The Village at Camelback nestled between Camelback Mountain Resort and Big Pocono State Park is a privately owned, four season townhouse community, located on Camelback Road, Tannersville, PA. One of the best things about the Village is the close proximity to Camelback Ski Area and Camelbeach Water Park. Some units are ski-in ski-out and within walking distance to the slopes, but all are just a 5 minute drive to the base of the mountain and all the activities that it offers. Camelback Ski area offers downhill skiing, snowboarding, snow tubing, lessons and more. Camelbeach/Aquatopia is one of the premier water parks in northeastern Pennsylvania with a wave pool, lazy river, tube rides and 30 water slides that are sure to provide a fun filled day. For the land lovers, CBK Mountain Adventures, the alter ego of Camelbeach, offers Canopy Tours through the treetops with zip lines down Camelback Mountain, rock climbing, a Eurobungi and lots more. Since, The Village at Camelback is next to Big Pocono State Park there is great hiking close by and some of the best Pocono Mountain scenery for photographers. For the more adventurous, the Delaware Water Gap National Park is just 30 minutes away and can provide the ultimate outdoor experience including: kayaking, canoeing, hiking and horseback riding. There are over 25 challenging 18 hole Public golf courses in the Poconos with stunning mountain scenery. The Crossings outlet stores are on the access road to the Village and nearby; there are casinos, vineyards, antique shops, movie theaters, and playhouses. If you need more exercise after a busy day, The Village at Camelback also offers a sports complex facility including an indoor pool, sauna and Jacuzzi, a weight room as well as outdoor tennis courts. THE VILLAGE AT CAMELBACK PROPERTY OWNERS ASSOCIATION 3 GENERAL RULES & REGULATIONS The Village at Camelback Property Owners Association has developed the following Rules & Regulations to assure that all homeowners and their guests have the best opportunity to enjoy our Pocono residential Village. Homeowners have responsibility for assuring communication of the rules to guests, and renters, who have shared responsibility for compliance. We also ask parents to supervise children, so that any unfortunate consequences can be prevented. We appreciate your support and assistance in the adherence to these rules. The Village strives to ensure a well maintained, respectful, relaxing, and considerate environment. To that end, we ask that you assist us in making the Village experience a positive one for both us and our children. QUIET ENJOYMENT • Please be considerate of your next door neighbors, and Village residents by keeping noise level to a minimum at all times, especially after 11 pm when loud noise may be disruptive to others. • Use of community parking areas is reserved for parking, and unloading of vehicles. For safety reasons, residents and guests should refrain from use of this area for other purposes (congregating, outside party, etc.) FIRE SAFETY • Fireworks: Fireworks are strictly prohibited in the Village because of the potential for fires. • Fireplaces: Wood fires need to be carefully controlled within the fireplace. Be extremely careful with hot coals when cleaning fireplaces. Under no circumstances should hot coals or logs be placed on the decks or in trash compactor. Ashes need to be cooled at least 2 days before discarding in the trash. • Ashes: Ashes present a fire hazard for several days after a fire. Ashes from a fireplace must be placed in a metal container and allowed to cool inside the unit for 2-3 days before disposal. Ashes and used logs cannot be left outside on decks for this reason. (See disposal below in Trash section). • Grills: Only propane gas or electric grills are permitted in the Village on the decks. To reduce the risk of fire, charcoal grills, chimneys, etc. are prohibited • Outdoor Smoking: The Village has experienced several fires as a result of discarded cigarettes. We implore our homeowners, guests and renters to safely discard cigarettes in appropriate containers. SAFETY • Driving: Speed limit is not to exceed 15 MPH. Please use extra precaution during snow, ice and rainy conditions. • No Sledding, Tubing on Village property: Unfortunately, due to environmental hazards, and personal safety risks, sledding, tubing, skiing, snowboarding, or any other form of sledding device in the Village cannot be permitted. (I.e. in between