A One of a kind Beach Vacation home on Ditch Plains Road This post and beam house is only a walk away from Montauk’s famous Ditch Plains Beach. The house provides a grand piano. The master bedroom has a Jacuzzi. The kitchen has a Garland commercial stove with two ovens, and the stove is flanked by a long counter and Sub-Zero refrigerator. There is one washer and two driers for your use, an outdoor shower, wrap around upper and lower decks. The space In booking our house through Air B & B you agree to the following provisions of our use and occupancy agreement, which delineates the cleaning fee and Hotel charges which are additional charges based on your stay and daily rate: Use and Occupancy Agreement This Agreement is personal to the guests booked through Air B&B and the owners. It is a nonassignable privilege relating to the use and occupancy of owner’s premises at 4 Ditch Plains Road, Montauk, New York 11954 during the term set forth in this agreement. No more than 10 total guests and their visitors can have use of and occupy the premises over any given night. This provision applies to all people over the age of 13 years old. THE CONSIDERATION The daily rate $ 850.00 End of Term Cleaning Fee is $350.00 or per day $ 50.00 Suffolk County Hotel tax of 5.5% of the gross daily rate $ 46.75 Total $ 946.75 . Cleaning Cleaning during the occupancy of the premises is the responsibility of the guests. The owners will provide cleaning service contact information and pricing for the guests. There is a $350.00 cleaning fee for post occupancy cleaning performed by our cleaning service. THE AGREEMENT AND RULES Septic System: Guest and guest’s visitors agree not to flush anything in the toilets other than toilet paper. If it is determined that other products have been flushed down the toilets causing the septic system to become clogged, and or damaged tenant will be held liable therefore. Parking: No more than 4 vehicles can be parked on the premises overnight (EH Town Code) Guests are required to leave the premises in the same general condition as guests found it at the beginning of the term of this Agreement. Repair and maintenance problems of which guests become aware must be communicated to owners immediately. If guests do not attempt to notify owners of maintenance and repair problems of which they become aware then the guests will be liable for damage, repairs, and expenses resulting from the failure to notify owners. Electricity and propane are provided on premises to operate appliances, fixtures and heat premises if necessary in normally required quantities. Excess usage will be the responsibility of the guest. Guests may use toilet paper, paper towels, dish soap, laundry detergent, hand soap, dishwashing detergent, and garbage bags to extent initially supplied on premises. TV access is internet only The short term vacation occupancy and use provided by this Agreement is intended for families and responsible adults only. Any guests and/or visitors who are minors must be adequately supervised. The Guests listed in this Agreement acknowledge that they will personally occupy and use the property for the entire term of this agreement and will not sublet any portion of the property or sell shares for other individuals to use and occupy the premises. The Guests further agree that the premises shall not be used for any illegal or unlawful purpose and acknowledges that there will be no possession or use of illegal controlled substances, firearms, or hazardous materials on the premises, house and grounds. Violation of the foregoing provisions of this agreement shall terminate the privileges, use, and occupancy provided to the Guests by this agreement, and be grounds for immediate eviction from the premises. Owner’s consent is required if the guest wishes to bring a dog or other pets on the premise during the period of use and occupancy. The minor children of adult guests are welcome but the number and age of children occupying the premise must be revealed to the owners and their right to occupancy will be subject to the owner’s discretion considering the number and age of such children and their impact on owners ability of safely and comfortably accommodate the children. Smoking is prohibited inside the premises. Evidence of smoking inside the property will result in immediate eviction and forfeiture of all payments made by the guests. Only local telephone calls are allowed on the house landline. Any calls made on the landline outside the local area are the responsibility of the guests. The premises are located in a neighborhood that has a “noise ordinance” in effect after dark. All Guests and visitors agree to respect the ordinance and to keep noise volume within legal parameters. Any police enforcement actions by the Town, County or State relating to noise are at the sole risk and expense of the guests and grounds for immediate eviction and forfeiture of amounts paid by the guest pursuant to this agreement. Guests and visitors accept and assume all risk involved in or related to the use of any of the owner’s equipment, such as boogie boards, surf boards, bicycles and all other equipment, items and appliances, and further assumes