Incredible views, a gourmet kitchen, sunken living room and foyer that surround a towering rock fireplace, large master bedroom with en suite bath, theater room, fitness room and 3 guest rooms and spacious decks make for an outstanding place to gather and entertain your group Guest access The whole home and garage, decks immediate yards and parking areas Other things to note Green Bluff Getaway Vacation/ Short- Term Online Rental Agreement Grand Getaway (Main Home) This Vacation/ Short Term Rental Agreement (‘Rental Agreement”) constitutes a contract between you, the online end user (herein Guest(s)) of any third party online booking platform or site (herein “Platform”) on which this listing should appear, and THE GREEN BLUFF GETAWAY, L.L.C., a Washington limited liability company, Owner, (or “GBG”) with respect to the rental of that certain residence located on a parcel of approximately 10 acres collectively, at Green Bluff, (the “Property”). The Property (the Grand Getaway) refers to the main executive 4 bedroom 3 bathroom home, 2 car garage, immediate yards and parking areas indicated on attached map. It shall not include the following areas and additional buildings and outbuildings which Guest(s) will not have access to: 1) The Suite Getaway, it’s adjacent garden, patios and designated parking areas, 2) The shop building adjacent to the Suite Getaway (marked “Owner”), Field office and outbuildings, their designated patio and parking areas also marked “Owner” on attached map. By making a reservation online, you agree to the following terms and conditions of this agreement, please read it thoroughly. Bookings longer than 14 days will be automatically renewed every 14 days until the end of the stay, ONLY if the Guest(s) remain in compliance with all the terms and conditions of this agreement. Any monies received by Owner for occupancy of vacation rental indicates the acceptance of all the terms and conditions of this Short-Term Rental Agreement listed herein. The term “refund” refers to an amount credited to guest(s) equal to the cost of the complete stay, unless otherwise specifically noted. It is the responsibility of the Guest(s) to be familiar with all policies and rules within this agreement and to ensure all guests, temporary guests and invitees are familiar with them as well. It is our goal to provide comfortable and high-quality lodging that will make your visit to GBG one you will remember fondly for years to come. To ensure this, we are committed to high standards and policies that will maintain the integrity of the GBG for all future guests and neighbors as well. GBG was designed to be a peaceful and private retreat, honeymoon destination, family vacation home, it is not a loud or house party or ceremony venue. Rental Property address: 7501 E. Greenbluff Rd, Colbert, WA, 99005 Rental Period: This lease begins at 3:30 p.m. PST on the Check-In Date of your online booking and ends at 11:00 a.m. on the check-Out date of your online booking. Entry and security codes are not available until the Property is ready for occupancy. No exceptions to this policy will be made. Guests that do not vacate the Property by the Check-out Date and Time, and leave the keys and openers in the main home, are subject to a fee equal to one rental day. The Property requires a two (2) night minimum stay. Stays lengthier than 14 days may occur at the sole discretion of the Owner and will depend on availability and the Guest(s) adherence to this Agreement. Rental Rates and Fees: The amount appearing in the details listed per night, (Which are generally between $495. and $750. depending on season, weekend rates and availability), plus taxes, cleaning fees and deposits as set forth below. Important: Owner is not responsible for fees charged by Platform/ site used to book, any charges or rates are specifically set and collected by the Platform/ site used to book, and may vary greatly between sites. Owner is not responsible for any errors, omissions or oversights made by Platform/site. Please read the terms and Conditions of the Platform or site used to book this reservation carefully in regard to fees, service, refunds and all other important information regarding your reservation booked through any third-party Platform/ site. Guest(s) agree to hold Owner harmless for any loss or damages caused by any errors or omissions of Platform/ sites. The maximum occupancy for this property shall not exceed 12 (twelve) persons at any time. If Guest(s) exceed the maximum occupancy, Guest(s), any and all visitors are subject to immediate removal and forfeiture of their security deposit and rental and fees payment. 1. Rental Party: All persons in the rental party will be bound by the terms of this Rental Agreement, there is no subletting allowed. All Guests and Invitees of the Rental Party are to be personally known by the person making the online booking or staying at the Property, all are to be informed as of the Terms and Conditions set out in this Agreement, and agree to it, in its entirety. When booking online, please confirm the number of guests and number of children in your Rental Party, by sending a message through the site to the Owner. 