units, behind units, roads etc.) • Firearms/ Weapons: The discharge of firearms, bows and arrows, or crossbows within the Village is strictly prohibited. ("Firearms" includes "BB" guns, pellet guns, rifles and other firearms of all types, regardless of size.) • No Hunting or Trapping: Of any kind is permitted anywhere in The Village at Camelback POA. THE VILLAGE AT CAMELBACK PROPERTY OWNERS ASSOCIATION 4 PARKING • Available Parking: Due to the limited number of parking spaces available outside the Village townhomes, each home has been allocated 2 parking spaces per home. • Parking Permits/ Passes: To ensure the spaces are available for homeowners, and their guests, within their respective parking area, parking passes will be provided. o Homeowners: Permanent Parking Sticker for 2 specified cars ○ Overnight Guests/ Renters: Official Paper parking pass will be provided by Front Office before 5:00 pm or at the Security Booth after 5:00 pm. • Parking passes must be prominently displayed on the dash board of the vehicle to be easily seen. ( drivers side) • Parking Spots: Some of the Village parking areas have designated spaces for each specific townhome, while others do not. For homes in Clusters without designated spaces, homeowners on either parking lot level or lower level, may park in any available space. • Please note that only authorized vehicles of homeowners, and their guests who reside in each Cluster may park in that respective Cluster. • “No Parking” Areas: o Please leave stairwell entrances accessible; vehicles should not block stairs. o Areas In front of Trash Compactor always need to be free and clear for easy access. o Parallel parking is not permitted anywhere in The Village. • Additional Parking: Homeowners and their guests, renters with more than 2 cars can park at the entrance to the Village in the overflow parking area. Security will provide a parking permit for this area. • Vehicle Limitations: Due to limited parking, only regular passenger 2 axle vehicles can be parked on Village property. Commercial vehicles, trailers, motor home type vehicles, campers, buses, snowmobiles, minibikes, or other unlicensed motor vehicles cannot be accommodated. • Special Note: Parking regulations are closely monitored and strictly enforced in the Village, so please be sure your parking pass is displayed at all times, to avoid ticketing/towing. TRASH • Basic Trash Disposal: The Village trash compactor is located at the base of the mountain, across from the outdoor tennis courts. Everyone is requested to dispose of their own trash, depositing it in the container. A fine for garbage bag left in ski lockers or on entry decks will be imposed as per attached fine structure. Since bears are one of our resident animals, please be sure to place all trash inside the container, and close the door. • Fireplace Ash Disposal: Ashes need to be discarded in the metal can by the compactor. Disposal of ashes in the trash compactor increases the risk of a trash can fire. THE VILLAGE AT CAMELBACK PROPERTY OWNERS ASSOCIATION 5 POOL SAFETY • Children: Children under 13 years of age MUST be accompanied by an adult swimmer at all times in the pool area. NO CHILDREN UNDER THE AGE OF 16 ARE ALLOWED IN THE HOT TUB PER THE BOARD OF HEALTH. • Swim Vests: Only Coast Guard approved personal floatation devices (PFD’s) are allowed in the pool. Coast Guard approved floatation devices will be labeled as such. Please be certain the PFD fits the individual using it. Never leave an infant, or child or non-swimmer unattended in the water, if they need a floatation device. PETS • Dogs, and Cats are welcome in the Village, but pets need to be leashed when outside the home to walk or play. Pets may not be left unattended on decks. • Persistent barking interrupts the quiet enjoyment of other residents, so please only bring man’s best friend if he can enjoy it quietly. • The Village relies on residents and their guests/ renters with dogs to keep the Village clean. Please clean up after your pet to avoid a pooper scooper violation. CAMELBACK SKI AREA • Mountain Access: During normal ski season hours of operation, Camelback allows skiers and snowboarders from the Village I slope side homes to access the Laurel Glade slope for skiing/ snowboarding activities. Non- skiers are NOT PERMITTED to use or cross the ski slopes. • Camelback Mountain Resort prohibits individuals on the slope after normal hours of operation, or in between seasons when Camelback