Unique. Stay literally above the water. Unbelievable water views in the largest bay (Lido Bay) in Discovery Bay. Water toys provided, swimming , fishing and other water sports just by stepping out into the backyard. Beach is so close by, you can paddle board to it! See pictures of location. This is a hosted rental property which means that we, the owner, live on the upper level of the house. The lower level is yours with its own front entrance. There is NO Kitchen with cooking provisions. The space Please note: This is a hosted rental property which means that we, the owner, live on the upper level of the house. The entire lower level is yours during your stay, which has it's own front door entrance. There is NO kitchen with cooking provisions; however there is BBQ grill with side burners on the dock. Of all of Discovery Bay, we are 1 of maybe 3 homes, if that, to have the water underneath your feet. We are a quiet family in a quiet neighborhood so no events, loud parties, raves, drugs or other nuisance. This rental isn't for you if you're into those things. This is not a Party House and that's strictly enforced. This waterfront property is unlike any other. Up close water views because you're literally staying above the water. Just stare out and take in the views from the living room with its huge windows. Enjoy both the sunrise and sunset from your living room or just imagine having a romantic diner with a waterfront view. The space: Enjoy the private guest space with stunning panoramic views. OUTDOOR SPACE: Lounge on the dock with water toys and a diving board. Paddle Board around this largest bay or paddle to the beach about 300 yards away. 3-5 Minutes to Fast Water, unlike 40 minutes or more for bays located in the south side. Provided: 2 Inflatable paddle boards with paddles , already inflated, ready to go. 1 hard shell Origami Kayak 1 Row boat 1 Pedal Boat, 5 seater Lounge Floating Dock with Trampoline Floating Mat , 18 ft x 6 ft Pool noodles 2 Hydro Bikes 3 Bicycles Clean stay with ample amenities Guest access You have access to the dock and the lake / Delta, but in case of emergencies we may need to access the dock as well, but we have our own access to the dock so you will not be disturb; but please understand the dock may be shared between us in the unlikely case of emergencies. We understand your privacy is important, so most likely, we would not use the dock unless it's an emergency The pontoon boat is ours and not for use; You may use other water toys that you see ; but please do your best to put them back the way you found it. At arrival, please use the visitor front door entrance which is towards the rear of the house above the water or follow the posted sign. Your last 4 digits of your phone number will be used to open the door locks on the dial pad. Push your 4 digit number ; followed by the # sign. Other things to note You must sign and agree to the rental contract before booking. Before booking, you will be sent a link to download and sign. A copy is below for your reference AirBNB Vacation Rental Agreement We, the Renters (also referred to as “Tenants” and “Guests”) agree to the following: 1) No un-booked and unregistered guests. Violation will be cause for cancellation. This means that you should not bring or invite additional guests over the # of people you stated at the time of booking. The house is arranged for you and the stated # of people at booking for you and your group to enjoy. The # of people in excess are not fair to our price structure and this house isn’t suited for large gatherings, such as wedding venue or birthday bash. It may also violate county code and we may lose our business permit, so we ask that you respect this rule and do not bring additional guests and we reserve the right to charge additional fees for additional visitors. We enforce this rule so please do not violate this rule or you may risk cancellation mid-stay. We have outside cameras that monitors entries / exits and since we live in the house, we obviously know who comes and goes. 2) There is NO Kitchen with cooking provisions. We have purposely disabled the Oven/Cooktop so that there is no cooking provisions in the unit in order to meet the County’s requirements. The county has banned ADU / In-Law-Unit from Short Term Rentals. What constitutes an ADU is a self-sustaining dwelling with cooking, sleeping and bathing provisions. Therefore, the oven has been disabled, and hence it doesn’t constitute a “kitchen” and is no longer categorized as an ADU. If cooking is needed, you may use the BBQ grill since there isn’t a kitchen anymore. 3) PAYMENT DUE - All rental monies are due according to the payment schedule disclosed under "Payment Policy" above on reservation acceptance. 4) CANCELATION will be set by AirBNB. There are NO REFUNDS for EARLY DEPARTURE. 5) STORMS - There are NO REFUNDS for storms or weather conditions, even if a mandatory evacuation is ordered (optional travel insurance is offered for Renters protection or Renter may obtain through a third party. Renter ASSUMES THE RISK). 