4x4 required. Perfect for 2 in a cozy cabin under the live oaks. This retreat gives you a peaceful feeling of being in nature. Shared access to pool, grill, hottub makes the house an amazing place to come enjoy the beach. We are a 8 minute walk to the ocean or drive out to it and enjoy your day. T Signed contract required--please see Other Details to note for the detailed contract terms The space The property is on 10 acres. Rocky's Recluse is approximately 450 SF. We are in nature. There are birds, bugs, snakes in the wild….. We are in the off road—there are no paved roads-so you have to drive on the beach to get to the house. We are 7.5 miles from the paved road. 4x4 vehicle is necessary to access the property. Beach parking permit provided for your stay. We require a signed contract before you stay. Our house is on site-and you have privacy Guest access The pool and hottub are next to the main house and can be seen in the photo of the property. We share that with you and try to establish times when you can use it privately, and same here. We also will let you use the pool house that has an oven and stove so you can cook a nice meal as the cabin is set up with a kitchenette. And of course we have an outdoor grill If it is working, you are free to grab some ice from our ice machine Your cabin has a king size bed, TV, nice shower, loveseat, refrigerator, microwave, mini oven. Property is 10 acres with SHARED hottub, pool (may-sept)--we can coordinate times so you can have privacy and us too. Access to SHARED outdoor grill and a full stove and oven in SHARED pool house available. Other things to note We are in the offroad which does not have road access. You have to drive on the beach to get to the home. There are sand roads behind the dunes, but they do not connect to the main road. We are several miles up the beach. Happy to give pointers and help you out if it is your first time on the sand. 4x4 vehicle is required. a AWD can work, if the tires are aired down and you have good clearance. We ask you sign a contract upon arrival (or I can send via email prior). Here are the terms. These are the rental contract terms and a signed contract is required upon arrival (or before If I can figure out how to attach it!) Vacation Rental Agreement The Shack at Hidden Oak Estate 1. This Short Term Rental Agreement (the “Agreement”) is made by and between owner of Hidden Oak Estate and The Shack (“Owner”), its property management firm Lynx International Ltd. (“Agent”) and _________ (name) of __________(address) verified through the Airbnb platform (“Tenant”, used interchangeably with “You” and “Your”) as of the date last set forth on the signature page of this Agreement. For good and valuable consideration, the sufficiency of which is acknowledged, the parties hereby agree as follows. 2. Owner hereby rents to You (e.g. tenant) and You (e.g. tenant) hereby rent from Owner, the Premises in accordance with the terms and conditions contained in this Agreement, including, but not limited to, the time period during which You are entitled to use the Premises, check-in and check-out times, payment of the rental amount and other fees, and all rental rules including attachments. In the event that any term of this Agreement varies from any term set forth in the Shack platform pages (including, but not limited to, the rental amount) or other correspondence, the terms specified in this Agreement shall govern absent written confirmation of a change. 3. Property: The property is located at 406 Bratten Way, Corolla, North Carolina—the Property is located in the 4WD area and access requires a 4WD vehicle. The property includes a main house and the Shack. The owner, its family and guests may be at the main house during your stay. The Shack is a furnished studio that includes a King bed, TV, loveseat, bath and kitchenette with a mini fridge, microwave, coffee maker, and small “oven”. The Shack is in the forest and as such it does not have a full kitchen due to fire risk, in addition smoking is not allowed nor open flames. The tenant can use the main house grill and may make arrangements with the owner if additional requests can be met. The property comes with bedding, two sets of towels (including a bath towel, hand towel, and face cloth, dish towel, glasses/silverware/plates, etc. For short stays (3 nights or less) toilet paper, paper towels, are included. Beach towels and personal care products are not provided. The property includes a pool that can be used by tenant and guest upon the condition that they assume all responsibility and hold the owner and property management harmless for any injury at the pool or hottub. The owner requests that the tenant and guest text owner when they are heading to the pool or would like to use the pool text or call my number so that as much privacy can be offered to both. There may be times with the tenant and guest both are using the pool at the same time as the owner and guests. 