The guests in my party wish to swim at this Airbnb listing's pool facilities during our stay at this Listing. By swimming in the vacation home's pool and spa (hereinafter referred to as amenities), I recognize and fully understand that in consideration for being permitted to use the amenities, l, for myself and on behalf of my heirs, personal representative, and assigns, release, waive, discharge, and hold harmless the owner of the property, insurers, and representatives ("Released Parties") from any and all liability, claims, and demands, either in law or in equity, relating to or arising from my use of the pool and spa. I also understand that: using the amenities carries with it certain inherent risks that cannot be eliminated regardless of the care taken to avoid injuries. The specific risks vary from person to person, but range from (1) minor injuries, such as muscle strains, (2) major injuries, such as heart attacks, and (3) catastrophic injuries, such as death. These risks are greater when there is no lifeguard on duty. I know, understand, and appreciate these and other risks that are inherent to swimming including but not limited to claims for property damage, loss, bodily injury, accidents, illnesses. My participation is voluntary, and I knowingly assume all such risks. I also understand that: At no time is there a lifeguard on duty, I (the renter) am responsible for the safe use of the pool, equipment and the safety of all persons using the amenities during the stay. The use of the pool during the stay involves certain risks, including but not limited to: (a) The risk of injury resulting from possible malfunction of the pool equipment; (b) The risk of injuries resulting from tripping or falling over obstacles in the pool area; (c) The risk of injuries resulting from unsupervised divers and swimmers colliding; (d) The risk of other injuries resulting from participating in any action in the pool; (e) The risk of falling or slipping when wet. There is no fence that restricts access to the pool and I will limit access to anyone under the age of 18 without adult supervision. I recognize and fully understand that the above list is not a complete or exhaustive list of all possible risks; the list only provides examples of types of risks that l am assuming. In exchange for the Owner allowing me to utilize the pool and area during my stay, I hereby agree to the conditions below. I fully intend and choose to give up the legal rights, as stated below: 1. TO WAIVE ANY AND ALL CLAIMS that I have or may have in the future against the Owner, its directors, officers, employees, agents, or representatives (hereinafter referred to as the "Releasees") relating to my use of the pool and pool area. 2. TO RELEASE THE RELEASEES from any and all liability for any loss, damage, injury, expense, or other cost that I may suffer or that my next of kin may suffer in connection with my use of the Releasees pool or pool area to any cause whatsoever, INCLUDING NEGLIGENCE ON THE PART OF THE RELEASEES; 3. TO HOLD HARMLESS AND INDEMNIFY THE RELEASEES from any and all liability to property, or personal injury to, any third party, resulting from the use of the pool or pool area. 4. That I am over the age of 21 and that I am responsible and will adhere to all the rules of the property. 5. That this Waiver, Release, and Agreement is fully effective and shall be effective and binding upon me, and my heirs, next of kin, executors, administrator, and assigns, or anyone else authorized to act on my behalf or on behalf of my estate. I AGREE TO INDEMNIFY AND HOLD HARMLESS THE PROPERTY OWNERS), SENIA GROUP LLC, ITS EMPLOYEES, INSURERS, AND REPRESENTATIVES FROM ANY AND ALL CLAIMS, ACTIONS, SUITS, PROCEDURES, COSTS, EXPENSES, DAMAGES, AND LIABILITIES, INCLUDING ATTORNEY'S FEES, RELATING TO OR ARISING FROM MY USE OF THE POOL AND WILL REIMBURSE THEM FOR ANY SUCH EXPENSES INCURRED. This Waiver will be governed by and interpreted in accordance with the laws of the State of Texas. In the event that any clause or provision of this Waiver is deemed invalid, the enforceability of the remaining provisions of this Waiver shall not be affected. By booking this property I acknowledge that I have read this waiver and fully understand its terms. I understand that I am giving up substantial rights, including my right to sue. I express my understanding and intent to enter into this Waiver willingly and voluntarily. My reservation acknowledges a complete and unconditional release of all liability of the Released Parties, to the greatest extent allowed by law.
