Premium Long Weekends: Victoria Day, Canada Day, Civic Holiday, Labour Day, = $1 054/night New Year’s = $895/night Family Day, Easter, Thanksgiving = $ 788/night Linens: King/Queen/Double $26.00, Single $16.00 Towels: $6.00 each REQUIREMENT: Before accepting or sending an offer, we will request necessary personal & group information. With this information, a Cottage Rental Agreement (CRA) will be issued (containing property & booking details) that will need to be signed by all guests (age 18+) staying at the cottage. Please read below for a “sample" Cottage Rental Agreement + Liability Waiver. Terms and Conditions (Specific terms and conditions may vary according to each cottage) Cottage Cleaning Unless extra cleaning service is purchased and specified in your contract, the cottage must be left in the same condition as you found it, ready for the next visitors (specific details will be in the final Cottage Rental Agreement). Garbage All garbage and recycling disposal is the responsibility of the rental client. Garbage is to be placed in garbage bags/recycling boxes and stored safely so that animals cannot get into it. Information and location of the garbage dump specific to the cottage will be provided in the final Cottage Rental Agreement. Water/Plumbing/Septic System There are strict rules with regards to septic systems. Failure to follow these rules may result in thousands of dollars in repairs. 1. Only bodily waste materials and toilet paper can be flushed down the toilet. NO FEMININE/BABY PRODUCTS: TAMPONS, PADS, DIAPERS, WIPES. 2. Do not put any solid waste materials or grease down the sink drains. As most cottages draw water from the lake and only some have water purification systems, you may wish to bring your own drinking water. Camp/Cooking Fires Small campfires are permitted as directed by the Ministry of Natural Resources. Please identify and adhere to local fire bans when imposed by local authorities (especially during dry/fire season). Do not burn plastic, tin cans, glass, or any other items that should not be in the fire. Always drown out your fire with plenty of water when left unattended, in particular before going to bed. For the use of firewood, there may be a charge from the owner, approx. $25.00 per cart/wheelbarrow. No Extra Guests/Parties If you plan on having any additional guests, you must request permission from the owner. No Smoking All of our cottages are Non Smoking of any kind in the interior (specific details will be in the final Cottage Rental Agreement). Pets If your pet has been approved by the cottage owner, you are solely responsible for its actions and whereabouts (specific details will be in the final Cottage Rental Agreement). Damage Deposit If there is any damage to the cottage the claim will be handled between the client and Airbnb. If there are any noise complaints from the neighbours &/or if the Police are called to the cottage for any negative reason, the owner will have the right to hold back some or all of your damage deposit. Some of this money held back may or may not go to appease the neighbours who have been inconvenienced. Cancellation Policy Please refer to Airbnb Cancellation Policy. Any amendment or revision to the CRA (Cottage Rental Agreement) requested by the rental client will be subject to an additional fee of $30.00. Boats/Watercraft Life jackets are the rental client’s responsibility to bring and equip. If you plan on bringing a watercraft, please notify us well before you arrive. If you are renting a cottage with a motor boat, someone in your group will need to provide proof of boater’s license, in accordance with Ontario law. (specific details will be in the final Cottage Rental Agreement). Additional Notes: Bed linens & towels may or may not be supplied. (specific details will be in the final Cottage Rental Agreement). Be respectful of neighbors. Noise and music should be limited, especially after 10pm. Any other important information specific to a particular cottage will be in the final Cottage Rental Agreement. Waiver and Release of Liability and Assumption of Risk Acknowledgement: Once your reservation is confirmed, we will issue a CRA (Cottage Rental Agreement) with the information you have previously submitted, signatures of all adults 18 an older will be required before the check-in date. DEFINITIONS: Facilities/Premises: Cottage name / Cottage address Indemnitee – Kawartha Cottage Vacations Inc., Ken Turner and the owner, Owners complete names Indemnitor – The individual(s) signing below hereinafter also referred to as the Renter(s) and his/her heirs, administrators, assigns and executors. The Indemnitor hereby agrees to indemnify and release the Indemnitee’s from any liability for damages from loss, illness, injury and/or death that arises out of, or is connected with, or in any manner relates to, Indemnitor’s use of the Facilities and services provided at the Facilities and will save them harmless in respect thereof. Indemnitor represents that: 1. I am 18 years of age or older. 