2. Reservation Requirements: Reservations are not “guaranteed” until payment of 50% of the Total Rental Fee are received by the Platform used, and this Rental Agreement read thoroughly and is accepted by Guest(s). All reservations must be paid in full prior to Check-In. Guest is responsible for payment of entire reservation, regardless of arrival and departure times. Beginning at 0000 hours at the first day of reservation, Guest is financially responsible if Guest terminates the stay early for any reason. GBG reserves the right to cancel any refuse any reservation with full refund of any money paid by Guest. 3. Cancellations: Cancellations are subject to our No Refund Policy. Cancellations must be made and received and acknowledged by the Platform used. In case of Guest cancellations received by the Online Platform at least 60 (sixty) days prior to Check-In date, will receive a full refund of the Reservation Deposit, in accordance with that Platform’s refund timetable and terms. If the Guest terminates the reservation less than 60 (sixty) days prior to the Check-In date, the Reservation Deposit will be forfeited and retained by the Owner. Cancellations must be made by 12:00 PST on the appropriate day. Please confirm the cancellation policy refund information and provisions set forth by the Platform that is utilized to make the reservation. 4. Vacation Rental Insurance: Vacation Rental Insurance is optional, but we strongly recommend it. This type of insurance helps protect your vacation investment if you cancel for a covered reason. Vacation Rental Insurance can usually be obtained through your personal insurance agent, and can also typically be obtained through the Platform being used to book the reservation. 5. Security Deposit; cleaning Fee; Cleaning: A $600.00 Refundable Security/ Damage Deposit and a $250.00 Non- Refundable Cleaning Fee are included in the Total Rental Fee, of which 50% is due at the time of booking a reservation. The additional 50% is due at least 60 days prior to the first day of stay. Payment type is specific to the Platform being used to book the reservation, and is generally received electronically by credit, debit or some combination thereof, in US Dollars. Please familiarize yourself with the payment options and the Security/ Damage Deposit refund, for how and when to expect it to be refunded, as this will be determined by the Platform that is used to book the reservation and may vary from site to site. The Security/ Damage Deposit will be returned within the time frame specified from the date of Check-Out by the Platform, provided there is no breakage or damage to the Property or its contents. Daily housekeeping or concierge services are not provided with this Property. Throughout the rental period, Guest(s) will be responsible for keeping the Property in good condition. Any unsafe or dangerous condition must be reported to the Owner immediately. Guest(s) acknowledge that on the Check- in date, the Property is in good condition, except for any defect the Guest(s) may report to the Owner by the end of the first day following the Check- In date. The Property should be left in the same condition as it was found except for the general cleaning and laundering that is included in the Cleaning Fee. Please refer to the Check- Out instructions for further details. 6. Confirmation of Reservation: The Platform used to book the reservation typically sends confirmation of the reservation to the Guest and Owner. Please make sure you receive confirmation of the reservation from the Platform, and check for accuracy of dates, mailing and contact information, number of adults and or children and accommodations. All errors should be directed to the Platform used to book the reservation immediately, as the Owner is typically unable to see contact info from the Guest, and vice- versa. If you do not receive a confirmation soon after successfully booking, please contact the Platform/ site that was used to book the reservation, and report the problem. 7. Refund Policy, Mechanical Failures: Owner attempts to properly maintain the property. While all electrical and mechanical equipment within the Property are in good working order, the Owner cannot guarantee against mechanical failure of electrical service, stopped plumbing, water supply, heating, air conditioning, audiovisual equipment, internet access, streaming services, or appliances. Guest(s) agrees to report any inoperative equipment or other maintenance problem to Owner immediately. Owner will make every reasonable effort to have repairs done quickly and efficiently. Guest will allow Owner or a person permitted by Owner to access the Property for purposes of repair and inspection. Owner is not responsible for any inconvenience that may occur and no refunds or rent reductions will be made due to failure of such items. No refunds or rent reductions will be made due to power outages or failure of appliances or equipment. No refunds for early departures (less days than reserved). No refunds will be given for delayed arrival. No refunds will be given for reducing the number of nights reserved. 8. Acts of God: Owner shall not be liable for events beyond Owner’s control which may interfere with Guest(s) occupancy, including but not limited to Acts of God, acts of governmental agencies, fire, strikes, war, or inclement weather. No rebate or refund will be given under these circumstances. 