The rules established herein are mandatory for all owners of each of the building towers of the Moana Condominium, whether natural or legal persons. The highest authority in this matter is the ASSEMBLY OF CO-OWNERS, which must meet at least once within the first 3 months of the year. 1. PAYMENT OF MAINTENANCE FEES OR EXPENSES: 1.1. It is the responsibility of the owner of each apartment or suite to comply with the payment of ordinary and/or extraordinary fees, whether the property was unoccupied or occupied by the owner or by third parties. 1.2. The payment of maintenance fees, whether ordinary and/or extraordinary, must be paid within the first five (5) days of each month, in order to allow the timely payment of all obligations related to the maintenance of the building towers, common areas and other administrative charges for the proper care of the MOANA CONDOMINIUM. 2. USE OF COMMON AREAS: 2.1. The common areas: stairs, elevators, vehicular entrance, corridors, parking lots, and others, are intended for the use of all Residents. 2.2. The entrance lobby is an area intended for transit, reception and waiting. 3. MAINTENANCE AND CARE OF COMMON AND PRIVATE AREAS: 3.1. It is forbidden to make physical alterations to the front and rear facade, windows, doors (construction or paint color) in the real estate units or in the common areas, which affect the original exterior appearance and the common areas of the Buildings. 3.2. In the case of additional constructions in the common areas, these must be previously approved by a qualified majority corresponding to two-thirds of the Assembly of Co-owners. 3.3 It is forbidden to lay clothes, towels, carpets, sheets, etc., on or invading the exterior or interior facade of the building, this includes balconies and railings of rear corridors of the towers. 3.4. Curtains facing the outside of the building must be neutral colors (white or beige), so that they do not affect the harmony of the facade, preferably Roman type or......... 3.5. The use of the apartments that make up the Condominium must be respected, this being for the exclusive use of Housing. 3.7 Every owner, tenant, user or occupant shall be liable for any infringements committed by their relatives, workers, visitors, etc. These responsibilities fall jointly and severally on the owner. 3.8 To place signs or notices on the facades, written authorization must be obtained from the administration. 3.9 The installation of radio or cable television antennas on the facade of the housing units that make up each condominium tower is prohibited. 3.10 It is forbidden to wash or drain water through the balconies to avoid discomfort to lower levels. 3.11 The lights used on balconies and corridors must be the SAME as decided by the majority of owners to maintain the aesthetics and uniformity of facades. 4. USE OF ELEVATORS: 4.1. Do not keep the elevator door open or the elevator stopped unnecessarily to avoid inconvenience to other users, as well as preferably entering dry. 4.2. Smoking or eating in the elevators is not allowed, nor in general entering with any element that produces dirt or bad odors in them. It is forbidden to produce noise in the common areas of the building that disturbs the peace and quiet of the residents, especially at night. 5.2. All family activities or social gatherings must be held within the boundaries of the apartments or suites. Such meetings should maintain a moderate volume of music and voices, so as not to cause inconvenience to neighbors. If speakers are used in the common areas, the volume must be LOW to avoid disturbing the other neighbors who are present. 5.3. If work or repairs that produce annoying noises are required, the schedule must be as follows: Monday to Friday from 9:00 am to 6:00 pm. 5.4 If you want to hold any type of event in common areas, you must first request the respective permission from management so that the other owners can be notified 5.5 The use of the pool and common areas will be within the permitted hours, that is, from 8:00 AM to 8:00 PM and before entering the pool it is important to remove excess sand or external agents that may damage the filters. 5.6 The number of guests in common areas must be limited to a maximum of 4 per housing unit, in order to avoid saturation of the same strictly on high occupancy holidays such as Carnival, Easter, New Year, etc. 5.7 In common areas, children must always be accompanied by an adult responsible for their safety. 5.8 Glass containers and containers shall be kept away from the pool and jacuzzi area. It is also forbidden to consume drinks or food INSIDE the pool or jacuzzi. It is also forbidden to put soapy substances, foams, bath salts and excessive sunblock or sunscreen as all these make it difficult to clean. 5.9 Each owner may use ONE pool station (parasol, 2 lazy chairs and 1 table) in order to give the majority of owners the opportunity to use them. In the event of moving a lazy chair or table, it is the owner's responsibility to put it back in its place and they may not be moved to areas other than those designated. 