2. I am submitting this release, waiver of liability, and assumption of risk declaration voluntarily and of my own free will, on behalf of myself and my family (which may include children under the age of 18 years) as Indemnitor and any of our guests who may visit the facilities in order to save harmless the owner, as Indemnitee from any possible claims therefrom. 3. I have no physical or psychological conditions, nor any history thereof, which will impair my ability to utilize the Facilities and its services in a safe manner. 4. I understand and agree that it is my responsibility to assess the hazards presented by my use of the Facilities and services of the Facilities, and further agree that I assume all risks associated with the exercise of personal judgment about the use of said Facilities and services, and in particular I acknowledge that the indemnitee has made no representation or warranty as to the status of the premises for the purposes of being sanitized, including for Covid-19, and I assume all risks associated therewith and will save the Indemnitee harmless in respect thereof. 5. I understand and EXPRESSLY ASSUME all the dangers incident to using the Facilities, accessories and their services, and hereby RELEASE ALL CLAIMS, including but not limited to, personal injury, property damage or destruction, and death, whether caused by NEGLIGENCE, breach of contract or otherwise, and whether for bodily injury, property damage or loss otherwise, which I may ever have against the Indemnitee. 6. My use of the Facilities and accessories listed above is entirely optional and of my own free choice. I acknowledge this is a lake-oriented property and I assume responsibility for personal safety and the proper and responsible operation of watercraft compliant with all Provincial and Federal marine regulations and licensing requirements. 7. The Indemnitor shall NOT bring any hazardous products or equipment onto the premises and shall not dismantle, alter in any manner whatsoever any of the existing Facilities, or equipment located on the premises. 8. The Indemnitor shall use any property, equipment or otherwise, including stoves, microwaves, kettles, televisions, barbecues, in a responsible manner and in accordance with the manufacturer’s instructions. The Indemnitee shall not be held liable for any loss resulting from the misuse of any such equipment, including any damages whatsoever flowing from the alteration or misuse of any such equipment or property. 9. All personal property of the Indemnitor placed in the rented premises, or in any other portion of the property on which the premises is located, shall be used responsibly and in accordance with the manufacturer’s instructions and must be removed at end of the rental period. The Indemnitee, in any event loss or injury flowing from the use of such personal property or equipment, shall NOT be liable for any loss, personal injury, theft, or damage to such property and the indemnitor shall not be entitled to any credit of deduction, in any manner whatsoever from the Indemnitee. The Indemnitor shall be responsible for all damage or loss caused by such equipment to the Facilities and the property or to other persons, guests, or their property and shall indemnify the owner from any suits, legal costs, loss or award of damages flowing from all claims brought as a result of loss from the use of or presence of such personal property of equipment brought onto the property by the Indemnitor. 10. The Indemnitor shall NOT use the internet service provided in any manner that is contrary to law or prohibited, under the agreement between the Indemnitee and their internet service provider. 11. I hereby agree that all and any legal action however so caused in relation to this rental is the sole and complete financial and personal responsibility of the undersigned. 12. I hereby undertake and agree to be fully responsible for the cost of repair for any damages caused to any of the property, equipment or belongings of the Indemnitee beyond reasonable wear and tear incident upon normal use. 13. This agreement represents the whole agreement between the parties and shall not be amended except in writing, by the Owner and on the consent of both parties. 14. I hereby agree to indemnify and save harmless Kawartha Cottage Vacations Inc., Ken Turner and the owner from any and all claims whatsoever in accordance with the foregoing. 15. Governing Law: This Agreement shall be governed by and construed in accordance with the laws of the Province of Ontario and the parties irrevocably agree that any dispute arising out of or in connection with this Agreement will be subject to the applicable laws of Ontario and Canada. Both parties agree that any action or proceeding relating to this Agreement will be brought to a court of competent jurisdiction in the Province of Ontario, Canada, BUT not proceed until the matter has been subject to Arbitration under the Arbitrations Act, 1991, S.O. 1991,c.17, as amended, before a sole arbitrator appointed on the consent of the parties.
