RECITAL: This Transient Agreement is made and entered into between it’s manager on behalf of property Owner(s) the vacation rental Property “Owner” and/or it’s “Manager”, “owner(s)” or “Homeowner” and the undersigned “Transient” who will be staying at this residential vacation property listed in the Reservation Confirmation. Please refer to the Reservation Confirmation for payment, dates, occupancy, and other details. For good and valuable consideration, the sufficiency of which is acknowledged, the parties hereby agree as follows: 2. PROPERTY: The “Property” or “property” or “Premises” or “premises” or “PRP” is located at: 14411 N Denver CT., Spokane WA 99208 Property is fully furnished and includes: Sterns Jurassic Park Pinball, Star Wars Simpsons, Street Fighter II and Dragon’s Lair home video Game machines three (3) TV’s including one 65” Ultra GIANT SCREEN 4K TV, linens, towels , cooking/eating utensils pots & pans, plates and cups, built-in microwave, stove/range, refrigerator, dishwasher, coffee maker, toaster, blender, full kitchen, basic condiments, indoor & outdoor furniture, beds, memorabilia, etc. 3.0 RENTAL PARTY: Occupancy: Transient agrees not to exceed the maximum number of individuals stated in the Reservation Confirmation. The undersigned Transient is aware of, and responsible for adhering to, local ordinance and occupancy restrictions, as applicable. In no case may the total aggregate number of persons during your stay exceed ten (10) in the Transient rental party. People other than those in the registered Transient party set forth above may not stay overnight in or on the property. All persons setting foot in or on the property is the sole responsibility of Transient. Occupancy: Transient acknowledges that any occupancy exceeding the maximum allowed in Transient rental party Agreement any including visitors as stated in the rental agreement is trespassing according to Chapter 70 Section 18-7011 Statutes and subject to criminal and civil legal action. A $100 charge to your payment credit card may be assessed per day and per person over the agreed upon occupancy. Events: The Premises is in a residential area, and may not be used for: Weddings, wedding parties, receptions, bachelor, graduation parties, or other group functions. Using a property managed by Owner for any event or function with the number of persons exceeding the agreed upon occupancy of the property without written approval may result in immediate removal of all persons and loss of fees to be determined solely by Owner. 4. CHECK-IN / CHECK-OUT The RENTAL begins at 4:00 p.m. on the "Check-in Date" and ends at 11:00 a.m. on the "Check-out Date". Owner reserves the right to charge the late check-out fee for any member of the party found inside the home after 11 am on their departure day. There are no late check-outs allowed. Transient agrees to leave the home in a clean, orderly condition. 5. MINIMUM STAY: This property requires a two (2) night minimum stay. Longer minimum stays may be required during holiday or other periods. If a rental is taken for less than two (2) days, the Transient will be charged the two-day daily rate. 6. RENTAL RULES: Transient agrees to always abide by the Rules in this Agreement while at the property and shall cause all members of the rental party and anyone else Transient permits on the property to abide by the rules described in this Agreement. If the premises appear dirty or damaged upon Check-in, Transient shall inform Homeowner immediately. 7. ACCESS: Transient shall allow Homeowner access to the property for purposes of repair and inspection. Homeowner shall exercise this right of access in a reasonable manner. 8. PAYMENT, SECURITY DEPOSIT and TRANSIENT FEES: The Property Damage/security deposit is refundable Providing: a. There is no vandalism or damage to any Property on the Premises, and b. Transient has checked out of House by 11:00am on the Check-out date. c. Transient has honored all terms of this Reservation Agreement. d. If Transient does not honestly state to owner in writing or email at least 72 hours PRIOR to arrival date the number of people in their party (this includes visitors who set foot onto the property but are not staying overnight) it will result in a loss of Transients’ damage deposit and potential additional cleaning charges. CALCULATION OF NUMBER OF PERSONS in your party is done by adding each person during your reservation who will be staying overnight plus anyone who is “just visiting” (i.e., sets foot on the property during your reservation but not be staying overnight). There is an additional charge of $12 per person per night for extra persons exceeding two (2) people. Total aggregate number of visitors and people staying overnight at the property during your stay may not exceed ten (10) persons. In the event you violate the maximum number of people allowed at the property there is a charge of $100 per person per night for each person exceeding ten (10) people. Total Payment including taxes and security deposit shall be due upon Transient approval of this Agreement. 