6) POWER OUTAGES – Should there be an extended electrical outage, planned or unplanned, requiring the guest to vacate the house, a refund for any unused days will be provided to the Renter. The Guest agrees to hold the Owner harmless from any liability for the power outage. 7) CONDITION OF PROPERTY: Owners have, to the best of their ability, given an accurate description of the property and its condition. Guest understands that it is considered as reserved "sight unseen". Our cleaning staff will have cleaned it before your occupancy. All electrical, plumbing and appliances should be in working order. The failures of operation of certain extra amenities, such as TVs, cable, games, water vessels such as kayaks and the likes, or the Internet and Wi-Fi service are not a basis for any refund. Owner will make every effort to have these items repaired but does not guarantee that they will be repaired during Guest’s occupancy. When you arrive, if you find that the house has not been cleaned to normal standards please notify the Owner immediately. We will do our best to have tradesmen attend to the problems but may not be able to fix everything over holidays and weekends. Under no circumstances will any of the rental money be refunded or returned because of the condition of the house. The Guest agrees to hold the Owner harmless from any liability for the condition of the house. 8) CLEANING & REPAIRS: All homes have cleaning included in the total rent. Please note that cleaning does not include dishes & cooking utensils. Guest agrees to keep house, furniture and furnishings in good order. Removing provided appliances, amenities and furnishing without Owner’s written approval shall be deemed a material breach of this Rental Agreement, and is strictly prohibited. Guest is responsible for cost of replacement of any damage to furniture or premises and replacement of missing items. 9) CLEANING & LINEN SERVICE: The home is provided with pillows, linens, blankets, towels, comforters, hand towels & wash cloths including extras located in closets. A cleaning service to clean the house and linens on your departure is included on your invoice. You are responsible for placing all debris, rubbish and discards in plastic bags and transferring them to the trash can. Soiled dishes and cooking utensils are placed in the sink. Linens, blankets, pillows, bedspreads, comforters and towels are provided. It is standard for beds (except Murphy, sofa beds, futon, and inflatable beds are not fully made) to be made for Guests arrival as part of the linen and cleaning service. 10) The home is provided with a starter set of toilet paper & paper towels. Owners do not guarantee that these extra items will always be available, and guests may need to replenish their own paper goods, toiletries, & laundry detergent, etc. 11) ENTRY OF PREMISES: With Guest’s permission, which is hereby given, Owner or Owner’s representative may enter the premises during reasonable daylight hours without securing prior permission from Guest but shall give Guest notice of such entry immediately prior if possible and immediately thereafter. For inventory and maintenance purposes a property management employee of the Owner may need to enter the premises. The same permission procedure applies as above. In any emergency, Owner or Owner’s servicing agents may enter the premises at any time without permission of Guest for the purposes of making repairs to alleviate such emergency. If Guest abandons or vacates premises, Owner may, at his option, terminate this agreement, re-enter the premises and remove all Guest's property. 12) ACCIDENTAL DAMAGE INSURANCE - Renters will be completely responsible for any and all damage to the home or property caused by Renters, whether accidental or due to Renter’s negligence. 13) USE OF EXTRAS – We provide a few beach towels and a 4 beach chairs. Renters will furnish their own beach towels, beach chairs and beach shades (EZUPs, umbrellas, etc.) if additional items like these are needed and we are not obligated to provide them. It’s a courtesy that we have provided. The beach chairs are in the bedroom closet. Any unused beds will be left as found. Leave used beds unmade and used towels in the hamper which is in the laundry room. Wet towels should be hanged dried in the shower with the hooks provided or somewhere in which water will not damage surface or dried in the dryer and after which, it should be placed in the hamper of soiled laundry. 