SHORT TERM RENTAL AGREEMENT Alpine JAKs, Leavenworth, WA 98826 STR License #000586 The booking of this property is confirmation of your acceptance of the contents of this Rental Agreement in its entirety. We are very thankful you have chosen Alpine JAKs for your vacation, and appreciate your business. Our objective of this agreement is to provide you with a safe and enjoyable experience, while maintaining the home’s condition for future guests and maintaining the peaceful atmosphere of the community. This agreement made on the day of this booking with the renting party (hereinafter called the Guests) and Richard & Wendy Garrett (hereinafter called Management) concerning the short term rental of the property called Alpine JAKs in Leavenworth, WA 98826 Rental period begins at 4:00 PM Pacific and ends at 10:00 AM Pacific on dates in the reservation. Total Rent, Cleaning Fees, Security Deposits, and taxes: As noted in the booking request. Cancellation Policy : As noted in the booking request. Access Code for Door Lock will be provided within 48 hours of guest arrival. Code will activate at 4:00 PM Pacific on the first day of the reservation. Code will expire at 10:00 AM Pacific on the last day of the reservation unless otherwise agreed upon with Management. Terms of the Agreement: 1. Management and/or management’s security personnel has the right to inspect the premises without prior notice at any time to enforce the terms of this agreement. Should the Guests violate any terms of this agreement, the rental period shall be terminated immediately. The Guests waive all rights to process if they fail to vacate the premises upon termination of the rental period. The Guests shall vacate the premises at the expiration time and date of this agreement. 2. The Guests shall maintain the premises in a careful and lawful manner. The Guests shall leave the premises in a ready to rent condition at the expiration of the rental agreement, defined by Management as being habitable by the next guests upon standard cleaning. Guests shall pay for maintenance and repairs should the premises be left in a lesser condition. Moving furniture could result in additional expense to cover the cost for personnel to move furniture back to its proper location. 3. The Guests agree to leave the premises in a condition that is normal use without excessive cleaning required by the Cleaning service upon their departure. Check-out Procedures are furnished here, and also a print out is provided in the guest binder within the cabin. Extra charges will apply for staying past check out time without our knowledge. Late fees start at $100 per hour. Check-in time is 4 PM and Check-out time is 10 AM sharp. Procedures are as follows: • Linens: leave beds unmade, gather all used towels and start a load of white towels. Leave the rest on the floor in the basement bathroom. • Trash: empty all trash containers and place bags in garbage can in the garage. • Dishes: please wash and put away utensils and cookware that is not dishwasher safe, place remaining dirty dishes in dishwasher and start load prior to leaving. • Furniture: leave home as you found it with all furnishings in their original location. Lock-up: ensure all windows and doors are locked prior to leaving home. 4. The Guests shall pay for any damage done to the premises over and above normal wear and tear. 5. No pets of any kind will be brought onto the premises. If a pet is found to be on the premises, the Guests could be asked to vacate the premises immediately. A pet fee of $200 per night will be due for extra cleaning. 6. The Guests shall not sublet the property. 7. Maximum occupancy for the home is 10 (ten persons). Over occupancy is grounds for immediate eviction. Management intends this home to be for family and responsible adult vacations. Absolutely no house parties or overcrowding allowed. The property is stocked according to maximum occupancy. If guests violate any terms of this agreement, an agent representing management, at their sole discretion, may evict guests and occupants of the property with no refund, which will also include, if applicable, guest’s security deposit. 8. The Guests shall behave in a civilized manner and shall be good neighbors respecting the rights of the surrounding property owners. Quiet hours start at 10:00pm. Outdoor noise should be kept to a minimum. • No Indoor furniture shall be moved outside. • Guests shall not remove, chop down or trim ANY trees or foliage. • Guests shall not drive across or park on any neighboring property. The paved driveway of Alpine JAKs is the only designated parking area for vehicles. Per City Ordinance, no street or cul-de-sac parking is allowed. Parking anywhere other than in our driveway will likely result in fines and/or towing at guest expense. 9. There shall be no smoking or vaping (cigarettes, vaping pens, marijuana, etc.) anywhere on the premises. This includes inside the home, all outdoor living spaces and amenities, and anywhere else on the property. There will be a significant fine if this rule is violated. 10. Management shall provide towels, linens, cups, knives, forks, spoons, dishes, and other items as commonly used by the Owners family. Toilet paper, paper towels, dish soap, bath soap, shampoo, conditioner, laundry detergent, trash bags are also provided. To protect the property’s septic system, please only use the toilet paper provided by the Management. 11. The Guests shall hereby indemnify and hold harmless the Management against any and all claims of personal injury or property damage or loss arising from the use of the premises regardless of the accident, injury or loss. Management expressly recognize that any insurance for property damage or loss which the Management may maintain on the property does not cover personal property of the Guests, and that Guests should purchase their own insurance if such coverage is desired. 