is closed. • The use of sleds, toboggans, or similar items is strictly forbidden on the slopes. TENNIS COURTS INDOOR TENNIS COURTS • There are no reservations required for either indoor or outdoor tennis courts – they are available on a first come, first serve basis. • Proper tennis attire is required—shirts are a must. Please no bathing suits. Footwear by all individuals using the courts must consist of tennis shoes. Please no street or black-soled shoes. • Food and beverages are strictly prohibited within the confines of the Indoor Tennis Courts. • No smoking allowed on the courts at any time. • Loud or boisterous conduct, profanity, racquet throwing, abuse of equipment and/or tennis courts will not be tolerated. Members and guests utilizing such conduct will be asked to leave the facility and subject to fines. THE VILLAGE AT CAMELBACK PROPERTY OWNERS ASSOCIATION 6 • NO PETS are permitted in the court area. • Only active participants are allowed in the tennis court areas. • No roller blading or skate boarding. • The Village at Camelback POA office shall be the final authority on all tennis concerns. OUTDOOR TENNIS COURTS • No reservations are required • Play should be limited to 1 hour per unit if other people are waiting. • Aside from reservations, the same rules and regulations listed above apply to the Outdoor Tennis Courts. Thanks for taking time to read and heed the rules and regulations. Have a great game and we hope you “Love” the renovated indoor tennis courts. RENTAL GUESTS: CHECK-IN PROCESS During Village Office Hours, before 5:00 pm • Reception/ Welcome: During the Village’s normal hours of operation (9am – 5pm) renters will be greeted by the Front Office staff when the responsible individual presents to the Front Office • Check-in, Parking Pass: Guests and renters should “check-in” at the Village at Camelback Property Owners Association building (grey building with indoor pool). Guests pre-registered by the homeowner will be quickly expedited. • A regular parking permit (blue and white) for the designated townhome/cluster parking area will be provided for 2 cars and dated for their length of stay. All other vehicles related to the unit will be asked to park in one of our overflow lots and given a yellow parking permit. • Information: The Front office staff will provide renters/ guests with the following information to enhance their visit to the Village: • Availability of Renter/Guest Guide in the unit • Displaying parking pass/ Gate access • Front office staff will direct the Renter to Gate B. THE VILLAGE AT CAMELBACK PROPERTY OWNERS ASSOCIATION 7 After 5:00 pm: Handled by Security 1. Reception/ Welcome: After the Front Office closes at 5:00 pm, renters should proceed directly to GATE B entrance where they will be greeted by the Security Guard on duty. Should the Security Guard not be at the GATE on arrival, guests/ renters should press the call button and Security will return to the entrance gate. 2. Check – in, Parking Pass: Security will verify that arriving renters/ guests have been pre-registered and provide a regular parking pass to pre-registered renters and overnight guests. • No temporary pass needs to be given to these expected guest/ renters. • Overflow parking passes will be issued according to the standard Village procedure for more than 2 cars per unit. 3. Note: Should a guest/ renter arrive whose pre-registration data is not available at the Security Gate: • Security will contact the Community Manager who will provide instructions or contact the Homeowner. • A red temporary parking pass will be given to overnight guests/ renters who have been approved by the Community manager/ Homeowner, but whose information was not made available to the Security Guard. • Guests/ Renters with red temporary parking passes will need to return to the Front Office the next day to retrieve a regular parking pass and gate card. 4. Information: Security will assist visitors with any questions they may have. AMENDMENT OF RULES & REGULATIONS WHEREAS, the original Declaration of Protective Covenants and Easements was amended by a Amendment of Declaration of Protective Covenants and Easements on January 31, 1981, recorded in Deed Book Volume 1087, Page 31; and WHEREAS, the original Declaration of Protective Covenants and Easements was recorded in Deed Book Vol. 681, Page 238, Article VIII, as modified by a Modification filed to Monroe County Deed Book Vol. 689, Page 74 and supplemented by