Guest access Entire Home Other things to note This Vacation Property Rental Agreement is for the property located at 450 Mount View Rd, Alexandria, AL 36250 THE AGREEMENT: Please read this agreement in its entirety before submitting payment. Submitting payment to secure the property for rental will be considered as an agreement to this rental agreement. Please download and keep a record of this agreement for yourself. This Rental Agreement and Contract is a legally binding agreement made and entered into as of the Reservation Date entered in AirBNB and between the person(s) or company (the “Vacationer”) and the Owner, manager, or agent (“Owner”), pursuant to which the Vacationer has agreed to rent the residence described below (the “Property”), for the duration of the Rental Term for the Total Rental Fee and other good and valuable consideration as described herein. GENERAL PROVISIONS: This Agreement contains the entire agreement between the parties with regard to the rental of the Property and any changes, amendments, or modifications hereof shall be void unless the same is in writing and signed by both the Vacationer and the Owner. The words “Owner” and “Vacationer” shall include their respective heirs, successors, representatives. The waiver or failure to enforce any breach or provision of this Agreement shall not be considered a waiver of that or any other provision in any subsequent breach thereof. If any provision herein is held invalid, the remainder of the Agreement shall not be affected. Any notice required to be given under this Agreement shall be in writing and sent to the contact information included herein. This Agreement may be signed in one or more counterparts, each of which is an original, but taken together constitute one in the same instrument. Execution of a digital signature shall be deemed a valid signature. A confirmed reservation shall be deemed a digital signature from both the “Owner” and the “Vacationer”. RELEASE: The Vacationer hereby waives and releases any claims against the Owner, the Property owner, and their successors, assigns, employees or representatives, officially or otherwise, for any injuries or death that may be sustained by the Vacationer on or near or adjacent to the Property, including any common facilities, activities or amenities. The Vacationer agrees to use any such facilities or amenities entirely at the Vacationer’s own initiative, risk, and responsibility. ENTRY AND INSPECTION: The Owner reserves the right to enter the Property at reasonable times and with reasonable advance notice for the purposes of inspecting the Property or showing the Property to prospective purchasers, renters, or other authorized persons. If the Owner has a reasonable belief that there is imminent danger to any person or property, the Owner may enter the Property without advance notice. UNAVAILABILITY OF PROPERTY: In the event the Property is not available for use during the Rental Term due to reasons, events, or circumstances beyond the control of the Owner, the Owner shall immediately return all payments made by the Vacationer, whereupon this Agreement shall be terminated and the Vacationer and the Owner shall have no further obligations or liabilities in any manner pertaining to this Agreement. CONDITION AND USE OF PROPERTY: The Property is provided in “as is” condition. The Owner shall use its best efforts to ensure the operation of all amenities in the Property, such as internet access, etc. as applicable. The Vacationer acknowledges that the use of amenities such as porches, and the like may be potentially dangerous and involve potential risks if improperly used, particularly with regard to children and such use is at the Vacationer’s own risk. The Vacationer shall use the Property for residential purposes only and in a careful manner to prevent any damage or loss to the Property and keep the Property in clean and sanitary condition at all times. The Vacationer and any additional permitted other “guests” shall refrain from loud noise and shall not disturb, endanger, or inconvenience neighbors, nor shall the Vacationer use the Property for any unlawful purposes, nor violate any law, association rules, or ordinance, nor commit waste or nuisance on or about the Property. Smoking is not allowed in the premises and Pets are only allowed in the Property with fee and deposit. The Vacationer will be fined additional charges if smoking or undisclosed pets are detected on the Property. DEFAULT: If the Vacationer should fail to comply with the conditions and obligations of this Agreement, The Vacationer shall surrender the Property, remove all of the Vacationer’s property and belongings and leave the