12. Guests expressly acknowledge and agree that this Agreement is for transient occupancy of the Property, and that Guests do not intend to make the property a residence or household. Management adheres to all state and local laws and ordinances in regard to transient occupancy. 13. We occasionally experience outages that are beyond our control. We report outages as each occurs. No refunds or compensation will be given for any outages that are beyond our control. 14. There shall be no refunds of rents because of shortened stays or ruined experiences due to work and family emergencies or other commitments. Our recommendation is to purchase travel insurance. 15. There shall be no refunds of rents due to shortened stays or ruined expectations because of weather conditions. Our recommendation is to purchase travel insurance. 16. The discharge of firearms and fireworks are not allowed on the property. This includes pellet and paintball guns. 17. Guest shall use the property for legal purposes only and other uses, such as but not limited to, illegal drug use, abuse of any persons, harboring fugitives, etc.; shall cause termination of this agreement with no refund of rents or deposits. 18. The property has fire extinguishers installed in the kitchen and in the game room. The fire extinguishers were fully charged at last inspection. It is the duty of the Guest to inform management immediately of any use of the fire extinguisher. Your personal safety is our highest priority, but we sincerely appreciate reasonable efforts to extinguish an unexpected small fire to prevent further damage. Please ensure you have a clear exit path when deciding to extinguish a fire. There are emergency exit maps posted on each floor of the home. Please familiarize yourself with these maps in case of an emergency. There is an emergency ladder located in the closet of the third floor bedroom. Emergency numbers are listed in the Guest Book. 19. The property has smoke alarms installed. Guests will notify Management without delay if a smoke alarm “chirps” or has a low battery condition. 20. There are multiple carbon monoxide detectors inside the property. Guests shall notify management if an alarm sounds as well as notify the appropriate emergency numbers. These numbers are listed in the Guest Book. 21. Guest shall see to their own security while on the property by locking all doors & windows when it is prudent to do so. 22. Valuable items left behind by Guest will be held for the tenant and every reasonable effort will be made to contact the Guest for return. If items are not claimed for longer than 6 months they shall become the property of the Management. The Management shall not be held liable for condition of said items. Shipping costs will be borne by the guest at reasonable market costs. 23. ROKU TV access is provided. No refund of rents shall be given for outages, content, lack of content or personal preferences with regard to this. Please let us know if you have any issues with the television setup, and we will be happy to help. 24. High speed wireless internet is provided as a convenience only and is not integral to the agreement. No refunds of rents shall be given for outages, content, speed, access problems, lack of knowledge of use, or personal preferences with regard to internet service. 25. Thermostat has a set range of 65-74 degrees and fan is set to ‘AUTO’. Guest may adjust the temperature within these set limits. Guest agrees to not adjust these settings. Doors and windows shall be closed when either heat or air conditioning is in operation. Management has remote control of thermostat and has parameters set. If thermostat is removed from wireless function during Guests stay, Guest will be responsible for all service fees for Landlord to have thermostat reconnected to wireless function.. 26. No third-party reservations allowed. Responsible party shall be on the premises with any and all underage guests. Minimum age of primary guest is 25 years of age. If there is found to be guests under the age of 25 without the responsible party present, this shall be means for immediate eviction and no refund of monies paid will be returned. This is not a party house and Management will not tolerate underaged minors to gather. 27. Guests acknowledges that Management does maintain exterior security cameras on the property for the safety and security of the property and our guests. No exterior cameras are focused on any area where one would expect any level of privacy, including hot tub. The use of cameras is strictly for safety and security purposes. There are no interior cameras. 28. We provide a gas grill that uses propane. We provide propane tanks. Do NOT use charcoal, wood or any other material in the grill. Guest will be responsible for all damages associated with attempting to burn charcoal or wood in our gas grill. 29. Do not attempt to make any repairs to any appliances, light fixtures or other electronics or furnishings. Please contact management should you notice something that may need repairs. Do not disassemble any appliances or electronics. We replace batteries in all electronic door locks, remotes, smoke detectors every 3 months. Should the battery in a remote for the tv go out, there are extra batteries located in the cupboard above the microwave. 30. Please leave doors and windows shut to minimize the presence of insects inside the house. Don’t leave drinks and food outside unattended as this attracts bugs, insects, and animals. Management is not responsible for bugs entering home during your stay. Management has a regular contract with pest service in place. Please be aware that there is a likelihood that you may encounter wildlife during your stay. Management is not responsible for encounters with wildlife, and no refunds will be issued due to wildlife encounters. Please let us know of any perceived wildlife threats and we will do our best to have them addressed. 