the risk of any activities participated in on the premises. Cause for Eviction. The guests and all parties brought by the guests on the premises will be subject to immediate eviction from the premises if the guests or parties present on the premises violate any of the provisions of this Agreement, including but not limited to, violation of the occupancy limits, pet provision, noise ordinance, smoking provision and/or parking restrictions. In the event of eviction the guest shall forfeit to the owners all amounts paid in connection with the agreement. It is further understood, agreed, and acknowledged by the parties that this Agreement does not convey any interest in the property, 4 Ditch Plains Road, Montauk, New York 11954, to the guests designated herein, but is a nonassignable privilege for vacation use and occupancy. The owners reserve their right of entry to the premises, and their right to revoke the privileges granted by this agreement if the guests fail to comply with the provisions of this Agreement. If the owner employs the services of an attorney to enforce any conditions of this Agreement, including actions taken by the guest to recover deposits and other moneys received by the owner pursuant to the terms of this agreement and which are not due the guest, the guest shall be liable to the owner for reasonable attorney’s fees and costs incurred by the owner in enforcing provisions of this agreement, or defending the guests unwarranted actions for recovery of moneys paid to owner in connection with this Agreement. Any representation made to enter into this Agreement under false pretense will be subject to forfeiture of deposit, and final balance, if paid, and such party will not be permitted to use and occupy the premises, will be subject to immediate eviction, and forfeiture of all amounts paid pursuant to this agreement. This Agreement is binding on, and its benefits inure to the heirs and personal representatives of the parties. This agreement or any rights hereunder may not be assigned, in whole or part by the guest. This Agreement is made in, and shall be governed solely by the laws of, the State of New York, and venue for any legal actions, enforcement or otherwise, based on this agreement shall be Suffolk County, New York. If any section, clause, paragraph or term of his Agreement is held or determined to be void, invalid or unenforceable, for any reason, all other terms, clauses or paragraphs shall be severed and remain in full force and effect. This Agreement is entered into by the parties herein acknowledging full compliance with federal, state and local laws pertaining to antidiscrimination addressing race, color, religion, sex, country of origin, handicap, or status. The guests are aware that the premises are located in a residential neighborhood and agree to be courteous to residents and other individuals in the neighborhood. East Hampton Town Rental Registry Law 2016 has been complied with by owners and has been registered under registry number 24-480. CANCELLATION, DAMAGE, INDEMNIFICATION, LIABILITY AND DESTRUCTION Cancellations: If the property becomes unavailable to the Guests prior to occupancy, for any reason, the owners agree to refund the full amount paid as of the date of cancellation, and the guest agrees to release any claims against the owner arising from such cancellation. Damage repair and missing items: Guests are responsible to the owners for any damage to the premises, 4 Ditch Plains Road, Montauk, New York 11954, caused by the guest’s or their visitor’s use and occupancy of the premises during the term of this agreement. The guest acknowledges that damage to the premises includes intentional damage, damage due to pets, extraordinary cleaning post occupancy, smoking, exceeding occupancy or parking limits, any fines imposed on the owners by the Town, County or State, as a result of the violation of any law or ordinance, rule or regulation resulting from the use, occupancy and/or actions of the guests and guests’ visitors during the time of this Agreement. Indemnification and insurance: The guests agree to indemnify and hold the owners harmless against all loss, damage, expense and penalty arising from any action, intentional or negligent, of the guest, or visitor, of the guest which causes injury or death to any person or damage to any property during the term of this Agreement, and/or as result of this agreement. The guest is encouraged to secure the appropriate travelers, vacation and/or renters’ insurance. Casualty or Destruction: Should the property be destroyed or rendered uninhabitable by an Act of God (including, but not limited to hurricanes, storms, floods, or fires), or by environmental disaster, or loss of utilities prior to occupancy by Guests, this Agreement shall be come null and void, and all payments made hereunder shall be refunded to the guest. Should the property be destroyed or rendered uninhabitable during use and occupancy of the guests, reimbursement on a pro-rata basis will be made by owner to guest. All guests and their visitors must comply with all government evacuation orders. No refund for inclement weather during the time of the Agreement will be made.
