Please be sure to read and understand the contents before you agree to the terms. ------------------------------------------------ STAYCATION Accommodation Agreement (Hotel Business/Private Lodging) The owner of the private lodging facility (hereinafter referred to as the "Business Operator") and the Guest, who is the person making the reservation, agree to the following terms and conditions regarding the accommodation facility operated by the Business Operator (hereinafter referred to as the "Property") or the services provided by STAYCATION, Inc. (hereinafter referred to as the "Company") at the Property (hereinafter referred to as the "Services"), and enter into a private lodging agreement (hereinafter referred to as the "Agreement"). In order to use the Service, you must agree to all of the terms of this Agreement, and when you use the Service, you are deemed to have agreed to this Agreement. [What Guests should understand about using the Property] The purpose of this service is to allow guests to become villa owners themselves and enjoy the lifestyle unique to villa owners in the area while using the property. In other words, it is not intended to provide hotel-like hospitality services to guests. Of course, the staff will prepare carefully for your comfort. However, insects and small animals may enter the room of a private lodging on a resort. Even in such cases, we do not provide services such as hotel-style butler extermination. In addition, if the window glass is damaged or leaking due to wear and tear of consumables, shortages, natural disasters such as typhoons, etc., the guest will be responsible for dealing with it on their own. I can't list everything, but if you become a villa owner, you'll need to do it yourself. Please understand that this property is an owner-absent private lodging facility. In addition, we may inconvenience you due to equipment and facility failures. In that case, it may take some time for the repair to be completed, and sometimes it may not be possible to repair. Please fully understand this point before applying for the property. * Please note that no cleaning will be done during your stay. 1. Purpose and Form 1.1. The purpose or form of the property under this Agreement shall be a private lodging agreement for temporary use. Guests may not use the property for any purpose other than this. Membership registration (STAYCATION member) is required to receive this service. 1.2. Unlike a hotel or inn, the Guest will use the property as a temporary base of living. Guests should be considerate of their neighbors and use the property with the duty of care of a good manager so as not to cause any inconvenience. 1.3. Unless specifically authorized by the Company, the Guest may not sublet or re-let the property, or transfer the Guest's right to use the property to a third party. 1.4. Please vacate the property at the end of your stay. You can't renew your contract or extend your stay. If you wish to continue using it, you will need to reapply and sign a new accommodation agreement. 2. Establishment of the Agreement 2.1. This Agreement shall be deemed to be in effect when the Guest applies for use after accepting this Agreement, pays the fees and expenses within the period specified by the Company, and the Company confirms the personal information (address, name, occupation, and in the case of foreign guests, passport number and passport copy) of all Guests. If we are unable to confirm payment of fees and expenses and the personal information of all guests, your private lodging application will be canceled. 2.2. We will ask you to pay the full amount in advance. If you pay by bank transfer, or if we issue a refund due to a cancellation, the guest will be responsible for the transfer fee. 2.3. Changes, cancellations, and cancellation fees for reservations for the use of the property shall be as stated on the relevant facility page on this website. 2.4. If there is any change in the registration information, the Guest shall submit the documents requested by the Company without delay, in the manner specified by the Company. 2.5. Guests shall manage and store their passwords and user IDs at their own risk and shall not allow third parties to use, lend, transfer, change the name, or buy or sell them. 2.6. The Guest is responsible for any damage caused by inadequate management of passwords or user IDs, misuse, or use by a third party, and the Company will not take any responsibility. 2.7. If the Guest finds out that their password or user ID has been stolen or is being used by a third party, they shall immediately notify the Company to that effect and follow the Company's instructions. 3. Terms of Use 3.1. The Guest may use the Service during the term of this Agreement, within the scope of the purpose of this Agreement and to the extent that it does not violate this Agreement, in accordance with the method specified by the Company. 3.2. The property may be unavoidably unavailable in the event of bad weather such as typhoons or natural disasters such as earthquakes. In addition, if the Company determines that the Property is unusable or if the Property is damaged or lost, this Agreement will be terminated immediately and the Company will refund the Guest the amount equivalent to the number of days that the Property was unavailable (24 hours from 12 noon to 12 noon the next day is considered one day). 3.3. In the event of a disaster such as an earthquake, fire, tsunami, typhoon, or landslide, or any other emergency, please take action to protect your life. If there is an evacuation order, be sure to follow the instructions of the local government and act promptly. 3.4. The Guest shall be responsible for and bear the cost of preparing and maintaining the computer, software, and other equipment, communication lines, and other communication environments necessary to receive the provision of the Service at the time of booking. 3.5. Guests shall take security measures, such as preventing computer virus infection, unauthorized access, and information leakage, at their own expense and responsibility, according to their own Service usage environment. 3.6. Please note that in the event of contact or inquiries from a third party, the Company will not forward them in order to protect the privacy of the Guest. 3.7. If you do not have Japanese nationality, you'll need to submit a copy of your passport when you check in. 3.8. This service may not be used by anyone under the age of 20. 4. Property management 4.1. The property is an "unattended private lodging property". Unlike a hotel or inn, this property does not have staff on hand. Guests are responsible for their own safety management, such as fire prevention, during their stay. Please also note that surveillance cameras are installed in the outer structure, garden, and entrance for management and security purposes. 