RENTED WITH SEASONAL CONTRACT. The space DIRECT ENTRANCE FROM THE STREET GROUND FLOOR APARTMENT Other things to note WE RENT WITH A SEASONAL CONTRACT. Personal information will be requested to complete the rental agreement after booking. We will request a photo of your ID/NIE or passport. You will also have to provide the following information: full address, telephone number, email and specific reason for your stay in Madrid. This information must be sent immediately after booking. It is not possible to give the data upon arrival, because we are a company, we manage many apartments and we need advance notice to prepare the contracts. If a reservation is canceled due to not having sent the information previously, the cancellation will be made in the name of the tenant, and the corresponding penalties will be applied. By law in Spain, a contract must be signed for temporary rentals and we comply with the law, so under no circumstances can we let a guest enter an apartment if the contract has not been signed. The hours available to make the contracts are from Monday to Friday from 10:00 am to 5:00 pm. There is no availability to prepare contracts on weekends or holidays. Therefore, if you book to enter on non-working days, you must take the precaution of sending the data in advance. ___________________________________________________________ In order to check in, you will need to sign the following contract in advance: On the one hand, Mr. XXXXXXXXXXXX, of legal age, with ID number XXXXXXXXXX, residing in Madrid on behalf of BEMADRID DREAMS S.L., with address for notification purposes at Calle Alcalá 20-2º - Oficina 209 and CIF B09717042 (hereinafter referred to as "BEMADRID") On the other hand, Mr. XXX, of legal age, with habitual address at Calle XXX and ID number XXX. With the following contact details for the purpose of notifications: Telephone: XXX E-Mail: XXX (Hereinafter referred to as "The Lessee") All parties recognize sufficient legal capacity for this act and freely, STATE 1. I. That BEMADRID manages the following property for seasonal rental in perfect condition: PROPERTY: Address: Calle XXX de Madrid in the conditions and with the furniture and services whose description and photographs are displayed on the page of the XXX platform. The house is clean, in perfect condition of use, conservation and habitability and the supplies and services that it has are in operation. II. Both parties have agreed to enter into the seasonal lease of the property described above, and therefore establish this contract, which will be governed by the provisions of the following, CLAUSES FIRST. - OBJECT BEMADRID assigns a seasonal lease with the duration that will be indicated to the Lessee, who accepts, the property described and the furniture described in Exhibit I. This lease constitutes a Seasonal Lease for the reason of XXX, provided for in article 3 of the Urban Leasing Law, and under no circumstances and situation that occurs, the lease of the object of this contract may be used for habitual residence. SECOND. - RENT AND EXPENSES. 2.1 The net seasonal rent is XXX EUROS (€XXX), and will be paid to the XXX platform, with whom you have contracted the stay, according to the conditions that the platform has indicated to the lessee in your reservation/contract. 2.2 Electricity, gas, water and internet expenses are included in the rent payment. THIRD. - DURATION. This contract is granted for the season that runs from XXX XXX 202X, and will be automatically terminated without the need for any notice, on XXX XXX 202X, and the Lessee must deliver the keys at that time, or before in the event of an earlier departure, at our offices in Alcalá 20 in Madrid. The duration of the contract is mandatory, so early cancellation will not be possible. It is expressly stated that under no circumstances will it be possible to extend the duration of the contract. The Lessee must leave the property in the state in which it was found, leaving it free of effects and furnishings and the services available and the furniture and furnishings mentioned in Recital I remaining in perfect condition. FOURTH. – CONSERVATION, WORKS, REPAIRS AND GENERAL ISSUES. 4.1 The Lessee undertakes to keep the Property in perfect condition for the duration agreed between both parties. 4.2 The Lessee may not carry out any activities in the dwelling that are annoying, unhealthy, harmful, dangerous, illegal or contrary to the Community Statutes. Nor may they store flammable, explosive or corrosive materials in the dwelling and/or carry out commercial or industrial activities in the dwelling. The Lessee shall be subject throughout the term of the contract to the rules of the community of owners, especially those relating to coexistence. It is expressly forbidden to hold parties or any other event in the house that disturbs the life of the neighbors of the property. 