4. Rental Party: The rental party shall consist of Taylor Bloom and guest. All members of the rental party and guest of the tenant shall follow the terms of this agreement, to include the rental rules (attachment A) and signs placed at the property (such as by the swimming pool) all of which are an integral part of this agreement. All guests of the tenant staying in the property will be asked to sign the attachment rental rules upon arrival. 5. Maximum Occupancy: The maximum number of guests is limited to 2 persons. 6. CHECK-IN/CHECK-OUT: You agree that check-in time is no earlier than 4:00 PM on _________(date) no earlier than 4PM (unless prior arrangements have been made and agreed to in writing) and check-out time is no later than 10AM on __________(date). Agent will use commercially reasonable efforts to have the Premises ready for Your occupancy at check-in time, but Agent cannot guarantee the exact time of occupancy. In the event You return to the Premises without the consent of the Agent after turning in the keys and checking out, a fee equal to the rental rate for one (1) day will be assessed to You.   7. Rental Rate and Fees. The rental fees are paid to Airbnb or VRBO. These services take out a service fee and handle all taxes and payments of taxes and reporting to the authorities. Tenant agrees to pay for any damages to the property that are due to the tenant or tenant’s guests. 8. IMPORTANT DISCLOSURES: (a) The premises has a private well. Homes with private wells occasionally experience low pressure, salty, distasteful or discolored water. There may be an unpleasant odor of sulfur. Some guests choose to use bottled water for drinking purposes even though the water is potable. (b) Occasionally, some pools in Dare & Currituck Counties may experience a mild ground current. Generally, this is not caused by a pool defect or the household electrical system, but appears as a result of the earth’s own natural electrical current. The current tends to be intermittent in nature. Please be advised, however, that this may affect the operation of pace makers and other similar devices; (c) Due to the possibility of accident or injury, Agent and owner prohibits children from using the hot tub. Also, the chemicals used to keep hot tubs sanitary may cause fading in some swimsuits and some individuals may experience mild skin rashes. For your safety, chemical dispensers shall not be removed at anytime; (d) The home is located on a 10 acre lot with adjacent 10 acre lots—the grounds are wooded and have various natural features---wetlands, mud, puddles (especially with rain and the location of these puddles varies), and various wild plants (including poison oak). Agent discloses that there may be snakes, including poisonous snakes, wild horses, wild feral pigs, ticks, and other wild animals. These animals can be dangerous. Children should not be left to roam the property without adult supervision. If doors are left open these animals may enter the property. If you decide to explore the grounds you do so at your own risk and will hold harmless Agent and owner. You will also hold harmless agent and owner if an animal gains entry into the property; (e) the swimming pool does not have a diving end and diving and horseplay are prohibited. There are no lifeguards and swimming or use of the pool and pool area is at your own risk. Additional pool rules are posted by the pool—children should not be unattended in the swimming pool at any time; (f) the Currituck Wild Horses roam the property often walking down the driveway and graze on the grass beside the home. The Wild Horses are protected by ordinances in the county—and are the State Horse of North Carolina. Rules and regulations concerning the Wild Horses will be part of the information package provided to You. Please do not feed the horses, attempt to pet the horses, or try to approach the wild horses. They can be dangerous, especially to children; (g) The property is treated by Outer Banks Pest Control on a quarterly basis. Please be advised that leaving the windows or doors open will invite in a significant amount of bugs. Agent is not responsible for controlling the bugs that might be let into the premise by your actions. Please also keep the garage door closed, to ensure that bugs and wild animals do not enter the home. (h) Dogs and cats are not allowed in the home, pool house, or garage; (i) the home is accessible only by 4WD vehicle. All cars are required to drive on the beach to access the home—there are no roads behind the dunes that enable you to drive from the paved road to the house. Rules on beach driving are covered by Currituck County Ordinances, and are provided in the information package. The tides change as does the beach on a daily basis. A tide chart is in the home and should be consulted on the best times to go up and down the beach. At times of high tide or storms, the beach can be impassable. (j) since the Shack is in the woods, smoking on the decks is prohibited. Open flames are also prohibited and the grill provided on the cement may be used by guests. 