Property in good order and free of damage. The prevailing party shall be entitled to reimbursement from the other party for all costs incurred. ASSIGNMENT OR SUBLEASE: The Vacationer shall not assign or sublease the Property or permit the use of any portion of the Property by other persons who are not family members or other ‘guests” of the Vacationer and included within the number of and as permitted occupants under this Agreement. RISK OF LOSS AND INDEMNIFICATION: The Owner attempts to properly maintain the Property. The Vacationer agrees to immediately notify the Owner of any maintenance problem so that the situation can be remedied as soon as possible. The Vacationer agrees that all personal property, furnishings, personal effects, and other items brought into the Property by the Vacationer or their permitted other “guests” and visitors shall be at the sole risk of the Vacationer with regard to any theft, damage, destruction, or other loss and the Owner shall not be responsible or liable for any reason whatsoever. The Owner is not responsible for any inconveniences that may occur for which he/she has no control. This includes, but is not limited to power outages, adverse weather conditions, mandatory evacuation, construction, mechanical failure such as television, etc. No refunds will be given for occurrences beyond the Owner’s control. The Owner shall not be held liable for any injuries that may occur to the Vacationer or their other “guests” as a result of the acts of said. The Owner is not responsible for any theft or damage to the Vacationer’s belongings during their stay at the Property. The Vacationer hereby covenants and agrees to indemnify and hold harmless the Owner and their agents, Owners, successors, employees, and contractors from and against any costs, damages, liabilities, claims, legal fees, and other actions for any damages, costs, attorney’s fees incurred by the Vacationer, permitted other “guests”, visitors or agents, representatives or successors of the Vacationer due to any claims relating to the destruction of property or injury to persons or loss of life sustained by the Vacationer or family and visitors of the Vacationer in or about the Property and the Vacationer expressly agrees to save and hold the Owner harmless in all such cases. ADDITIONAL TERMS TO THE RENTAL AGREEMENT In addition to the standard terms included herein, the Vacationer acknowledges and agrees that the following additional terms and conditions apply to the Vacationer’s rental of the Property. LEGAL and LAWFUL: You must comply with all local laws, ordinances, and rules. PROPERTY ACCESS: 24 hours prior to the date/time of check in, instructions will be sent via a messaging app and/or by email prior to check-in time to gain access to the Property. FURNISHINGS: The Property is furnished by the Owner. The Property is fully furnished including a fully stocked kitchen, washer, and dryer. There is a fire extinguisher. WiFi is provided Linens, a blowdryer, an iron, an ironing board are provided along with toiletries. Supplies are provided for light housekeeping. The Vacationer will be liable for any damage and/or missing items. The Vacationer will be liable for any damage and/or missing items. TV/INTERNET: Each TV is managed by one remote. There will be a $50 fine for each lost TV remote. QUIET ENJOYMENT: Quiet time is from 11 pm - 6 am. You shall be entitled to the quiet enjoyment of the Property. You shall not commit or permit any nuisance, noxious, offensive, immoral, or illegal act on the property. Any disturbance resulting in police action, neighborhood complaints, or any violation of the rules and regulations is considered sufficient cause for immediate termination of your stay with all monies paid forfeited. TRASH: Trash, garbage, or other waste shall be put into sealed trash bags. All trash bags shall be placed inside the big trash container located by the road. Trash bags shall not be left beside the trash container for any reason. Trash shall not be placed on the porch at any time, bagged or not. CHECK-IN/CHECK-OUT PROCEDURE: Check-in time is 4:00 pm on the day scheduled reservation begins. No early check-ins without the prior consent of the Owner. Check-out time is 11:00 am on the day the scheduled reservation ends. Any delay in check-out, without the prior consent of the Owner shall result in the Vacationer being charged additional fee-see below. Upon departure, please ensure the following: * PLEASE LEAVE ALL SHEETS, COMFORTERS, BLANKETS, AND PILLOWS ON THE BEDS. The cleaner will take care of these. Please put dirty towels in the washer and start. LAKE CHECK-OUT FEES: There may be a late check out fee of $100 per hour.