9. CANCELLATION POLICY: You may cancel your reservation at any time. If reservation is canceled payment will be refunded as follows: No Refunds unless requested by Transient in writing and received by Owner more than 7 days before your arrival date. OUR REFUND POLICY (excludes Airbnb.com) is as follows: a. Bookings canceled at least 60 days before the start of the stay will receive a 100% refund. b. Bookings canceled at least 30 days before the start of the stay will receive a 50% refund (minus service fees). c. No refunds if: Reservation cancelled less than 30 days or after your arrival date or you do not show up for your reservation or if you interrupt or cancel your vacation once it has begun. REFUND POLICY (for Airbnb.com only): a. Cancel within 48 hours of booking and 14 days before check-in to get a full refund. b. Cancel up to 7 days before checking in and get a 50% refund (minus service fees). c. Cancel within 7 days of your trip and the reservation is non-refundable. 10. INSURANCE: We encourage all renters to purchase traveler’s insurance. 11. PAYMENT: Acceptable payment methods are online payment by E-check or credit card. 12. SMOKING VAPING OR PETS as well as GUNS AND RECREATIONAL WEAPONS ARE NOT ALLOWED: in the house or anywhere on the property. Aerial fireworks are prohibited by local ordinance. If Transient: Smokes, vapes or brings a pet in house or on property there is a $250 fine plus any additional cleaning charges. Fine may be taken from Transient’s damage deposit. 13. Garbage: Properly bag garbage, place in cans and keep cover to avoid wild animals. Garbage collection is on a regular weekly schedule. Please take note of your rental garbage schedule and leave cans by the street. Transient may leave up to 2 full cans with closing lids upon departure. Please haul excess garbage to the nearest disposal and recycling site, as posted. Fees apply for excessive garbage left at the home, or if wild animals such as raccoons, bears or dogs get into the garbage. Directions: Address information is provided once the following have all been received: final payment, photo ID, and signed rental agreement. Transient is solely responsible for finding the rental home. Planning is recommended. Please be sure to contact staff between 10am-4pm PST if you need help planning your route. No refunds will be given for failure to locate the property. Items Provided: Premises is furnished for typical use. Owner will provide an initial supply of towels, linens, blankets, pillows, cups, knives, forks, spoons, pots & pans, dishes, and other like and similar items. A limited quantity of other kitchen and bath items may be provided for the Transient’s convenience. The purchase of any missing or additional kitchen, bath, and laundry items are the sole responsibility of the Transient. Additional Items: The nightly rate paid for a vacation rental is for the exclusive use of the home during the agreed upon reserved dates. Furnishings and amenities found within the home are complimentary and may not be removed from the property. The premises are equipped for typical use but may not be equipped with all the items the Transient is accustomed to having at home as each Owner has provided their own combination of items. Transient should expect to bring or provide any item which is important to them, at their own cost. For more information about whether specific items are on site, contact Owner or staff prior to arrival. Using Items: The property Owner and Staff will make every effort to assure the home and all equipment is operational prior to your arrival and use of such is complimentary in the event of: Power outage or an item or system is not working (including but not limited to WIFI, A/C or cable) no refunds will be given. Transient is responsible for operating the items and systems found in the home. Transient will only use appliances for their intended uses. Homeowner can NOT guarantee every item requested is available and in working order. Use of Premises: Transient shall use the premises only in a careful and lawful manner. The Premises shall be used for a private residential vacation rental by the persons comprising the Transient’s approved Rental Party. Transient shall not permit other individuals to reside in the Premises or to treat the Premises as a residence. Transient shall not misuse, damage, waste or neglect the Premises. Transient shall not use the Premises for any business, commercial, immoral, or unlawful use. Aerial fireworks are prohibited by local ordinance. If any person: Smokes, vapes, or brings a pet in house or on property there is a $250.00 fine plus any additional cleaning charges. Fine may be taken from Transient’s damage deposit. NO