9. Use and Tenant Duties. The use of the Premises is restricted to use by You and Your family, unless both parties agree in writing to occupancy by a non-family group or for a special event. Agent considers You hosting a special event without Agent’s prior consent or knowledge a material breach of this Agreement. In that instance, You agree to immediately pay an amount equal to the Special Event Fee in liquidated damages. You should contact Agent directly for more information. A “family” as used herein means parents, grandparents, children and extended family members vacationing at the Premises. Use Of the Premises by Fraternities, Sororities or Unrelated Groups Under 24 Years of Age Is Strictly Prohibited and Lessee agrees that, in the event Owner or Agent discovers same, that ANY AND ALL FUNDS COLLECTED AS RENT will be considered LIQUIDATED DAMAGES to cover losses, expenses and damages of the Owner and Agent for Lessee taking the premises off the market. Occupancy shall not exceed the maximum number allowable by law. You agree to comply with all obligations imposed on you by the Vacation Rental Act with respect to maintenance of the Premises, including but not limited to, the following: (a) keep the Premises as clean and safe as the conditions of the Premises permit, and cause no unsafe or unsanitary conditions in the common areas and remainder of the Premises that You use; (b) dispose of all ashes, rubbish, garbage, and other waste in a clean and safe manner; (c) keep all plumbing fixtures in the Premises or used by the Tenant as clean as their condition permits; (d) not deliberately or negligently destroy, deface, damage, or remove any part of the Premises or render inoperable the smoke detector provided by the Owner, or knowingly permit any person to do so; (e) comply with all obligations imposed upon the Tenant by current applicable building and housing codes; (f) be responsible for all damage, defacement, or removal of any property inside the Premises that is in Your exclusive control unless the damage, defacement, or removal was due to ordinary wear and tear, acts of the Owner or Owner’s agent, defective products supplied or repairs authorized by the Owner, acts of third parties not invitees of the Tenant, or natural forces; (g) not move any of the furniture in the home; and (h) notify Agent in writing of the need of replacement of and/or repairs to a smoke detector, and replacing the batteries as needed during the tenancy. You agree not to use the Premises for any activity or purpose that violates any criminal law or governmental regulation. Your breach of any duty contained in this paragraph after commencement of tenancy shall be considered material, and shall result in the termination of Your tenancy with NO REFUND OF RENT. 10. Agent Duties. Agent agrees to provide the Premises to You in a fit and habitable condition. If, at the time of occupancy, Agent cannot provide the Premises in a fit and habitable condition or reasonably cure same or substitute a reasonably comparable property in such condition, then Agent shall refund to You all payments made by You. In the case of a cure wherein the Premises sustains a failure of a system or amenity, manner, (at the time of or during the tenancy) including, but not limited to, water, sewer, septic, heating, electrical, mechanical, ventilating, structural systems, pool, hot tub, whirlpool tub, entertainment equipment, Internet or Internet access or other facilities or major appliances, Agent shall promptly repair in a commercially reasonable manner and time such system or amenity upon receipt of written notification from You that repairs are needed. You agree to permit Agent or its service staff to have reasonable access to the Premises to inspect and make such repair in a commercially reasonable manner and time. Neither Owner nor Agent shall be liable to You in damages and no refunds will be given for such temporary failure, provided the Agent is causing the system or amenity to be repaired in a commercially reasonable manner after having received written notification from You that repairs are needed. If the repair is not possible, Agent may offer you alternative lodging. 11 Acts of God/Construction Noise. Neither Owner nor Agent shall be liable for events beyond their control which may interfere with Your scheduled occupancy, including but not limited to Acts of God, acts of governmental agencies, fire, strikes, terrorism, war, inclement weather, including flooding and construction noise from nearby sites. Please be advised that at times of high wind and high tide, the beach can be impassable. A tide chart is located at the home and you should pay attention to the tides in order to be able to use the beach as the main road to and from the home. NO REBATE OR REFUND will be offered in these circumstances. 