In addition, there is a 27 hole Championship Golf Course for guests. You may Book directly with the Golf Club. This property boasts 3 bedrooms, 2 inside the main house and one casita (BR 3). BR 3 is a converted Golf Cart Garage, it does not have an en suite bathroom. Enjoy the saltwater pool and hot tub. A close walk to the festivals avoid the hassle of ride share and parking. Guest access This Property is an entire home with pool. There are 3 Bedrooms and 2 Bathrooms. Bedroom 1 has a TV, an en suite bathroom and walk in closet. BR 2 has a TV and closet and the 3rd bedroom is detached. BR 3 is a converted Golf Cart Garage. There is a gourmet Kitchen and a Pool with hot tub. There is a laundry room included in the main house. There is a 2 car garage and also room in the driveway for 2 more cars. There is no street parking. You may use the Lifestyle Center/ Gym, Please notify host if you want access, as we need to notify the Lifestyle Center. Indian Palms has a public golf course and you may play Golf all fees paid directly to the club. Full Laundry Room with washer, dryer and counter space for folding/ironing. Other things to note You must be 25 to book this property, per our insurance requirement. This property is located in a gated residential community and within an HOA. The HOA requires Quiet hours between 9 pm and 8 am Sunday-Thursday and 10 pm and 8 am Friday and Saturday. Pool heating is available. Pool can be heated to 80 degrees for an additional $50 per day fee. Should you want to heat the pool, please let us know in advance so it will be heated when you arrive. Please note that we can control and monitor the pool (and heating of the pool). Should we find that the pool heating has been turned on without prior request, you will be charged the $50/Day heating. Air Conditioner Usage: In order to ensure no damage is caused to the AC unit, we ask that the AC temperature is not lowered any less than 72 degrees. To help keep the home cool, please ensure the doors remain closed to avoid heat entering the house during the hot days. House thermostat is monitored remotely. Garage Opener: we will provide a garage opener for your convenience. If this is not left at the house, you will be charged a$175 to buy and replace the opener. Guest assumes all risk/liability associated with use of the pool and hot tub. Note BR 3 is detached, a converted Golf Cart Garage. Noise Policy per the HOA: Quiet hours begin at 10:00pm-8am on Fridays and Saturdays, and 9pm-8am Sundays through Thursdays. Please be responsible, we want our guests to enjoy their stay but not at the expense of disturbing our neighbors and community. POOL USE WAIVER AND RELEASE OF LIABILITY Vacation Rental Property This Agreement is made and entered into by and between the guest(s) (hereinafter referred to as “Guest”) and the property owner(s) or manager(s) (hereinafter referred to as “Owner”) of the vacation rental property located at 82740 Burnette Dr. Indio, Ca. 92201, which includes access to a private swimming pool (the “Pool”). 1. Acknowledgment of Risks By renting this property, the Guest acknowledges that use of the Pool involves inherent risks, including but not limited to drowning, slips, falls, accidents, and injury. The Guest understands and accepts these risks, and agrees to assume full responsibility for any injury or harm that may result from their use of the Pool. 2. Supervision and Safety Guests are required to ensure that all children and non-swimmers are supervised by an adult at all times while in or around the Pool. The Owner does not provide lifeguard services. It is the responsibility of the Guest to ensure that all pool users are aware of and follow all posted pool rules and safety guidelines. 3. Health Condition and Fitness to Swim The Guest confirms that they, and any persons under their care, are in good health and are physically able to swim and use the Pool. Guests with any medical conditions that could be exacerbated by swimming or pool activities (such as heart conditions, respiratory issues, etc.) should consult with a physician before using the Pool. 4. No Diving or Running Diving or running near the Pool is prohibited. The Guest agrees to observe and enforce all safety rules, including not engaging in risky behaviors such as diving, running, or horseplay in or around the Pool area. 5. Pool Equipment and Chemicals The Guest agrees not to tamper with any pool equipment, including pool covers, ladders, controls and cleaning devices. The Owner is not responsible for any injury caused by improperly using or altering the Pool’s equipment. Additionally, the Guest understands that the Pool is treated with chemicals that may cause irritation to the skin, eyes, or respiratory system. 6. Indemnity and Release of Liability The Guest agrees to indemnify, defend, and hold harmless the Owner, its agents, employees, and affiliates from any and all claims, actions, or liabilities arising out of the Guest’s use of the Pool, including, but not limited to, personal injury, death, or property damage. The Guest agrees not to sue the Owner for any injury or damage sustained as a result of house or Pool use. 7. Compliance with Local Laws The Guest agrees to comply with all local laws, regulations, and property rules while using the Pool. This includes observing posted hours of operation, maintaining a reasonable level of noise, and adhering to any other guidelines provided by the Owner. 8. Right to Suspend Pool Use The Owner reserves the right to suspend or limit access to the Pool at any time for maintenance, safety concerns, or if the Guest or any member of their party fails to comply with this waiver or any other pool rules. 9. No Lifeguard on Duty There is no lifeguard on duty at the Pool. The Guest acknowledges and accepts full responsibility for their own safety and the safety of others using the Pool. Golf Course Activities Guests may play golf at Indian Palms Golf Course for an additional fee. Please contact host for details. The property is situated on or near a golf course, and the Guest acknowledges that: • The golf course is a public/private space, and access to or use of the course may be subject to additional fees or availability. • The Guest assumes all risks associated with being near or on the golf course, including but not limited to errant golf balls and noise from golf activities. • The Owner is not responsible for any injury, damage, or inconvenience resulting from activities on the golf course. Liability and Safety The Guest agrees to indemnify and hold the Owner harmless from any claims, damages, or expenses arising from the use of the property or from activities on the golf course.