OPEN FLAME CANDLES allowed in house or anywhere on the property. Trailers, Tents and RV’s Using trailers, tents or RV’s for living space or sleeping is not allowed in residential areas of City and County. Parking only (not living or sleeping) for trailers or RV’s MAY be available at some properties with WRITTEN PERMISSION. Quiet Enjoyment Quiet hours are 9 pm to 9 am. The Transient and their Rental Party shall govern themselves at all times in a civilized, respectful manner and shall be good neighbors respecting the rights of the surrounding property owners. The Transient and Rental Party shall not create noises or disturbances likely to disturb or annoy the surrounding property owners. Hot tub, beach, deck and other outdoor noise should be kept to a minimum. Inspection Owner or Agent shall be entitled to access all areas of the Premises for the purpose of inspecting, maintaining and repairing the Premises or having a contractor perform the work deemed necessary. 14. Check-in Address and entry information are provided once the following have all been received: Final payment, photo ID, and signed the rental agreement. Check-in time begins at 4 PM. Owner or staff will make every effort to assure the home is ready prior to 4PM but cannot guarantee any specific time on the day of Arrival. Owner reserves the right to charge the early check-in fee for any member of the party who is found inside the home prior to 4pm on their arrival day. 15.0 LIABILITY: Transient and those who are in the Transient party understand Transient assumes all responsibility and liability and will hold Owner harmless and agrees to all the following: a. This house is privately owned; the owners are not responsible for any accidents, injuries or illness that occurs while on the premises or its facilities. b. The Homeowners are not responsible for the loss of personal belongings or valuables of the Transient or their rental party or visitors. c. UNSUPERVISED CHILDREN: Transient acknowledges that they have been advised that children should never be left unsupervised as windows may pose a fall risk and HAZARDOUS CLEANING CHEMICALS ARE OFTEN STORED UNDER SINKS INSIDE HOME. d. Homeowner strongly recommends that Transient with: Children, disabled or elderly people NOT use the fireplaces. The stove and fireplaces are not adequately protected from a child or elderly person accidentally touching the hot surface. Touching the surface of stove or fireplaces can result in instant third degree burns and may require immediate medical attention. e. Transient use of fireplaces is at Transients' sole risk and liability and Transient agrees that Homeowner will be held harmless and not be in any way held accountable or liable for Transient use or misuse of stove or fireplaces. f. By accepting this reservation, it is agreed that all Transients are expressly assuming the risk and liability of any harm arising from their use of the premises or others whom they invite to use the premises. g. Transient is aware of the inherent risks of renting this house on this property. h. There are wild animals and creatures and insects including but not limited to: Snakes, mice, spiders, Mountain Lions, Moose, etc. that may come reside and go in or on the property and/or throughout Spokane, and Transient and those who are in the Transient party are responsible to take precautions to identify and determine said risks before and when venturing on throughout and in the property and Transient assumes all responsibility and will hold Owner harmless for any incidents that may result from interaction and/or contact with any living creatures or organisms. Transient agrees that all damages to the property that occurs during the Transient’s stay because of the Transient, the Transient’s Rental Party and visitors or pets are the responsibility of the Transient and will accept charges to the credit card on file to make repairs. Indemnification and Liability Owner and Agent shall not be liable for any damage or injury to Transient or to any other person or to any property, occurring on or within any portion of the Premises. Transient acknowledges that the Premises is subject to certain inherent dangers, such as its proximity to a golf course or body of water, the existence of a water fountain, spa, rocks, stairs, fire pits, and fireplaces, etc. Transient agrees to defend and hold Owner and Agent harmless, and to indemnify Owner and Agent from any claims for damages or injuries caused by Transient, the Rental Party and/or other occupants, visitors, or other individuals. DISPUTES Transient agrees to give us an opportunity to resolve any disputes or claims by contacting Owner Monday - Friday 10AM – 4PM and submitting a formal written complaint. If we are not able to resolve your Claims within 60 days, you may seek relief through arbitration, as set forth below. All Claims will be resolved by binding