4.2. The utility fees for electricity, gas, water, etc. used in the property are as follows: Electricity: 67.5 kWh/day, Water: 3 cubic meters/day, Gas: 3 cubic meters/day, Hot water: 1000 L/day (24 hours from 12 noon to 12 noon the next day is one day). This amount is included in the price and administrative expenses. Hot spring water is only available in the corresponding facilities. We will charge you separately if the usage exceeds the amount specified by us. In addition, there will be a separate usage fee for cold regions and specific facilities. 4.3. When using the property, in addition to this Agreement, the Guest will comply with the house rules of the property and related laws and regulations, as well as the rules of the neighborhood association, residents' association, and management association. 4.4. In the event of unlawful acts or similar acts during use, acts that cause inconvenience to the neighborhood, suspension of use by the business operator, or significant damage to the property, we may refuse all future stays at properties handled by the Company. 4.5. If you are using the property for the purpose of seminars, events, parties, or selling goods, you'll need to submit the relevant documents, such as a project plan and product brochures, to the Company in advance. Please note that if we determine that the content is inappropriate or unsuitable, we may refuse to use it after the application or after receiving the payment. If the above materials are not submitted by the date specified by the Company, or if it is found that the use was for the purpose of seminars, events, or sales of goods, etc., after use, the contract will be canceled immediately and use will be discontinued. In that case, the fees and repair deposits will be used as part of the penalty, so they will not be refunded. In addition, we will not compensate for any damages suffered by the guest as a result. 4.6. We strictly prohibit entry to the property (including the premises) by anyone other than the guests registered at the time of application. If someone other than a guest enters the property, a separate advance notice and submission of personal information will be required, as well as a fee. Please note that we may not be able to accommodate your request. If you enter without permission, we will confiscate the fee and you will be charged a penalty. 4.7. On the first day of use, the Guest will check the Property and any attached equipment or facilities for dirt, damage, or malfunction, and will notify the Company by email and telephone on the first day of use if there is any dirt, damage, or malfunction. This serves as property confirmation, but no notification is required if there are no problems. However, if the Company or business operator confirms that there is dirt, damage, or other problems after the guest has left the room without notice, the guest agrees in advance that they will be responsible for paying the cost of restoring the room to its original condition. 4.8. If the Guest causes damage, such as stains, breakage, destruction, loss, or malfunction, to the Property or the equipment or fixtures attached to the Property, the Guest will be charged the cost of restoring the Property to its original condition. In addition, if the guest is found to be intentionally or negligently responsible, the guest will be liable for any damage caused by such acts. 4.9. The extension, renovation, relocation, remodeling or remodeling of the property or the installation of works on the premises of the property is strictly prohibited. 4.10. If the Guest stops using the property before the expiration of the period of use or shortens the period of use for their own convenience, the Company will not refund the fees received. 4.11. The property is a rental house and villa, so we may be selling it at the same time as accepting private lodging reservations. As a result, the property you booked may not be available if the sale is completed. In that case, please note that we will change or refund the property you are using. We may also have to cancel your contract due to business reasons or other circumstances. In that case, we ask for your understanding that we will either change the facility or refund the payment. 5. Expenses for which the Guest is liable 5.1. In addition to paying the usage fee, the Guest will be required to pay a repair deposit or register a credit card number at the time of booking as a guarantee of the expenses for which the Guest is liable. The repair deposit is generally 50,000 yen, but there are exceptions depending on the facility and plan. Please note that the credit card number you used to make the reservation (for payment) will be used as the credit card number you register. 5.2. The repair deposit may be used for expenses for which the Guest is liable under this Agreement (hereinafter referred to as "Other Expenses") may apply. In addition, if the Guest falls under the prohibited matters in paragraph 11 or the cancellation and compensation for damages in paragraph 14, or if the Guest breaches this Agreement, this repair deposit will be used as part of the penalty and will not be refunded. 5.3 If a credit card number is registered, we will charge the credit card for actual costs, expenses, and penalties at our discretion. 5.4 The repair deposit will be refunded without interest within 14 days of the departure date if the Company or the business operator (including the consignor of both) confirms the facility and that it does not fall under the above reasons for negligence or violation. We will only pay the transfer (remittance) fee at the time of refund to domestic financial institutions (in the case of foreign financial institutions and refunds overseas, the transfer (remittance) fee will be borne by the Guest). 5.5. Guests who have used the repair deposit in the past under this Agreement as part of other expenses or penalties will be charged a higher repair deposit at the time of their next use. 6. Vacating the property 6.1. If the Guest does not immediately vacate the property after the expiration of this Agreement, the Guest will be charged double the amount of the fee as damages from the expiration date to the completion date of the vacation. 6.2. Any fixtures, fittings, food, or other items left in the property by the Guest will be disposed of by the Company at any time. If there is a cost for disposal, we will charge the guest. 