To: (Owner of Property, Releases) From : (Guest) I wish to use the Condominium swimming pool facility during the length of my stay at your vacation home. By swimming in the condominium swimming pool, I recognize and fully understand that : • At no time is there a lifeguard on duty, you (the Guest) are responsible for the safe operation of the pool and are responsible for all persons using the pool during your stay. • My use of the pool facilities during my stay involves certain risks, including but not limited to: 1. The risk of injury resulting from possible malfunction of the pool equipment; 2. The risk of injuries resulting from tripping or falling over obstacles in the pool area; 3. The risk of injuries resulting from unsupervised divers and swimmers colliding; 4. The risk of other injuries resulting from participating in any action in the pool. • I recognize and fully understand that the above list is not a complete or exhaustive list of all possible risks; the list only provides examples of types of risks that I am assuming. In exchange for the Owner allowing me to utilize the pool and area during my stay, I hereby agree to the conditions below. I fully intend and choose to give up the legal rights, as stated below: 1. TO WAIVE ANY AND ALL CLAIMS that I have or may have in the future against the Owner, its directors, officers, employees, agents, or representatives (hereinafter referred to as the “Releasees”) relating to my use of the pool and pool area; 2. TO RELEASE THE RELEASEES from any and all liability for any loss, damage, injury, expense, or other cost that I may suffer or that my next of kin may suffer in connection with my use of the Releasees pool or pool area to any cause whatsoever, INCLUDING NEGLIGENCE ON THE PART OF THE RELEASEES; 3. That this Waiver, Release, and Agreement is fully effective and shall be effective and binding upon me, and my heirs, next of kin, executors, administrators, and assigns, or anyone else authorized to act on my behalf or on behalf of my estate. I have read and understood this document. I am aware that by signing this document, I am waiving certain legal rights that I may have against the Releasees, and I fully agree to do so. I also understand and agree that only me and my registered companion can use the pool area and no additional friends, guest, family is allowed in the building exterior pool common area. I assume all risk of injuries associated with participation including, but not limited to, falls, contact with other participants, the effects of the weather, including high heat and/or humidity, and all other such risks being known and appreciated by me. I hereby acknowledge my responsibility in communicating any physical and psychological concerns that might conflict with participation in activity. I acknowledge that I am physically fit and mentally capable of performing the physical activity I choose to participate in. After having read this waiver and knowing these facts, and in consideration of acceptance of my participation, I agree, for myself and anyone entitled to act on my behalf, to HOLD HARMLESS, WAIVE AND RELEASE Owner of unit 307 and the Building Association, its officers, agents, employees, organizers, representatives, and successors from any responsibility, liabilities, demands, or claims of any kind arising out of my participation in the building exercise room. No other Beach items. ======== RENTAL boat : 1/2 block away SHORT TERM OCCUPANCY AGREEMENT W H E R E A S A. Provider is the owner of the premises municipally described as 255 west 24th Street, Unit # 307 (The Mantel Condominium), Miami Beach, FL 33141 (the "Unit"), Provider agrees to rent to Guest, & Guest agrees to accept short term rental of Unit; B. Occupant desires to occupy and use such premises more particularly described as the Unit; and agrees to compensate Owner/Agent for use of Property, by the Balance, Due Date, at the applicable Daily Rate for use of Property, concluding in a Total Balance Due for rental of Property, plus any applicable Cleaning Fee and Security Deposit. N O W T H E R E F O R E In consideration of the mutual covenants and agreements hereinafter contained, and for other good and valuable consideration, the receipt and sufficiency of which is hereby acknowledged, the parties agree as follows: 1. The term of this Agreement shall be for a period of xxx nights from xx to xxx. 2. It is expressly understood and agreed that this is a short-term vacation rental under the provisions of Chapter 509, Florida Statutes, and is not a lease or other long term residential tenancy agreement. This Agreement is only for the licensed use of the Property for the stated Term. It creates no property rights in Guest and no rights to renewal or for recurring usage. This Agreement is NOT ASSIGNABLE (family included). The Occupant understands that the Provider is allowing the rental of his/her unit in the spirit of cooperation and good citizenship for Miami Beach to our City Visitors. 