The Sky Castle offers a serene escape where you can live among the clouds and create memories that will linger long after you’ve returned to earth. The space This unit is directly on the Pond. This unit also boasts several upper and lower decks for your enjoyment. Zenfulcove is composed of 4 units in 10 acres carefully crafted so each unit enjoys privacy. Each Unit has its own deck, patio furniture and outdoor grill. The Pond is shared by all units. Guests can fish (catch and release) and enjoy the kayaks. Guest access Guests for this unit enjoy 4 private decks and backs up to the pond with amazing views. This unit also has a small beach area where you can kayak fish and enjoy and outdoor camp fire. Entry codes will be provided on day of reservation. Other things to note By booking this Unit, guests agree to the Rules and Terms and Conditions below: RULES – ZenfulCove o Check in times: 3:00 p.m. Check out times; 11:00 a.m. o No pets allowed with stay. o Canoeing and Kayaking are at your own risk must wear a lifejacket (life jackets are provided by Property and are located next to Kayaks in Box). o No swimming allowed in the pond. o Fishing allowed as a catch and release. o Quiet hours: 10 p.m. – 7 a.m. o Interacting with wildlife is at your own risk. o No smoking or vaping inside units. o All camp fires must be monitored and COMPLETELY put out by guest when finished. o If Grilling outside, guests must ensure they shut off gas to grill. o If you are in a unit with a key card, all key cards MUST be returned or a $100 fee will be assessed. o The pond is a common area. INTRODUCTION This document outlines the terms and conditions ("Terms") that apply to your stay at ZenfulCove ("the Property"), located at 103 Potato Smith Rd, Elgin TX which is owned and operated by ZenfulCove LLC. By booking and staying at the Property, you ("the Guest") agree to comply with these Terms. Please read them carefully. 2. ACCEPTANCE OF TERMS By confirming your reservation and staying at the Property, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree with any part of these Terms, you must not proceed with your reservation. 3. OCCUPANCY AND USE OF THE PROPERTY 3.1 Authorized Occupants: Guest agrees that no more than the guests listed in the reservation shall be permitted on the Property at any time during the Rental Term, all of whom shall comply with the conditions and restrictions imposed upon Guest under this Agreement. No Pets allowed. Unless agreed by the Owner. 3.2 Use of the Property: The Property is to be used solely for residential purposes. No commercial activities, parties or large gatherings are allowed without prior written consent from the Owner. 3.3 Noise: Guests are required to observe quiet hours from 10:00 PM to 7:00 AM. During this time, noise levels must be kept to a minimum to respect the neighbors. Guests shall refrain from loud noise, loud music and shall not disturb, annoy, endanger, or inconvenience neighbors, nor shall Guest use the Property for any immoral, offensive or unlawful purposes, nor commit waste or nuisance on or about the Property. 3.4 SECURITY AND MONITORING Cameras: For the safety and security of both Guests and the Property, there are cameras installed at the entrances of the units and on the streets. These cameras are used to monitor entry points and common areas, directly on the pond and do not record inside any private living spaces. By staying at the Property, the Guest consents to the use of these security cameras. This clause ensures transparency about the use of cameras and reinforces the safety measures in place. 4. POND AND WILDLIFE 4.1 No Swimming in Pond: Guests are strictly prohibited from swimming in the pond. This restriction is for your safety and to preserve the natural habitat. There is no life guard on duty. 4.2 Kayaking / Canoeing allowed but Tenants and their guests agree they MUST WEAR LIFE JACKETS. THERE ARE LIFE JACKETS PROVIDED BY ZENFULCOVE (FOUND IN THE BOX NEAR THE CANOE_). 4.2 Fishing: Guests are allowed to fish in the pond under a catch-and-release policy. Any fish caught must be returned to the water. 4.3 Wildlife: The Property may have various forms of wildlife. Guests acknowledge that interaction with wildlife is at their own risk, and the Owner is not responsible for any harm, injury, or damage caused by wildlife encounters. 5. RELEASE OF LIABILITY 5.1 General Liability: The Guest agrees to release the Owner from any and all liability for any injuries, damages, or losses that occur during their stay at the Property. This includes, but is not limited to, injuries resulting from use of the Property’s amenities, interactions with wildlife, and any accidents occurring on the premises. 5.2 Indemnification: The Guest agrees to indemnify and hold the Owner harmless from any claims, damages, or expenses arising out of their stay, including but not limited to any breaches of these Terms. 