This Charming Apartment is made to have all your basic needs met, while being easy to clean and maintain. It has a separate kitchen of good size with a dining table in it. All basic pots and pans, utensils, and dishes are supplied. The apartment has a very comfortable twin bed (the more comfortable type with real wooden slats under the mattress... no springs or metal bars under the mattress. Its a sportive, on the firm size memory foam mattress that people say is very comfortable.) We also have a second twin bed of the same type of frame and mattress, ready if requested for having a guest. All our linens are well cleaned well between each guest stay. The Mattresses and pillows are encased in hypoallergenic water proof pillow case and mattress protectors. The apartment has a nice full bathroom. The apartment has blazingly fast speed wifi. The small 24" smart TV gets local HDTV reception and ROKU smart streaming functions. Many channels for free, or you can access you Netflix account or whatever streaming services you use. If your unit listing says it has "Rooftop Down Draft Evaporative cooler" and you never used one before you can google or youtube how it works to be familiar with it. People in southwest desert have familiarity with these simple efficient and effective coolers that only work in dry climates. If you're not from her this style of air conditioner might be new to you. The cooler is oversized and cools the apartment very capabably. (It is rated to cool 1200 square feet but the apartmet is about 400 square feet.) We also have an automatic gate to our parking lot to discourage trespassers or solicitors and to keep our property private. The Blue line bus is one block away at 3rd and Date. Adults $1 or 50cents for students, seniors, disabled . Local bus to Walmart or Bullocks grocery store, Elephant Butte lake state park, Williamsburg and Hatch. Bus operated M - F and runs about every 1/2 hour. There is a new Airport Shuttle service called "AT MY DOOR SHUTTLE" for Door-to-Door Service to and from the El Paso Airport and points between - cities of Hatch and Las Cruces and Deming . they have a website and FB page There is a Regional bus line with a stop in Truth or Consequences on certain routes called Limousines Express. With buses stopping in T or C from Albuquerque, Socorro, Las Cruces, El Paso and other cities. Bus stop behind the Mc Donald's across street from Walmart which is about 3 miles from our location and can connect to the blue line at Walmart. Guest access Guest's main access is to the Apartment, the walkways to get directly to the apartment from the apartments and the parking lot. Guests do not have access to the back yard. there are chairs and benches in front of most of the apartments for guests to use, but guest should not loiter in front of other apartments of course they should be mindful of the house rules and quiet hours in order to respect the quiet enjoyment of the other tenants and guests . For most of the units on the property the parking spot for normally sized passenger vehicles is directly in front of the apartment door and for most of the units you can park straight Infront or back into the parking spot as you like. But depending on the size of your vehicle and what unit you are booking some of the units required you to park parallel to your front door. We will message you right when you book if this is the case and how/where to park. We also have extra parking spots outside our parking lot but still on our property next to our building near the alley way on the east side of the building . So for a few of the units we find people like to use those spots but we only allow parking there with permission. So we will talk to you about it if needed. If you are in a unit with the more restrictive space in front of your apartment we will message you upon your completed booking where on the property your parking spot will be and it is always pretty convenient from your front door. If you have a larger vehicle there is also ample street parking which is still safe alternative right In front of our building. It is a quiet street with good street light lighting at night. There is also a house across the parking lot from the airbnb apartments. That house is private. We asks guests to not go beyond the parking lot on that property or into that area through that properties sidewalk or front steps. It is clear to see because of gardening fence and curb around the parking lot that it is a seperate area. Therefore please do not go onto that property. There Airbnb Host is hereinafter called “AirbnbHost”. TERM LENGTH OF OF STAY: The booking is for the dates booked on airbnb The AirbnbGuest shall restore the unit to the owner on the end date of the airbnb booking by 11AM (corresponding with the airbnb check out time with this booking is 11AM). STAY CANCELLATIONS: Because there are situations where violations of Airbnb policy can deem your stay subject to immediate cancellation such as, non-payment, safety situations, or violating Airbnb’s “no party and no events policy”, or other violations, if Airbnb deems you violated one of their policies and cancels your stay before the 28th day of a stay, depending on what violation you committed, you can be considered a "licensee" whose permission to stay has been revoked. The AirbnbGuest agrees to