3. CHECK IN TIME IS AFTER 2:00 PM AND CHECK OUT TIME IS NOT LATER THAN 11:00 AM. A late check out, unless approved in writing by the Provider, may result in the forfeiture of the entire Security Deposit. If Guest holds over or remains on the Unit beyond the specified Departure Date of this Agreement, by Check out-time, unless otherwise approved by Owner/Agent, Guest agrees and consents to be removed from the premises and locked out of the Property by Owner/Agent, its representatives, and/or law enforcement. Guest further consents to permit Owner/Agent to remove Guest’s personal belongings to a location of Owner/Agent’s choice, where Guest can retrieve them. 4. There is a mandatory Departing Cleaning Fee, and Florida Hotel & Resort Tax, included to the rental rate. (These charges are already been accounted in your AirBnB quote) 5. A security Deposit of $ 500.00 or 1 month’s if 30 days or more is required prior to arrive (not to be paid if you rent with AirBnB - please see their policy, and full payment is required in advance, prior to the time of check in. This deposit is not to be applied toward the payment of your stay. The Security Deposit will be refunded within five business days of departure providing the following are met: 1. No damage is done to unit or its contents, beyond normal wear and tear. Any items abused, taken or broken as a result of your visit will be deducted from your Deposit. 2. No damage is done to the condominium complex including but not limited to: lobby, elevators, weight-room, hallways and pool areas (if any). 3. No bathroom towels are removed from the unit after your stay, including towels designated as pool or beach towels. For your convenience we will provide two beach towels for your use outside the unit, however they must be returned and will be counted in our departure audit 4. All garbage must be disposed prior departure. Failure to do so will result in extra charges Silverware and kitchenware to be placed in the kitchen sink. 5. Keys & electronic access keys (if any) are returned to the owner agent at check out. There is a lost or destroyed charge of $ 200.00 per each Special MEDECO access key + 7% Sales Tax + $ 25.00 Delivery cost per each set replaced. The registered guest accepts full responsibility of payment of fines and will not dispute the fines which may be deducted from the security deposit. If damages exceed the amount of Security Deposit, Occupant understands & agrees to refund the difference to Provider upon presentation of repair receipts. 6. Cancellations and changes to reservations will be considered on an individual basis, however the following is our basic cancellation policy to which we will refer in most cases. We will not be responsible for acts of God, unfavorable weather conditions, cancellation of flights or any circumstances beyond our control, and any of these will not be considered grounds for cancellation or refund. Cancellations made 14 days or less, prior to scheduled check-in time may not be eligible for a refund. Cancellations made 15 to 59 days prior to check-in may be eligible for a refund of 50% of the total rent for that reservation, and will be charged a $100.00 processing fee. Cancellations made 60 days prior to check-in may receive a full refund less a $50.00 processing fee. Date changes resulting in a reduction of the number of days reserved are subject to a $50.00 cancellation fee for each day canceled. There will be no refunds for early check-out or for late check-in, or for "no show". NO CREDIT WILL BE ISSUED IN THE CASE OF EARLY DEPARTURE OR LATE ARRIVAL. No refunds at any time during high season, holidays & special events. Occupant understands to rent in a heavy traffic location, parking and silence is not guarantee. Owner/Agent cannot guarantee against mechanical failure of heating, air conditioning, appliances, TVs. Guest agrees to report any inoperative equipment to Owner/Agent promptly. Owner/Agent will make every reasonable effort to have repairs done quickly and efficiently. NO REFUNDS OR RENT REDUCTIONS WILL BE MADE DUE TO MECHANICAL FAILURES OR MALFUNCTIONS, INTERRUPTIONS OF UTILITIES, MAINTENANCE PROBLEMS OR CONSTRUCTION IN THE AREA OR NOISY NEIGHBOURS. 7. Maximum occupancy of guests unit is limited only to the Occupant(s) listed in this Agreement. If more guests, including children or infants, are found in the unit, a $100.00 per day, for each additional person will be charged and this Agreement may be cancelled. All pre-payments and security deposit may be forfeited. 