Guest access ☀ Check In Time : 4:00 PM ☀ Check Out Time : 10:00 AM Make yourself at home! Guests have full access to the entire house, carport and pool. Other things to note ☀ Pool is open year round and has a gas heater that can be used to heat the pool upon request. There is an additional charge of $200 per day required to heat the pool. Guests must let us know at least 2 days prior to check in if they would like to pool to be heated and have the pool heat fee added. The heater is set at 88 degrees when being heated. Please note that although 88 degrees is very warm, it is not hot tub temperatures (99-102 degrees). ☀ We use a fantastic house cleaning company that provides clean bedding, towels/wash cloths, and a starter kit for each new guest that includes 1 use of the following items to get you started for your trip: Dishwasher soap, liquid dish soap, paper towels, toilet paper, trash bags and laundry detergent. *RENTAL AGREEMENT DETAILS** By acceptance and execution or capture of initial payment herein, Lessee agrees to be bound to the terms and conditions herein, on behalf of Lessee and as Agent for all members of Lessee’s collective party. This Agreement applies to all members of the Lessee’s party, regardless of age, relationship or affiliation with Lessee. Lessee acknowledges that Lessee is responsible for sharing these Terms and Conditions and the requirements therein with all members of Lessee’s party and anyone else permitted onto the property by Lessee. INITIAL PAYMENT: An initial payment of 20%, 50% or 100% of the rental balance (rent, fees, taxes) is due immediately upon booking depending on your chosen booking platform. If booking through a 3rd party booking channel, any service fee will also be due immediately upon booking. PAYMENT BALANCE: The BALANCE OF RENT is due at least thirty (30) calendar days before your arrival date. NON-PAYMENT: No reservation is confirmed until the Initial Payment is received. Any balance payment not received thirty (30) days prior to the scheduled arrival date may be canceled at any time by Lessor. If canceled due to non-payment, no refund of Initial Payment will be provided to Lessee. DAMAGE FEES & EVICTION: Lessee will be charged by Lessor for any damages to property and/or its contents, including anything missing upon Lessee’s departure. It is the Lessee’s responsibility to report any damages upon check-in, if not properly done, Lessee may be charged for damage. The following provisions must be met to avoid damage charges: a. No early check-in or late check-out is permitted unless agreed upon by both parties. Entering the property before 4 p.m. on arrival day and departing after 10 a.m. on departure day without prior approval will result in a $100/15 minute charge. In general, Lessor does not allow early check in or late check out, and may withhold approval in its sole discretion. b. No damage is done to property or its contents and no contents from the property are missing. Items on the property are inventoried after each stay including pillows, linens, remote controls, furniture, pots, and pans, etc. Do not rearrange the furniture. Any special appliances must be provided by Lessee and removed upon departure. Any furniture found rearranged may incur extra charges to the Lessee. c. SMOKING: No smoking is allowed on the property, inside or outside. Evidence of smoking anywhere on the property will cause forfeiture of rent and immediate eviction from the property. Additional charges will be incurred for any damage to the property or its contents, and an additional cleaning fee of up to $1500. d. PETS: Pets are not permitted on the property under any conditions. Evidence of a pet on the property will result in forfeiture of rent, deposit, and immediate eviction from property. Additionally, Lessee will be charged a $500 fee for a steam cleaning of the property. e. All debris, rubbish, and discards are placed in the trash and soiled dishes are placed in the dishwasher and cleaned. If housekeeping finds the property to be left excessively dirty Lessee will incur charges for the additional cleaning time at a rate of $100/hour. f. The house is to be locked by Lessee upon departure. g. Any and all charges accrued during the stay are paid prior to departure. h. The Lessee is not evicted by the Lessor (or representative of the Lessor), law enforcement, or a security company. i. CABLE RAILING: No cable railing on deck or stairs has been disconnected or removed. Each disconnected cable will incur a $30 charge to the Lessee, where applicable. j. PARKING: All vehicles must be parked in the paved driveway or dedicated parking spaces. If all vehicles do not fit in the driveway, it is the Lessee’s responsibility to find off-site parking. Do not park vehicles on grass, turf, or surrounding landscaping. If vehicles are parked on grass, turf, or surrounding landscaping a $500 fee will be incurred by the Lessee. k. OCCUPANCY: Maximum occupancy for this property is 22 guests. The numbers above include all adults and children of all ages. Violation of this maximum occupancy is grounds for immediate eviction and forfeiture of rent. l. MINIMUM RENTAL AGE: We will not rent to those under thirty (30) years of age, unless accompanied by an adult guardian or parent who is over 30. No house parties are allowed. Any reservation obtained