arbitration, rather than in court. This includes any Claims you assert against Owner or employees, relevant property owners or others (which are beneficiaries of this arbitration agreement). This also includes any Claims that arose before you accepted this agreement, regardless of whether prior versions of the agreement required arbitration. If a dispute arises from or relates to this contract or the breach thereof, and if the dispute cannot be settled through direct discussions, the parties agree that any unresolved controversy or claim shall be settled by arbitration in administered by the American Arbitration Association in accordance with its Commercial Arbitration Rules and judgment on the award rendered by the arbitrator(s) may be entered in any court having jurisdiction thereof. By agreeing to arbitration under the AAA Rules, the parties agree, among other things, that the arbitrator, and not any federal, state, or local court or agency, shall have the exclusive power to rule on any objections with respect to the existence, scope, or validity of the arbitration agreement or to the arbitrability of any claim or counterclaim. Arbitration and Attorney Fees Owner and Agent shall be entitled to recover any costs and/or attorney fees incurred in enforcing the terms of this agreement. Entire Agreement This agreement constitutes the entire agreement between the parties and may not be modified except in a writing signed by both parties. Any prior understanding or representation of any kind preceding the date of this agreement shall not be binding on either party except to the extent incorporated within this agreement. Governing Law This agreement shall be construed and enforced in accordance with the laws of the State in which property is located. You must also acknowledge Security Deposit - if you damage the home, you may be charged up to $1,500. 15.1 Rivers and Streams... Water Safety is Your Responsibility. Transient is aware of the inherent dangers of residing at a house located near a river. Be Aware of Hazards Anytime you're recreating in and around water -- especially with children: They must be supervised by an adult at all times, Be aware of surroundings and take precautions, a child may easily wander or fall into the river, water is deep in the Spokane River that runs through Riverside State Park which our property connects to. Always wear safety flotation vest when venturing near or into water, There are wild animals that visit the connecting forest or river such as Deer, Otter and Moose, Always wear water shoes in the water. a) Consider these precautions as flash flooding from upriver storms and spring snow melts and rivers and streams water levels rise. b) Also be cautious when water appears warm or slow moving but can have strong and sometimes dangerous currents below the surface. c) Water Temperature: Air temperatures may feel hot, and the water may feel or appear warm, but temperatures can be extremely cold below the surface. Hypothermia can quickly set in and overwhelm even the strongest of swimmers, becoming too weak to escape. d) Currents: In as little as six inches, water that may look calm on the surface and slow-moving can have enough force to knock you off your feet and sweep you downstream. Even a slow current can take you where you do not want to go towards hazards and leave strong swimmers unable to reach the shore. e) Water Hazards: A slippery and uneven river bottom and sharp protruding objects can cause injury or death the stream’s current can suddenly sweep you off your feet. Debris and underwater features such as trees, branches and logs, and even narrow gaps between rocks can trap you under water, causing hypothermia or even death. Never dive or jump into a river. 16. Additional Charges: Transient agrees to accept charges to the credit card on file and to keep an up-to-date credit card on file for any additional fees or fines incurred during the Transient`s stay. Should a credit card be declined Transient is aware that they may be pursued legally for any charges applicable to their stay. 17. Action and Behavior: Transients are expected to behave respectfully regarding people and property, such as the house, land, amenities, furnishings, neighbors, neighborhood, and representatives of Homeowner. Specifically, Transient and all other occupants will be required to vacate the premises, forfeit their payment, and incur additional fees for any of the following (including but not limited to): ● Using the premises for any illegal activity including, but not limited to, the possession, serving or consumption of alcoholic beverages by or to persons less than 21 years of age. ● Causing damage to the premises rented, or to any of the neighboring properties. ● Any other acts which interfere with neighbors’ right to quiet enjoyment of their property. NOTE: If law enforcement is notified due to disturbances emanating from the premises or grounds, there will be a minimum $250.00 charge to your credit card per incident. Vacation Rental Damage Protection Transient agrees that all damages to the property that occurs during the Transient’s stay because of the Transient, the Transient’s Rental Party, visitors or pets are the responsibility of the Transient, and will accept charges to the credit card on file to make repairs. 