12. Insurance/Mandatory Evacuation. You may elect to purchase a policy for Travel Insurance, the selection of which is totally your decision. Subject to the terms, conditions and limitations contained in the policy, policies can provide insurance for trip cancellation, trip interruption and trip delay, emergency medical, baggage delay and loss, car rental collision coverage and assistance services.. Please note that the terms of the policy define the coverage. This Agreement is not intended to serve as a substitute for the policy or to define any of the policy terms or provisions. If State or local authorities order a mandatory evacuation of an area that includes the Premises, You shall comply with the order and a travel insurance policy can cover you in these instances. All questions concerning claims should be directed to the travel insurance company. You will not be entitled to a refund from Agent or Owner. Possible travel insurance options will be provided to Tenant upon request to the owner. This will be a courtesy to You by the Agent and owner, and does not represent any responsibility on the part of the Agent for the policy. 13. Expedited Eviction. A material breach of this Agreement by You, which, in the sole determination of the Agent, results in damage to the Premises, personal injury to You or others, a breach of the peace, a nuisance to others, or a violation of criminal law or local code, shall be grounds for termination of Your tenancy. If the tenancy created hereunder is for 30 days or less, the expedited eviction procedures set forth in the Vacation Rental Act will apply. You may be evicted under such procedures if You: (i) hold over in possession after Your tenancy has expired; (ii) commit a material breach of any provision of this Agreement that according to its terms would result in the termination of Your tenancy; (iii) fail to pay rent as required by this Agreement, or (iv) have obtained possession of the Premises by fraud or misrepresentation. 14. Indemnification and Hold Harmless. You agree to indemnify and save harmless the Owner and Agent for any liabilities, theft, damage, cost or expense whatsoever arising from or related to any claim or litigation which may arise out of or in connection with Your use and occupancy of the Premises including but not limited to any claim or liability for personal injury or damage or theft of property which is made, incurred or sustained by You. Neither Agent nor Owner is providing any other warranty of any kind, except as otherwise expressly provided herein, whether written or oral, statutory or contractual, express or implied, including, without limitation, THE WARRANTY OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE OR USE, which are hereby expressly excluded. The terms “Agent” and “Owner” as used in this Agreement shall include their heirs, successors in interest, assigns, employees, agents, and representatives where the context requires or permits. The terms “Tenant,” “You,” and “Your” as used in this Agreement shall include Tenant’s heirs, successors, assigns, guests, invitees, representatives and other persons on the Premises during Your occupancy (without regard to whether such persons have authority under this Agreement to be upon the Premises), where the context requires or permits. 15. Right of Entry. You agree that Agent may enter the Premises during reasonable hours to inspect the Premises, to make such repairs, alterations or improvements thereto as Agent may deem appropriate, or to show Premises to prospective tenants. Agent will schedule an inspection mid week of the property and the pool. 16. Assignment. You shall not assign this Agreement or sublet the Premises in whole or part without written permission of Agent. 17. Pets. No pets shall be allowed on the Premises. Your breach of this provision shall be considered material, and shall result in the termination of Your tenancy. You agree to be immediately responsible for any damages proximately caused by Your pet(s) and a $1000 fee will be paid to owner. 18. Disputes: This Agreement shall be governed by and interpreted in accordance with the laws of the State of North Carolina, and the County of Currituck, State of North Carolina. Any action relating to this Agreement shall be instituted and prosecuted only in the Currituck County Superior Court, North Carolina. You specifically consent to such jurisdiction and to extraterritorial service of process. 