fulfill and complete all Airbnb Payment Installments and never miss any airbnb payments and follow the airbnb payment schedule they have agreed to do upon booking the stay on Airbnb. Airbnb divides the entire amount due for the bookings to line up monthly installments collected on the same day of each monthly period with a regular predictable schedule. They disclose this payment schedule in the booking process to you. AirbnbGuests are aware that installments might be attempted to be drawn by airbnb up to 10 days before stays installement due date. Airbnb attempts to contact you to collect any payment that fails, for 72 hours. Within a reasonable amount of time upon termination of this Agreement or AirbnbGuests departure, whichever should occur first, the AirbnbHost shall perform an inspection of the property for the purpose of assessing damage to the Property, if any, and the cleanliness of the Property. AirbnbGuests will be responsible for costs of repair of all such damage, any lost items, and any cleaning costs required to restore the property to the condition it was in at the time the AirbnbGuest took possession, normal wear and tear excepted. The AirbnbHost will not be bound by any estimate of damages made during an inspection at the termination of this Agreement. Any estimates are subject to modification before the final accounting. REPAIRS/ALTERATIONS: AirbnbGuest will not make any repairs at the expense of the AirbnbHost. AirbnbGuest will not paint, paper or otherwise redecorate or make alterations to the apartment or anything on the property without the prior written consent of the AirbnbHost, which shall not be unreasonably withheld. AirbnbGuest will not change or alter or reprogram the door locks or door hardware. Any permitted alterations which are not performed in a workmanlike manner will be corrected at AirbnbGuests expense. DISCLAIMER: Neither the AirbnbHost nor any person working for the Airbnb Host will be liable to AirbnbGuest for any damage or injury to Airbnb-Guest or any other person or any personal property on the Property or the common areas unless it is caused by a deliberate or negligent act of the Airbnb-Host. Neither the AirbnbHost nor any person working for the Airbnb-Host will be liable for the acts of any other AirbnbGuest of any other unit near the Property, or any other person, in the area around the Property or the common area. The AirbnbHost is not responsible for any losses due to fire, flood, any damage by water from whatever source, interruptions of utilities, burglary, assault, theft, vandalism or other crimes in or around the Property, acts of God or any other cause. AirbnbGuest acknowledges that no insurance carried by The AirbnbHost provides coverage or protection for any property of AirbnbGuest. CRIMINAL ACTIVITY: Neither AirbnbGuest, nor any member of AirbnbGuests booked group, nor any other person under AirbnbGuest’s control shall engage in criminal activity, including drug-related criminal activity, on or near the Property or permit the Property to be used for criminal activity, including drug-related criminal activity, regardless of whether the individual engaged in such activity is a member of the household, or a guest. Drug- related criminal activity or criminal activity is a material breach of the house rules and Violation of this policy will result in immediate cancellation of the stay without refund. SECURITY CAMERAS: For everyone's safety and security, the outdoor parking lot and common outdoor areas of the premises are protected by 24 hour Video/Audio Surveillance. When entering these areas you acknowledge and agree to be recorded. INDEMNITY: AirbnbGuest will indemnify and hold harmless the AirbnbHost for all expenses incurred (including attorneys’ fees) as a result of claims of third persons based on conduct or acts of AirbnbGuest or a family member or guest of AirbnbGuest. ATTORNEYS’ FEES: If either party uses the services of an attorney to enforce that party’s rights or the other party’s obligations under this Agreement, any award of damages shall include costs and reasonable attorneys’ fees. If court action is required to terminate this rental agreement, AirbnbGuest agrees to pay all reasonable costs, attorney’s fees and expenses that shall be made or incurred by the Airbnb-Host or apartment managers in enforcing this rental agreement. FORCE MAJEURE: Neither party shall be liable for delay or failure to perform any obligation under this Agreement if the delay or failure is caused by any circumstance beyond their reasonable control, including but not limited to, acts of God, war, civil unrest or industrial action. LAW AND JURISDICTION: This Supplimental Lodging Agreement shall be governed by and construed in accordance with the laws of New Mexico and each party agrees to submit to the exclusive jurisdiction of the courts of New Mexico. SEVERANCE: If any provision of this Agreement is held invalid, illegal, or unenforceable for any reason by any court of competent jurisdiction, such provision shall be severed and the remainder of the provisions hereof shall continue in full force and effect as if this Agreement had been agreed with the invalid, illegal, or unenforceable provision eliminated. TIME IS OF THE ESSENCE: Time is of the essence with respect to the parties’ performance under this Agreement.