5.10 After using the rooms that are on the lawn, they must be in order and clean, likewise when using them it is forbidden to use objects that can cut or burn the furniture or its upholstery (knives, cigarettes, prepare barbecues very close) 5.11 In case of smoking in common areas, they must carry ashtrays or containers to deposit the ashes and butts, it is forbidden to throw butts in any common area 5.12 The exclusive area for barbecues in the common areas is on the sandy beach located in the lower part, in front of the pool, in order to avoid disturbing the co-owners with smoke or noise, in addition the area must be completely clean after use and the waste deposited in suitable covers inside the bins located near this area. Likewise, the practice of sports and activities related to them should be carried out only in this area. 5.13 It is forbidden to use the common areas of the condominium for political, religious, union meetings or to hold rallies, gatherings or events of the same nature. 5.14 It is forbidden to occupy corridors or circulation corridors, stairs, passages and other common goods with merchandise, furniture or objects that prevent free transit or affect the aesthetics, good presentation and cleanliness of the condominium. The administrator is empowered to remove them immediately. 6. MOVING: When a move is made, it must be notified in advance to the management office, no less than 24 hours in advance. The schedule for moving is as follows: Monday to Friday from 9:00 am to 6:00 pm. 6.1. The personnel carrying out the move must register at the gatehouse. 6.2. In cases where the use of elevators is necessary, it must be previously coordinated with the administration staff, who will supervise the weight, volume and nature of the load, to avoid damage to the elevator car and common areas. In the event of any damage, the owner will assume the full cost of the repair. 7. USE OF PARKING LOTS: 7.1. Visitor Vehicles shall use only and exclusively the parking lots designated for this purpose. 7.2. Each owner must park his vehicle in his respective parking lot, taking care not to invade the neighbors or obstruct the common areas. 7.3. Children should not use the parking area as a recreation area. For safety reasons, the movement of children in the parking area must be in the company of a responsible adult. 7.4. It is not allowed to use the parking lots for a purpose contrary to their destination, such as a warehouse, garbage dump, etc. It is also not allowed to place tents on vehicles, but the use of covers is allowed. 8. GARBAGE DISPOSAL: 8.1. Garbage should be disposed of in tightly closed bags, taking care that they do not contain sharp objects that could pierce the bags during transport. 8.2. No liquid should be disposed of in the trash to prevent it from spilling during its transfer to the main container. 8.3. Waste objects such as disused appliances, furniture, building materials, etc. etc. ARE NOT CONSIDERED GARBAGE, so their handling and removal is the responsibility of the owner. 8.4 It is not allowed to leave garbage in the hallways, it must be removed by the owner and must be left in the general container. 9. PETS: 9.1. Breeds considered dangerous are prohibited. 9.2. Pets should only circulate in the areas behind the apartment towers, that is, between the buildings and the road. It is forbidden to circulate in the area between the apartment towers and the sea (swimming pool, jacuzzi, planters, etc.). 9.3. Pets must always be accompanied by a responsible person and have their respective leash on. 9.4. In the event that the pet soils or causes any damage to the common areas of the building, the owner will be responsible for the immediate cleaning or repair, as the case may be. 10. SECURITY MEASURES: The owner must notify the security checkpoint when he has visitors to register their entry in the logbook, as well as to leave it settled and their departure can be verified. 11. POSSIBLE DAMAGE IN COMMON AREAS: 11.1. Any damage to common areas resulting from unforeseeable circumstances or force majeure shall be borne by all owners in accordance with the percentage of participation in the common expenses of the building. 11.2. Any damage caused by a resident or persons under their responsibility (visitors, relatives, workers, tenants, etc.) will be fully assumed by the owner. 12. TENANTS 12.2. Owners who rent apartments must incorporate in the respective rental contracts a clause stipulating that the tenant is obliged to observe and comply with these rules of coexistence, specifying that their non-compliance will be grounds for termination of the rental contract. 12.3 Payment of the monthly fee will always be the sole responsibility of the apartment owner. 13. GARITA SERVICE: 13.2. GATE STAFF are prohibited from providing any information about the owners and/or tenants of the building under any circumstances, such as names, check-in and/or check-out times or others. 13.3. It is the responsibility of the GATE STAFF to record in the notebook the entry and exit of people outside the building. 14. APPLICATION OF PENALTIES 14.1. In the event of repeated non-compliance with the rules described or another not considered, but which violates coexistence in the building, the Assembly will proceed with a verbal warning in the first instance and in the event of not finding an adequate response, with a written warning. 12.1. Owners who rent apartments are obliged to inform the Administration of the personal data of the tenant as well as the agreed rental period. 13.1. GARITA PERSONNEL are prohibited from leaving their job without justified reason, as well as from carrying out work or tasks outside their competence for other owners, tenants or any other person. If they persist in the breach of their duties and obligations in accordance with the rules of coexistence described in this document, an economic penalty equivalent to half a unified basic salary will be applied and if they incur in the fault, the penalty will be a unified basic salary