under false pretense will be subject to forfeiture of initial payment, rental money, and the party will not be permitted to check-in or if discovered after check-in, may be evicted immediately. m. EVENTS: Parties, group events, gatherings, and weddings are not permitted unless approved in writing by Lessor. The property is not considered wedding/event friendly, and such use could constitute an unlawful use according to local law. Unapproved events are cause for eviction without refund of rents, fees, or taxes. n. ELEVATOR: Please limit elevator use to elderly or disabled guests and moving of luggage and supplies. Absolutely no horse play is allowed on the elevator at any time. Any service calls determined to be from misconduct of Lessee will be charged directly to Lessee. Please know that the elevator computer keeps an internal record of all activity. Lessor reserves the right to charge Lessee or evict Lessee for reasons not listed above, based on circumstances that may arise. CANCELLATION POLICY: All cancellations must be submitted in writing.. A cancellation is not considered final until Lessor acknowledges cancellation request in writing. Cancellation fees are based on total rental balance including rent, fees, and taxes. Airbnb/VRBO/HomeAway fees are collected by third parties and are subject to their cancellation policies. Lessor is under the belief these are non-refundable. Cancellation charges will be based on the following time frames: Cancellations made less than 24 hours after the booking is accepted will receive a full refund Cancellations made between 24 hours after booking acceptance and 30 days prior to check-in will be receive a 50% refund Cancellations made within 30 days prior to check-in are non-refundable In some rare cases, Lessor may need to cancel a reservation due to property damage, natural disaster, or other unforeseen circumstances. If this happens Lessee will incur no financial loss. In the event of a cancellation by Lessor, Lessor shall not be liable to Lessee for any loss, claim, damages or expenses resulting from the cancellation by Lessor. No refunds will be provided due to power blackouts, water shortage, flooding, snow, construction at adjacent properties, or mandatory evacuations of the area by local, county or state officials due to weather or other potentially dangerous conditions or situations arising from acts of God, nature, or other force majeure. UNFORESEEN DEVELOPMENTS: Lessor’s cancellation policy does not provide refunds for unforeseen developments such as illness, death, weather, or other events which may impact your trip. Purchasing a third-party travel insurance policy to protect against any unforeseen developments is highly recommended. TRAVEL INSURANCE: A travel insurance policy is highly recommended to protect your investment but not required by Lessor. Lessor does not offer travel insurance for purchase, but many third-party options exist including Generali, AAA, AIG Travel Guard, Allianz, etc. Lessor agrees to provide third-party insurer with required information to obtain coverage at Lessee’s request. CHECK-IN: Check-in time is 4:00 PM CST or later on the scheduled arrival date. On a very rare occasion, the cleaning staff may need additional time to ready the home for your stay. We ask for your patience and suggest having alternate plans available in the event additional time is needed. Please do not interrupt or delay the cleaning staff if they are at the house. If the unit is not properly cleaned or anything is damaged, please inform us immediately. Lessee will be charged for damages not properly reported at check in. CHECK-OUT: Check-out time is 10:00 AM CST or before on the scheduled departure date. A $100 per 15-minute fine will be assessed for guests remaining after 10:00 AM CST on the schedule day of departure. Upon departure, please leave the home neat and orderly to avoid additional charges. If housekeeping finds the home has been left excessively dirty, Lessee will be billed for the additional cleaning time at a rate of $100 per hour. Check-out time is 10 AM CST. Any alteration of check-in or check-out time must be approved in writing by Lessor. In general, Lessor does not permit early check-in or late check-out, due to the size of the home. We need to give our cleaning and maintenance teams the full time to prepare for our next guests. KEYS: This property is fitted with a keyless lock system on the front door. You will be provided a code no later than three (3) days prior to your arrival. This code will allow you to access the property during your stay. DOORS: Please keep doors to house locked especially when property is being left vacant. STARTUP SET: A basic complimentary starter set of toiletry items is provided. These items are not replenished during your stay – it is the Lessee’s responsibility to provide toilet paper, paper towels, trash bags, etc. during the stay. POOL: The pool is available for your use 7 AM through 10 PM each day. Please do not use the pool outside of these hours. All children under the age of eighteen (18) must be always supervised by an adult while in or around the pool area. Swimming pools and hot tubs are inherently dangerous and can result in serious injury, drowning, or death. QUIET ENJOYMENT: Lessee and their Guests shall respect the surrounding accommodations