14) ASSUMPTION OF RISK: No lifeguard may be on duty. Accordingly, persons using the delta / body of water do so at their own risk and the owner assume no responsibility for accident or injury. No one should swim alone. Renters will hold the Owners harmless from any and all bodily injury and/or property damage incurred on the property arising out of Renters' negligent acts or omissions. Being surrounded by water is inherently dangerous so please put safety on top of mind. A waterfront property may have slippery surfaces; especially when wet and it has uneven surfaces due to the nature of floating platforms so please watch your steps and maintain balance and awareness at all times. Knowing how to swim is essential, but nonetheless, the water of the delta is dark so if a person falls in and goes under; you may not see them in the dark waters; regardless of swimming abilities. Life jackets are provided and located on the dock; it's either hanging or in the dock box. Use life jackets at all times to prevent drowning. See disclaimer below. 15) CHILD PROOFING: Guest understands that no special efforts have been made to “childproof” this house, and accept the risk or harm to any children we allow on the property. These risks are not limited to, but include access to the delta, adjacent street, cleaning supplies in the house and plants in the house, patio and on the street, that might be poisonous if ingested. 16) FURNITURE: All furniture must be returned to its original location on Guest's departure or an additional charge will be made. 17) MISSING ITEMS - Renters will be charged for any missing items reasonably attributable to Renters and not returned after notification. The cleaning service performs an inventory/survey of the property after Guests depart and notifies the Owner of any missing items. Owner will notify guests in the event that items were inadvertently taken, and provide guests the opportunity to return the missing items. 18) USE OF SECURITY CAMERAS - Renters understand and accept that the property is protected with outside security cameras. These cameras are used to protect the property from potential break-ins and theft. There are NO cameras inside the house. 19) PERSONAL PROPERTY: Guest understands that any personal property of and used by Guest is not insured by Owner and Owner shall not be responsible for any lost, stolen or missing property of the Guest or property of Guest left after check-out. 20) KEYS - Lost keys / card access will incur replacement costs of $25 per key. 21) DELTA CONDITION: Guest understands that Owner has no control over the condition of the delta and cannot be held liable for any changes to the delta conditions or any closing as ordered by any official agency. We can’t control natural factors such as tide changes, water quality, wind, etc. that may affect your swimming plans or other planned outdoor activities. 22) NO PARTIES - This is not a party house. The Renter must be 21 years of age to book this Vacation Rental. Any special occasions such as weddings, receptions, family reunions or increase of occupants (guests not registered on registration form, regardless of whether they stay overnight or not; in short; any visitors of our guest which is not known or approved by the owner is NOT allowed) must be disclosed at the time the reservation is made and is subject to Owner's advanced approval. Prom parties, fraternity or sorority parties and graduation parties are not allowed at any time. Adults cannot rent property on behalf of underage guests, no exception. 23) NON-SMOKING - This is a NON SMOKING (VAPING, cannabis, etc) vacation rental. Evidence of smoking, such as the smell of cigarette or cigar smoke inside the home by the cleaning crew is sufficient basis to charge the renter for smoke cleanup and removal from carpeting and furniture. This type of cleanup is expensive and Renter is Liable for the deep cleaning costs incurred. A fee of $500 will be deducted from the damage deposit. 24) NO PETS ALLOWED. Unless made an exception in writing by the owner, no pets are allowed. If you bring a pet(s), this rental agreement will be forfeited, terminated and deposits will be retained and a deep cleaning fee of $500 will apply. No pets please as we have a very severe allergy to dog and cat dander that has led to many emergency room visits. Please do not "sneak" in pets as this is our home and I want to be able to use it (without health issues) when we occupy the space and not renting it to guests. 25) MAXIMUM OCCUPANCY - is 6 per Contra Costa County ordinance. 2 per bedroom plus 2 additional person. Children under the age of 12 are not counted towards the total number of guests 26) PARKING / BOAT PARKING – Parking is limited to two (2) vehicles. The driveway can accommodate one vehicle which must be parked in the middle of the driveway of a 3 car garage and the remainder may park on the street. Do not park any vehicles or trailers that extends beyond the driveway property line. Parking is only for passenger vehicles, no commercial vehicles / trailers / RV. If you car has an oil leak, please only park on the public street; do not park on the driveway. Boat Parking is only allowed for Boat Owners. Please no boats or boat parking if you are renting your boat. There is space for 1 boat on the dock. Please send your Boater’s Card for verification. 