5.3 CAMP Fire – Because we live in a very wooded area, we only allow CAMP fires to be built in the designated areas. (near the pond ONLY). Fires must be completely out before guests leaves fire. 6. The participant voluntarily agrees to use the Sauna and/or hot tub or cold plunge, fully understanding the inherent risks, including injury or harm due to extreme temperatures or medical conditions. By signing this waiver, the participant acknowledges their responsibility for ensuring they are in good health, assumes all risks, and waives any claims against the facility and its affiliates for injuries or damages arising from the use of these amenities. The participant also agrees to indemnify the facility from any related claims. 7. RISK OF LOSS AND INDEMNIFICATION Guest agrees that all personal property, furnishings, personal affects and other items brought into the Property by Guest or their permitted guests and visitors shall be at the sole risk of Guest with regard to any theft, damage, destruction or other loss and Rental Agent shall not be responsible or liable for any reason whatsoever. 8. INDEMNIFICATION Guest hereby agrees to indemnify and hold harmless Rental Agent and their agents, owners, successors, employees and contractors from and against any costs, damages, liabilities, claims, legal fees and other actions for any damages, costs, attorneys fees incurred by Guest, permitted guests, visitors or agents, representatives or successors of Guest due to any claims relating to destruction of property or injury to persons or loss of life sustained by Guest or family and visitors of Guest in or about the Property and Guest expressly agrees to save and hold Rental Agent harmless in all such cases. 9. RELEASE Guest hereby waives and releases any claims against The Property, Rental Agent, the Property owner and their successors, assigns, employees or representatives, officially or otherwise, for any injuries, bodily injuries or death that may be sustained by Guest on or near or adjacent to the Property, including any common facilities, activities or amenities. Guest agrees to use any such facilities or amenities entirely at the Guest’s own initiative, risk and responsibility. 10. CONDITION AND USE OF PROPERTY Rental Agent shall use its best efforts to ensure the operation of all amenities in the Property, such as internet access. Rental Agent shall not be held responsible for such items failure to work, but will make every effort to correct any issues as reported as quickly as possible. 11. PROPERTY RULES 10.1 Compliance: The Guest agrees to comply with all Property rules, including those posted within the Property and communicated by the Owner which are also made part of this agreement. Any violation of these rules may result in immediate termination of the stay without refund. 11.2 Guest acknowledges that use of amenities such as outdoor tubs, saunas, canoeing, and the like may be potentially dangerous and involve potential risks if improperly used, and are at the Guest’s own risk. 11.3 Guest shall use the Property for residential purposes only and in a careful manner to prevent any damage or loss to the Property and keep the Property in clean and sanitary condition at all times. 11.4. DAMAGES AND SECURITY DEPOSIT Responsibility for Damages: The Guest is responsible for any damage to the Property or its contents caused by them or their visitors. Any damages should be reported immediately to the Owner and communicated via Airbnb App. Security Deposit: The Owner reserves the right to withhold part or all of the security deposit to cover any damages or extra cleaning costs incurred during the Guest's stay. 12. CANCELLATION POLICY 12.1 Cancellation by Guest: Cancellations must be made in accordance with the cancellation policy outlined on the platform the reservation was made on. Refunds, if any, will be processed according to the terms specified at the time of booking. 12.2 Cancellation by Owner: The Owner reserves the right to cancel the booking in the event of unforeseen circumstances, such as natural disasters, which render the Property unsafe or uninhabitable. In such cases, refunds shall be refunded according to the policy provided by the rental platform. 13. GOVERNING LAW These Terms shall be governed by and construed in accordance with the laws of the state of Texas County of Bastrop. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts in that state. 14. SEVERABILITY If any provision of these Terms is found to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions shall remain in full force and effect. 15. ENTIRE AGREEMENT These Terms constitute the entire agreement between the Guest and the Owner regarding the Guest’s stay at the Property and supersede any prior agreements or understandings, whether written or oral. 16. AMENDMENTS The Owner reserves the right to amend these Terms at any time. Any amendments will be communicated to the Guest, and continued occupancy of the Property will constitute acceptance of the amended Terms. By booking and staying at the Property, you acknowledge that you have read, understood, and agree to these Terms and Conditions.