19. Miscellaneous: This Agreement, together with the attachments referenced herein and attached hereto, constitutes the entire agreement between the parties relating to the subject matter hereof, and supersedes all prior written oral negotiations, representations, or agreements. No modification of this Agreement shall be binding on either party unless it is in writing signed by both parties. Each section, subsection or paragraph of this Agreement shall be deemed severable and if for any reason any portion of this Agreement is unenforceable, invalid or contrary to any existing or future law, such unenforceability or invalidity shall not affect the applicability or validity of any other portion of this Agreement. For all purposes hereunder, facsimile or electronic signatures shall be deemed to be originals and such signatures shall be given the same effect as would an original signature. THE PARTIES ACKNOWLEDGE THAT THEY HAVE READ THIS AGREEMENT, UNDERSTAND IT, AND AGREE TO BE BOUND BY ITS TERMS AND CONDITIONS. 20. THIS IS A VACATION RENTAL AGREEMENT UNDER THE NORTH CAROLINA VACATION RENTAL ACT N.C.G.S 42A. THE RIGHTS AND OBLIGATIONS OF THE PARTIES TO THIS AGREEMENT ARE DEFINED BY LAW AND INCLUDE UNIQUE PROVISIONS PERMITTING THE DISBURSEMENT OF RENT PRIOR TO TENANCY AND EXPEDITED EVICTION OF TENANTS. YOUR SIGNATURE ON THIS AGREEMENT, OR PAYMENT OF MONEY OR TAKING POSSESSION OF THE PROPERTY AFTER RECEIPT OF THE AGREEMENT IS EVIDENCE OF YOUR ACCEPTANCE OF THE AGREEMENT AND YOUR INTENT TO USE THIS PROPERTY FOR A VACATION RENTAL. LYNX INTERNATIONAL, LTD. WILL CONDUCT ALL ITS ACTIVITIES IN REGARD TO THIS AGREEMENT WITHOUT RESPECT TO THE RACE, COLOR, RELIGION, SEX, NATIONAL ORIGIN, AND HANDICAP OR FAMILIAL STATUS OF THE GUEST OR ANY OTHER PARTY TO THIS AGREEMENT. I agree that all rental monies are non-refundable per cancellation policy above and that I have read the suggestion that I purchase travel insurance, as well as all clauses in this agreement and the attachments. The parties agree to the terms of this Vacation Rental Agreement, as evidenced by the signatures set forth below. The signature of the tenant represents their agreement with all the terms and conditions in this Vacation Rental Agreement, including the attachment to the agreement. Attachment A: Rental Rules 1. Smoking is NOT allowed in the home. If you smoke outside please use the sand filled ashtrays to dispose of cigarettes that are by the grill on the cement. Please also note that the area is dry and heavily wooded. The area is prone to wildfires. You will be held responsible for all damages from any action that you take that creates a fire. 2. People other than those in the Tenant party set forth above may not stay overnight in the property. Any person in the property is the sole responsibility of Tenant. 3. Owners are not responsible for any accidents, injuries or illness that occurs while on the premises or its facilities. The Homeowners are not responsible for the loss of personal belongings or valuables of the guest. By accepting this reservation, it is agreed that all guests are expressly assuming the risk of any harm arising from their use of the premises or others whom they invite to use the premise. 4. Keep the property and all furnishings in good order. Please do not move the furniture or take any inside furniture outside. Do not put furniture in the pool. 5. Only use appliances for their intended uses. 6. Pets. Pets are NOT allowed. 7. Parking: Parking is prohibited to the northern side of the house, as this is a septic field and significant damage can occur from parking on the septic field. Vehicles ARE NOT allowed in the wooded areas. 8. Housekeeping. There is no daily housekeeping service. While linens and bath towels are included in the unit, daily maid service is not included in the rental rate. We suggest you bring beach towels. We do not permit towels or linens to be taken from the home. 9. Hot Tub. No children under the age of 18 are permitted in hot tubs at any time. When using the hot tub, remember there is a certain health risk associated with this facility. Use at your own risk. Our housekeepers sanitize, refill and replenish chemicals in all tubs prior to your arrival; therefore, it may not be warm until later that evening. [DO NOT STAND ON THE HOT TUB COVERS}. Hot tub covers are for insulation purposes and are not designed to support a person or persons. They will break and you may be charged for replacement.] Remember when not using the hot tub, leave cover on so hot tub will stay warm. Also secure the hot tub cover as the wind can blow hard at any moment and a loose hot tub cover can result in significant damage. If the hottub is over 104, please do not use it. 10 Water and Septic: The home is on a well and septic systems. The mineral content in the water is high. During a drought, the well water may have an odor. The septic system is very effective; however, it will clog up if improper material is flushed. DO NOT FLUSH anything other than toilet paper. No feminine products should be flushed at anytime. If it is found that feminine products have been flushed and clog the septic system, you could be charged damages of up to $3000. 