27) CONTRA COSTA COUNTY SHORT TERM RENTAL RULES - The Guest agrees to abide by the ordinance set by the county. The link to the PDF can be obtain at by searching for Contra Costa County Short Term Rental Ordinance. 28) SUBLETTING: Guest is not authorized to let or sublet all or any part of the premises nor assign the lease or any interest in it without the prior written consent of the Owner. 29) WEAPONS: No weapons of any kind are allowed on premise. If you are a CCW (Concealed Carry Weapon ) holder or a police officer, we ask that you leave your weapon(s) locked in your vehicle. In summary, no person shall bring any weapon(s) onto the premise. 30) BITCOIN: No mining of any bitcoin or any crypto currencies. Doing any activities such as mining or anything else that consumes excessive electricity usage beyond a reasonable manner will cause for immediate cancellation and ejection without refund. 31) CHECK-IN & CHECKOUT - Check-in is at 4:00 PM unless otherwise noted on the booking platform and checkout is 11:00 AM. A late checkout is subject to extra rental charges at the rate of $100/hour after a grace period of 30 minutes. Guests may arrange for extra nights in advance to avoid any late checkout fees. Extra nights are charged at the daily rate and may be granted if available. If Guests are not present when cleaning crews arrive and have left their possessions in the house, cleaning crews will collect their possessions and remove them from the premises in order to prepare the unit for incoming guests and Guest will be charged $150 for this service. PLEASE checkout promptly, the cleaning crews have a very short time window to prepare the unit for new guests. 32) CHECK-OUT PROCEDURES - Renters are responsible to complete the check-out procedures in the provided guest package that includes a check out list and to insure that the keys are placed back next to the Welcome Guide binder and the home is vacated. 33) HOLDING OVER: Because of the nature of Owner's business (short term vacation rentals) Guest understands, and is hereby put on notice that any unauthorized "holding over" of the property past the stated rental period could severely jeopardize Owners business and cause loss of rental income from other previously booked guests, temporary and/or permanent loss of business, goodwill and reputation and, among other things, could force Owner to breach an agreement with similar short term summer and winter recreational Guest(s) who may have reservations during Guest's unauthorized "holding over" period. In the event, Owner may be legally liable in damages to said other guests. Guests should be aware that unauthorized "holding over" has been construed as a factor in establishing "malicious continuing occupation" of rental property, which may entitle Owner to treble damages in any unlawful detained action. Guest also recognizes the unauthorized "holding over" could be grounds in court as a cause of action for intentionally interfering with Owner’s prospective business advantage. In addition, we will charge $100.00 an hour past 11:30 a.m. on day of check out. 34) RELATIONSHIP OF PARTIES: It is specifically agreed and understood that the relationship between the parties herein shall be deemed to be of proprietor and lodger or Guest as opposed to a relationship of landlord/tenant. Guest specifically waives and make inapplicable to this lodging the provisions of California landlord/tenant Law. Guests staying beyond the duration of the booked stay will be considered trespassing / trespassed. 35) REMEDIES: In the event of a default to the Rental Agreement, particularly, but not limited to Guests unauthorized "holding over" or those acts mentioned above in this agreement, and in addition to all other rights and remedies Owner may have at law, Owner shall have the option, upon written notice or as the Law may hereinafter provide, Owner may immediately re-enter and remove all persons and property from premises. In such an instance, the Rental Agreement will be terminated, and Owner shall be entitled to otherwise recover all damages allowable under the Law. The Guest, as part of the considerations of this special rental, in recognition that this property is booked in advance by other Guests throughout the year, hereby waives all claims for damages that might be caused by Owner; re-entry and taking possession of premises or removing or storing property as herein provided, and will hold Owner harmless from loss, costs and damages occasioned thereof, and no such re-entry shall be considered or construed to be a forcible entry as defined in the California Code of Civil Procedure or other similar statutory provisions. Further, if for any reason Owner is unable to deliver possession of the premises to Guest at the commencement of the term specified in the Rental Agreement, Owner shall refund amounts paid by Guest, but shall not be liable for any other damages caused thereby. 