A holding tank and pump system provide great water pressure and water supply. Since we share a spring with our neighbors, out of an abundance of caution, guests are asked to use water responsibly. In the event of a power outage, the water pump at the holding tank will not operate. We supply gallon jugs of water that are stored in every bathroom and the utility room and laundry room. We do not have a generator. **Details about the Sapphire Valley Resort amenities available for guest use: Sapphire Valley Resort charges guests $5/day or $25/week if you would like to use any of the Sapphire Valley amenities. Pick up amenity cards at the Guest Services Center. The Sapphire Valley Resort website has a current activity schedule as well as details about all the amenities offered. Some of the amenities have additional fees. For example, boat rental at Fairview Lake has hourly and daily rates. Please contact Sapphire Valley Resort for up to date availability and fees for all of the amenities offered. Guest access Parking for 4 cars at the end of a long, gently sloping gravel driveway. The streets at the top of the mountain near our home are walkable and have very little car traffic. The Ingles grocery store in Cashiers is about a 20 minute drive from our house. Our home elevation is 4240 feet and you will be driving up a very well maintained road that can be steep and very curvy in parts! Once you are near the top of the ridge, we are a good distance from the main mountain road . It is normally very quiet up in our little neighborhood. Owner will require guest to provide a picture of a government issued photo ID. Guest will be in payment default and invoke cancellation if payment is not received according to the schedule set forth in the AirBnb or VRBO booking or direct booking arrangement with owner. Payments Method--Via Airbnb or VRBO Cancellation Policy - details in Guest VRBO or Airbnb reservation. Homeowner Contact: Please use VRBO or Airbnb portal. TERMS AND CONDITIONS: 1. NON-LIABILITY OF THE OWNER: This Agreement is entered into based upon Guest’s independent knowledge of the Property or the representations specifically contained in this Agreement and not on any representations made by the Owner or its Agents. The Owner shall not be liable for any damage or injury of or to the Guest, Guest's family, invitees or agents or to any person entering the Premises or the building of which the Premises are a part or to goods or equipment, or in the structure or equipment of the structure of which the Premises are a part, and Guest hereby agrees to indemnify, defend and hold Owner harmless from any and all claims or assertions of every kind and nature. The Owner is not responsible for the loss of personal belongings or valuables of the Guest. It is agreed that all guests are expressly assuming the risk of any harm arising from their use of the premises or others whom they invite to use the premise. 2. ACCEPTANCE OF PROPERTY: Opinions as to the condition of the Property vary from individual to individual and are very subjective. If the Guest has not personally viewed or inspected the Property, the Guest shall not rely on any opinions expressed by a third party, including the Owner or its Agent. The Guest bears the sole risk of renting the Property sight unseen and in not being satisfied with the condition of the Property at the time of check-in. The Guest has not been promised anything as to the condition of the Property unless stated in this Agreement. The Property is rented “as is”. 3. PETS: Absolutely no Pets (including emotional service animals) shall be permitted on the Property. The Guest shall obey this and all of the Owner’s other rules for the safety and cleanliness of the Property and for the comfort and convenience of future occupants. If a guest is found to have a pet on the premises, the guests will be immediately asked to vacate the premises with no refund. Having a pet on the Property is grounds for potential retribution for future lost income and cleaning fees. This includes but is not limited to the relocation of future guests, extensive carpet and upholstery cleaning, and restoration of property and contents to a satisfactory level as determined by owner. 4. NO SMOKING: This is a non-smoking rental unit. No smoking is permitted anywhere inside of the rental property. Please no smoking outdoors near open windows or doors. 5. FIRE SAFETY: GUESTS SHALL USE THE UTMOST CAUTION IN THE OPERATION OF BOTH THE INDOOR AND OUTDOOR FIREPLACES. When in use Fireplaces SHALL NOT BE LEFT UNATTENDED. All fires must be extinguished before leaving unattended. Fireplaces shall only be used with dampers open and screens in place. GUESTS ARE REQUIRED TO MAINTAIN A 3 FOOT SAFETY ZONE AROUND THE OPENING OF FIREPLACE AND MAKE SURE ALL IGNITABLE OBJECTS ARE MOVED OUT OF THE 3 FOOT SAFETY ZONE. A FIREPLACE GUIDE IS POSTED NEXT TO EACH FIREPLACE. NO CANDLES ARE ALLOWEED IN THE HOUSE. NO FIRES ON THE PROPERTY OTHER THAN IN THE FIREPLACES. Firewood is provided. 6. USE: The Guest shall take possession of and use the Property only as a private residence for not more than the maximum number of persons as indicated above. The Guest shall not allow the Property to be used for any business, professional or unlawful purposes. House trailers and recreational vehicles are not permitted on the Property. There shall be no alterations of the Property and no fixtures, appliances or air conditioners shall be installed without the written consent of the Owner. The Guest affirms to use all appliances and furniture for their intended uses only. The Guest affirms that he/she is over twenty-five (25) years of age and minors will not occupy the property unless an adult is present. Unreasonable noise or disturbance by the Guest may result in default of Agreement in addition to a fine of $500 if our neighbors contact Sapphire Valley/Blue Ridge Public Safety to report a noise disturbance violation. 