The code is activated at check-in date and time and deactivated at checkout date and time. Other things to note In NC, by booking our home you agree to and our bound by the following: 1. RENTAL GUESTS All persons in the rental party will be bound by the terms of agreement. Guest securing the reservation will be responsible for all guests they are bringing to the property as well as any damages or incidents that occur by guest, additional guests, or visitors in the home or on the premises. No other individuals but those listed in the reservation may be on the property. The Owner reserves the right to deny access or to have the premises vacated with no refund of monies. If Guests remains on the Property beyond the Departure Date and time, there will be a late fee equal to a night’s stay. The Owner reserve the right to vacate the Guests to the fullest extent of the law if necessary. a. Upon checkout the home will be cleaned and inspected for damage or theft. The guest agrees to pay the cost of any damages, incidents, or replacement costs. Perusal for excessive damages will be according to the North Carolina Law. All accidents, damages, or incidents to, in or on the property must be reportedly immediately to the owners. 2. GENERAL. The Owner(s) reserves the right to refuse rental to any individual or group. It is a crime to obtain this rental property under false pretenses. The use of premises shall not be as such to disturb or offend neighbors. The Owners reserve the right to have disruptive guests removed from the property without refund. 3. PETS. Pets of any nature are NOT permitted on or in the premises. We do not allow for pets to be on the property due to allergies. Please be respectful of this rule. Any evidence of pets on the property including odors will result in your payment method being charged an additional $500.00 for cleaning fees. Any additional damage found due to animals on the premises will be charged according to the cost to replace the damage. 4. SMOKING & DRUGS. Smoking, vaping, or drugs are NOT permitted in or on the Premises. If there is any evidence or odor indicating smoking, vaping or drugs has occurred in or on the property your credit card will be charged a $500.00 cleaning fee + any damages. 5. TRASH DISPOSAL. Guest shall dispose of all waste during the rental term by placing it in the proper outdoor receptacles and pulling it to the curb on trash days. 6. CANCELLATION AND REFUNDS. Refunds will not be given for cancellations less than 30 days from arrival date. No refunds will be given for late arrivals or early departures. The Guest shall not receive a refund due to a shortened stay and/or poor experience that resulted from unfavorable weather conditions. 7. ENTRY. The Owner(s) or it’s designated vendors shall have the right at all reasonable times to enter the Premises for the purpose of any repair, modification, alteration, installation, or other reasonable action, and will notify the guest as early as possible. 8. CONDITIONS OF PROPERTY The Guest understands that they are solely responsible for and assume responsibility and liability for any damages during their stay, caused by guest, additional guests on the reservation and any visitors. The Guest shall maintain the premises in a good, clean, and ready to live in condition, and use the premises only in a careful and lawful manner. The Guest shall leave the premises in a ready to live in condition at the expiration of the rental agreement, defined by the Owner as being immediately habitable by proceeding guests. The Guest shall pay for maintenance and repairs should the premises be left in a lesser condition. In the event of damage, theft, or the need for excessive cleaning guest authorizes the owners to charge credit card on file to cover the expense to bring the premises back to original state during their arrival. Should the guest dispute the charges or the credit limit on the credit / debit card on file is not sufficient to cover the Damages/Theft/ And Cleaning, owners may charge the guest with vandalism and/or pursue collection from the guest within the county of Onslow, NC. Guest agrees to pay for all reasonable costs, attorney’s fees, and expenses that result from the Owner enforcing this Agreement. 9. MAINTENANCE: The Owners perform regular maintenance and make every effort to keep all amenities in good working order. As in any home, appliances, A/C and heating units, water, electricity, internet access, etc. may malfunction on occasion. While we will make every effort to correct any deficiencies, no refunds will be given as a result non -working amenities or malfunctions of equipment. Please report all maintenance issues immediately. Please be respectful that emergencies take precedence over non-emergency issues. Please call immediately in case of an emergency. 10. USE OF EQUIPMENT AND AMENITIES: Guest and all persons staying on the premises, and visitors should inspect and be familiar with the proper us and application of all items and amenities available prior to using them. If you have any questions, please reach out to the owners. Guests have full privileges to use all amenities found on the property, including but not limited to firepit, grills, beach toys, kayaks, gear, water entertainment, baby equipment, as well as amenities and appliances inside of the home. Please use at your own risk. The Owner’s will not be held liable for any injuries resulting in the use of this equipment on or off the property. 11. LIABILITY. The Owner is not liable for any loss or damage to the personal property of the Guest or their guests. The Guest is liable for the acts of anyone listed in this Agreement in addition to any guest that they should allow on the Premises. Tenants expressly recognize that any insurance for property damage or loss which the Owner may maintain on the property does not cover the personal property of Tenants, and that Tenants should purchase their own insurance for Tenants and Guests if such coverage is desired. 12. LOST OR STOLEN ITEMS Owners are not responsible for lost, stolen or damaged items. We will do our best to notify the gust of any found item’s and do our best to return the item(s) to their owner. 19. GOVERNING LAW. This Agreement shall be governed by the laws of the state of North Carolina 20. ADDITIONAL PROVISIONS. Guest(s) hereby agrees to indemnify and hold the Owners harmless from any and all claims including those of third parties arising out of or in any way related to guest use of premises or the items of personal property provided therein. Guest assumes the risk of injury or other losses relating to any recreational activities and will hold owners harmless with respect thereto.
