Occupancy at _Buffalo Ridge Condo . This agreement is a temporary license for guest occupancy from __________ to __________, with no right to renewal. The guest acknowledges this is not a permanent residence and agrees to vacate by 12 p.m. on the check-out date, with occupancy limited to 5 persons unless otherwise approved in writing; invitees may stay up to 10 days. This agreement is governed by Airbnb policies and does not establish a landlord-tenant relationship or any tenant rights under Colorado law. The guest waives all rights to tenancy protections, including claims to possession, renewal, or formal eviction procedures. Refusal to vacate as agreed may result in removal by local authorities. 2. Payment All payments for bookings of 30 days to 2 months will be processed through Airbnb, including the nightly rate, applicable taxes, and fees. Payments are non-refundable and subject to Airbnb’s cancellation policies. 3. Language of Agreement The guest agrees that the preferred language for this agreement, notices, and all communication will be ENGLISH. 4. Right to Quiet Enjoyment Guests have the right to quiet enjoyment of the property. The property shall not be used for retail, commercial, or any professional activity that violates local zoning laws. 5. Right of Entry The host and management reserve the right to enter the property between 8:00 a.m. and 6:00 p.m. Mountain Time for maintenance, repairs, inspections, or emergencies. Except in emergencies, 24-hour notice will typically be provided. 6. Security Deposit and Damage Claims • No Security Deposit: A security deposit is not collected; guests are encouraged to obtain rental insurance for personal property protection. Airbnb’s AirCover will manage damage claims. • Property Care: Guests and invitees agree to care for the property and contents responsibly. Guests are liable for any damages beyond normal wear and tear. • Liability for Damages/Injury: Guests are responsible for damages or injuries caused by themselves or invitees on the property. Airbnb coverage may apply, but guests are encouraged to understand its limitations. • Dispute Handling: Disputes, refunds, and relocation assistance are governed by Airbnb policies. The host is not liable for relocation or alternative accommodations beyond Airbnb’s AirCover. 7. No Subletting or Assignment Subletting, rental arbitrage, or any form of subleasing is strictly prohibited under this agreement. 8. Animals • Pets: No pets are allowed, except for ADA-compliant service animals, which require pre-approval from the HOA and owner. Documentation of ADA compliance is required. • Allergies: Cats are prohibited due to owner’s allergies. 9. Emergency Evacuation and Removal In cases of emergency, safety risks, or significant property damage, the host reserves the right to terminate the stay and require guests to vacate immediately. Refunds or relocation will be managed solely through Airbnb’s AirCover. In natural disasters or government-mandated evacuations, the host is not liable, and Airbnb’s support may assist with relocation. 10. Non-Renewable Term and Holdover Fee • Fixed Term: This agreement is non-renewable and ends on the specified date. Extensions require mutual agreement and must be rebooked through Airbnb. • Holdover: Unauthorized holdovers will be charged at twice the nightly rate and may result in immediate removal. 11. Early Termination • The booking is non-refundable. If the guest chooses to terminate the stay before the agreed check-out date, no refund will be issued, and the guest remains responsible for the full booking amount. • In the event that the landlord must terminate the agreement due to unforeseen circumstances, a prorated refund for unused days will be issued to the guest. • If the guest violates any terms of this agreement, including but not limited to occupancy limits, illegal activities, or property damage, the landlord reserves the right to terminate this agreement immediately without refund. 12. Disclosures and House Rules • HOA Rules: Guests and invitees must follow HOA rules, as posted at Blue Fin Resolutions. Major violations may lead to immediate termination of occupancy and require the guest to vacate. • Property Conditions: No known issues with bedbugs, pests, mold, asbestos, or lead (property built in 1979). • Safety: Smoke and carbon monoxide detectors are installed and maintained as required by Colorado law. Guests should secure all windows and doors when not in the unit and avoid storing items on the balcony or fire escape. • Amenities: Common amenities, including hot tubs, pools, and game rooms, are unavailable this season due to renovations. Guests may use the Silverthorne Recreation Center as an alternative. • Internet: Internet service will transition to Xfinity in December 2024, without anticipated outages. Streaming requires guest-provided login credentials; cable/satellite TV is not available. • Parking: One covered parking spot is provided. Additional cars must be moved every 48 hours for snow clearing. Blocking common paths, dumpsters, or roads is prohibited. • Fire Safety: Use extreme caution when using the fireplace or candles. FIRES ‐ Cooking, barbecuing, frying and/or the use of any types of fires or barbecues shall be prohibited on all balconies and under covered garage areas. Charcoal braziers, gas grills, and electric grill must not be stored on balconies as occupants may be tempted to use them, creating a dangerous fire hazard and invalidating our fire insurance. If barbecue grills are in use on a balcony, there will be no warning; an automatic $25.00 fine will be levied against the unit. 2. BALCONIES ‐ Bicycles, motorcycles, or motorbikes are not to be placed, at any time, on the balconies/decks. Balconies/decks are not to be used as storage areas for refrigerators, freezers, automotive equipment, or any other obviously stored items. The balconies, terraces, decks, or patios shall not be used for hanging garments, birdseed or suet feeders, or other articles, or for cleaning rugs, household articles, or other items. No rugs or other materials shall be cleaned by beating or shaking from windows, balconies, decks, or patios. 