Other things to note House Rules and Guest Responsibilities: To ensure the safety, comfort, and preservation of the Property, the Guest agrees to the following rules. Violations may result in fines, immediate eviction without refund, and/or deductions from the security deposit: 1. Quiet Hours: No excessive noise (e.g., loud music, parties) between 12:00 midnight and 7:00 AM. 2. Social Events: The Property must not be used for events, parties, or gatherings exceeding maximum occupancy as specified above. Unauthorized parties will incur a minimum of N70,000 fine and possible eviction. 3. Property Use: The Property is for residential, vacation use only. No commercial activities, illegal acts, or hazardous materials (e.g., fireworks, drones without permission). 4. Cleanliness and Maintenance: Leave the Property in the same condition as upon arrival (normal wear excepted). Report any pre-existing damage immediately. Floors must not be littered with trash – use available trash bins. Guests are responsible for daily trash removal, dishwashing, and basic tidying. Excess mess (that incur additional cleaning/replacement fees), includes but not limited to heavily-stained linens, disorganized furniture, deep carpet stains, accumulated garbage or leftover food, unpleasant odors, or any condition requiring extra cleaning effort or professional services. 5. Amenities: No relocation or rearrangement of furniture. 6. Access: Keys/access codes must be returned/left as instructed. Lost keys incur replacement fees. 7. No Damage or Misuse: The Guest is liable for any damage, loss, or theft caused by themselves, occupants, or invitees, including but not limited to stains, breaks, or unauthorized modifications. Intentional abuse (e.g., vandalism) may lead to reporting to authorities and blacklisting from future bookings. 8. Prohibited Items/Actions: No smoking, vaping, or illegal substances. No pets. No high-risk activities (e.g., open flames). The Guest agrees to comply with all local laws, including noise ordinances and short-term rental regulations. Non-compliance may result in fines from authorities, charged to the Guest. Security Deposit and Damage Protocol: The Guest authorizes the Host to charge the security deposit (or credit card on file via Airbnb) for: - Repairs/replacements at current market rates (e.g., broken window). - Professional cleaning if needed or replacement of linens resulting from over use. - Any excess utility usage or fees. The Host will provide an itemized invoice and photos within 48 hours of check-out. Disputes over charges will follow the Dispute Resolution section below. Insurance and Liability Waiver: The Guest is strongly encouraged to obtain renter's or travel insurance covering personal property, liability, and trip interruptions. The Host's property insurance does not cover Guest belongings or injuries. Hold Harmless Agreement: The Guest agrees to indemnify, defend, and hold the Host harmless from any claims, losses, or damages arising from the Guest's (or occupants'/invitees') use of the Property, including personal injury, property damage, or third-party claims, except where caused by the Host's gross negligence. The Guest assumes all risks associated with the Property's use. Dispute Resolution: The parties agree to resolve any disputes arising from this Agreement through non-judicial means to avoid costly litigation: 1. Informal Negotiation: The parties will first attempt to resolve issues amicably, face to face or via email or phone within 7 days of notice. 2. Mediation: If direct negotiation fails, the parties agree to mediate through a neutral third party service, such as [e.g., Airbnb Resolution Center or a local mediation provider if available]. Mediation costs will be shared equally, unless otherwise agreed. Mediation is confidential and non-binding. 3. Other Means: If mediation fails, any unresolved dispute will be referred to the authorities for possible arbitration or adjudication under the laws of Abia State and the Federal Republic of Nigeria.