a Supplementary Declaration of Protective Covenants and Easements on February 3, 1979, recorded in Deed Book Volume 929, Page 289 and further modified by Instrument dated December 21, 2012 and recorded in Rec. Book 2413 Page 1217 et seq.; and WHEREAS, The Village at Camelback Property Owners Association, Inc., amended the previous Declaration, so as to amend Article V Section H and Section P, more particularly: Replace the language in Article V. Section H. Insurance with the amended language as follows: 1. Article V. Section H. Insurance “The Board of Directors and/or the Managing Agent shall, on behalf of members of the Property Owners Association insure all Dwelling Units and all Property Conveyed to the Property Owners Association. Such insurance shall be subject and under the terms and conditions of this Declaration with fire and extended coverage insurance, exclusive of improvements and betterments by the Dwelling Unit Owners which are the responsibility of such individual Owners, their successors and assigns, and such other insurance as it may deem necessary, the fire and extended coverage insurance to be for replacement cost, and to name the Property Owners Association, the Managing Agent, the appropriate Property Owners, and any lien holders, and insureds, as their respective interests may appear, and the proceeds of such fire and extended coverage insurance shall be applied as hereinafter provided. The Board of Directors, at its discretion from time to time or at any time, may select a property deductible amount, which deductible shall be the responsibility for coverage by the Dwelling Unit Owners. Further, the Board of Directors may promulgate rules and regulations for insurance under the Declaration, as well as, but not limited to upkeep, maintenance, repair, and replacement for perils or causes of loss including but not limited to a maintenance policy. “ 2. Replace the language in Article V. Section P with the amended language as follows: Article V. Section P “P. Each Dwelling Unit Owner shall be responsible for (i) purchasing, at their own cost and expense, liability insurance to cover accidents occuring within their own Unit, and for purchasing insurance upon their own personal property and such deductible(s) as established by the Board of Directors. Unit Owners are responsible for any applicable deductibles on the Property Owner Association’s insurance policy and for improvements and THE VILLAGE AT CAMELBACK PROPERTY OWNERS ASSOCIATION 10 betterments by the Dwelling Unit Owners, their predecessors, successors and assigns and should insure as such on their HO-6 policy or such other comparable policy, and tender to the Association evidence of such coverages and interests as may be required by the Board of Directors; and (ii) name the Association as an additional insured as its interest may appear for coverages, it is intended the Dwelling Owner insurance coverage shall be the primary coverage.” NOW, THEREFORE, Board of Directors of The Village at Camelback Property Owners Association, Inc., does hereby make the following amendment to the Rules and Regulations reflective of the amended Declaration of Protective Covenants and Easements as follows: INSURANCE 1. All dwelling unit owner’s: a.) Must carry and maintain insurance policies (HO-6), or similar policy as required by the Declaration of Protective Covenants and Easements, which shall include but not be limited to any structural casualty, damage or loss with extended coverage insurance for replacement cost with building coverage limit of a minimum of twenty-five thousand dollars ($25,000). The Dwelling Owner’s insurance coverage shall be the primary coverage. The aforesaid minimum amount is for the protection of the Association and is not an endorsement or representation as to the amount of coverage; and b.) Must name “The Village at Camelback Property Owners Association, Inc. 601 Camelback Road, Tannersville Pa. 18372”, or such other address as the Association may provide from time to time, and list the Association as a certificate holder on their policies for building coverage; and c.) Must provide and maintain a current insurance certificate(s) with the Association evidencing appropriate coverage’s. 2. All dwelling unit owners shall be subject to all fines, penalties, costs and attorney’s fees associated with enforcement of this rule including a suspension of rights/privileges including but not limited to use of the fascilities