3. BLOCKING BLDGS A&B BALCONY FIRE ESCAPES is always prohibited. Blocking fire escapes can create a life-threatening situation in an emergency. Any balcony fire escape, which is blocked, shall be subject, without warning, to an initial automatic $25.00 fine to be levied against the unit. Subsequent violations will be assessed fines as stated in the Rules and Regulations Penalty Schedule. Also, the blockage will be removed immediately by staff and the owner charged for all costs and expenses, including staff's time, incurred in doing so. 4. OBSTRUCTIONS ‐ Any common sidewalks, driveways, entrances, or passageways shall not be obstructed or used by any unit owner for any other purpose than ingress and egress from the units. No items shall be placed on or in any of the general common elements except for those articles of property which are the common property of all of the unit owners. 5. PARKING AND TRAFFIC ‐ Vehicles belonging to or under control of a unit owner or member of the family or a guest, tenant, lessee, or employees of a unit owner shall not be parked in such a manner as to impede or prevent ready access to any part of the project. Vehicles shall be parked within designated parking areas. Vehicles violating a "no parking" zone will be tagged and if not moved within the designated time allotment, will be towed at the owner's expense. IMMEDIATE TOW: The following constitute a "no parking" zone: a. Vehicles parked in front of dumpsters. b. Vehicles parked in front of fire hydrants or fire department standpipes (red painted areas). c. Vehicles parked in handicapped zones. Parking in these areas is permitted only for those vehicles displaying a handicapped tag or license plate or by special arrangements made with the manager. d. Vehicles blocking the snow storage areas as indicated by signs. e. Vehicles parked for more than 10 minutes for the purpose of loading or unloading on the service road behind Buildings A/B/C. f. Unauthorized vehicles parked in carports ‐ carports marked with unit numbers are for owners, guests or tenants of that unit. Any vehicle illegally parked in a carport will be immediately towed at the expense of the owner of the vehicle. WITHIN 7 DAYS: a. Campers or trailers parked in the parking lot. Exception: Homeowners or short‐term renters will be allowed to park trailers in the back parking lot of CC/DD for no more than 7 days. These trailers have to be registered with the Resident Manager and are subject to towing if not registered. b. Unlicensed or improperly licensed vehicles. ADDITIONAL: a. Vehicles that have not been moved from designated parking areas (exclusive of carports) within 48 hours or more will be tagged. If not moved in 48 hours from the date of tagging, it will be towed at the owner's expense. Upon the third occurrence of this violation, the vehicle will be towed immediately, without notice, at owner's expense. b. Repairs on vehicles cannot be performed in the parking lots except on an emergency basis. c. Bicycles, motorcycles, or any other items may not be stored or parked on the walkways at the front of the carports. 6. CHANGES ‐ No owner, resident, or lessee shall install wiring for electrical or telephone installation, or for any other purpose, nor shall any television or radio antennae or satellite dish, machines, or air conditioning units be installed to protrude through the walls or the roof of the condominium improvement except as may be expressly authorized by the Association. No work of any kind shall be done upon the exterior building walls or upon the general or limited common elements by any unit owner. Such work will be done by the Association. 7. MODIFICATION OF FLOORING SURFACES ‐ An owner must request and obtain permission to change from one type of flooring surface to another (e.g. carpet, hardwood, tile, laminate, vinyl, etc.). This will allow the Board to evaluate the impacts of the proposed modification. The modification request must include: • Description of modification, including square footage. Please include a drawing/layout of the unit. • Estimate of start and duration of work along with contractor information • Minimum sound requirement of 65 STC (Ambient sound transfer in dB) and 70 IIC (Impact sound transfer in dB). 8. PRIVILEGES ‐ The Association common property, including the swimming pool, sauna, Jacuzzi, pool tables, bar, lounge, and all other recreational items and facilities shall be used only by the owners, members of their families, and their guests, and by compliant renters who are occupying a Buffalo Ridge/Village unit in lieu of owner occupancy. 9. NOISES ‐ Quiet hours are between 10:00 PM and 8:00AM. At all times owners and occupants shall exercise reasonable care to avoid making or permitting to be made loud, disturbing, or objectionable noises, and in using or playing or permitting to be used or played musical instruments, radios, phonographs, television sets, amplifiers, and any other instruments or devises in such a manner as may disturb or tend to disturb owners, tenants, or occupants of other units. Persistent violation of this rule will subject offending unit occupants to fines and/or eviction from the premises. 