The optional damage waiver is $40 for stays up to 10 nights, with an additional $2 per day for stays longer than 10 nights. Damage waiver purchases are optional. Guest access Guests have access to the entire home and property, with the following exceptions: • Garage – no guest access. • Owner’s Closet – secured and unavailable to guests. • Sunset Overlook – this upstairs open viewing area is not safe for use as it does not have a railing. For safety reasons, it must remain off-limits during your stay. All other spaces, including the bedrooms, kitchen, living areas, sunroom, game room, dock, and outdoor spaces, are available for your enjoyment. Vacation Rental Agreement This Vacation Rental Agreement is entered into on the booking date between Matthew and Mary Santala, hereinafter referred to as "Host," and Renter, hereinafter referred to as "Guest." This agreement may be updated from time to time. The final version will be sent to the Guest two days before their stay. Rental Property: The rental property, Redwood Retreat, Oscoda, Michigan 48750, is being rented to the Guest for vacation purposes only. The Guest agrees to use the property solely for residential purposes and not for any illegal or hazardous activity. Rental Dates: The rental period shall be for the specified dates in your confirmation email. Check-in is at 4:00 PM on the start date, and check-out is at 11:00 AM on the end date, unless otherwise agreed upon by both parties. Rental Payment & Cancellation Policy For reservations made through Airbnb, payment and cancellation policies are governed by the terms presented at the time of booking. Occupancy Limit: The maximum number of guests allowed to occupy the property is 13, including children. Additional guests may only stay with prior approval from the Host and may be subject to an additional fee. Pets: Dogs are allowed on the premises with prior approval from the Host and payment of a pet fee of $50. We are sorry, but the Host is allergic to cats; therefore, cats are prohibited. House Rules: The Guest agrees to abide by the following house rules at all times while at the property and shall cause all members of the rental party and anyone else permitted on the property to abide by the following rules: Smoking and vaping are strictly prohibited inside the house, including the three-season room. A $250 fee will be charged for any violation to cover cleaning and deodorization. Please respect our neighbors and keep the noise down from 10 PM to 8 AM. Excessive noise or disturbances that result in neighbor complaints or require host intervention may result in a $250 fee or immediate termination of stay. No unregistered guests are allowed. No parties. Guests are responsible for disposing of trash and keeping the property clean and tidy. Any damages to the property must be reported to the Host immediately. The garage is currently off-limits to guests. Please refrain from entering for safety reasons. The balcony overlooking the lake from bedroom 5 is not intended for guests. Please ensure children do not exit onto the balcony, as there is no railing. Dispose of all cigarette butts in the sand bucket. Failure to properly dispose of butts may result in a $100 fee. Charging of electric vehicles (EVs) is strictly prohibited on the property. Should this rule be violated, the Guest will be charged an additional $25 per day for the duration of their stay. Check-out is strictly at 11:00 AM unless otherwise agreed upon in writing. Unauthorized late check-outs will incur a $100 per hour fee. Tampering with or disabling smoke detectors, carbon monoxide alarms, or security cameras is prohibited and will result in a $250 fee. If the property is left in an excessively dirty condition or items are lost, broken, or removed (e.g., remotes, linens, game pieces), the Guest will be charged a minimum fee of $100 plus the cost of repair or replacement. Use of fireworks, open flames (other than in the designated fire pit), or candles is prohibited and may result in immediate termination of stay. Noise Monitoring and Smoke/Carbon Monoxide Detection: This property is equipped with a Minut noise decibel detector, smoke detectors, and carbon monoxide alarms to ensure safety and compliance with our house rules. These devices monitor sound levels and detect safety hazards but do not record audio. Tampering with, removing, or disabling any of these devices will result in an immediate notification and may lead to the termination of your booking without a refund. Please respect our quiet hours from 10 PM to 8 AM and ensure safety by not interfering with any installed safety devices. Smoking is only permitted in designated outdoor areas. House Access: Guests shall allow the Host access to the property for purposes of repair, inspection, or in case of emergency. The Host shall exercise this right of access in a reasonable manner by providing at least 4 hours' notice, except in cases of emergency. Lawn Maintenance: To ensure that the property remains in excellent condition, routine lawn maintenance may be scheduled during your stay. Maintenance may include mowing, trimming, or other landscaping activities. These will be scheduled to minimize disruption and typically occur on Thursday or Friday, depending on weather conditions. Indemnification: The Guest agrees to indemnify and hold harmless the Host from any claims, damages, or liabilities arising from the Guest's use of the property. Liability Waiver for Bicycles, Watercraft, and Swimming: Assumption of Risk: The Guest acknowledges that the use of bicycles, watercraft (including kayaks and rowboats), and engaging in swimming or other water-related activities involves inherent risks, including but not limited to physical injury, drowning, or property damage. The Guest voluntarily assumes all risks associated with these activities. Guest Responsibility: Bicycles: Guests are responsible for the proper use of bicycles. Guests must wear helmets and any other safety gear while operating bicycles. The use of bicycles is at the Guest’s own risk, and it is the Guest’s responsibility to ensure that all users are capable of safely operating the equipment. Watercraft: Guests must operate all watercraft safely and in accordance with local regulations. Life jackets must be worn at all times while using any watercraft. Guests must ensure they possess adequate swimming skills and are aware of the risks associated with water activities. Swimming: Swimming is allowed only in designated areas. The Guest acknowledges that there are no lifeguards on duty and that swimming is at the Guest’s own risk. Guests are responsible for supervising children and non-swimmers at all times. Release of Liability: The Guest agrees to release and discharge the Hosts, their agents, and employees from any and all claims, demands, actions, and causes of action arising out of or in connection with the use of the provided amenities, including but not limited to injuries, death, or property damage. Indemnification: The Guest agrees to indemnify and hold harmless the Hosts, their agents, and employees from any and all liability, damages, costs, and expenses (including legal fees) resulting from the use of the bicycles, watercraft, or participation in swimming activities by the Guest or any member of the Guest’s party. Acknowledgment of Rules and Regulations: The Guest agrees to follow all posted rules and safety guidelines regarding the use of bicycles, watercraft, and swimming areas. Failure to comply with these rules may result in the loss of use of these amenities during the stay. Binding Agreement: By booking your stay at Redwood Retreat, the Guest agrees to the terms of this liability waiver on behalf of themselves and all guests in their party. If the Guest does not agree with the terms, they may contact the Host within 24 hours of booking to cancel the reservation for a full refund. Governing Law: This Agreement shall be governed by and construed in accordance with the laws of the State of Michigan. Acceptance: By accepting your reservation, both parties acknowledge that they have read and understood this Agreement's terms and conditions.