18. PARKING: Parking is limited to 4 vehicles. Vehicles are to be parked in designated paved parking areas only. Parking in driveway and directly in front of the house is only place allowed. Any illegally parked cars are subject to towing and ticketing; applicable fines/towing fees are the sole responsibility of the vehicle owner. There is no additional parking nearby. 19. HOUSEKEEPING: There is no daily housekeeping service. While linens and bath towels are included in the unit, daily maid service is not included in the rental rate. We do not permit towels or linens to be taken from the house. 20. HOT TUB: a) No children under the age of 16 permitted in hot tubs at any time without adult supervision. b) When using the hot tub, remember there is a certain health risk associated with this facility. Transient agrees that all members of their Rental Party shall use the same at their own risk. c) DO NOT STAND ON THE HOT TUB COVERS. Hot tub covers are for insulation purposes and are not designed to support a person. THEY WILL BREAK and you may be charged for replacement. d) Remember when not using the hot tub, LEAVE SPA COVER ON AND SAFETY STRAPS LOCKED DOWN so hot tub will stay warm and help prevent and protect young children from climbing into tub and potentially drowning. e) Hot Tub automatically turns off and will not operate after 12 midnight. It will turn on and begin operation after 6am in the morning. f) CHILDREN WEARING DIAPERS MAY NOT BE IN THE HOT TUB! (Diaper material disintegrates and pollutes the water and clogs spa pipes as well as water heater elements and filters). Breaking this rule will result in an extra cleaning charge to you. 21. GAS and PROPANE/WOOD FIREPLACE, FIREPITS AND BBQ’S: - Use at your own risk. - Outdoor fires are strictly prohibited. (Excludes Gas BBQ and/or fire-pit if provided by Owner) 22. WATER AND SEPTIC: The property is on a septic sewer system. It will clog up if improper material is flushed. DO NOT FLUSH anything other than toilet paper and human waste. No feminine products should be flushed at any time. If it is found that feminine products have been flushed and clog the sewer system, Transient could be charged damages of up to $600.00. 23. SYSTEM FAILURE: a. In case of failure of a system or amenity during your stay including but not limited to: Water, septic, sewer, electrical, mechanical, ventilating, structural systems, major and minor appliances, or entertainment equipment, etc., we shall reasonably attempt to make repairs. You agree to permit access to the House to make any such repairs. We shall not be liable to you for damages, and NO REBATE OR REFUND will be given for such temporary failures; provided, we will reasonably attempt to repair the system or amenity after having received written and phone notification from Transient that repairs are needed. b. No refunds will be given for storms snow or weather related. Roads can be slippery, curvy or steep. The driveway is maintained however we highly recommend four-wheel drive and/or chains during the snow months. We do not refund due to road conditions. c. AMENITIES OR SERVICES OFFERED: Everything will be reasonably done to make sure that what was offered in our advertising will be in the property as described. Every attempt is made to keep the inventory and/or services as advertised. A difference in amenities or services does not entitle You to any refund of rents paid. Amenities or services may be added or removed at the owner's sole discretion. Example: We have advertised Blu-Ray DVD players; it may be out for service. That fact does not warrant any refund. d. SLEEP ARRANGEMENTS FOR TRANSIENT AND THEIR PARTY. There is a total of SIX (6) beds: There is 1 (ONE) King, (FOUR) Queens, and (ONE) Twin roll-away bed 31” x 75”. 