Description

This idyllic countryside home is situated in the historic neighborhood of Sonoma Valley called Schellville and within the Carneros wine region. You’re within minutes to world class vineyards and after a day of wine tasting -play pickle ball on our private court followed by a dip in the pool, or a soak in the hot tub. Cook on our luxe outdoor grill, and dine al fresco on our back patio. We require a signed rental agreement prior to check-in. The space The pool is heated in winter (November- April) by request only. There is an additional fee of $100/night for pool heat during these months. The pool is heated to 80 at no charge between May-October. If guests desire a pool temp over 80 degrees which requires us to use additional energy, an additional $100 per day charge applies. TOT# 4672N Rental Agreement This Short-Term Rental Agreement (the “Agreement”) is made by and between Kim and Alex Kilgo (“Homeowner”) and_________ (“Guest”) as of the date last set forth on the signature page of this Agreement. For good and valuable consideration, the sufficiency of which is acknowledged, the parties hereby agree as follows: 1. Property: This property is located at: 21800 Bonnes Rd., Sonoma, Ca. 95476 The property is furnished and includes: Basic kitchen pantry items, coffee maker, electric kettle, microwave oven, toaster oven, bakeware, dishes, glassware, and flatware . Video/Audio: flat screen television, wifi, Bath towels, pool towels, bed linens, wood fired/propane BBQ. The property has forced air central heating and central AC. 2. Maximum Occupancy: The maximum number of overnight guests is limited to 8 persons except by permission of the property manager and is strictly enforced. If a violation of this rule occurs, an additional charge of $100 per extra person per night will be assessed and all guests will be asked to vacate premises and will forfeit any rental fees and deposits. 4. Terms of the Lease: The lease begins at 4pm on _________ (the “Check in Date”) and ends at 11am _________ (the “Check-out Date”). 5. Rental Rules: Guests agree to abide by the Rental Rules, as set forth herein, at all times while at the property and shall cause all members of the rental party and anyone else Guest permits on the property to abide by the following rules at all times while at the property. Sonoma County has a vacation home noise ordinance which is strictly enforced. a. No outdoor noise louder than 60db (normal conversation) after 9pm and before 7am. Any verified noise complaints from neighbors during these hours may result in immediate eviction with no refund for unused rental days and forfeiture of deposit. Guests agree not to disturb the peace and enjoyment of neighbors and their guests. This includes but is not limited to excessive noise and/or music, as well as offensive language and/or behavior, and raised voices outside the house. b. Smoking is NOT allowed in the house or on the entire property due to HIGH FIRE DANGER. Smoking on the property may result in a $1000 penalty and immediate eviction. c. People other than those in the Guest party set forth above may not stay overnight in the property. Any other person in the property is the sole responsibility of the Guest. d. The owners are not responsible for any accidents and injuries or illnesses that occur while on the premises or its facilities. e. The Homeowners are not responsible for the loss of personal belongings or valuables of the guest. By accepting this reservation, it is agreed that all guests are expressly assuming the risk of any harm arising from their use of the premises and equipment or others whom they invite to use the premises. f. Keep the property and all furnishings in good order. g. A maximum of 3 vehicles are permitted at the property. h. Events/Parties: Property use is not permitted for special events. This includes but is not limited to special events, outdoor events, lawn parties, weddings or similar activities. Furthermore, it is strictly prohibited to host any type of event or party of any size at the property. If a violation of this rule occurs, an additional charge of $5,000 will be assessed and all guests will be asked to vacate premises and will forfeit any rental fees or deposits. 6. Housekeeping: There is no daily housekeeping service. While linens, pool and bath towels are included in the unit, daily maid service is not included in the rental rate. We do not permit towels or linens to be taken from the premises. 7. Plumbing/Sewage System: The property operates with a septic system. DO NOT FLUSH anything other than toilet paper. No feminine products should be flushed at any time. If it is found that feminine products or any other improper material have been flushed and clog the system, you could be charged for damages including, but not limited to, the cost of the service call for the plumber or the septic system. 8. Access: Guests shall allow Homeowner access to the property for purposes of repair and inspection. Homeowners shall exercise this right of access in a reasonable manner. 9. Rental Rate and Fees: All rental fees including tax, cleaning fee, insurance fee, and nightly rental fee is due no less than 60 days prior to check-in, unless reservation is made less than 60 days before arrival in which case all fees are due at the time the reservation is made. 10. Pets: This is a pet free property. If guests bring a pet without permission the pet fee will be $1,000 billed to the guest. 11. Damage Deposit: If a damage deposit is made, it will be refunded in accordance with the service through which the reservation was made, provided no deductions are made due to: i. Damage to the property or furnishings. ii. Dirt or other mess that requires excessive cleaning. iii. Any other cost incurred by the Homeowners due to the Guest’s stay beyond normal wear and tear. Violation of the Sonoma county vacation rental noise ordinance resulting in neighbor complaints between the hours of 10pm-7am or any violation of rental rules. If the premises appear dirty or damaged upon Check-in, Guest shall inform Homeowner immediately. If Guest fails to do so within 24 hours or check-in, Guest will be responsible for all damages and excessive cleaning charges prior to their stay. 12. Cancellation Policy: To protect both guest and host due to the uncertainty of travel due to illnesses like coronavirus and other unforeseen occurrences, we strongly urge all guests to purchase travel insurance, otherwise the stated cancellation policy on Airbnb or VRBO applies. The parties agree to the terms of this Short-Term Rental Agreement as evidenced by acknowledgement on the VRBO website or the Airbnb website and the signatures set forth below. All of the foregoing representations and agreements are made by Guest on behalf of himself or herself, and his or her party, and guests. As consideration for being allowed to rent the premises, All Guest(s) agree to assume full and complete risk, responsibility and liability for any injury or accident which may occur while on the premises, including but not limited to Personal injury, death, illness, and/or property damage, whether resulting from the use or misuse of the pool, hot tub, pickleball court or any other portion of the premises. a. All Guest(s) hereby waives, releases, covenants not to sue and forever discharge Owner and Property Manager for all liabilities, claims, actions, or damages that All Guest(s) may have against Owner arising out of or in any way connected with All Guest(s) rental of premises, including without limitations any liabilities, claims, actions, or damages caused by negligence or Owner and Property Manager (except for Owner’s or Property Manager’s gross negligence). b. All Guest(s) further agree to indemnify, defend, and hold harmless Owner and Property Manager, and Lawrence Bearg Revocable Trust, Dated October 20, 2015, and any Amendments thereto, from all liabilities, claims, demands, causes of action, damages loss or expense (including court costs and attorney’s fee) of any kind or nature brought by a third party against owner which arise out of or is in any way connected with Guest(s) rental of premises. Country Property Disclosure: Tenant acknowledges and understands that this property is located in a rural area. In such a setting, one may find spiders, snails, geckos, snakes, frogs, and ticks (which have been known to cause Lyme Disease).