6.3. The method of surrender shall be explained by the business operator at the time of departure. (This may vary depending on the property, so an explanation may be given before entering the building.) In addition, the time of check-out will be the time when the Guest notifies the Lessor of their departure. In other words, it will be automatically extended until the Lessor receives the notice of departure. 7. Entering the property In the event of an emergency, when we are unable to contact you, for repairs or inspections, etc., we may determine that it is necessary to enter the property, in which case, a manager entrusted by us may enter the property. 8. Photography, etc. on the premises (including the grounds such as the exterior and garden) Unless for private use, photos, videos, etc. taken at the property may not be used to duplicate or publicly transmit (including making it possible to transmit) to websites, blogs, social media, image, video posting sites, bulletin boards, etc. without the Company's permission. In addition, regardless of the reason, if you shoot without permission (including bringing in a large amount of shooting equipment or commercial shooting equipment), you will be charged a studio usage fee (amount obtained by multiplying the length of stay by 27,000 yen) and penalties and damages will be charged. In addition, if photos and videos are leaked to the Internet, or sold on paper media such as books and DVDs, they will be completely deleted, collected and disposed of within 7 days at the guest's expense. In that case, we will charge 10 million yen as damages. 9. Changes or cancellation of reservations 9.1. Changes and cancellations to your reservation are subject to the cancellation policy listed for each facility on this website. 9.2. Changes and cancellations are free of charge until the cancellation fee is incurred. Cancellations and changes to the schedule after the cancellation fee is incurred will be subject to the cancellation fee for the entire period of your reservation. In case of no-show (unauthorized cancellation), 100% of the fee will be charged. However, this does not apply if all means of transportation to the property are interrupted due to bad weather. Guests will be responsible for any bank transfer fees associated with refunds for cancellations made by the guest. 9.3. If you miss the arrival time you declared at the time of application, it will be treated as a same-day cancellation. 9.4. We may cancel your reservation as a result of our review of guests. Please note. 10. Optional Services For optional items such as wedding parties, catering, marine sports, nature walks, and other tours and treatments, you will be entering into a direct contract with the service provider. In this case, we will only be able to introduce you, so we cannot be held responsible for any accidents, injuries, etc., including refunds of usage fees. Please use them at your own risk. 11. Prohibited matters 11.1. Guests are prohibited from engaging in the following: In the event of a violation, the full amount of the repair deposit will be confiscated, a penalty will be charged, or both. (a) Smoking, fireworks, candles, bonfires, or any other use of fire not permitted by the Company on the premises (Use of fire outside the specially permitted areas and discovery of cigarette butts, etc. in the facility will be considered a violation) (B) Manufacture or store guns, swords, or explosive, flammable, or other dangerous substances (C) Violations of the rules of neighborhood associations, residents' associations, management associations, etc., and acts that cause complaints from neighbors (D) Eating, drinking, barbecuing, or similar activities outdoors, on the terrace, or on the balcony, unless specially permitted by the Company (E) Making noise outdoors, day or night (K) Dangerous or disturbing noise, loud TV, stereo, etc., or playing musical instruments. Such measures may include the forfeiture of the entire security deposit, the collection of penalties, credit card chargeback, or both. The Company may suspend or discontinue the use of the Service in whole or in part without prior notice or demand if the Guest falls under any of the following reasons: (a) In the event of a breach of any provision of this Agreement (B) When false information is found in the registration information (C) When the Service is used or attempted to be used for a purpose or method that may cause damage to the Company, other Guests, external social media network providers, or other third parties (D) When the operation of the Service is interfered with, regardless of the means (D) When conducting regular or emergency inspection or maintenance of the computer system related to the Service (F) When the Service can no longer be operated due to force majeure such as fire, power failure, or natural disaster (G) When it becomes difficult to provide the Service due to a failure of the building facilities necessary to provide the Service (g) In addition, when the Company determines that it is necessary to suspend or interrupt the Service 12.2. The Company is not liable for any damages caused to the Guest by the Company's actions under this paragraph. 13. Disclaimer 13.1. The Company and the business operator are not responsible for any damage caused by the guest or the guest's companion, such as an accident, injury, theft, or other reasons not attributable to the Company or the business operator, in the vicinity of the building, inside the building, or in the parking lot. 13.2. In the performance of this Agreement, the Company shall only be liable for direct damages suffered by the Guest if the Company has caused such damages intentionally or through gross negligence. In all other cases, the Company shall not be exempt from liability. 14.4. Complaints and claims regarding the property will only be accepted from the representative of the guest who is the contract holder. 14.5. We are not responsible if any valuables are lost or stolen in the facility. 14.6. We are not responsible for any accidents or injuries that are not caused by the facility or the Company. 15. Changes to the Service and Terms 15.1. The Company may terminate the provision of this Service at its discretion. 15.2. The contents of this Agreement are subject to change without notice to the Guest. In this case, the Guest will be bound by the revised terms. Please be sure to review and understand this Agreement again before entering the property. 16. Text and Governing Law The text of this Agreement is in Japanese and the governing law is Japanese law. 17. Jurisdiction The Tokyo District Court or the Tokyo Summary Court shall have exclusive jurisdiction in the first instance over any dispute arising out of or in connection with this Agreement.