31. Pollen season leaves a coating of yellow pollen on everything outside. The patios and outdoor furniture will be blown off and cleaned prior to your arrival. However, pollen accumulates fast! Management is not responsible for pollen on outdoor furniture and patios. We leave a blower and broom for your use, should you need it. 32. Please do not take cabin towels off-site to other activities. You will be charged for lost or damaged towels and linens. $10 - $50/depending on item. We suggest you pack extra towels for activities outside of staying at our cabin like going to the river, pool, or picnics. 33. Guests will not add anything to the hot tub water, except sanitizing granules (Hot Tub Shock) provided by the owner. Hot tub water is serviced between each guests’ stay. NO bubble bath or bath salts in the hot tub. No glass in or around the hot tub. Please do not sit, stand, or lay on hot tub cover. Guests will be responsible for repairs to hot tub and cover if mis-used. Please cover hot tub every night when you’re finished. All children under the age of 14 must be accompanied by an adult in the hot tub. Please be careful when entering the cabin with wet feet as the floor is very slippery and you can fall. The safety of our guests is our highest concern. Please stay aware of children playing near the hot tub, and instruct them to stay away unless accompanied by an adult. There are rules pertaining to hot tub use posted on the wall next to the hot tub. Please read and respect these rules. 34. Sauna is provided for the enjoyment of our guests. Guest agrees to follow all posted safety rules including supervision of minors around the sauna area. Please do not permit children to play in or on the sauna. Do not use if you have any physical condition that would make use unsafe. Please keep the door closed and latched, as potential winds could cause breakage. By agreeing to the property rental, Guest acknowledges risk of sauna use, confirms they will follow all posted rules, and agrees to hold host free from any liability for injuries or illness incurred while using the sauna. Rules pertaining to the sauna are posted on the sauna and in the Guest Book. Please read and respect these rules. Cold Plunge will only be available from April through October. Please use only for its intended purpose. Please do not permit children to play in or on the Cold Plunge unit. Please read and respect all posted rules regarding use of the Cold Plunge. 35. Cancellations: If for any reason you need to cancel your reservation, please note the refund structure cited in Airbnb. 36. RV Hookups & Tent Camping is prohibited per County Regulations. A pup tent for kids play is ok. 37. Maintenance issues: we cannot guarantee against encountering problems at the cabin. Please report all non-emergency requests between 9 AM – 4 PM for same day response (exception holidays). We will make every reasonable effort to address the issue. Please call anytime with an emergency. Emergency numbers are listed in Guest Book. If your non-emergency can wait until business hours, it would be greatly appreciated! 38. Upon entering the home, if you find something wrong or unsatisfactory, please notify Management as soon as possible. We want your stay to be enjoyable, so let us know of any issues we can help with. 39. Our bunk room is designed to be a fun area for kids to enjoy, but please understand the inherent risk of sleeping in bunk beds. Please assist children while using these amenities as needed. We want them to have fun AND be safe! • Do not have small children (under 6) sleep in top bunk bed • We have provided a night light in the room; please leave it on for safety purposes • Please ensure any belts, scarves, ropes etc. are removed from the sleeping area as those could provide a strangulation hazard • Weight limit on top bunk is 150 pounds; only ground bunks are suitable for adults or children over 150 pounds 40. Game Room: Please do not move pop-a-shot, table, foosball, shuffle board, or video arcades. Do not sit or stand on any of these amenities. Please do not remove any wall mounted games. Please return all game pieces to their appropriate location. Please notify us of any missing or broken items/pieces. **Please do not set beverages or food on any gaming amenities** 41. Clean out dryer filter after each use to prevent fire. 42. Do not touch septic equipment located on property. Please do not flush any products other than the toilet paper provided by management. Please be careful about what you put in the garbage disposal as the septic system is very sensitive. Thank you! 43. Bicycles: We provide 4 adult sized bicycles for your use. Do not ride on Pedestrian Only streets in town. Please lock bikes with the locks we provide. Do not misuse bicycles. Any damage over normal wear will result in a fine of $100 per bike. We do not provide helmets as it is difficult to ensure sanitization. You will be responsible to bring your own helmets. Management will not be held liable for any injury incurred while using bicycles. Please ride with caution. 44. Home Gym: Please consult your physician before starting any exercise program. Management shall not be held liable for any injury resulting from using any of the gym equipment. Please be careful to keep weights under control and do not drop or slam on ground. Please do not allow children under the age of 16 to use exercise equipment without adult supervision. Please treat equipment with respect and wipe down after each use with provided wipes. 45. Snow and Ice: During winter months snow and ice will be present. We contract with a snow removal company that services the property regularly. However, it is still prudent to exercise extreme caution on snowy/icy surfaces. If there is a problem area, we provide extra bags of icemelt in the white cabinet in the garage. We recommend entering and exiting the house through the door on the ground floor (laundry/mud room) as an extra precaution as exterior steps may be icy. Management shall not be held liable for any injuries sustained from falling on slippery surfaces. By booking a stay at Alpine JAKs Guests agree to abide by the above conditions. STR License #000586