24. RESERVATION: Any reservation obtained under false pretenses will be subject to forfeiture of advanced payment, deposit, and/or rental money and the Transient will not be permitted to check in. Likewise, Transients who have already checked in and who are found to have used the premises under false pretenses will be subject to further legal action to recoup costs which exceed the amount of the security/damage insurance or deposit. Owner may at Owner’s sole decision for any reason elect to cancel any Transient reservation by providing notification to Transient via Email or verbally at least two calendar days prior to the Transient arrival date. In this event Owner will refund all money’s paid by Transient to owner. Transient shall have no recourse other than to receive a full refund of all money paid by Transient to Owner. By sending payment in full to hold a chosen date, or by pre-paying for rent with a credit card. Transient agrees to all terms and conditions of this Agreement, and further agree that 7519 W Greenside CT., Nine Mile Falls, Spokane WA 99026 and it's owners and representatives will be bound by the terms within this written Agreement. Transient further states that they are at least twenty-five (25) years of age and will be the principal Transient and as such will be completely responsible for the actions of other persons including any for whom may be making these arrangements. No rental will be made to vacationing students or singles under the age of 25 unless accompanied by a parent or guardian at a ratio of no more than 2 children for one adult over the age of 25. A PARENT OR GUARDIAN MUST BE STAYING IN THE RENTAL HOME AT ALL TIMES.OUR RENTAL HOMES ARE MONITORED FOR VIOLATION OF THIS POLICY. Reservations made under false pretenses will be subject to eviction and forfeiture of all deposits and payments. If Transient does not honestly state, the number of people in their party including visitors (not staying overnight) in writing (Email) it will result in loss of Transients’ damage deposit and potential additional cleaning charges. The parties agree to the terms of this Reservation Agreement. By sending payment in full to hold a chosen date, or by pre-paying for the rent with credit card: Transient agrees to all terms and conditions of this Agreement, Transient further states they will be the principal person and as such will be completely responsible for the actions of all other people in their party as well as all visitors who set foot on the property during Transient’s stay. This home is a 'vacation' home, and it is strictly forbidden to use it as an: Event or invitation to the public, Loud music, drinking or party house or to in any way disturb the neighbors. We support responsible Vacation Renters. Unreasonable noise in or from the SPA or home after 10pm results in either the police being called or neighbors calling the owner This gives Homeowner the right to immediately suspend the renters' stay and forfeit remaining rent and deposit. Transient and all its related parties agree to the terms of this Reservation Agreement. Transient agrees to sign this Agreement using electronic signature and to provide a photocopy of ID 72 hours prior to arrival and to complete all requirements stated in Arrival/check-in Instructions. IMPORTANT NOTE TO TRANSIENT: If Transient (you) have not departed at check-out time, the owner or manager may enter home and take possession of the Transient’s property, re-key the doors and clean up the Property for next Transient. Our family fell in love with the peace and tranquility of this magnificent location and coziness of our house. Most noticeable is the lack of traffic and sirens, just the quiet sounds of nature. I love the four seasons, each for their own unique character. Imagine yourself gently guiding your birch bark canoe through the serpentine meanders of the Little Spokane River. You stop your pelt-laden canoe only long enough to check the next trap or perhaps study the long-legged Great Blue Heron fishing the shallows for some unlucky rainbow trout smolt. Such was the scene that early fur trader and explorer David Thompson may have viewed with his interpreter and guide Jacques Finlay as they canoed the river in search of beaver and muskrat in the early 1800's. Today, you may still explore the Little Spokane River and experience much of the same environment as David Thompson discovered almost 200 years ago. The river remains pristine, undisturbed by the march of civilization occurring just a couple miles away and seemingly centuries removed. Wonder at the ancient Indian rock pictographs and about the people who painted them. Hike along some or all of the six miles of trails (Riverside Park area) to re-discover a sense of solitude and sensitivity. A blanket of white may encourage a cross-country ski trek. More hearty voyagers will take to paddle. Helpful Hints • Parking and canoe launch sites* at Pine River Park for pick-up or launch. * In the Riverside Park area at the upstream launch off St. George's School Road and at the Indian Painted Rocks. Both are reached off Rutter Parkway. You must carry your watercraft a short distance at both launches • There is a takeout at Pine River Park; or, on the boat launch road off Highway 291, north of Nine Mile Falls. • Anyone paddling the Little Spokane should know the basics of maneuvering their craft around sharp turns and brushy banks. It is important to know that outside of Pine River Park and the Haynes Conservation Area itself the river is Privately owned to be used at your own risk. Enjoy your visit, and remember to "leave no trace".