11. Grills. A grill is provided for tenant use. Tenant and guests are prohibited from using grills on decks, screened in porches, close to the trees—due to fire safety reasons. A grill area has been established to provide a safe environment away from the decks and trees. Please use that area. 12. Fire safety. The home is equipped with smoke detector, fire extinguisher, and fire blanket. Tampering with this equipment is prohibited as these are safety devices provided for our tenants and guests. 13 Grounds. The home is located on a 10 acre lot with adjacent 10 acre lots—the grounds are wooded and have various natural features---wetlands, mud, puddles (especially with rain and the location of these puddles varies), and various wild plants (including poison oak). Agent discloses that there may be snakes, including poisonous snakes, wild horses, wild feral pigs, ticks, and other wild animals. These Hidden Oak Estate for The Shack! Vacation Rental Agreement - animals can be dangerous. Children should not be left to roam the property without adult supervision. If you decide to explore the grounds you do so at your own risk and will hold harmless Agent and owner. Animals may access the house or vehicles—and you hold owner harmless. No vehicles of any kind are allowed on the grounds, outside of the parking and driveway area. 14. Storms: No refunds will be given for storms. 15. TV and internet. A smart TV and internet is provided in the Shack. Owner assumes you have your preferred streaming services. Please use those services. Should you have any questions please text the owner. 16. Decks. Please enjoy the decks. Do not sit on the rails, drag furniture across the decks or move furniture. High winds are normal and often unexpected—so please be sure to secure your personal belongings, and in the case of high winds, take the cushions on the chairs into the home. 17. Windows. In the summer, storms can happen quickly. Please keep all doors and windows closed. And please help protect our wood floors by not letting wet clothes or towels drip on the floor. Repairs to wooden floors will be charged to your security deposit. 18. Wild Horses. The Currituck Wild Horses roam the property often walking down the driveway and graze on the grass beside the home. The Wild Horses are protected by ordinances in the county—and are the State Horse of North Carolina. Rules and regulations concerning the Wild Horses are included in the guest manual. Please do not feed the horses, attempt to pet the horses, or try to approach the wild horses. They can be dangerous, especially to children. 21. Pests. Agent is not responsible for controlling the bugs that might be let into the premise. In the summer, wasps sometimes build nests near the home, and as this is a natural environment we cannot control wasps, mosquitoes, flies and bugs. 22. Beach driving. The home is accessible only by 4WD vehicle. All cars are required to drive on the beach to access the home—there are no roads behind the dunes that enable you to drive from the paved road to the house. Rules on beach driving are covered by Currituck County Ordinances, and are included in the guest manual for your knowledge. The tides change as does the beach on a daily basis. A tide chart is in the home and should be consulted on the best times to go up and down the beach. At times of high tide or storms, the beach can be impassable. 23. Pool. Swimming is at your own risk and should be arranged with the owner via text as it is a shared pool. There is not a deep diving end and diving is prohibited. A complete set of pool rules are posted at the pool site and in the guest manual. Please do not take glass to the pool area. If glass breaks we will have to drain the pool, and any charges associated with the pool draining and cleaning will be charged to the tenant. This might include not having the pool ready for the subsequent tenants. Complete plastic glass and dining products are provided for the tenant in the guest house. Please report any problems to the owner or property management firm immediately. 24. Bonfires and fireworks. Bonfires are prohibited on the outer banks as are fireworks. These can easily cause forest fires and endanger the wildlife as well as personal property. Please do not have bonfires, open air fires, or use fireworks. 25. Internet, TV, Phone. The property has internet service through the phone company—Centurylink. The owner cannot guarantee that the wireless internet service will always work. The owner cannot guarantee that the wireless phone service will always work. If there are any difficulties with these services, please contact the Agent. Full information will be provided in the guest manual.
