The property is leased exclusively to serve as a temporary residence, and its use cannot be changed, replaced or added to any other. It is also forbidden to sublet, assign or transfer this contract, as well as to partially or totally loan the leased property, under penalty of contractual termination and immediate delivery of the property. 2. If the property is not returned in the agreed form and within the agreed deadlines, it will incur the figure of the esbullo, in addition to being liable for a daily fine until the effective return of the property. 3. Guests are obliged to maintain the property as if it were their own, as well as the furniture, decorative objects and utensils, under penalty of contract termination and compensation for any damage caused. They also undertake to keep all electrical and hydraulic parts in the same working condition, carrying out all necessary repairs of any nature caused by incorrect use during the hosting period. Objects damaged during the rental must be replaced by guests with others of equal value or origin. Guests undertake to deliver the property in perfect clean condition and with all equipment (showers, refrigerators, televisions, fans, etc.) in working order. No alteration or modification to the property is allowed, which must be returned to the Lessor in the perfect condition in which it was found. 4. Guests are committed to reimbursing the owner for any damage caused to the property, furniture, appliances, household utensils, beds, armchairs and others, giving the owner the right to register a police report on behalf of the contractor and in the due processes of compensation for the damages occurred. 5. The guests hereby allow the owner to examine and access the service area for the maintenance of the leased property, whenever he deems it necessary, without the need to notify the guests in advance. 6. The obligations of guests, in addition to those provided for by law, are: a) Not to assign or franchise the property to third parties, without the prior written notice and express consent of the owner; b) Not to allow access to persons not registered in the reservation for the use of the bathroom or gatherings in the property; c) No access is allowed to strangers in the external and internal area of the property; d) The use of the property is restricted to those indicated in the reservation who are named, and the entry of third parties is not allowed, under penalty of fine and/or expulsion by the owner of the property without the right to any reimbursement. e) No smoking inside the house; f) Loud sounds are not allowed at any time, either inside or outside, and the guests must observe the legal period of silence from 10:00 p.m. to 7:00 a.m. the following day; g) Return the property in the same conditions as received, without damage, breakdowns or damage, including furniture and utensils, trimmings and other belongings; h) Ensure the custody of the property, making sure that all doors, gates and windows are locked when leaving the property, the owner being exempt from any liability with respect to tenants' belongings in the event of invasions, robberies, depredations, fires and other acts caused by third parties or by a phenomenon of nature. Guests are responsible for guarding the property. 7. Guests release the owner from any and all liability for accidents to persons who are staying or using the property both indoors and outdoors; 8. If the guests do not vacate the property on the day stipulated in the contract, they will be required to pay for the time that exceeds the daily rate, and if necessary, resort to the Judiciary to leave the property, the Lessor will immediately file the competent Eviction Action with Injunction Request for the vacancy of the property. 9. The lease is signed for up to 10 (ten) adults/children, all of whom are previously indicated in the reservation or by message to the owner prior to entering the house, with full name and CPF. If this number is exceeded, the Lessee must pay 50% of the daily rate per day per person. If guests exceed the maximum number of people allowed to stay overnight, without the express consent of the owner, they will incur a fine of 20% of the daily rate, per day for each additional person, in addition to the possibility of the penalty of contractual termination and immediate delivery of the property, which is at the discretion of the owner. 10. The following situations also characterize a breach of contract with the immediate vacancy of the property, without the return of the amount paid: a) Installation of tents on the property; b) Excess of people inhabiting the property; c) Disturbing the peace of others with noise at any time and inappropriate behavior in accordance with Article 42 of Decree-Law No. 3.688/41 (Criminal Misdemeanors Law); d) Other conduct considered disrespectful and antisocial. 11. Pets are not allowed. 12. The owner is not responsible for the supply of electricity or water. These services are provided by the public concessionaires Celesc and Águas de São Francisco do Sul respectively, and in the event of their absence, the owner cannot be held liable. 13. When cleaning, do not throw garbage or debris into the drains, and do not throw toilet paper or other objects into the toilet that may cause clogging of the pipes. In addition, due care should be taken when removing sand from the outdoor shower of the house, so as not to cause clogging of the internal bathroom drain. 13. All garbage generated must be placed in the trash can on the public road. At checkout, the refrigerator and trash cans must be empty and the dishes used washed, and in case of non-compliance, a fine will be charged.