4.3 The Lessee shall be directly and exclusively liable for any damage that may be caused to persons or things and that may be derived from facilities for services and supplies of the leased house and contracted by the Lessee, as well as for any damage, deterioration or loss that may occur in the same, whether caused by the Lessee or by the persons living in the dwelling. 4.4 Minor repairs required due to wear and tear from the ordinary use of the property shall be borne by the lessee. The lessee may not carry out any other type of work or modification to the property or building to which it belongs without the express consent of the lessor. Despite not being considered a work, the tenant is expressly prohibited from making holes or perforations in the walls of the property. In the event that the tenant requires the presence of our maintenance personnel for any type of repair requested by the tenant or for reasons not attributable to the lessor, BEMADRID will charge 50 euros for the displacement of the maintenance personnel and another 50 euros for each hour employed. 4.5 The lessee will allow BEMADRID to enter the apartment to show the house to other future tenants and for this BEMADRID will notify with a minimum of 24 hours. FIFTH. -WAIVERS The Lessee waives the rights contained in articles 31 to 33 of the Urban Leasing Law, and therefore the rights of Leasing, subrogation, assignment, or transfer, whether in whole or in part, trial, withdrawal and right to challenge the transfer. SIXTH. - PENALTY CLAUSE Failure to comply with the obligation to leave the Property within the agreed term will oblige the Lessee to pay, as a penalty clause, the sum corresponding to three times the daily rent, payable for weeks due until the free availability of the property by the lessor, without prejudice to the costs, expenses and other compensation that may be borne by them, including lawyers' and solicitors' fees, even if their intervention is not mandatory. SEVENTH. - JURISDICTION AND APPLICABLE LEGISLATION. The constituent parties submit to the jurisdiction and competence of the courts and tribunals of the place where the Property is located, expressly waiving their own jurisdiction. The laws of Spain and specifically the current Urban Leasing Law are applicable. Both parties ratify this contract and sign in duplicate, for a single purpose, in the place and on the date indicated in the heading. BEMADRID XXX -------------------------------------------------- REGARDING CHECK-IN: We remind you that our check-in hours are Monday to Friday from 4:00 pm to 8:00 pm. IN CASE OF CHECK-IN FROM MONDAY TO FRIDAY FROM 4:00 PM TO 8:00 PM, YOU MUST COLLECT THE KEYS AT OUR OFFICE LOCATED AT CALLE ALCALA 20, PLANTA 2 OFICINA 207. If your arrival is at a time other than the one previously informed, you must confirm if there is a possibility of check-in at that time, especially if it is night check-ins, weekends and holidays and in that case the tenant will pay a one-time supplement of 15 euros, which will be delivered by hand to the person in charge of check-in. Only in these cases will the keys be delivered to the home. ---------- DURING YOUR STAY/COMMUNICATION: Once you have checked in, we will be available to assist you Monday through Friday from 10:00 AM to 8:00 PM. Communication must be through the Airbnb platform. We are not available on weekends or holidays. If you leave us a message on a holiday that falls from Monday to Thursday, you will receive a response the next day, and if it is a holiday that falls on Friday or on a weekend, you will be attended to on Monday. The email and phone number you will have after booking is from the office and is also available during the hours explained above. --------- REGARDING CHECK-OUT: You just have to leave the keys inside the house, close the door tightly and let us know that you have left. CHECK-OUT TIME 10:00 AM. ---- FURNITURE, ARTIFACTS: It is very important that you know that we cannot remove furniture from the house or take something that we have not offered in our listings, for example cribs, desks, etc. The apartments are delivered just as shown in the photos. We ask that you please check before booking whether or not the apartment has appliances that are vital to you, since not in all cases the apartments have, for example, a coffee maker, toaster, iron, etc., and if it does not have it and we do not offer it, we will not be able to take it. We clarify this as we do not want to give guests false expectations. And know what you are booking and what you have in the apartments before you do it. ----------------- CLEANING: We deliver the house clean. We do not provide maid service during your stay. We only leave welcome personal hygiene products (for 1 day) We do not leave cleaning products. ------------------ Pets are prohibited. --------- No parties are allowed inside the house. ------------- WE ADHERE TO OUR CANCELLATION POLICY WITHOUT EXCEPTION We assume that you have read the rental terms before booking.