and maintain a quiet environment. If you are reported to being disruptive, you may be forced to evacuate and will result in forfeiture of advance payments and loss of security deposit. No loud music or noise after 10:00 PM. NO FIREWORKS. SECURITY: Property is considered to be in a relatively safe location; however, burglaries, theft, and vandalism are always a possibility no matter the location. Lessee is strongly advised to lock all doors and windows at night and when absent from the property. Lessor assumes no liability for theft, damage, vandalism or other loss due to the actions of third parties. MAINTENANCE ISSUES: Report all maintenance issues promptly via text or phone call. Every effort will be made to correct the situation quickly and efficiently; however, no refunds or rate adjustments will be made for mechanical or maintenance issues and/or failures. Lessor tries to keep home in excellent condition, but maintenance issues may occur just as they may in your own well-kept home. Prompt notification provides Lessor the opportunity to correct issues quickly. Working conditions of pool, air conditioners, TV service, internet service, TVs, DVRs, electronics, appliances, elevator, pool heater, etc. are NOT guaranteed. No refunds or rate adjustments will be made for mechanical failures and/or malfunctioning equipment. These amenities are extras provided in addition to the house. Although all attempts will be made to correct the situation, some breakdowns cannot be prevented or repaired during your occupancy. Lessee will be held responsible for the loss of or damages to furnishings, appliances, and other items from the property. BEACH COURTESY: (This section is only applicable to Sea Glass reservations.) Please take a container to clean any debris you create at the beach. Leaving trash or items on the beach is strictly prohibited and may result in personal fines by the City of Gulf Shores. The beach areas above the high tide line are private property. Please do not walk under houses, use their showers, etc. as this is considered trespassing. Please do not leave any belongings on the beach after 8:00 PM. The City of Gulf Shores clears the beaches after 8:00 PM every night and any belongings left on the beach will be disposed of by the city. RISKS: Oceans, swimming pools, elevators, cooking appliances/equipment and areas surrounding the property are inherently dangerous and can result in serious injury, drowning, or death. Children must be supervised at all times. Lessor assumes no responsibility for any accident or injury in connection with such use. Lessee, members of Lessee’s party, or other authorized Persons using the amenities agree to indemnify, defend, save and hold harmless and make no claim against Lessor for or on account of any loss of life, personal injury, or damage to or loss of personal property for and in consideration of the amenities. By renting this property, Lessee assumes all risks and liabilities for any damage done to persons or property, agents, employees, or visitors occasioned by the present or future condition of the premises, both latent and manifest. Lessor is not responsible for accidents or injury to guests or loss of money or valuables of any kind except for injury or loss caused by the intentional acts of Lessor. All rules, laws, and regulations must be strictly observed at all times. LESSOR’S RIGHTS: Lessor reserves the right to refund initial payment, refuse rental, or discontinue occupancy, if, in Lessor’s judgment, Lessee’s occupancy is detrimental to the property. If evicted, all rents and deposits are forfeited. Lessor, or representative of Lessor, reserves the right to enter the premises at any time for the purpose of inspection, repair, maintenance, management, or to show to a prospective buyer. LESSOR’S RESPONSIBILITY: Lessor agrees to provide house in a clean, decent, and sanitary condition on arrival of Lessee. Lessee accepts house as is, and as shown online. Upon arrival, please inspect house and notify Lessor of any immediate problems within two (2) hours of arrival. Any non-immediate problems/issues are to be relayed in a timely manner. Lessee agrees to give Lessor a reasonable amount of time to resolve any problems that may be encountered on arrival at property. On some rare occasions, the house may not be cleaned before your arrival, by inadvertent fault of cleaners. If house is not cleaned with fresh towels and linens upon arrival or if any other immediate problem(s) are found, Lessee agrees to contact Lessor immediately, so Lessor may fix problem(s), as deemed necessary by Lessor and at Lessor's sole discretion. WRITTEN EXCEPTION: Any exceptions to the above-mentioned policies must be approved in writing in advance. By booking this property and/or submitting the initial payment, the lessee read and agrees to all terms and conditions of this agreement in its entirety. The undersigned also acknowledges and agrees to release, indemnify, and hold homeowner, manager and any of their agents, employees, representatives, successors and assigns harmless from and against any damages or other liability as a result of any economic loss, personal injury, loss of life, or damage to or loss of personal property stemming from the undersigned’s and undersigned’s guests’ use of the property and amenities described herein.