9. Age Requirements: Guest(s) under the age of 25 unaccompanied by a parent or legal guardian will not be permitted to register and will lose all funds paid to the Owner. Any reservations made under false pretenses will result in loss of advance payments and possible removal of Guest(s) from rental unit. 10. Non-Disturbance; Non-Smoking; Illegal Drugs: NO SMOKING/ VAPING OF ANY KIND IS ALLOWED ON THE PROPERTY. Due to fire danger and smoke damage to property, any smoking will result in the Guest(s) being asked to leave immediately without a refund. There will be a $500.00 fine PLUS a fee equivalent to two consecutive nights rental at the price per night determined by and listed by the Platform used (for loss of use while the premises are being cleaned). Under no circumstances shall any illegal drugs as defined under federal law, which include marijuana and cannabis related products, be allowed on the Property. Guest(s). Guest(s) understands that possession and use of such substance is grounds for immediate eviction and forfeiture of payment. Guest(s) further waives any and all rights to recourse against Owner for enforcing this provision. Occupancy and use of the Property in such a fashion that disturbs or offends other guests or neighbors be deemed grounds for termination. We wish you an enjoyable vacation, but you must respect the rights of other guests and neighbors. Guest(s) are expected to observe quiet times between 10 p.m. and 7 a.m., In order to minimize noise that is audible to neighbors and other guests, Guest(s) agree to move gatherings indoors closing doors and windows if they become noisy. Drunk, belligerent or unruly Guest(s), temporary visitors or invitees will not be tolerated. 11. Restrictions: Glitter, confetti, combustibles: Glitter, confetti rice or any other substance that is difficult to remove is not allowed. The burning of any type of combustible is not permitted. This includes, but is not limited to candles, incense and sparklers. 12. The Grand Getaway: Furnishings and Amenities: The Property is a 4 bedroom, 3 bathroom executive home that sleeps 8 people. The Property is fully furnished by the Owner, and is equipped for light housekeeping. Furnishings are subject to change without notice. The following amenities are included in the Property. Fully equipped kitchen with Viking fridge/ freezer, Viking 6burner gas stove/oven, microwave, dishwasher, drip and pod coffee makers, toaster, Kitchen Aid mixer, blender, waffle maker, electric griddle, air popper, air fryer, crock pot, and more. The kitchen table seats 8, and another 3 at kitchen island. Dishes, glasses, cups, flatware serving and cooking utensils, pots, pans bakeware, outdoor gas grill and griddle, outdoor furniture, washer and dryer upstairs and downstairs, gown/clothing steamers, streaming services, Wi-Fi, DVD player, hair dryers, furniture throughout. Child booster seat and Pack & Play with bassinet, toddler utensils. Main floor living area and foyer surround rock fireplace with comfortable seating for 8+, half bath, and pantry off kitchen. The master bedroom features a Tempurpedic king mattress, high quality sheets, down bedding, mirrored vanity, sitting area with a private deck. The En Suite Master bath includes a large walk-in shower, a Jacuzzi jetted bathtub, double sinks and private toilet, lockable safe and walk-in closets. All bedrooms feature Samsung smart TVs with streaming service and are Bluetooth headphone compatible. Three downstairs guest rooms feature queen beds, high quality bedding and high thread count sheets, reading lamps, desks/ vanities, magnifying mirrors, suitcase stands and ample closet space with hangers, pillows assortment and ample spare bedding. Fitness room, dumb bells, elliptical machine, recumbent bike, treadmill, far infrared sauna, and TV. Theater/ family room: 80” TV, surround sound, DVD player, wet bar, mini fridge. Full bath downstairs with double sinks, shower/bathtub. Linen closet with ample towels. Laundry rooms upstairs and downstairs with ample supplies for Guest(s) laundry. Games, cards and books. 13. None of the items of personal property supplied with the Property can be taken off the Property. Loss of these items as well as damage to the Property or furnishings in excess of normal wear will be charged to the Guest(s). 14. Streaming TV: Many services are provided and many options are available, such as Hulu, Paramount+, Disney+, Netflix, and many more. Service level has been chosen by the Owner. No refund of rents shall be issued for Wi-Fi outages, content or lack of content, or personal preferences with regard to streaming services. Additional channels may be downloaded by Guest(s) at the time of stay. 15. Internet: Two high-speed wireless hotspots are provided as a convenience only and are not integral to the agreement. No refunds shall be given, content, lack of content, speed, access problems, lack of knowledge of use, or personal preferences with regard to internet service. 16. Firearms and Hazardous Materials: Firearms shall not be allowed on the Property. Guest(s) agree that fireworks and other hazardous materials shall not be used in, on or around the Property. 