risks associated with the use of the property, waterfront, dock, shoreline, swimming areas, lake access, watercraft, and surrounding outdoor areas. Guests understand that waterfront and dock-related activities involve known and unknown risks that cannot be eliminated and may result in serious injury, death, or property damage. Guests acknowledge that participation in any waterfront, swimming, boating, fishing, dock, or water-related activity is entirely voluntary and undertaken at their own risk. TEXAS LIABILITY RELEASE AND HOLD HARMLESS AGREEMENT TO THE FULLEST EXTENT PERMITTED BY TEXAS LAW, GUESTS VOLUNTARILY ASSUME ALL RISKS OF INJURY, ILLNESS, DEATH, PROPERTY DAMAGE, OR OTHER LOSS ARISING FROM OR RELATED TO THE USE OF THE PROPERTY, INCLUDING THE WATERFRONT, LAKE, DOCK, SHORELINE, SWIMMING AREAS, WATERCRAFT, AND SURROUNDING OUTDOOR AREAS. BY BOOKING, ENTERING, OR OCCUPYING THE PROPERTY, GUESTS AGREE TO RELEASE, WAIVE, DISCHARGE, DEFEND, INDEMNIFY, AND HOLD HARMLESS THE PROPERTY OWNER, PROPERTY MANAGER, HOSTS, EMPLOYEES, CONTRACTORS, REPRESENTATIVES, AND AFFILIATES FROM ANY CLAIMS, DEMANDS, CAUSES OF ACTION, DAMAGES, LOSSES, COSTS, EXPENSES, OR LIABILITIES ARISING FROM OR RELATED TO THE USE OF THE PROPERTY OR PARTICIPATION IN WATERFRONT ACTIVITIES. TO THE EXTENT PERMITTED BY TEXAS LAW, THIS RELEASE INCLUDES CLAIMS ALLEGING THE ORDINARY NEGLIGENCE OF THE RELEASED PARTIES. THIS RELEASE DOES NOT APPLY TO GROSS NEGLIGENCE, RECKLESS CONDUCT, FRAUD, OR INTENTIONAL MISCONDUCT TO THE EXTENT SUCH RELEASES ARE PROHIBITED BY APPLICABLE LAW. GUEST RESPONSIBILITY Guests are responsible for the conduct, supervision, and safety of all members of their party, including children, visitors, invitees, and guests. Guests acknowledge that they have been informed of the absence of waterfront barriers, gates, door alarms, and window alarms and accept responsibility for supervising all members of their party accordingly. ACKNOWLEDGMENT BY BOOKING AND STAYING AT THIS PROPERTY, GUESTS ACKNOWLEDGE THAT THEY HAVE READ, UNDERSTOOD, AND ACCEPTED THIS WATERFRONT AND DOCK SAFETY NOTICE, ASSUMPTION OF RISK, LIABILITY WAIVER, AND GUEST ACKNOWLEDGMENT AND AGREE TO COMPLY WITH ALL SAFETY REQUIREMENTS DURING THEIR STAY.
