Other things to note The tenant expressly undertakes not to organise or allow parties, events, large gatherings, or any activity that is disturbing, noisy, unhealthy, harmful, dangerous, or illegal, in accordance with Law 8/2012 of 19 July on Tourism in the Balearic Islands, and Decree 20/2015 of 17 April regulating the commercialisation of tourist stays in dwellings, as well as the applicable municipal regulations on noise and civic coexistence. Failure to comply with this obligation shall be considered a serious cause for the automatic termination of the contract, without the right to a refund of the amounts paid, and with the immediate obligation to vacate the property. The landlord shall be entitled to take any necessary measures to recover possession of the property. Furthermore, the tenant expressly authorises the landlord, their representatives, and the Law Enforcement Authorities (Local Police, Civil Guard, or National Police) to access the property in the event of well-founded evidence or reports of a party or prohibited activity taking place, solely for the purpose of restoring order, ensuring safety, and protecting the property. This authorisation is granted under Article 18.2 of the Spanish Constitution, constituting prior and express consent for these specific situations, without implying a general waiver of the right to the inviolability of the home. In case of infringement, the tenant shall pay the landlord, as a penalty clause, the amount of €3,000, plus the full amount of any administrative sanctions, fines, or surcharges that may be imposed on the landlord, owner, or property by any public body or administrative authority (Government of the Balearic Islands, Island Council, Town Hall, or police bodies), directly or indirectly arising from the offence committed by the tenant or their companions. This penalty shall apply without prejudice to: The claim for material or economic damages caused to the property or its furnishings. Any civil or criminal actions that may arise from the facts. Essential and irrevocable clause: This clause is essential and determining for the contract and constitutes an indispensable condition for the formalisation of the tenancy. Its validity, effectiveness, and application shall remain in force throughout the tenant’s stay, without the possibility of unilateral modification or cancellation by either party. The tenant expressly acknowledges having read, understood, and accepted it in all its terms, undertaking to comply strictly with it. Failure to comply with this clause shall entitle the landlord to terminate the contract immediately, without refund of the amounts paid and without prejudice to any civil or administrative liabilities that may apply.