7. The Guests affirms to the TRASH REMOVAL PROCEDURES POSTED BY EACH KITCHEN TRASHCAN SO BEARS WILL NOT BE ATTRACTED TO THE ODORS OR PRESENCE OF ANY TRASH IMPROPERLY HANDLED. TRASH REMOVAL PROCEDURE: ALL TRASH MUST BE CARRIED DOUBLE BAGGED THROUGH THE HOUSE AND DOWNSTAIRS TO THE LOWER-LEVEL OUTDOOR DECK UTILITY ROOM AND PLACED IN THE LARGE GREEN TRASH CANS. DO NOT PLACE UNBAGGED TRASH IN THE TRASH CANS. CLOSE THE TRASH CAN LID TIGHTLY AND CLOSE THE UTILITY DOOR TIGHTLY. GUESTS SHALL NOT LEAVE FOOD OUTSIDE. TRASH SERVICE TRUCKS COME PICK UP TRASH EVERY TUESDAY AND FRIDAY AND HAVE ACCESS TO THE LOWER-LEVEL DECK AND UTILITY ROOM VIA THE STEEPLY SLOPED WALKWAY TO THE RIGHT OF THE PROPERTY NEAR THE RAMP. 8. The Guest acknowledges that the Property water supply for the neighborhood is from a treated spring. (Pump No. 2). The spring water is tested regularly for safety. In the event of a power outage, water supply will be affected. The Property does not have a generator. There is an emergency supply of bottled drinking water in the utility room at the foot of the stairs inside. Most of the homes on the top of this mountain ridge are using a spring water supply. The Property is on the Eastern Continental Divide and obtaining well-supplied water and municipality supplied water is not an option at this altitude and location. Because the Property shares a spring water supply with other homes nearby, responsible water use by Guests is required so as not to drain the entire water holding tank. The Owner asks guests to use the clothes washer and dishwasher at night instead of at peak morning/daytime hours. Guests may prefer to bring in their own supply of drinking water. (The owners have always obtained all drinking water directly from the faucets at the Property.) 9. ACCESS TO PROPERTY: The Owner or his agent shall have access to the Property to inspect the property, make necessary repairs, alterations, or improvements, supply necessary services, and show the Property to possible buyers, contractors, etc. Owner shall exercise this right of access in a reasonable manner. 10. AGREEMENT AND GUEST DEFAULT: This Agreement is valid only when accepted by the Owner in writing and may be terminated by the Owner upon the default of any payment, falsified information, or other obligation of the Guest as outlined in this Agreement. Any default by the Guest under the terms and conditions of this Agreement, shall result in the termination of this Agreement, and guest agrees to pay all reasonable costs, attorney fees and expenses made or incurred by Owner in enforcement of this Agreement. 11. RENTABILITY: If the premises are destroyed by fire, other casualty or acts of God so as to be unfit for occupancy, either prior to or during the term of the Agreement, the Owner shall return an equitable, prorated share of any rents that may have been paid in advance. The Agreement shall not terminate as a result of off-site or on-site conditions beyond the control of the Owner or as a result of inoperable appliances at the property. There will be no refunds or rebates given for inoperable appliances or faulty equipment, unfavorable weather, early departure, interruption of utilities, construction in the area, nor maintenance problems. All renters are encouraged to purchase traveler insurance. 12. SUBLETTING: The Guest shall not sublet the Property. 13. UTILITIES: Unless set forth above, utilities are included in rental rate. 14. KEYS AND ENTRY. Owner will provide code for entry to the guest 15. HAZARDOUS MATERIALS, FIREARMS, AND ILLEGAL SUBSTANCES: The Guest shall not keep or have on the premises anything of a dangerous, flammable, or explosive nature that might unreasonably increase the danger of fire or explosion on the Property, or that might be considered hazardous materials (including propane) by any responsible insurance company. Fireworks of any kind are not permitted on the premises. Firearms and illegal substances are not permitted on the premises. BB guns, pellet guns, and Airsoft guns are not permitted on the premises. 16. LEFT BEHIND ITEMS: Owner will not store property left behind by the guest. Personal property of the Guest left after the term of the Agreement will be considered trash and removed by cleaning crew to prepare the unit for incoming guests. Every reasonable effort will be made to reunite Guest with valuable items found by another guest or cleaning crew but no guarantee is implied. 17. OPERATION OF OUTDOOR GAS GRILL: GUESTS SHALL USE THE UTMOST CAUTION IN THE OPERATION OF THE OUTDOOR GAS GRILL. When in use, GAS GRILL SHALL NOT BE LEFT UNATTENDED. Gas Grill must be turned off and all flames extinguished before leaving unattended. Gas supply for the gas grill is under the grill in the cabinet and is controlled by a timer. No outdoor cooking other than on the gas grill. Guest agrees to clean grill after each use. 18. Guest acknowledges that there are security cameras (video only, no audio) placed outside of the rental unit that actively record the parking area and entry and exit activity. 19. DAMAGES/ACCIDENTS TO RENTAL PROPERTY. The rental property will be inspected before check in and after check out. Guest agrees to notify Owner of any pre-existing damages or accidents that occur to the premises or property during the rental period. This must be reported via Airbnb or VRBO portal prior to final departure from the property. Guest hereby assumes all liability for reimbursement to Owner for any damages caused by Guest and their party. 20. MODIFICATION: The parties hereby agree that this document contains the entire Agreement between the parties and this Agreement shall not be modified, changed, altered, or amended in any way except through a written amendment signed by all of the parties hereto.