17. Responsibility for Children: All children under the age of 18 shall be accompanied by a responsible adult. The Property is not child- proofed environment. This does not mean children are unwelcome, children are welcome, as long as the Guest(s) bringing children to the Property insures that the child/ children remain(s) under the close, constant and complete control and supervision of the responsible adult at all times. Guest(s) accept responsibility for children(s) behavior and safety. Do not allow children to jump on beds or furniture. 18. Rights of way; Parking; Signage: All Guest(s), visitors and invitees must give the right of way to Owner’s family and pet, Host/Manager, and other guests. Drive slowly and use caution backing up and around snow removal equipment if present. There are a total of 7 (seven) parking spaces, 2 inside the garage, 3 in front of the home, as marked by white lines and two to the right of the curve in the driveway when entering, as indicated on parking map. Do not allow any Guest(s), visitors or invitees to park in front of any roll up garage door, block other vehicles in or double park. Guest(s) or visitors or invitees that are improperly parked will be towed at the Guest(s) expense. Guest(s) visitors and invitees are to read and obey all signage, heed all warnings, including but not limited to parking, use of sauna and exercise equipment. Guest(s) who use sauna and exercise equipment do so at their own risk. 19. Host/Manager/ Owner Contact: a. Host, Manager and Owner contact information is usually release after the booking process is completed online. 20. Items provided for Guest(s): High quality linens and towels, complimentary ground coffee, coffee pods, creamers, plastic zipper bags, wraps, paper plates and bowls, plastic utensils, paper towels, toilet paper, facial tissue, napkins, trash bags, anti-bacterial hand soap, dish soap, dishwasher pods, laundry soap pods, softener, and laundry supplies, salon quality shampoo, conditioner, and body wash for the duration of your stay. 21. Items Guest(s) must provide: Guest(s) are responsible for providing all personal supplies and all food and beverages. Any necessary or desired personal items, and any food and drink items. 22. Lost, Stolen or Abandoned Articles: Valuable items left behind by tenant will be held for tenant and every reasonable effort will be made to contact for return. If items are not claimed after 15 days after check-out they shall become property of the Property Owner (GBG). The Property Owner (GBG) shall not be held liable for the condition of said item(s). There will be a $25.00 fee plus shipping for any returns. 23. Rental Cancellation: Owner reserves the right to refuse rental to anyone. Owner reserves the right to cancel the rental (reservation) of the Property without prior written notice or liability in the event of a sale of the Property or if the Property becomes unavailable. Guest(s) will receive a complete refund. 24. Pets: There are NO PETS ALLOWED at the Property. Documented service animals are the only exception, fees for damages and cleaning still apply should they oocur. Any violation will result in occupant removal and forfeited rental fees. By making this reservation, Guest(s) acknowledge that NO PETS are allowed anywhere on the Property without prior written consent of the Owner. IMPORTANT: Unauthorized occupancy with pets will result in a $500. Fine, immediate termination of rental contract and loss of all rents and security/ damage deposits/ payments. 25. Check-In Time and Procedure: Check-in anytime after 3:30 pm. The Property has a contactless check- in. An email and text will be sent to you prior to check-in with the gate code, and a code for the entry, garage and kitchen doors, as well as information regarding the roll up garage door openers and gate openers. 26. Check-Out Time and Procedure: Check- No Later than 11:00 a.m. It is not necessary to strip beds, start laundry or take out trash. At the termination of stay, leave used/ soiled beds in unmade condition and used/ soiled or wet towels and robes in bathtubs. Do not leave food outside. Check thoroughly for all personal items. Turn off air conditioner. If temperatures are expected to be below 32 degrees, leave heat on 50 degrees. Leave garage and gate openers on desk in kitchen. Lock all doors and windows. Guest(s) will be charged $45. For every missing gate opener, garage opener, or safe key. 27. Property Rules and Regulations: Guest(s) agree to abide by any and all additional use rules and regulations as set out by the Owner, a copy of which is provided in the Property binder located on the kitchen island. 