While we live on the property, we stay out of the way during your stay, giving you full control over the hot tub (available all year), fire pit, and pool (open from Mid May to Mid September), pond, gardens, and indoor spaces. During your stay The owners live in the property, so we are available 24/7. The owners do not use the hot tub, swimming pool, decks, screen room, living room, dining room during your stay. We are very flexible concerning the shared spaces and give all guests priority in using the shared spaces privately. Other things to note This listing is for a one-bedroom stay. This is a home share. Safety Reminder: The area has limited street lighting. Please watch for deer when you drive at night. Our beautiful year-round hot tub is enclosed with a luxurious Covana automated cover that lifts with ease to create a private, spa-like retreat. During periods of strong wind, we keep the cover closed to ensure your safety and protect the system. Once the winds settle, the hot tub will be ready again for you to soak, unwind, and enjoy the peaceful beauty of BGH. If you agree, kindly state in the app at the time of booking, that you accept the terms of the Liability Waiver for the pool and hot tub use. *Also include the full names of all guests staying in the house at the time of booking in the app. Please read the Waiver of Liability below for our hot tub and pool and agree to it, in order to use these amenities during your stay. Condition and Use of Property: The property is provided in "as is" condition. The owner shall use his/her best efforts to ensure the operation of all amenities on the property, such as internet access, cable tv access, hot tub, pool, as applicable. The owner will make every effort to correct any issues, however, the guest must report the issue to the owner and/or cohost as quickly as possible. Guests acknowledge that the use of amenities such as hot tub, pool, fireplace, electric tea kettle, deck, and the like may be potentially dangerous and involve potential risks if improperly used, particularly with regard to children and such risk is at the guests' own risk. I hereby for myself, personal representative, executors, administrators, assigns, guests, children, heirs, and next of kin, (hereinafter collectively, Releasor, "I" or "me", which terms shall also include Releasor's parents or guardians, if the Releasor is under 18 years of age), knowingly and voluntarily enter into this waiver and release of liability and hereby waive any and all rights, claims or causes of action of any kind arising out of my participation in the activity of using the hot tub/pool. I hereby release and forever discharge, Nakoley Renville and Lawrence Renville (owners), their agents, affiliates, managers, members, agents, attorneys, staff, co-hosts, volunteers, heirs, representatives, predecessors, successors, and assigns (collectively "Releasees"), from any physical or psychological injury that I may suffer as a result, direct or indirect of my participation in the activity of using the hot tub/pool. I hereby acknowledge that upon entering the hot tub area, I will continuously thereafter, thoroughly inspect the area. My continued presence in the hot tub/pool constitutes an acknowledgment that I have inspected these areas and found and accept such areas as being safe and reasonably suited for the purposes of using the hot tub/pool. I further agree and warrant that if at any time, I feel or think anything to be unsafe, I and all my guests, and family members will immediately leave the areas of the hot tub/pool and notify Nakoley and Lawrence Renville. I am voluntarily participating in the use of using the hot tub/pool and I am participating in their use and am participating entirely at my own risk. I am aware of the associated risks, which may include, but are not limited to drowning, heat exhaustion, heat stroke, skin, ear, bladder, lung, or other infections, chemical burns or irritations, physical, psychological injury, pain, suffering, illness, disfigurement, disability, economic or emotional loss, paralysis, or death. I understand that these injuries or outcomes may arise from my own or others' negligence or the conditions of the hot tub/pool location. Nonetheless, I assume all related risks, both known and unknown to me, of my participation in using the hot tub/pool. I further agree to indemnify, defend and hold harmless the Releasees/owners/hosts against any and all claims, suits, or actions of any kind whatsoever for liability, damages, compensation, or otherwise brought by me or anyone on my behalf, including attorney's fees and any related costs. I further acknowledge that Releasees/owners/hosts are not responsible for errors, omissions, acts, or failures to act of any party or entity involving this activity of using the hot tub/pool, on behalf of the Releasees/owners/host. In the event that I should require medical care or treatment, I will obtain the medical care deemed necessary, including, but not limited to first aid, emergency transport, and sharing medical information with emergency personnel. I further agree to assume all costs involved and agree to be financially responsible for any costs incurred as a result of such treatment. I am aware and understand that I should carry my own health insurance. I hereby acknowledge that I have carefully read this "waiver and release" and fully understand that it is a release of liability. I expressly agree to release and discharge the Releasees/owner/hosts from any and all claims or causes of action and I agree to voluntarily give up or waive any right that I otherwise have to bring legal action against the Releasees/owners/hosts for personal injury or property damage. To the extent that the statute or case law does not prohibit Releasees/owners/hosts for ordinary negligence on the part of the Releasee/owners/host. I agree that this release shall be governed for all purposes by New York State law, without regard to any conflict of law principles. This release supersedes any and all previous oral or written promises or other agreements. This waiver and release of liability shall remain in effect for the duration of my stay and participation in the activity of using the hot tub/pool. In the event that any damage to the hot tub, Covana Oasis cover, swimming pool, and related equipment or facilities occurs as a result of my family's, guests' or recklessness, I acknowledge and agree to be held liable for any and all costs associated with any such actions of neglect or recklessness. In the event that any provision contained within this release shall be deemed to be severable or invalid, or if any term, condition, phrase, or portion of this agreement shall be deemed to be unlawful or otherwise unenforceable, the remainder of this agreement shall remain in full force and effect. I hereby acknowledge that I have carefully read this "waiver and release" and fully understand that it is a release of liability. Please see the Hot Tub Safety Rules for your information. Hot tub Safety Rules: 1. You must shower prior to getting into the hot tub to remove any oils, lotions, skin care products, make-up, etc. as these may make the water murky and slimy in the hot tub. 2. Pregnant women should consult their doctor before hot tub use. 3. Please keep the hot tub clean and clear. No shoes, street clothing, or glass containers are allowed in the hot tub. 4. Please close the Covana Oasis cover by turning the key when you are finished using the hot tub. We do not want critters, leaves, or dirt to get into the hot tub I have read, understand, and agree with all hot tub/pool rules as well as the Short Term Rental Release and Waiver of Liability and Indemnity Agreement for Hot Tub/Pool use. By booking your stay at the property, you understand and are agreeing to all rules, accepting all waivers of liability and agreements regarding hot tub/pool use, and amenity use.