10. ANIMALS AND PETS ‐ No cats, dogs, or other animal or bird or reptile (hereinafter for brevity termed "animal") shall be kept, maintained, or harbored on any part of the condominium property or unit by renters or non‐ owners. Non‐owner violation shall be reported to the unit owner for action. Any animals required for disability or special needs will need to be preapproved by the HOA and owner prior rental agreement signing. Homeowners have an implied permission to keep animals provided they are kept on a leash or are wearing an electronic collar and are within ten feet of a person competent to control and restrain them while on Association common areas and are not a nuisance to others. No animal will be allowed to be tied to any common area of the Association while unattended. Such implied permission is revocable if the animal becomes obnoxious to other owners, in which event the owner or person having control of the animal shall be given a written notice to correct the problem. If the situation is not corrected, the owner, upon written notice that may include a fine, will be required to remove the animal from the unit and project. Owners are required to clean up after their pets. 11. STORAGE ‐ Boats, boat trailers, travel trailers, motorcycles, bicycles, motor homes, snowmobiles, or any other vehicles or private property shall not be stored on Association common property, except in the designated storage lot behind CC/DD building; i.e., parking lots, stairwells, etc., and will be subject to parking and traffic violations. Bicycles may not be chained up in hallways, stairwells, or walkways. 12. KEYS ‐ The Resident Manager, the Managing Agent, of the Board of Managers shall retain a passkey to each unit. New locks must be keyed to the master key system and one unit key must be provided to the manager as a "back‐up" key in the event emergency access to a unit is required by the owner, a guest or renter or a contractor. Failure to do so will be corrected at the owner's expense. 13. TRASH - Disposition of garbage and trash shall be only by the use of garbage disposal units or by use of the common trash and garbage facilities. Ash cans are located next to each dumpster. Fireplace ashes shall be placed in the ash cans and not in the dumpster. Do not place large furniture items in or around the dumpsters. 14. FIREWORKS ‐ Fireworks of any kind, whether explosive or non‐explosive, shall not be stored, carried, or brought or permitted on any part of this project, including within a unit, nor shall any fireworks be ignited, displayed, or exploded on any part of the project. 15. GAMES ‐ No football, baseball, soccer, golfing, or other games that might present a hazard to persons, private property, or Buffalo Ridge/Village facilities, are to be played in the common area. 16. LIABILITY ‐ The Association assumes no liability for, nor shall it be liable for, any loss or damage to articles left or store on Buffalo Ridge/Village Condominium project property. 17. DAMAGES ‐ Any damage to the Association common property caused by owners, family members, guests, or renters will be repaired at the expense of the offending or responsible homeowner. Any damage or expense which results from water flow (i.e. from tubs, showers, or damaged pipes within the unit) shall be the liability of the owner of the unit where the water originated. PLEASE REPORT ANY DAMAGE TO THE COMMON AREA OR SUSPICIOUS BEHAVIOR TO THE MANAGER. 18. SMOKE DETECTORS ‐ The cost for repair or replacement of smoke detectors is the owner's responsibility. 19. SIGNS ‐ Signs, including "For Sale" and "For Rent" shall not be placed or maintained on Buffalo Ridge/Village Condominium Association property or in individual units where readily visible from Association common property. 20. OBLIGATION ‐ It is the obligation of an owner who rents to inform renters or guests to read and heed the Association Rules & Regulations. 21. RULES ‐ The Clubhouse Rules, Pool Rules, Notice of Violation, and future facility rules are hereby made a part of the Buffalo Ridge/Village Condominium Association Rules & Regulations. 22. ENFORCEMENT OF RULES & REGULATIONS ‐ The Board of Directors has the authority to institute a schedule of reasonable charges against owners of their agents for violation of these Rules & Regulations, the By‐Laws, the Declarations, and the Articles of Incorporation. Reasonable procedures (including notice of alleged violations and opportunity to be heard by a grievance committee) shall be implemented by the Board. All fees, charges, and penalties imposed by the Board and costs incurred by the Association in enforcing the Rules & Regulations shall be considered assessments enforceable against units and unit owners pursuant to these Rules & Regulations, the By‐Laws, and Condominium Declarations of the Association. The Board shall have the authority to take any remedial action it deems appropriate in the event of a violation of these Rules & Regulations, the By‐Laws, or the Declaration including assessment of charges and penalties, the filing of a lien, and the filing of an action for injunction or money judgment or filing of a suit for unlawful detainer. The foregoing Rules & Regulations are subject to amendment by the Board of Directors. 23. PENALTY SCHEDULE • No warning for barbecuing on balconies ‐ automatic $25.00 fine. • First offense: A written warning • Second offense: $ 25.00 assessment against the unit • Third offense: $100.00 assessment against the unit • Fourth offense: $150.00 assessment against the unit • Fifth and each following offense: $200.00 assessment against the unit =-=-=-=-=-=-=-=-=-=-=-=-=-=-=-=-=-=-=-=-=-=-=-=-=-=-=-=-= Any fines will be charged to guest should they violate any of these rules.