8. There is no daily maid service included in the rental fee, however a full-service concierge service may be available and maid service can be arranged and paid by renters. Linens, bath towels and beach/pool towels are included in unit. We do not permit any bath towels or linens to be taken from the unit. Any linen found missing from your stay will result in a deduction from your damage deposit for reasonable replacement costs. All charges accrued during the stay are deducted from security deposit upon departure. 9. There will be no refund or credit offered to the guest if they clean the unit themselves before check out. Our trained cleaning teams perform the cleaning and preparation for the next guest under high hotel standards. For cleaning standards during COVID: we maintain Airbnb’s 5-step enhanced cleaning process—we follow a set of standards developed in partnership with experts. For this, there will be refund or credit for guest self cleaning of the unit. PLEASE NOTE THAT : unless provider will make a different arrangement at time of booking, any change of sheets and towels will be charged $ 40.00 per change. 9. Falsified reservations – any reservation obtained under false pretense will be subject to forfeiture of advance payment and deposit and the party will not be allowed to check-in. All pre-payments and security deposit may be forfeited. 10. Written exceptions – any exception to the above mentioned policies must be approved in writing and in advance by Provider and/or his/her Agent. 11. Occupant understands that this unit is a NON SMOKING UNIT, and smoking is NOT PERMITTED. At check-out, the unit will be checked and if Occupant smoked in the unit, the entire Security Deposit will be held for Special Dry Cleaning of all fabrics + steaming of beddings & odor removal. 12. If Occupant do not personally inspect the premises prior to signing this Agreement, Occupant agrees to accept the rental property upon arrival, provided it meets the basic description as listed on the rental Website or add. In addition, Occupant agrees that Occupant will not be entitled to a refund nor relocation to another property, and Occupant will have no claim or recourse against the Provider or Provider’s Agents. 13. Occupant has to immediately report to Provider any damages made or found in the unit. IN THE EVENT THERE IS A WATER LEAK, PLEASE CALL IMMEDIATELY Provider will immediately send an agent to check and repair the damage(s). Occupant agrees to always allow entry to the unit in the event of an emergency or a repair. 14. Occupant understands that NO PETS of any kind ARE ALLOWED in the unit, failure to observe this rule will result in the forfeiture of the entire Security Deposit to cover the costs of dry cleaning of all fabrics + steaming of bedding & odor removal. 15. Risk of Loss: Subject to the next sentence, Landlord and or Landlord’s Agent shall not be liable for any damage or injury or any loss by reason of damage, theft, or otherwise to the contents, belonging, and personal effect of the Tenant, or Tenant’s family, agents, employees, guest, or visitors located in or about the Premises. Nothing contained in this provision shall relieve Landlord and or Landlord’s Agent or Tenant from responsibility for loss, damage, or injury by its own negligence or willful conduct. 16. In the event the payment is made with 2 installments, and if the second payment is not paid on the date indicated (+/- 2 business days) in this Agreement, the reservation may be cancelled and voided with the loss of any previous payment(s). 17. As most hotels, the provider inspects and treats the unit regularly for various insects such as roaches, ants termites, palmettos, bed bugs, etc. Inspection and treatments take just minutes and you may be asked to give access to the representative during your stay. Provider is not responsible if any insect is found in the unit during your stay or transferred to your home. 18. SWIMMING POOL & EXERCISE ROOM WAIVER & RELEASE OF LIABILITY: Please remember that inherent risks are assumed with the use of exercise equipment and swimming pool. It is the responsibility of the registered guest to inform anyone using these facilities of the potential hazards. Each guest’s use of these facilities constitutes a release of liability and waiver of any and all rights, claims or causes of action of any kind whatsoever arising out of such use, for any physical or psychological injury, including but not limited to illness, paralysis, death, damages, economical or emotional loss; and constitutes agreement that the owners and hosts of the property assume no responsibility for any accident, illness, injury, or death. Please remember that this is an up-scale condominium facility with permanent residents. All guests who occupy the unit will be subject to current condominium association guidelines and are asked to respect the entire property, including but not limited to: lobby, elevator(s), hallways, Gym & pool areas.