36) ATTORNEYS FEE/DEFAULT: If any legal action or proceeding (including default, non- payments, etc.) arising out of or related to this Rental Agreement is brought by either party to this Rental Agreement, the prevailing party shall be entitled to receive from the other party, in addition to all other relief that may be granted, the reasonable attorney's fees, costs and expenses incurred in the action or proceeding by the prevailing party. 37) INDEMNIFICATION: Guest agrees to indemnify and hold harmless Owner for any liability arising before termination of this Rental Agreement for personal injuries or property damage caused by the negligent, willful or intentional conduct of Guest(s). This indemnification agreement does not waive Owner's duty of care to prevent personal injury or property damage when that duty is imposed by law. 38) PRIOR AGREEMENTS: No prior agreement or understanding not contained in writing herein shall be effective. Furthermore, Owner, other than what is specifically written and set forth herein, makes no other or further representation regarding the nature, character and quality of the premises to be rented, and no representation shall be deemed to exist or be material unless and until it is reduced to a writing and signed by the parties. This Rental Agreement may be modified in writing only and must be signed by the parties in interest at the time of the modification. It constitutes the entire agreement of the parties. If any provision in this contract held by any court to be invalid, void or unenforceable, the remaining provisions shall nevertheless continue in full force. 39) FORUM SELECTION, JURISDICTION, LAW AND VENUE– The parties agree to the exclusive jurisdiction and venue of the District Court of the State of California for Contra Costa County for the resolution of all disputes arising under this Agreement. The sole and exclusive venue (i.e. place where lawsuit may be filed) for any legal proceedings shall be in the Contra Costa County, California. Guest expressly waives any other right or privilege with respect to the election of venue or court (i.e. state or federal) and location of the venue of action. GOVERNING LAW – It is expressly agreed that this Agreement shall be governed and construed by the laws of the State of California only, irrespective of the state of residency of Guest. 40) HOUSE RULES: a. As mentioned in the Property Listing, the dock is a shared space and we may need to use it at times to access our boat and the waters, but you will not be disturbed as we do not need to use the door on the gangway as we have our own access to the dock. During your stay, it’s doubtful if we would use the Dock and would only use it in an emergency. We will try to keep our access limited during your stay as we are conscious of your space and privacy. Other than the dock, nothing else is shared and you have your own “in-law” living quarters. c. Fishing: It's best to catch and release. Do not bring fish into the house. No cleaning or gutting of fish at any time. If you wish to keep the fish, you should keep it in a iced cooler; preferably on the last day of your stay. d. Swimming: Beach towels are provided, please use them if you are swimming to dry yourself on the dock before you enter the house to not track water inside the house. e. DO NOT use our pontoon boat unless it was arranged ahead of time. You may use the pedal boat. The Fireplace is for aesthetics only, please do not use. f. Please no food / drinks at the Arcade station. Only those that are 7 years and older may use the Arcade g. No running, jumping or horseplaying in the house. The house is built on pilings and not concrete foundation so the sounds and vibrations reverberates easily. You can jump to your heart’s content on the diving board and water toys. Disclaimer: Renters understand that the Homeowners are not responsible for any personal injury caused by slipping on wet pavement or surfaces, and that tenants are responsible for exercising care when surfaces are wet or slippery due to weather or use of hoses to wash down areas, and further, that the homeowners are not responsible for any personal injury or loss or damage to tenants’ property caused directly or indirectly from foul, inclement weather conditions, Acts of God or nature, failure of heat, accidents related to fire, heaters, stoves, tenants’ failure to take adequate precautions around wet areas, or any unforeseeable circumstances. If Guests and their parties decides to participate in any extra excursion or activities that may be offered by the host as a courtesy, they must sign a waiver before participating in those activities and hold Owners harmless in said activities. Under no circumstances will Tenants or their guests hold the Owners of the Vacation Rental responsible for any damages or claims of any kind resulting from their stay, except for intentional acts of harm. This agreement and disclaimer applies to Renters and all guests in the Renters’ party.