28. Indemnification and Hold Harmless: Guest(s) agree to indemnify and hold harmless Owner, Manager and/ or Host for any liabilities, theft, damage, cost or expense whatsoever arising from or related to any claim or litigation which may arise out of or in connection with Guest(s) use and occupancy of the Property including but not limited to any claim or liability for personal injury, death or damage or theft of property which is made, incurred or sustained by Guest(s) or Rental Party, and any damages or liability resulting from the use of the Property, or resulting from exploring or hiking on the Property, etc. The Owner shall specifically have no liability with respect to the use of the Property, premises, etc. by the Guest(s), Rental Party, or their family, guests, visitors, invitees, etc. and the Guest(s) shall specifically indemnify and hold the Owner harmless, including the costs of attorney’s fees necessary to defend such actions. Guest(s) acknowledges that the use of the Property by the Guest(s) and Guest(s) visitors and invitees is entirely at their own risk. Guest(s) will indemnify and hold harmless Owner from any and all expenses, costs, damages, suits, actions or liabilities whatsoever arising from or related to any and all loss of or damage to personal property, injury or death resulting from the use or occupancy of the Property or the failure of any member of the Rental Party or Guest(s) visitors or invitees to observe the Rules and Restrictions set forth in this Agreement. 29. Violation of Agreement: If Guest(s) any of the conditions of this Agreement, the Host/ Manager/ Owner may terminate this Agreement and enter Property. Upon notice of termination of this Agreement, Guest(s) shall vacate Property immediately and forfeit all rents and security deposits. 30. Holding Over: Because this is a short- term vacation rental, Guest(s) understands and is hereby put on notice that any unauthorized “holding over” of the Property past the stated rental period could cause loss of rental income from other previously booked guests, temporary and /or permanent loss of business and reputation and could cause Owner to breach an agreement with similar short term vacation guests who have reservations during the Guest(s) unauthorized “holding over” period. In such event, Owner may be legally liable in damages to said other guests. Any unlawful detainer action shall be brought under the laws of the State of Washington. Guest(s) acknowledge that this is defined as a short-term rental agreement under Washington law and that no notice is required in order for Owner to take any necessary legal action to evict the Guest(s). If Owner shall agree, in it’s sole discretion to allow the Guest(s) to extend their stay, said extension shall require booking a new reservation and agreement to the Terms and Conditions of Agreement. 31. Consent to Jurisdiction and Venue; Waiver of immunities: Guests hereby irrevocably submit to the jurisdiction and venue of the state Superior Court sitting in Spokane County, Washington, in any action or proceeding brought to enforce or otherwise arising out of or relating to this Agreement. Guest(s) irrevocably waive to the fullest extent permitted by law any objection that Guest(s) may now or hereafter have to the laying of venue in any such action or proceeding in any such forum, and hereby further irrevocably waive any claim that any such forum is an inconvenient forum. Guest(s) agree that a final judgment in any such action or proceeding shall be conclusive, and may be enforced in any other jurisdiction by suit on the judgment, or in any other manner provided by law. Nothing in this Agreement shall impair the right of the Owner to bring any action or proceeding against the Guest(s) in the courts of any other jurisdiction. 32. Attorney’s Fees: In any action or proceeding involving a dispute between Owner and Guest(s) arising out of this agreement, the prevailing party will be entitled to to reasonable attorney’s fees. 33. Time: Time is of the essence of the Agreement. 34. Acceptance of Agreement: By booking a reservation online, Guest(s) agree to pay all rent and charges related to Property rental. Guest(s) accepts all terms of the lease agreement and accepts all liability for rent and charges related to Property rental as well as any damage beyond normal wear during the Guest(s) lease with Owner. 35. THIS IS A VACATION RENTAL AGREEMENTUNDER THE LAWS OF THE STATE OF WASHINGTON. THE RIGHTS AND OBLIGATIONS OF THE PARTIES TO THIS AGREEMENT ARE DEFINED BY LAW AND INCLUDE PROVISIONS PERMITTING EXPEDITED EVICTION OF TENANTS. BY MAKING THE RESERVATION ONLINE, YOUR PAYMENT OF MONEY OR TAKING POSESSION OF THE PROPERTY AFTER RECEIPT OF THE AGREEMENT IS EVIDENCE OR YOUR ACCEPTANCE OF THE AGREEMENT AND YOUR INTENT TO LEASE THIS PROPERTY FOR A VACATION RENTAL. House Rules: • No Pets without Owner’s prior written consent. • No Smoking or Vaping, (Marijuana or tobacco cigarettes, cigars, electronic cigarettes, or any similar product whereby using it generates smoke, odors or vapors). • No loud parties or events. • Self-Check- In with gate and door codes. • No ATV’s or other off-road vehicles shall be used on the Property. • The Property is there for your enjoyment. While enjoying the Property please stay within the Property’s boundaries as defined by the attached map. • Guest(s) making online reservations must be at least 25 years of age. Members of rental party under the age of 18 must be accompanied by a responsible adult. • No bikes or other recreational equipment inside the home. Please use the garage for those items. • Use complimentary make-up remover wipes and black wash cloths to remove makeup. • Use only dark towels for spills or messes. • Use exhaust fans when cooking/ showering. • Be respectful of neighbors and reduce noise during quiet hours of 10 a.m. and 7 a.m. • Enjoy your stay at the Grand Getaway, and have fun!
